1. Call to Order and Introduction of Members, Ex -Officio Members and Staff
Vice Chairman Hake called the meeting to order at 7:30 a.m. and introduced Board members and
asked staff to introduce themselves. A quorum was present to hear the items on the agenda. The
following members were designated to vote: Graham, Hake, Lacy, Rimiller, Schaefer. Those
wishing to speak to the Board were sworn in.
2. Procedures Explained
Vice Chairman Hake explained the procedures of the meeting. Mr. Zollinger entered the following
documents as exhibits for all items under consideration at the meeting:
1. The City Code of the City of Jefferson, as amended
2. The Comprehensive Plan and Land Use Map
3. Copies of applications under consideration
4. A list of Property owners to whom notice of the hearing was sent

6. New Business — Public Hearing
Case No. 818002 -1129 Cedar City Drive; Variance from Flood Plain Regulations. Request
filed by Joshua Korte, property owner, for a variance to floodplain regulations. The purpose of the
request is to permit construction of a structure designed to be flooded during flood events on the
property. The property is described as part of the South half of Section 9, Township 44 North,
Range 11 West, City of Jefferson, Callaway County, Missouri (Four Points Land Surveying &
Engineering Inc. Consultant).
Mr. Zollinger described the proposal and explained that the Planning and Zoning Commission
approved a request from the Applicant for a Special Permit Exception to operate an outdoor mulch
production, sales and composting facility. This request will be forwarded to the City Council for a
public hearing on June 18, 2018. Mr. Zollinger explained that the property is zoned M-1 Light
Industrial.
Mr. Fontana explained that Mr. Korte is requesting a variance to construct an agricultural type
structure to be built in the floodplain. He stated that the applicant proposes to construct an open
sided building using wet floodproofing techniques. Mr. Fontana explained that the roof will be higher
than the base flood elevation to allow flood waters to enter and recede unimpeded. He stated that
the applicant is proposing a future addition east of the proposed structure. Mr. Fontana explained
that the applicant would like both structures to be approved at this meeting. Mr. Fontana explained
that the applicant proposes to use the subject property and proposed building as a log and mulch
storage/sales yard and an equipment storage yard.
Mr. Joshua Korte, owner of 1129 Cedar City Drive and resides at12510 County Road 4031 Holts
Summit, MO, spoke regarding this request and explained that he proposes to construct a steel
building set on concrete piers. He stated that no wood or sheet rock type materials will be used. Mr.
Korte explained that he will try to minimize impact on this site. He stated that there will be no beams
or arches on the inside of the structure. Mr. Korte explained that the purpose of the proposed
structure is to store equipment to keep them out of the elements and minimize deterioration.
No one spoke in opposition to this request and no correspondence was received.
Mr. Fontana gave the Engineering Division staff report and stated that staff recommend approval
of the variance. He explained that the southwestern corner of the site does lie within the floodway
and will require a conditional no -rise certificate if the variance is granted. Mr. Fontana stated that
there will be no impact to this site. He explained that the City will review the no -rise certificate every
two years for compliance. Mr. Fontana stated that Mr. Korte is aware of the conditions and technical
requirements and is aware that everything has to be removed and evacuated during a flood event.
Mr. Graham moved and Mr. Rimiller seconded to grant a variance to the floodplain regulations
permitting the Applicant to build two structures, one now and one future structure at his option with
substantially the same materials as the original structure. Both structures must be designed to
withstand flooding during a flood event.
The motion passed 5-0 with the following roll call vote:

Case No. B18003 - 501 Broadway Street, Setback and Parking Lot Landscaping Variances.
Request filed by River Region Credit Union, applicant, and RRRE Holdings LLC, property owner,
for the following:
1. A 25 feet variance to the 25 feet front setback requirement to permit a 0 foot front setback
on Miller Street frontage.
2. A 10 feet variance from the 25 feet front setback requirement to permit a 15 feet setback
from the Broadway Street frontage.
3. A variance from the Parking Lot Landscaping requirement to remove the requirement.
The property is located 100 feet south of the intersection of Broadway and Highway 50 and is
described as N 100' of Inlot 688 and W 35.62' of N 100' 1Mot 689, City of Jefferson, Cole County,
Missouri (Crocket Engineering Consultant).

Mr. Zollinger described the proposal and explained that the property is a vacant lot zoned C-2
General Commercial. He stated that the applicants desire to construct a 2,560 sf community center
and drive thru remote bank teller. Mr. Zollinger explained that the proposed building would
encroach into the 25' front setback of the property from Broadway Street and the 25' into the other
front setback from Miller Street. He stated that the property owner is requesting variances in order
to accommodate the proposed building. Mr. Zollinger explained that the applicants also desire to
seek a variance from the parking lot landscaping requirement. He stated that the nature of the
parking lot is such that landscaping would better serve the right-of-way then the parking lot itself.
Mr. Tim Crockett, Crockett Engineering, 1000 W. Nifong, spoke on behalf of River Region Credit
Union regarding this request and explained that the applicant is proposing to construct an
approximately 2,500 square foot facility. He stated that an ATM will be located on the site while the
remaining portion of the property will consist of a community center. Mr. Crockett explained that
capacity for the facility is 80 people however it will fit 50 people comfortably. He stated that
landscaping will be to the north along the right-of-way. Mr. Crockett clarified that this is not a full
banking facility.
No one spoke in opposition to this request and no correspondence was received.
Mr. Zollinger gave the Planning Division staff report and explained that the required findings
appear to be met. The impact of a reduced front setback on the property to the side and for other
adjacent properties is minimal and the proposed variance would not create any unsafe conditions.
Ms. Lacy moved and Mr. Graham seconded to approve a 25' variance to the 25' front setback
requirement to permit a 0' front setback on Miller Street frontage. The motion passed 5-0 with the
following roll call vote:
Aye: Graham, Hake, Lacy, Rimiller, Schaefer
Mr. Graham moved Ms. Lacy seconded to Motion to approve a 10' variance from the 25'front
setback requirement to permit a 15' setback from the Broadway Street frontage. The motion
passed 5-0 with the following roll call vote:

Mr. Graham moved and Ms. Lacy seconded to Motion to approve a variance from the Parking Lot
Landscaping requirement to remove the requirement with the following condition:
a. A comparable level of landscaping to be installed in front of the building as show on the
submitted site plan, subject to right -of -way approval by City Staff.
Mr. Hake commented that he is glad to see improvements along Rex Whitton Expressway.
The motion passed 5-0 with the following roll call vote:

story utility building and storage yard. The property is located on the western side of Vieth Drive at
the intersection of June Court and is described as part of the Northwest quarter of the Northwest
quarter of Section 23, Township 44, Range 12, in the City of Jefferson, Missouri. (Central Missouri

NATURE OF REQUEST
The applicants are applying for a Conditional Use permit to expand the current water tower utility site
and constructing a 3,200 sf single story building and storage yard.

gravel lay down yard surrounded by a 6 foot chain link security fence and installation of a tree
row/bufferyard in the open area on the west side of the property. The building would be built in the
same area of the existing home. The natural forested area to the north of the property would be left
undisturbed to act as a natural buffer.

STAFF RECOMMENDATION
The required findings appear to be met. The expansion of the water tower utility site is a necessary
improvement to utility operations that serve the city. The chosen site is suitably separated from
existing residential uses in the area and screened with a combination of an existing forested area and
installed trees.

Findings of Fact:
1. Is the proposed use consistent with the goals, objectives and policies of the
Comprehensive Plan?
The proposed use is consistent with the Comprehensive Plan.
2. Does the proposed use comply with all applicable provisions of the zoning district
regulations and conform to the general intent and purpose of the Zoning Code?
The design of the facility will comply with all provisions of the zoning district and the
intent and purpose of the Zoning Code including building height, lighting, signing,
off-street parking, and parking lot landscaping.
3. Does the proposed use comply with all applicable fire, health, building, plumbing,
electrical and stormwater drainage regulations?
The design of the facility will comply with all City adopted building codes. A preliminary
meeting has been held with City Staff to ensure all other City Codes will be followed.
4. Is the proposed conditional use materially detrimental to the public health, safety,
convenience and welfare or does it result in material damage or prejudice to other
property in the vicinity?
The proposed use will not be harmful to any adjacent properties. The property will be
purchased by the adjacent property owner, Public Water Supply District #2 and will be
used as additional area to carry out its day to day operations. The water district has
operated in this area for years and this will be an small expansion of their operation.

5. Is the proposed use compatible with and does it preserve the character and integrity of
adjacent development and include improvements to mitigate adverse development
related impacts such as traffic, noise, odors, visual nuisances, or other similar adverse
effects to adjacent development and neighborhoods?
The use is compatible with and does preserve the integrity of adjacent development.
Day to day operations of the water district will not changes, so there will not be
changes in regards to traffic, noise and odors. A natural buffer will be utilized on the
north side of the property and a row of trees will be planted on the west side of
property to screen the property use.
6. Does the proposed use generate pedestrian and/or vehicular traffic which will be
hazardous to the existing and anticipated traffic in the neighborhood?
With the property acquisition and proposed use, the operations of the water district
will not change, and therefore, will not generate additional pedestrian and/or
vehicular traffic in the area.
7. Do adequate utilities exist to serve the proposed conditional use?
All utility services are currently located on the property or will be extended from the
existing Public Water Supply District #2 site.
