HomeMy Public PortalAboutOrd. 1010ORDINANCE NO. 1010 AN ORDINANCE OF THE CITY COUNCIL OL' THE CITY OF LYNWOOD APPROVING AND ADOPTING AN AM~NDMENT TO ORDINANCE NO. 945, AS AMENDEll, AND TO THE OrPICIAL REllL;VELOPMF.NT YLAN F'OR REDEVELOPMENT PROJECT AREA "A". WHEREAS, by Ordinance No. 945 the City Council of the City of Lynwood has adopted a Redevelopment Plan for Redevelopment of Project Area "A" (the Lynwood Cor.imercial Area); and WHEREAS, by Ordinance No. 960, said City Council adopted an amendment to said Redevelopment Plan, enlarging the area thereof; and WF7EREAS, b,y Ordinance No. 990 said City Council adopted a second amendment to said Redevelopment Plan, further enlarging the area thereof; and WHEREAS, by Ordinance No. 1000, said City Council adopted a third amendment to said Redevelopment Plan, by adding thereto and deleting therefrom certain properties; and WHEREAS, on October 19, 1976, the Lynwood Redevelopment Agency adopted its Resolution of Intention, Resolution No. 76-18, declaring its intention to again amend the Redevelopment Plan for Project Area "A" by deleting therefrom certain properties; and WHEREAS, the Lynwood Redevelopment Agency and the City Council of the City of L,ynwood have called, duly noticed, and conducted a joint public hearing with respect to said proposed amendment; and WHEREAS, the Lynwood Redevelopment Agency and this City Council have considered all relevant testimony pertaining to said proposed amendment; and WHLREAS, no written objections to said proposed amendment were delivered to the City Clerk prior to the hour set forth at said heari.ng, and no•oral objections to said plan were presented during the hearing, or, in the alternative, such written and oral objections as have been presented to the a£oresaid bodies pursuant to the Community Redevelopment Law have been and hereby are overruled by this City Council, NOW, THER~FORE, the City Council of the City of Lynwood hereby does find, determine, and ordain as follows: SL^;CTION 1. The Official Redevelopment Plan for Redevelopment Project Area"A~ as heretofore amended, is amended by eliminating land from the boundaries of said Project Area as described below: (a) Lots 20, 21, 'L2, 23, 24, 25, 26, 27, 2II, and 29 of Block 16 of 1Vlodjeska Yark Tract. (b) Lots 428, 429, 430, 431, 432, and 433 of Tract 2551. (c) Lots 17, lII, 19, 20, 21, `L2, 23, `L4, and 25 of Btock 17 Modjeska Parl: Tract, (d) Lots 450, 451, 452, and 453 of Tract No. 2551. SECTION 2. Redevelopment Project Area "A" as amended by Section 1 hereof, is a blighted area, the redevelopment of which is necessary to effectuate the public purposes declared in the Community Redevelopment Law. SECTION 3. The Official Redevelopment Plan for Project Area "A" would redevelop said Project Area "A," as amended in conformity with the Community Redevelopment Law and in the interests of the public peace, health, safety, and welfare. SL;CTION 4. The adoption and carrying out of the Official Redevelopment Plan, as amended, is economically sound and feasible. SECTION 5. The Official Redevelopment Plan, as amended, conforms to the General Plan of the City of Lynwood. SECTION 6. The carrying out of the Official Redevelopment Plan, as amended, would promote the public peace, health, safety and - welfare of the City of Lynwood and would effectuate the purposes and policies of the Community Redevelo~ment Law. SFCTION 7. To the extent that the condemnation of real property is provided for in the Official Hedevelopment Plan, as amended, said condemnation is necessary to the execution thereof; and adequate provisions have been made for payment for property to be acquired as provided by law. SECTION 3. The rehousing and relocation of families and persons displaced from the Project Area "A" as amended, have been provided for by a plan for relocation adopted by the Lynwood Redevelopment Agency. There are other areas not generally less desirable than Project Area "A" as amended, in regard to public utilities and public commercial facilities, with available, decent, safe and sanitary dwellings, at reuts or prices within the financial means of the families and persons displaced from said project area, and reasonably accessible to tlieir places of employment. The Council is satisfied t!iat permanent housing facilities are now available and wi11 be available at the time occupants of the project area are displaced. SECTION 9. In approvin~ and adopting the aforesaid Amendment to the Official I{edevelopment Plan, it is the purpose and intent of this City Council to elixninate and to prevent the spread of blight in the community and to encourage, promote, and stimulate the redevelopment of Project Area "A, " as amended, as a commercial and professional area. SLCTION 10. The City Clerk hereby is authorized and directed to forward to the Lynwood Redevelopment Agency a certified copy of this Ordinance. Said City Clerk is further authorized and directed to recox•d with the County Recorder of the County of Los Angeles a description o£ the land within Project Area "A, " as amended, and a statement that proceedings for the r•edevelopinent of said Project Area have been instituted under the provisions of the Community Redevelopment Law. Said City Clerk is further authorized and directed to forward copies of Ordinance Nos. 945, 960, 990, 1000, and this Ordinance, a map indicating the boundaries of Project Area "A, " as amended, and a description oF the land within said Project Area "A, " as arnended to: (a) The Auditor and Tax Assessor of the County of Los Angeles; (b) The governing body of eacli of the taxing agencies which levy taxes upon any property in said Project Ax~ea; and (c) The State Board of Equalization. SECTION ll. The City Clerk shall certify to the adoption of this ordinance and cause the same to be puUlished in the Lynwood Press, a newspaper of general circulation, printed, published and circulated in the City of Lynwood. SLCTION 12. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordtnance, or the application ;iereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or places. The City ~uncil hereby declares that it would have adopted this Ordinance, and each section, subsections, subdivisi ons, sentences, clauses, phrases, or portions, or the application thereuf to any per•sons or place, be declared iuvalid or unconstitutional. First read at a regular meeting of the City U~uncil of said City held on the 16th day of November, 1976, and finally adopted and ordered puUlished at a regular meeting of said Council held on the 7th day of Deceinber, 1976, by the following vote: AYES: COUNCILMEN: Byork, Green, Higgins, Morris, Rowe.
