HomeMy Public PortalAboutOrd. 1005, ORDINANCE N0. 1005 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDINANCE N0. 570 TO PROHIBIT THEATRES, CONCERT HALLS, AND SIMILAR ESTABLISHMENTS IN THE C-2, C-2a, AND C-3 ZONES OF SAID CITY, EXCEPT SUBJECT TO A CONDITIONAL USE PERMIT. The City Council of the City of Lynwood hereby does ordain as follows: SECTION 1. Section 8.01 of Ordinance No. 570, the Zoning Ordinance of the City of Lynwood, hereby is amended by deleting therefrom Subparagraph 52 thereof. SECTION 2. Section 8.10 is added to said Ordinance No. 570, to read as follows: Sec. 8.10. Theatres Prohibited. Theatres, concert halls, and other similar establishments primarily devoted to theatrical performances shall be prohibited in the C-2 Zone, except as permitted pursuant to a conditional use permit. SECTION 3. Section 8A.10 hereby is added to the said Ordinance No. 570 to read as follows: Sec. 8A-10. Theatres Prohibited. Theatres, concert halls, and other similar establishments primarily devoted to theatrical performances shall be prohibited in the C-2a Zone, except as permitted pursuant to a co~ditional use permit. SECTION 4. Section 9.10 hereby is added to the said Ordinance No. 570 to read as follows: Sec. 9.10. Theatres Prohibited. Theatres, concert halls, and other similar establishments primarily devoted to theatrical performances shall be prohibited in the C-3 Zone, except as permitted pursuant to a conditional use permit. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause,phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. First read at a regular meeting of the City Council of said City held on the 20tlY1ay of July , 1976, and finally adopted and ordered published at a regular meeting of said Council held on the3rd day of August 1976, by the following vote: AYES: COUNCILMEN: gyork,Green,Higgins,Morris,Rowe.
