PLACE: Brewster Town Office Building,2198 Main Street PRESENT: Selectman Norton, Selectman deRuyter, Chairman Foley, Selectman Dickson(6:33pm), Selectman Hughes, Assistant Town Administrator Jillian Douglass, Rich Eldred, Colin Odell, Todd Montgomery ABSENT: Selectman deRuyter Call to Order Chairman Foley called the meeting to order at 6:30pm. Executive Session Chairman Foley announced that the Board would be going into executive session to consider the purchase, exchange, lease or value of real property as an open meeting may have a detrimental effect on the negotiating position of the Town and to discuss strategy with respect to litigation as an open meeting may have a detrimental effect on the litigating position of the Town. Selectman Hughes moved that the Board dissolve open session and go into executive session at 6:31pm to consider the purchase, exchange, lease or value of real property as an open meeting may have a detrimental effect on the negotiating position of the Town; Black Duck Cartway and Tubman Road and to discuss strategy with respect to litigation as an open meeting may have a detrimental effect on the litigating position of the Town; Thomas and Carol Edmondson, et als. V. Town of Brewster Conservation Commission, Town of Brewster, et al. vs. Atlantic Richfield Co., et al., In re Methyl Tertiary Butyl Ether("MTBE") Products Liability Litigation and the MacDonald Claim and to return to open session, Selectman Norton second. The Board voted unanimously: Selectman Hughes—Yes, Selectman Norton —Yes, Chairman Foley—Yes. Selectman Hughes moved to dissolve executive session and return to open session at 7:11pm, Selectman Dickson second. BoS Minutes 09-02-14 Page 1 of 4 Citizens Forum None Review & Sign Quitclaim Deed for Property on Black Duck Cartway Selectman Hughes moved to vote that the Selectman transfer the care, custody and control of the property at 0 Black Duck Cartway to the Conservation Commission and sign the Quitclaim Deed for 0 Black Duck Cartway, Selectman Dickson second. The Board voted 4-Yes, 0-No. Update from Government Study Committee and Review & Approve Town Survey Colin Odell stated that the committee has been meeting since mid-July and has looked at the process that other towns have used. They developed a citizen's survey that they would like to include in the fall tax bill as well as putting it online and distribute it through the Chamber, schools, library and Town Clerks office. The format of the survey is very open ended as they seem to have the most successful return rate. They hope this will also get broad based results. They have also developed a set of questions to interview boards, committees and Town employees. They are happy with their progress. Selectman Dickson stated that it is an excellent survey. How might this tie in to the survey that the Building &Needs Assessment Committee (BNAC) could do? Selectman Norton stated that they are related, but he feels they should be kept separate. Selectman Hughes clarified that there will not be a survey from BNAC, but a separate group was created to look at long range planning and they will be developing a survey. Mr. Odell stated that they will be happy to share the results of this survey to the other group and a member of the Government Study Committee would be happy to serve on the working group. Selectman Dickson stated that this survey is about process and not policy. Selectman Dickson moved to approve the Town survey for inclusion in the fall tax bill, Selectman Hughes second. The Board voted 4-Yes, 0-No. Update on Stony Brook Elementary School Window Project Charlie Sumner thanked Bob Miller the chairman of the BNAC for all of his work on both of these projects. In the 1989 section of the school the windows are being replaced. Half were done last year, there are about 5 or 6 more that could be replaced. Barry Schofield reported that some windows in the original section that were replaced in 1995 have been having some problems. Through a change order some of these were opened and found to be in very bad shape as well. There is a punch list for the initial project and in November there will be a request for design funds for additional windows. The next section of windows would be replaced in the summer of 2015. Update on the Eddy Elementary School Roof& HVAC Project Mr. Sumner stated that this project is well ahead of schedule. The construction was finished last week, the Fire Department did a test today of the new fire alarm system. The punch list items will be worked on in the next few weeks. The contractor, Varieka, did a great job as did all their subcontractors. In regards to the additional cost of removing and reinstalling the solar panels, Mr. Sumner will ask for help from Cape Light Compact to fund the cost of this. Mr. Sumner had a conversation with Bond Counsel today, and he stated that while it is a tax exempt project, the portion with the solar panels may not be tax exempt. The cost should be minimal; .5%on the interest rate. Chairman Foley stated that the School Administration was very worried about the disruption of school at the beginning of the year, what can they expect. Mr. Sumner stated that it will not be disruptive to classes; it is only punch list items that are left; trim work, clean up, etc. Review & Discuss November 17,2014 Special Town Meeting Warrant Articles Mr. Sumner stated that there have been a few changes,there were some items moved from the Selectmen to www.town.brewster.ma. BoS Minutes 09.02.14 Page 2 of 4 Natural Resources in the Capital article. Mr. Sumner added some Community Preservation Committee articles at the request of Lisa Souve that have to do with reallocation of funds. Right now the warrant stands at approximately $1.6 million; free cash spending is at $1,050,000 dollars and the Town usually spends one million of free cash at fall town meeting. Lisa Souve should have a certification of free cash at the end of this week. The warrant went to all department heads to ask for their feedback. The Library may have an addition to the warrant. He did let the Government Study Committee know that if they needed more money, fall would be the time to ask. Mr. Sumner met briefly with Sue Leven, and the storm water bylaw may be delayed. The East Brewster village district bylaw change was put on the warrant, as it needs to be re-voted, due the way it was posted last spring. Selectman Hughes stated that the Town does not have a budget for printing items, as many people like to have paper, rather than electronic copy; i.e. the brochures on the ponds meetings. She suggests having a sum of money that any department could use. For example the Board of Health has a great brochure on septic systems that they say they do not have the money to print. Mr. Sumner stated he could add an item to the budgetary transfer article and let the Board discuss it. Chairman Foley stated that he agrees with the idea, but would want defined controls on the account. Selectman Dickson stated that all materials should be available on-line. They are, but for example, at a ponds meeting, there were over 200 people who may have liked the hand out. Mr. Sumner stated that he also added an article on changing the dates on the private road repair bylaw. There is a group on Tower Hill Circle that approached the Town just before he left for vacation,they did have their 51% of signatures, but did not have any engineering plans and they asked for an extension. Under the current bylaw, they would now have to wait until May 2016. The deadlines should be reflective of the deadlines to get to a May Town meeting. Any work on roads helps the DPW,the Fire Department, etc. In regards to the capital request; for the DPW, there is the annual request of$150,000 for road/drainage repairs; the Comprehensive Water Planning Committee is going to submit a request to work on drainage, especially in the pond areas to work on correcting storm water runoff. Bob Bersin is working with CDM Smith on drainage projects and there should be a list in the next month. Chapter 90 funds may be used to do some preliminary design work. A project for this fall and winter is for Linnell Landing, to work on the storm water. This will be done with chapter 90 funds. There may be an article added regarding parking regulations. Review & Approve August 4,2014 Executive Session Meeting Minutes Selectman Norton moved to approve the August 4, 2014 executive session meeting minutes, Selectman Dickson second. The Board voted 4-Yes, 0-No. Appointments Selectman Hughes moved to appoint Brandon L. Rice as probationary Police Officer and Keeper of the Lockup, effective September 2, 2014— September 1, 2015 and Joseph Rinaldi to the Brewster Coastal Committee for a term of three years, expiring June 30, 2017, Selectman Dickson second. The Board voted 4- Yes, 0-No. Action Items Selectman Norton moved to approve action items 1-5, as recommended by Administration, Selectman Dickson second. The Board voted 4-Yes, 0-No. FYI Items Selectman Dickson made mentioned that the September 11th memorial service is at 6 pm. Selectman Hughes made mention of item, D, from Barnstable County on the role of the treasurer. Mr. Sumner stated that Lisa Vitale attends those meeting and counts the ballots. www.town.brewster.ma. BoS Minutes 09.02.14 Page 3 of 4 Liaison Reports Selectman Hughes stated that there has been a lot of attention on ponds and it is now being handed over to a citizens group. The consultant developed a pond mapping tool that that can identify the groundwater flow in and out of a pond. The Board of Health is considering a regulation to provide more protection from phosphorus. Ground water flow is identified and the properties that would be effective are only those that are in the area of the flow. Topics the Chair did not Reasonably Anticipate Chairman Foley recognized Tim Whelan from Leland road. He is representing the Meehan Turlock Foundation. This Sunday will be the 7th annual Mighty Meehan 5K. It is begins at 10am at West Dennis Beach. You can register on line or at the Dennis Fire Department. Last year over $250,000 was raised for the Dana Faber Cancer Institute. Selectman Hughes brought up the Cape Cod Commission Metropolitan Planning Organization, and stated that Sims McGrath is currently the regions representative. It was clarified that each Board member can make individual recommendations for the regions next representative.
