HomeMy Public PortalAboutAddendum No 1 to Contract 173-2009 - Burgess Niple - monitoring wells remediation.docPROFESSIONAL SERVICES AGREEMENT ADDENDUM NUMBER 1 THIS ADDENDUM Number 1 to Contract Number 173-2009 is made and entered into this _22nd ____ day of _June_____, 2010, by and between Richmond, Indiana, a municipal corporation through its Board of Public Works and Safety (hereinafter referred to as the “City”) and Burgess & Niple, 5085 Reed Road, Columbus, Ohio, 43220 (hereinafter referred to as “Contractor”). WHEREAS, City and Contractor entered into an Agreement numbered 173-2009, on December 17, 2009, which Agreement is attached hereto as Exhibit “A” and incorporated by reference; and WHEREAS, City wishes to retain Contractor to provide certain additional services ancillary to those within the scope of Agreement Number 173-2009, which additional services are set forth on the attached Exhibit “B” and incorporated by reference. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including the above stated recitals, City and Contractor hereby agree as follows: Contractor shall visually inspect the condition of the five monitoring wells and observations will be noted such as evidence of tampering of each protective casings and/or well pad, natural degradation of protective casing and/or well paid, existence of pressure cap, and general condition of each well. Contractor shall remove the well pad and protective casing from the five wells using a spud bar or similar tool/equipment while keeping the integrity of the well in mind and debris from the well pads and the protective casings will be hauled off site for proper disposal by Contractor. Contractor shall remove the polyvinyl chloride (PVC) monitoring casing and screen utilizing a cable from the drilling rig and if the casing and screen cannot be completely removed the top five (5) feet will be cut off and removed from the borehole. Contractor shall, after monitoring well PVC casing and screen (or the top five (5) feet) have been removed, place similar grain-sized sand at a thickness of the saturated zone material and the borehole will be pressure grouted with bentonite slurry to three (3) feet below ground surface and clean backfill will then be placed by Contractor in the remaining three (3) feet and graded at ground surface. Contractor shall complete well abandonment logs for the five (5) monitoring well locations and include these in the remedial action report and final clean-up documentation. Addendum No. 1 to Contract 173-2009 Contractor shall perform the above additional design activity services in a manner consistent with Contractor’s proposal, which is attached hereto, made a part hereof and marked as Exhibit “B”. Contractor shall perform all work and services described on Exhibit “B”. Contractor shall be paid an additional sum not to exceed Three Thousand Nine Hundred Dollars and Zero Cents ($3,900.00) for all services described on Exhibit “B”. City and Contractor expressly agree that all other terms, conditions and covenants contained in Contract Number 173-2009 shall be applicable to the work performed pursuant to this Addendum, unless such term, condition or covenant conflicts with this Addendum and expressly agree that all state, federal, and USEPA Brownfield grant guidelines must be complied with.
