HomeMy Public PortalAboutOrd. 0972 ORDINANCE NO. 972 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING THE NECESSITY FOR A SURPLUS PROPERTY AUTHORITY TO FUNCTION IN SAID CITY WHEREAS, pursuant to Section 40520 of the Government Code of the State of California, there is in the City of Lynwood a public body, corporate and politic, known as the Surplus Property Authority oF the City; and WHEREAS, pursuant to Section 40521 oF the Government Code, said Surplus Property Authority is not permitted to transact any business or exercise any powers unless and until the City Council of the City of Lynwood by ordinance declares that there is a need for the Authority to function in the City; and WF3EREAS, the City Council of the City of Lynwood has Found that there exists within said City property of the United States, as defined in Section 40517 of the Government Code, which may be purchased or otherwise acquired by contract pursuant to the authorization of Section 40567; et seq. of the Government Code in the interest of the health, safety, and general welfare of the people of said City, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1: There is a need for a Surplus Property Authority to function in this City, and such agency hereby is permitted to transact any business and to exercise any powers conferred thereon by the provisions of the Municipal Federal Surplus Property Authority Law (Chapter 19, commencing with Section 40500, of Part 2, Division 3, Title 3, of the Government Code of the State of California), SECTION 2: Pursuant to Section 40530 of the Government Code the City Council of the City of Lynwood shall be ex officio the governing body of the Authority and shall be known as the Surplus Property Commission; and all the rights, powers, duties, privileges and immunities which are vested by the Municipal Federal Surplus Property Authority Law in such a Commission shall be vested in said City Council, except as otherwise provided by the Municipal Federal Surplus Property Lawe SECTION 3: The City Clerk is authorized and directed to file a certified copy of this ordinance in the office of the Secretary of State. SECTION 4e The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and to cause same to be published once in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood, First read at a regular meeting of the City Council of said City held on the 6th day of August, 1974, and adopted and ordered pubiished at a regular meeting of said Council held on the 20th day of August , 1974, by the following vote: Ayes: Councilmen Byork, Green, Liewer, Morris, Rowe. Noes. Councilmen None Absent.
