AN URGENCY ORDINANCE OF TAE CITY COUNCIL OF THE CITY
OF LYNWOOD ADDING SECTION 22-9 TO THE CODE OF THE CITY
OF LYNWOOD RELATING TO SWIMMING POOLS, WADING POOLS,
AND OTHER SUCH BODIES OF WATER.
The City Council of the City of Lynwood hereby does
ordain as follows:
SECTION 1. Section 22-9 hereby is added to the Code
of the City of Lynwood to read as follows:
Sec. 22-9. Turbid water prohibited in swimming
pools, wading pools, etc.
Every owner of and resident at property on which
there is located a swimming pool, wading pool, or other similar
body of water shall maintain the water therein in a sufficiently
clear state so that objects on the bottom thereof will be readily
visible from the surface. In no case shall the turbidity of
such water exceed ten parts per million.
SECTION 2. This ordinance is necessary for the
immediate preservation of the public peace, health and safety,
and shall take effect immediately. The City Council hereby
declares that the following facts constitute the urgency so re-
quiring: The City has recently experienced a tragic death by
drowning of an infant child. Attempts to rescue the child were
hindered because the water in the swimming pool into which he
had fallen was so turbid that he could not be immediately located.
Other swimming pools in the community being so maintain constitute
an immediate threat to the health and safety to young children
within the City and should be cleaned immediately.
SECTION 3. If any section, subsection, subdivision,
sentence, clause, phrase, or portion of this ordinance, or the
application hereo£ to any person or place, is for any reason
held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this ordinance or its
application to other persons or places. The City Council hereby
declares that it would have adopted this ordinance and each
section, subsection, subdivision, sentence, clause, phrase or
portion thereof, irrespective of the fact that any one or more
sections, subsections, subdivisions, sentences, clauses, phrases
or portions, or the application thereof to any person or place,
be declaredinvalid or unconstitutional.
SECTION 4. The City Clerk is hereby ordered and
directed to certify to the passage of this ordinance and to
cause the same to be published once in the Lynwood Press, a
newspaper o£ general circulation printed and circulated in
the City of Lynwood.
First read, adopted and ordered published at
a regular meeting of the City Council of the City of
Lynwood held on the 4th day of March, 1975, by the following
vote:
Ayes: Councilmen Byork, Green, Liewer, Morris, Rowe
Noes: Councilmen None
Absent: Councilmen None __
