HomeMy Public PortalAboutOrd. 0986 ~ ORDINANCE NO. 986 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SECTIONS 27-1/2-44, 27-1/2-45 AND 27-1/2-46 OF THE CODE OF THE CITY OF LYNWOOD R~LATING TO REAL ESTATE TRANSACTIONS THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY DOES ORDAIN AS FOLLOWS: Section 1. Subsection (e) of Section 27-1/2-44 of the Code of the City of Lynwood hereby is amended to read as follows; (e) BLOCK is all property fronting upon one side of the street between intersecting and in~ercepting streets or between a street and right-of-way, water way and of dead-er~d street, or city boundary of the block on the side of the street which it interceptse Section 2. Subsection (b) of Section 27-1/2-45 of the Code of the City of Lynwood hereby is amended to read as fol.lows: (b) The Form shall contain the following information: (1) The name, address and signature of the carlvasser; (2) The name and address of the person or firm by whom the person completing the Form is employed; (3) A listing ofthe specific blocks ofthe properties proposed to be canvassed, which in no case shall exceed 30 blocks; (4) The dates and times at which each block is proposed to be canvassed; and, ifthe canvassing is to include the distributlon of printed materials, a copy thereof shall be attached to said f o rm; (5) The manner in which the canvass is to be conducted (telephone, door-to-door solicitation, distribution of llterature, door-to- door solicitation together with distribution of literature, etc. ); only one such manner may be proposed in each application. Section 3e Subsection (c) of Sectiorn 27-1/2-45 of the Code of the City of Lynwood hereby is amended to read as follows: (c) The form shail be completed and filed not less than fourteen (14) days nor more than thirty (30) days prior to the date on which the canvass is proposed to be commenced, Each such form shall be accompanied by a filing fee in such amount as the City Council may determine by resolution. Section 4e Subsection (d) hereby is added to Section 27-1/2-45 ofthe Code of the City of Lynwood to read as follows: (d) The cpnvasser shall cause to be published in a newspaper of general circulation within the City, at least once prior to the commencement of the proposed canvassn legal notice thereof, which notice shall contain the information set forth in subsection (b) hdreof; provided, however, that said legal notice shall not include any reproduction of printed material proposed to be distributed in connection with the canvass, . .. ~~ .. ORDINANCE NOa Page :~3 Section 5e Subsectic~n (e) hereby is added to Section 27-1J2-45 of the Code of the City of Lynwoo3 to read as fo~llows: (e) In the event the applicant has previously filed a Notice of Intent to Canvass, his application shall be accompanied by proof that his most recent prior Notice of Intent was published a3 required by subsection (d) hereof. Sectio~ 6a Subsection (f) is hereby added to Section 27-1/2-45 of the Code of the City of Lynw~o~ to read as io?.l~ws; (f) All ~,anvassing pursuant to a iorm submitted in accordance with this Section shabl be completed within thirty (30) days after the commencement thereofe Section 7e Subsection (k) hereby is added to Section 27-1/2-46 of the Code of the City of Lynwood to reaci as follows: (k) To canvass in the City in an attempt to obtain listings of real property or in an attempt to ef£ect a real estate transaction unless a form describing said nanbassing activitiea has been filed as required by Section 27- 1/2-45 hereof ~nd unleas such canvassing is conducted in accordance with the information contained on said forme Section 8e Severability If any section, subsection, subdivision, sentence, clause, phrase, or poxtion of this ordinancen or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdictlon, such decisio^ shall not affect the validity of the remaining portions of this ordirnance or its application to other persons or places. The City Council of the City of Lynwood hereby declares that it would have adopted this ordinance, and each section, subsectior~, subdivision, sentence, clause, phrase or portionthereofn irrespective ofthe factthat any one or more sections, subaectLons, subdivisions, sentencess cl.auses, phrases, or portions, or the application thereof to any person ar plac2~ be cYeclared invalid or unconstitutional.
