HomeMy Public PortalAboutOrd. 0960 ORDINANCE NO. 960 AN URGENCY ORDIIVANCE Or 'T'rIE CITY COUNCIL OF THE CI'I'Y OF LYNWOOD APPROVINCx AND ADOP~l'ING AN AI~4ENDMENT TO ORDINANCE NO. 945 AP~TD 'I'HE OFFICIAL REDEVELOPT.~/fENT PLAIV FOR PROJECT AREA "A" WHEREAS, by Ordinance 945, the City Council of the City of Lynwood adopted a Redevelopment Plan for Lynwood Commercial Area - Project Area "A", and WHEREAS, this City Council on September 2, 1973 enlarged the Redevelopment Survey Area surrounding Project Area "A" and commenced proceedings with the Lynwood Redevelopment Agency to designate and plan an amendment to Project Area "A", and WHEREAS, the Planning Commission of the City of Lynwood on Decernber 20, 1973, did consider the plan of the Agency and found by unanimous approval of the Planning Commission in Resolution No. 549 that the redevelopment plan proposed for said Project Area "A" As Amended by said Agency is consistent with the Land Use Element of the General Plan of the City of Lynwood and with ±he other elements of said General Plan, and WHEREAS, this Council has received and reviewed the VTN "Market Feasibility Report, " the Wainwright and Ramsey Lynwood Commercial Center Project 'A' Financial Feasibility Report June 1973 proposing use of the State Redevelopment Act, and the Wainwright and Ramsey report of Decexnber 1973 "Lynwood Commercial Center Summary of the Financial Feasibility of Project Area 'A' As Amended, Using the State Redevelopment Act, " and WHEREAS, the Lynwood Redevelopment Agency and this City Council have duly noticed and conducted ajoint public hearing with respectto the afore- said plan, and WHEREAS, this Council has considered testimony relating to said reports and proposed amendment, and ~NHEREAS, no written objections to said plan were delivered to the City Clerk prior to the hour set for said hearing and no oral objections to said plan were permitted during the hearing, or, in the alternative, such written and oral objections as have been presented to this Council pursuant tc the Community Redevelopment Law havE been and hereby are overruled by this City Council, NOW, THEREFORE, the City Council of the City of Lynwood hereby does find, determine, and ordain as follows: SECTION 1. The Redevelopment Plan for Project Area "A" is amended by adding land to and increasing the boundaries of said project area to include all land within the areas in the City of Lynwood bounded by: (a) The west line of State Street, the north line of Imperial Highway, the east line of Long Beach Boulevard and the north line of Fernwood Avenue, excluding therefrom the list of specific properties shown on Exhibit "A" attached hereto and incorporated herein by reference, which appear on the 1973-1974 property assessment roll of the County which have been or will be acquired by the City or State for right-of-way for the widening of Long Beach Boulevard or the construction of the Norwalk Freeway, and (b) That land located at the northeast corner of California Avenue and Imperial Highway shown as Assessor's Numbers Book 6191, page 10, parcels 7, 15, 16, 17, 19, 20, 21, 22, 23 on the 1973-1974 assessment roll being the west 50 feet of Lot 68, Lots 144, 145, 146, and the west 50 feet of Lot 147, Tract 2551, a11 as shown on a map attached hereto and incorporated herein by reference as Exhibit "B". SECTION 2. Redevelopment Project Area "A" as amended by Section 1 hereof is a blighted area, the redevelopment of which is necessary to effectuate the public purposes declared in the Community Redevelopment Law. SECTION 3. The Official Redevelopment Plan would redevelop Project Area "A" As Amended in conformity with the Community Redevelopment Law and in the interests of the public peace, health, safety, and welfare. -2- SECTION 4. The adoption and carrying out of the Ofiicial Redevelopment Plan is economically sound and feasible. SECTION 5. The Official Redevelopment Plan conforms t.o the 1Via.ster or General Plan of the City of Lynwood. SECTION 6. The carrying out of the Official Redevelopmer~t ~=lan would promote the public peace, heal.th, safety, and welfare of the City of Lynwood and would effectuate t.he purposes and policies of the Community .Redevelopment Law. SECTION 7. To the extent that the condemnation of real px~operty is provided for in the Official Redevelopment P1an, said condemnation is necessary to the execution of the Official Redevelopment Plan and adequate prr~visions have been made for payment for property to be acquired as provided by law. SECTION 8. The rehousing and relocation of families and persons dis- placed from the Project Area "A" As Amended has been provided for by a plan for relocation adopted by the Lynwood Redevelopment Agency. There are other areas not generally less desirable than Project Area "A" As Amended, in regard to public utilities and public and commercial facilities, with available, decent, safe and sanitary dwellings, at rents or prices within the financial means of the families and persons displaced from said project area, and reasonably accessible to their places of empioyment. 'I'he Council is satisfied that permanent housing facilities are now available and will be available at the time occupants oi the project area are displaced. SECTION 9. In approving and adopting the Official Redevelopment Plan, it is the purpose and intent of this City Council to eliminate and to prevent the spread of blight in the community and to encourage, promote, and stimulate the redevelopment of Project Area "A" As Amended as a commercial and professional area. SECTION 10. The City Clerk hereby is authorized and directed to forward to the Lynwood Redevelopment Agency a certified copy of this Ordinance. Said City Clerk is further authorized and directed to record with the County Recorder -3- of the County of Los Angeles a description of the land within Project Area "'A" As Amended and a statement tY.at proceedings for the redevelopment of said project area nave been instituted tzrider the p:ovisions of the Community Redevelopment Law. Said City C1erk is further authori.zed and directed to forward bef.ore January l, 197~, a copy of this Ordinance and a copy ei a map indicating the boundaries of Project Area "A" As Amended to: (a) The Auditor and `i'ax Assessor of the County of Los Angeles; (b) The governing body of each of the taxirig agencies which levy taxes upon any property in said project area; and, (c) The State Board cf Equal~~ ~~~ t~ion, SECTION 11 For a period o~: i~wo (2) S~ears following the adoption of this Ordinance, all applicants for• l uildi~~g perinits in Project Area "A" As Amended shall be advised by the Building Department of. the City of Lynwood tha± the site for which a building perr~~it is sought is within a redevelopment project area. SECTION 12. 'I'he City Council finds and determines that the following facts require that this Ordinance take effect immediately upon its passage as an Urgency Ordinance for the preservation of the health, safety, and general wel- fare of the citizens of Lynwood: The Council has determined that there are a number of conditions of blight located within Project Area "A" _9s Amended. The existence of these conditions affect the general weLfare of the residents of this City and contribute to the necessity for excessive expenditure of funds for public services to preserve said public health, safety and welfare. SECTION 13. The City Clerk shall certify to the adoption of this Ordinance and cause the samE to be published in the Lynwood Press, a news- paper of general circulation, printed, published and circulated in the City of Lynwood.
