HomeMy Public PortalAbout2000/08/29 A Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by James A. Failace at 7:30 P.M. Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday, August 29, 2000. Upon individual roll call, the following were noted present: Councilmember Patrick Crilley " Jack Fazekas " James O'Brien " Remy Quinones " Janet Santoro Noted absent was Councilmember Sohayda and Borough Attorney Craig Coughlin. Also noted present was Nick Goldsack, Business Administrator and Attorney Dough Walsh who was substituting for Attorney Coughlin. The meeting was opened with a minute of silent prayer and the Pledge of Allegiance led by Mayor James A. Failace. The Clerk stated that on August 14, 2000, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News Tribune and The Star Ledger and posted on the Bulletin Board. Firefighter Kevin Gomm. - Mayor Failace swore in Kevin Gomm. Jennifer Decibus - Mayor Failace said he has a newspaper article on Jennifer Decibus who received, The Distinguished Citizen Award, from Core of the Art from Middlesex County. She is associated with the Carteret Specials and is a student in a Secondary Class in Piscataway Regional Day School and volunteered her services daily in classrooms of younger students with Special Needs for the past four (4) years, during her Recess Period, she provides a Music Program for a class of nine (9) students, of seven (7), eight (8) and nine (9) years olds and the students love her and she develops her own activities and is commended by her teachers and piers. Upon MMS&C by Councilmembers Crilley and O'Brien and unanimous affirmative vote of the five (5) Council members present they recessed at approximately 7:40 p.m. At approximately 7:45 p.m. they reconvened the meeting. At approximately 7:45 p.m., Councilmember Sohayda was noted present. Upon MMS&C by Council members Santoro and Sohayda and unanimous affirmative vote of the full Council present the Minutes of April 6, May 18 & 25, 2000 were approved, transcribed and engrossed by the Clerk. ORDINANCE #00-35 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held September 7, 2000, upon MMS&C by Councilmembers Fazekas and Quinones. Upon individual roll call vote Councilmembers Crilley, Fazekas, O'Brien, Quinones, Santoro and Sohayda voted in the affirmative. - "AN ORDINANCE ESTABLISHING A NEW SUBSECTION "160-67 A" OF THE CODE OF THE BOROUGH OF CARTERET" ORDINANCE #00-36 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held September 7, 2000, upon MMS&C by Councilmembers Quinones and Fazekas. Upon individual roll call vote Councilmembers Fazekas, O'Brien, Quinones and Sohayda voted in the affirmative. Councilmembers Crilley and Santoro voted No. "ORDINANCE AMENDING CHAPTER 168 OF THE CODE OF THE BOROUGH OF CARTERET BY ADDING A NEW SUBSECTION REGULATING THE USE OF MOBILE TELEPHONES WHILE OPERATING A MOTOR VEHICLE" Council member O'Brien said he is following Jersey City and Marlboro and one reason is to save lives in the Borough and he 2 spoke of some people that have lost their lives. He wants to help push the state into action. He said he did research on people using cell phones and their reaction time is actually cut down because of it. ORDINANCE #00-37 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held September 7, 2000, upon MMS&C by Councilmembers Quinones and Fazekas. Upon individual roll call vote Councilmembers Crilley, Fazekas, O'Brien, Quinones, Santoro and Sohayda voted in the affirmative. "AN ORDINANCE PROVIDING FOR LIBRARY REPAIRS FOR THE BOROUGH OF CARTERET, COUNTY OF MIDDLESEX, NEW JERSEY, APPROPRIATING $55,000.00 FROM THE CAPITAL IMPROVEMENT FUND OF THE BOROUGH FOR THE COST THEREOF" ORDINANCE #00-38 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held September 7,2000. Councilmember Quinones said she wanted to Table this Ordinance because she thinks there is issues regarding this ordinance that needs to be ironed out at the Agenda Meeting. Attorney Walsh said this would be Adjourned to Public Hearing not Tabled because he said by statute the First Reading is a Public Hearing. Upon MMS&C by Councilmembers Quinones and Crilley they moved to Adjourn this to a Public Hearing. He asked if any research had been done with availability to State and Federal Funds from the 7 AUGUST 29, 2000 Ordinance #00-33 Cont: Public Hearing Hearing Closed Adopted ORDINANCE #00-34 Bond Ordinance Appropriating $3,600,000.00, Re: Year 2000 Sewer System Capital Improvement Program Public Hearing AUGUST 29, 2000 Ordinance 4/{)1.)- 34 Public Hearing Cont: DEP . He suggested until they find out if there is funds available they shou]d hold off on the sewer program because the sewers have been bad for so many years anyway. Mayor Failace said they have been looking for funds. He said he was just on the phone with Congressman Menedez's office and he said they will possibly be getting 2.5 million dollars for us in some kind of water bill, so the bottom line is we have twelve (12) million dollars in sewer projects that the DEP has mandated that we continue with our sewer separation and our projects. He said they have also applied for Emergency Management for 2.5 million dollars after the storm we had last year. He said they still have people with sewage in their basements, etc. and it is a quality of life thing and we have to keep moving forward. He explained that they inherited these projects and no one should have to pay our taxes and put up with these problems. Andy Tarrant asked Mr. Goldsack what effect wou]d this have on the tax rate. Mr. Goldsack said based on the fund anticipation of rates if we went out on the full funding on that it would cost us approximately $180,000.00 with two (2) tax points. The average house would be about $20.00. Mr. Tarrant said he spoke to many people and he agrees with Mr Sudia and he thinks they should go out and try to get these monies before bonding for 3.6 million dollars. The taxpayers are overburdened. If there is monies out there they shou]d go out and research it and if we could get it within the next seven (7) months they could save the taxpayers money. Mayor Failace said they have and are looking for money and regardless of what we get we wi II still have to bond for some money and for the quality of life we have to go forward and he said they have to demolish the o]d sewer plant, it is a hazard. Daphne Miles, 25 Pulaski Ave., she said she is standing in front of him as the Chairman of the Carteret Housing Authority. She had witnessed the problem of flooding on Bergen Street and it is beyond quality of life. The problem goes back about thirty (30) years. She also spent time with the parents so the children would not play in this filthy water. Even when the water goes down the residue is there and there is some cars damaged. She saidf that it has been going on too long. There is work that needs to be done but cannot be done unti] the flooding problem is taken care of. Councilmember Santoro asked Nick Goldsack if any of the projected sewer projects they are doing now under the 3.6 million dollars, are going to address that area. Nick Goldsack said the illegal connection separation. 8 Councilmember Santoro asked Mr. Goldsack which year wou]d the rest of that be addressed in the next five years. Mr. Goldsack said Killam wou]d have to be addressed on that. Pat Tozzi, Carteret, he asked about when we first had to start paying the sewer bills some of that was put in escrow and we had millions of dollars set aside. He questioned where this money went. Nick Goldsack said any excess revenue from the sewer bills are transferred over to the Capital Reserve, which have been utilized to do the sewer projects, which has been about three million dollars. Mr. Tozzi asked how much is put aside in a year. Nick Goldsack said in 1998 it was about a million dollars and last year it was about $650,000 and this year it is about $450,0000.00. Pat Tozzi asked if that goes against the twelve (12) million dollars they are talking about and asked if over the years it will be up to fifteen (15) million dollars at that time. Mayor Failace said he really couldn't tell him that. Pat Tozzi asked with the 3.6 million dollars how many homes would be satisfied. The Mayor said we are doing the Hill Section and the illegal connections. They have rehabilitated Pump Stations. Pat suggested that they should borrow the twelve (12) million dollars and have an eighty (80) dollar increase, but that would solve all the problems. Council member Santoro said we might not have that kind of bonding capability. Pat mentioned all the money in the state in surplus with no interest. Nick Goldsack said that is true and they are all being addressed, but the only problem is with some of these grants and ]oans there are time frames that have to be addressed with them. Councilmember Santoro said they told us by April 2000 they could give us a pre-committal and we could receive them by November 2000. Nick said if they get it in November they cannot use it until the next year. Mr. Tozzi said some people Jive through this every time it rains and their quality of life stinks. Something has to be done. 9 AUGUST 29, 2000 Ordinance #00-34 Public Hearing Cont: AUGUST 29, 2000 Ordinance (X)- 34 Public Hearing Cont: Ms. Shaunessy asked how long it would take before this project hits Bergen Street. Mayor Failace said some of the sewer separation is part of Bergen Street. It will start as soon as they bond and it is set into motion. John Sudia spoke of a drainage ditch a]ong Bergen and Edward Street and has to be cleared of debris and completely dug out. James Mancuso spoke on how the public gets up and tells the Governing Body that there is money out there to be had and why aren't they getting it and he commented if they know about it to pass it to the Governing Body. Council member Santoro told Mr. Mancuso if he was at the last Agenda he heard what she had discussed with Killam. She has the information in front of her for the Grant Program that had to be filed by October 2nd. They were well aware of what had to be done. She said she has a sheet of paper from the budget from when he was on the Council and it was a five (5) year plan for the sewers for eight (8) million dollars and now a year later for twelve (12) million dollars. She questioned if there was an error. Mr. Mancuso said that many illegal hookups have been found since then, more problems have been found and the state wants them done. He commented that he had never seen her come to a Council Meeting before and speak on the sewers. Counci]member Santoro said she was giving six (6) years of her time to the Board of Education and she never saw him at those meetings. Ron Rios, 105 Marion Street, Carteret. His concerns are the citizens that have improper sewage in their houses and we have to take care of them and finance them at the ]owest cost that we can. If there is loans or grants out there we have to try and get them and we have people on the Borough payroll to do that. Mayor Failace told Ron Rios that if anyone thinks that this Council wants to bond just to bond and see if we can just get it done and spend as much money as possible, that is not true. We have people working on the money and grants and if we can get them he will guarantee this Council will get them and if we don't it is not because the Council is not trying. Mrs. Gatos, Hermann Street of Carteret, spoke saying after an hour of heavy rain she already couldn't use her shower. She said the town has to come out when it is raining to see where the water is coming from. Mayor Failace said we have already worked on Hermann Street but the problem was not alleviated but they will be working on it again. 10 There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C by Councilmembers Crilley and Quinones and unanimous affirmative vote of the full Council present. Upon MMS&C by Councilmembers Crilley and Quinones ORDINANCE #00-34 "BOND ORDINANCE PROVIDING FOR YEAR 2000 SEWER SYSTEM CAPITAL IMPROVEMENT PROGRAM IN AND BY THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY, APPROPRIATING $3,6000,000 THEREFORE AND AUTHORIZING THE ISSUANCE OF $3,428,500 BONDS OR NOTES OF THE BOROUGH TO FINANCE PART OF THE COST THEREOF" was finally adopted. Upon individual roll call vote Councilmembers Crilley, Fazekas, O'Brien, Quinones and Sohayda voted in the affirmative. FAILACE Advertised as Finally Adopted SEPTEMBER 4. 2000 BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS: Section I. The improvement described in Section 3 of this Bond Ordinance is hereby authorized to be undertaken by the Borough of Carteret, New Jersey. For the improvement or purpose described in Section 3, there is hereby appropriated the sum of $3,60,000, including the sum of $171,500 as down payment required by the Local Bond Law. This down payment is now available from the Reserve for Sewer Improvements. Section 2. In order to finance the cost of the improvement or purpose not covered by application of the down payment, negotiable bonds are hereby authorized to be issued in the principle amount of $3,428,500 pursuant to the Local Bond Law. In anticipation of the issuance of bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law. 11 AUGUST 29, 2000 Ordinance #00-34 Hearing Closed Adopted ORDINANCE #00-34 AUGUST 29. 2000 ORDINANCE 4/{)1.}- 34 Cont: Section 3. (a) The improvement hereby authorized and the purpose for the financing of which the bonds are to be issued is the Borough's Year 2000 Sewer System Capital Improvement Program consisting of the renovation and rehabilitation of the Dorothy Street Pump Station, the Roosevelt A venue Pump Station and the Harrison Avenue Pump Station, the improvement of the storm water system in the Hill District, in the SabolPinho area and in the Columbus Schoo] area, the demolition of the o]d wastewater treatment plant, system-wide major capital repairs and pre]iminary planning work with respect to future capital improvements, including acquisition and installation of all materials and equiprnent necessary therefore or incidental thereto. (b) The estimated maximum amount of bonds or notes to be issued for the improvements or purpose is as stated in Section 2 hereof. © The estimated cost of the improvement or purpose is equal to the amount of appropriation herein made therefore. Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the Chief Financial Officer, provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer. The Chief Financial Officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the Chief Financial Officer's signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to provisions of NJ.S.A. 40A:2-8(a). The Chief Financial Officer is hereby authorized to sell part or all of the notes from tirne to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from the dates to the date of delivery thereof. The Chief Financial Officer is directed to report in writing to the Governing Body at the meeting, next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser. Section 5. The Capital Budget of the Borough of Carteret is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services, is on file with the Clerk and is available there for public inspection Section 6. The following additional matters are hereby determined, declared, recited as stated. 12 (a)The improvement or purpose described in Section 3 of this Bond Ordinance is not a current expense. It is an improvement or purpose that the Borough may lawfully undertake and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby. (b )The period of usefulness of the improvement or purpose within the limitations of the Local Bond Law, according to reasonable life thereof computed from the date of the bonds authorized by this ordinance, is 40 years. © The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk and a comp]ete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Borough as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this Bond Ordinance by $3,428,500 and the obligations authorized herein will be within all debt limitation prescribed by that Law. (d) An aggregate amount not exceeding $900,000 for items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein for the purpose of improvement. Section 7. Any grant moneys received for the purpose described in Section 3 hereof shall be applied either to direct payment of the cost of the improvement or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used. Section 8. The Chief Financia] Officer of the Borough is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Borough and to execute such disc10sure document on behalf of the Borough. The Chief Financial Officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the Borough pursuant to Ru]e l5c212 of the Securities and obligations of the Borough and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized Bond Counsel, consistent with the requirements of the Rule, in the event that the Borough fails to comp]y with its undertaking, the Borough shall not be liable for any monetary damages and the remedy shaH be limited to specific performance of the undertaking. Section 9. The fuH faith and credit of the Borough are hereby pledged to the punctua] payment of the principal of and the interest on the obligations authorized by this Bond Ordinance. She recognized Sergeant McFadden and Ditective Curran, who actually helped out and assisted in Traffic Control when President Clinton gave his speech in South Brunswick. Our Police Director was invited there and attended and recei ved some compliments on our officers. She said our Special Investigations Unit is continuing to do very well. Mayor Fai1ace said they are surveying that property but nothing is happening. Olga said she lives on Roosevelt Avenue and she said something has to be done with alJ the truck traffic. Mayor Failace said they talked to the County on that. Mrs. Gatos said the old First Union Bank in Carteret never has anyone come in and maintenance it. She also mentioned cleaning up the old McDonald's property in Chrome. Mayor Failace said they try to keep up on cleaning up things and if someone calJs with a complaint they send someone to clean up. NorvelJ Pendleton spoke asking when they would taking the tree trunk out on Union Street. He said he passed a house yesterday on Mathew Street and they were cutting down trees. Councilmember Sohayda said that was done as a contingent on the sale of a house. We are in a non tree cutting mode right now and Councilmember CrilJey agreed with him. Norvell then asked in reference to Roosevelt Avenue to Bergen Street and from Edwin Street to Hudson Street the Water Company left hoses and lumps of tar there. Council member Sohayda said he was there and he saw it and they told him they were doing a major Capital Improvement there. He commented it is not on]y there but all over Carteret. Mayor Failace said it is approximately a six (6) month project, they are doing some relining. The construction officials will be looking over what they will be doing when done. NorvelJ mentioned that when they were spraying for mosquitoes they only let out one puff. An unidentified man said he never saw the mosquito truck and he asked if they were supposed to have sprayed every block. Mayor Failace said they were suppose to. 24 Councilmember Quinones said some of the streets were sprayed around midnight. At approximately 9:25 p.m., Council member Fazekas was noted absent. A lady who said her name inaudibly, from 109 Dorothy Street, spoke. She sings with the Blazing Stars. She asked what room they would have in the Community Center for their rnusic equipment and cabinets. Mayor Failace said they hadn't made that decision yet. Councilmember Santoro said she would try to see what they will be doing with this. She met with the three (3) groups and now she has to see their schedules to see what can be done. The same woman spoke saying about two (2) months ago someone tried to break into her house. The police came and they did not even look around her backyard. Mayor Failace said he thinks our police Department on a whole does a good job. Stan Gutowski, New Jersey Avenue, said a few months ago there was heated discussion about the Graffiti Ordinance. He asked if we in fact police our own graffiti. They had a company picnic in Carteret Park and there was a lot of profanities in the Gazebo which have been there for a while. It showed a bad example of our town and it should have been painted over. The condition of the lake was terrible, it was filled with debris. We need to enforce our own Graffiti Ordinance. Mayor Failace agreed. He admitted not telling anyone to paint over the graffiti but he thought it would be done. At approximately 9:25 p.m., Councilmember Fazekas was noted present. Mike from Locust Street asked about the quality of the air we breathe from International Bakeridge. They shut down but then three (3) hours later they start up again. Andy Tarrant questioned the issue of grants, how many we have applied for since January 1st of this year and how many pending applications we have for State and Federal or County Agencies. 2~ AUGUST 29, 2000 Councilmember Fazekas noted absent Citizen, 109 Docothy Street Graffiti Ordinance Councilmember Fazek; noted present Air Pollution Grants AUGUST 29, 2000 Grants Cont; Mayor Failace said since last year and he spoke to Congressman Menendez, that our Emergency Management has filled out the papers for the two and one half million dollars. Andy said he is aware of five (5) grants Emergency Management has gone out for, but, he is wondering about the Borough itself. He said he is aware of the one million dollar one they have for the area down here. Nicholas Godsack, our Business Administrator, said they have a D.O.T. Grant for the sewers that was discussed tonight and he said they are applying for the one million dollar one for this year because now we know the projects that have to be done. DamIan Pallet Andy Tarrant asked about the Host Community status with Dauman Pallet that we had with the wood. He asked if there is anyway we can still have that. We didn't pay for them to chop our wood and it is very expensive. Councilmember Sohayda said after the death of former Mayor Sica that was over. Atlantic Realty Andy also asked about Atlantic Realty, being that Councilmember Crilley brought it up, that they were going to give us a $40,000,00 Basketball Court and maybe we can give them Mr. Mangieri's the name for the Board of Education because they will need funds to educate the children. Police John Sudia said he is glad to see we finally had a woman on the Police Force and now more than one. We also have another minority and we can look forward to hopefully having a black minority. He then asked about, when he was checking the bills over he noticed we are still paying Stowell. Mayor Faiice said we still have a case going on.
