HomeMy Public PortalAboutOrd. 0959 ORDINANCE N0. 959 ~~7~X A.N OR.DINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING PORTIONS OF CHAPTER 17 AND ADDING PORTIONS TO CHA.P- TER 17 OF THE CODE OF THE CITY OF LYNVTOOD, RELA.TING TO BiJSINESS LICENSES THE CITY COUNCIL OF THE CITY OF LYNWOOD ~3EREt3Y DOES ORDAIN A.S FOLLOWS: SECTION 1, Section 17-35 of the Code of the City of Lynwood is hereby amended to read as follows: Section 17-35. ISSUA.NCE, GENERALLY. Upon the payment of the fee for a license as prescribed by this ~.rticle, the license collector shall prepare and issue a license as provided in this chapter to every person required to obtain a license by this chapter. In addition to the license fees prescribed elsewhere in this chapter, an applicant for a. new license, as distinguishedfrom the renewalfor a succeeding current or unexpired license, shall pay an occupancy inspection fee of ~15. 00. SECTION 2. Section 17-45 hereby is added to the Code of the City of Lynwood to read as follows: Section 17-45. TEMPORARY PERMIT. `Lhe license collector, may, in his discretion, upon the filing of a.n application for a license pursuant to this chapter and pending a final decision on the issuance of such a license, issue a temporary permit to conduct the busim ness described in the application for a period not to exceed 90 days. The tem- porary permit shall state specifica,lly that it is of a temporary, provisional nature and that it will expire automatically once the license collector has de±ermined to either issue or deny the issuance of the business license for which application has been made. A person issued a temporary permit shall, at. the time of said issu~ ance, pay a fee equal to that required for the business license for which applica- tion has been made. In the event a business license is subsequently issued, the amount paid for the temporary permit shall be credited toward the amount other- -1- _ , wise due for the business licensea In the event the business license is not subse- quently issued, then the fee paid for the temporary permit shall be refunded, less an amount equal to the ratio between the number of days the temporary perrnit remained in force and the period of time covered by the business license, if it had been issued. SECTION 3. Subsection (11) of Section 17-57 of the Code of the City of Lynwood is hereby amended to read as follows: (11) CONTRACTORS. (a) General contractors: For each person conducting, managing, engaged in or carrying on the business of general contracting, whether or not as an established place of business in the city: 1. Per year ~ 60. 00 2. Semi - annually ~ 30. 00 (b) Electrical contractor: For each person conducting, managing, engaged in or carrying on the business of installing, main= taining, altering or repairing electrical wiring, equipment apparatus or fixtures, whether or not as an established place of business in the city: 1. Per year 2. Semi - annually ~ 60. 00 ~ 30. 00 (c) Plumbing contractors: For each person conducting, managing, engaged in or carrying on the business of installing, al- tering, maintaining, or repairing plumbing and gas equipment, pipes, apparatus or fixtures, whether or not as an established place of busi- ness in the city: 1. Per year ~ 60. 00 2. Semi - annually ~ 30. 00 (d) Subcontractors: For each person conducting, man- aging, engaged in or carrying on the business of subcontracting, whe- ther or not as an established place of business in the city. S4zbcontrac- -2- ting shall include installing, altering, maintaining or repairing the follow ing: Accoustical; alarm and time systems; awnings; boilers, hot water heating, steam fitting; cabinet and mill work; carpentry; cement and concrete; electrical signs; elevator installation; excavating, grading, trenching, paving, surfacing; fencing; fire protection, engineering; flooring; glazing; heating, ventilating, air conditioning; house and building moving; insulation; landscaping; lathing; linoleum; masonry; metal sash and doors; ornamental metals; painting, decor- ating, and paperhanging; plastering; rig building; roofing; sewer, sewage disposal, drain, cement pipe laying; shades, venetian blinds; sheet metal; sign painting and writing; soil tests; sprinkler systems; steel, reinforcing and structural; structural pest control; tile, waterproofing; welding; well drilling; wrecking and demolition; classified specialists. The license fee shall be as followso 1. Per year 2. Semi - annually ~ 30. 00 ~ 15. 00 SECTION 4. Subdivision (b) of Subsection (15) of Section 17-57 of the Code of the City of Lynwood is hereby amended to read as followso (b) Laundry; laundry and dry cleaning: For each pe.rson managing, conducting or carrying on the business of collecting or deliverinq articles to be dry cleaned, pressed or dyed, by hand, steam or other motive power, per vehicle per year ~ 30. 00 Where a dry cleaning plant is operated in connection with a laundry, the licensee shall be required to pay the one licer.se fee stated in this paragraph. SECTION 5. Subsection (20) of Section 17-57 of the Code of the City of Lynwood is hereby amended to read as follows: -3- (20) FIREWORKS STANDS; CHRISTMA.S TREE STANDS AND SIMILAR BUSINESSES, For each person managing, conducting or carrying on the business of operating a Christma.s ±ree lot, fireworks stand, flower., fruit or veget~~~k~le stand or any similar type of business, the license fee shall be b?~sed on Che number of persons employed in the amounts set forth in subsection ~`~7) oY this section. SECTION 6. Subsection (24) of Section 17-57 of the Code o~ the City of Lynwood is hereby amended to read as follows: (24) HOTELS A.ND MOTELS. For each person engaged in the business of accomodating transient patrons by the day, week or month, at each such business location, shall pay the following license fee: (a) One (1) through nine (9) units, per year ~ 20. 00 (b~ Ten (10) units or more beginning with the tenth unit, ~1. 50 per year for each additional unit SECTION 7. Subsection (26. 5) of Section 17-57 hereby is added to the Code of the City of Lynwood to read as follows: ~26, 5) LEASING PROPERTY FOR OFF'ICE, COMMERCIAL, OR 11/iANUFA.CTURING PJRPOSES. Every person who rents or leases, or offers to rent or lease, ls.nd, buildings, or structures of any kind whatsoever, or portions thereof, for office, commercia.l, manufac±uring, and other non-residential purposes shall pay a license fee equal to 50% of the license fee or fees required by this chapter to be paid by the licensee lessee or lessees thereof. ~5 SECTION 8, S1~bsection (3) of Section 17-.59 of the Code of the City of Lynwood is hereby amended to read as follows: (3) CARNIVALS, CIRCUSES AND SIMiLAR SHOWS: For each person managing, conducting or carrying on any carnival, circus, rodeo or itinerant show ~ 15. 00 -4- SECTION 9. Subsection (6) of Section 17-75 of the Code of +..he Ci±y of Lynwood is hereby a.mended to read as follows: (6) FIRE~3JORKS STANDS, CHRISTMAS 'rREE :TANDS AND SIMILAR BlJSINESSES: For each person managing, conducting or carrying on the b~Asiriess of operating a Christmas tree lot, fireworks stand, flower, fruit or veget.able stand or any similar type of business ~ 15. 00 Permits required by this subsection shall be issued for a maxi- mum of thirty (30) days in any one (1) twelve (12) month period. SECTION 10~ Subsection (7) of Section 17-75 of the Code of the City of Lynwood is hereby amended to read as follows: (7) HOME OCCUPATIONS. For each person managing, conducting or carrying on any business in the home ~ 15. 00 SECTION 11. Subsection (9) of Section 17-75 of the Code of the City of Lynwood is hereby amended to read as follows: (9) MA.SSA.GE PA.RLORS; STEAM AND TURKISH BATHS. For each person managing, conducting or carrying on the business of massage parlor, steam baths, public baths, Turkish baths a.nd other health or beauty ba+hs or schools or any schools of massage or hydrotherapy or any other similar therapeutic school ~ 15. 00 SECTICN 12, Subsection (11) of Section 17-75 of the Code of the City of Lynwood is hereby amended to read as follows: (119 PRIVATE PATROL SERVICES. For each person managing, conducting or carrying or. the business of a private detective, private investigation service or patrolling and watching business establishments, residences or other premises ~ 15, 00 Nothing contained in this subsection shall be construed as abro- gating or repealing the provisions of any present or future ordinance or regu- lation dealing specifically with the types of businesses enumerated in this subm section. m 5- SECTIGN 13. Subsection (12) of Section 17-75 of the Code of the City of Lynwood is hereby amended to read as follows: (12) SECONDHAND DEA.LE.RS: For each person, the major portion of whose business consti±utes the buying, selling or otherwise dealing in secondhand goods, wares ox° xnercYiaridise ~ 15. 00 Nothing contained in this subsection shall be construed as abrogating or repealing the provisions of any present or future ordinance or regula.tion dealing specifically with these types of businesses. SECTION 14. Subsection (13) of Section 17-75 of the Code of the City of Lynwood is hereby amended to read as follows: (13) TRASH, RUBBISH AND REFUSE DISPOSAL. For each person managing, conducting or carrying on tYie business of soliciting for and collecting, removing and disposing of refuse and rubbish ~ 15, 00 SECTION 15. Subsection (4) of Section 17-57 of the Code of the City of Lynwood is hereby amended to read as follows: (4) APARTMENT OR HOT7SES. Every person as either an owner, lessee, proprietor or operator who rents or leases, or offers to rent or lease, a total of four (4) or more dwelling units located within the city shall pay a license fee as followse lo Four (4) dwelling units through nine (9) dwelling units per year ~ 20, 00 2, Ten (10) dwelling units, or more beginning with the tenth dwelling unit, ~1. 50 per year for each ad- ditional dwelling unit SECTION 16. SU.bsection (42) of Section 17-57 of the Code of the City of Lynwood is hereby amended to read as follows: (42) TRASH, REFLJSE AND RUBBISH DISPOSAL: For each person mana.ging, conducting or carrying on the business _ge 1 of soliciting for and collecting, removing and disposing of refuse a.nd rubbish, per year ~300. 00 SECTION 17. Slzbsection (34) of Section 17-57 of the Code of the City of Lynwood is hereby amended to read as follows: (34) PROFESSIONAL-TYPE BUSINESSES AND PROFESSIONS. Each person carrying on a professional-type business, or a profes~ sion, including but not limited to the following professional-type businesses and the professions: Architects; attorneys; certified public accountant; chiropractors; dentists; engineers (all types); funeral directors and morticians; insurance brom ker (one who, on behalf of another person, transacts insurance with, bu.t not on behalf of, an insurer); ophthalmologists and oculists; optometrists; osteopaths; psychologists; public accountants; veterinarians. The annual license fee shall be as follows: (a) For a single member ~ 20. 00 (b) If a partnership: 1. For one (1) partner ~ 20. 00 2. For each additional partner 15. 00 (c) If a professional corporation: 1. For one (1) shareholder ~ 20. 00 2, For each additional shareholder 15. 00 (d) In addition to the fee imposed by para- graphs (a), (b), or (c), the following fee shall be paid: l. For the first four (4) employees, excluding members and shareholders, each ~ 4.00 2. For employees in excess of four (4) excluding members or shareholders, each 2. 00 -7- ` }.
