AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH COLE COUNTY
ESTABLISHING RESPONSIBILITIES FOR THE FAIRGROUND ACRES SUBDIVISION
TO COUNTY PARK GREENWAY TRAIL.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to
execute an agreement with Cole County regarding the establishment of responsibilities
for the Fairground Acres Subdivision to County Park greenway trail.
Section 2. The agreement shall be substantially the same in form and content as
that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.

AGREEMENT
This Agreement is entered into this *141 day of .Q,l/J . 2019 by
and between the County of Cole, (hereinafter"County") and the City of Jefferson,
(hereinafter"City").
WHEREAS, the City wants to install a ten foot wide concrete trail (hereinafter
"greenway")at Cole County Park, County Park Road,Cole County, Missouri; and
WHEREAS,the Cole County Commission agrees to allow this installation at Cole
County Park to provide a connection from Fairgrounds Acres for the citizens of Cole
County.
NOW, THEREFORE, the Parties in consideration of the foregoing recitals and
the mutual covenants and promises contained herein, hereby agree as follows:
1. The City agrees to finance and construct a greenway, and provide and
fund the future maintenance of the greenway.
2. The County will allow the greenway trail to remain in place for a period of
not less than twenty five years.
IN WITNESS WHEREOF, the parties hereto have executed this contract as of the
date first above written.
