ORDINANCE NO, 95~
AN ORDINANCE OF THE CITY COUNCLL OF THE CITY OF LYNWOOD
ADDING SECTION G8-6 TO THE LYNWOOD CITY
CODE PROHIBITING CERTAIN OBSTRUCTIONS IN PUBLIC
RIGHTS OF WAY
THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 2806 hereby is added to the Lynwood City Code
to read as fbllows:
Sece 28-6e News Racks Prohibited in Rights of Way,
(a) Definitionso
(i) As u~ed in this section, "news rack" shall mean any
self-service or coin-operated box, container, storage unit or other
dispenser installed, used, or maintained for the display and sale
of newspapers or news periodicals;
(ii) "Street" shall mean all that area dedicated to public
use for public street purposes and shall include, but not be limited to
roadway~, parkways, alleys and sidewalks;
(iii) "Roadway" shall mean that portion of a street which
is improved, designed, or ordinarily used for vehicular travel;
(iv) "Parkway" shall mean that area between the sidewalk
and the curb of any street and, where there is no sidewalk, that area
between the edge of the roadway and the property line adjacent thereto.
"Parkway" shall also include any area within a roadway which is not
open to vehicular travel;
Qv) "Sidewalk" shall mean any surface provided for the
exclusive ~ise of pedestrian~,
(b) No per°sen shall install, use or maintain any news rack or
structure which projects onto~ into or over any parit ofthe roadway
of aeny public street, or which rests, wholly or in partn upon, along or
over any portion ofthe roadway of any public street,
(c) No person shall install, use or mainta'in any news rack which
in whole or in part rests upon9 in or over any public sidewalk of park-
way.
(d) Ara~a new~ rack installed, used or maintained in violation of
the provisiorns of this section may be summarily removed and stored
in any convenient plaee by any officer of the City, Such officer shall
take reasonable steps to notify the owner of said news rack of the fact
that it has been removed pursuant to this section, Upon failure of the
owner to claim such news rack and pay the expenses of removal and
storage within thirty (30) days after such removal, said news rack
shall be deemEd to be unclaimed property in possession of the Police
Departmeni and may be di~posed of pursuant to the provisions of this

SECTION 2. If any sectlon, subsection, sentence, clause, phrase
or portion ofthis ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, such portion shaLl be deemed a separate,
distinct and independent provision and such hoLding shalL not affect the validity
of the remaining portions thereof,
SECTION 3. The City CLerk shall certify to the adoption of this ordinance
and cause the same to be published in the Lynwood Press, a newspaper of general
circulation, printed, pubLished and circulated in the City of Lynwood.
First read at a regular meeting of the City Council of said City held on
the 17th day of July, 1973, and finaLly adopted and ordered publiched at a re-
gular meeting of said Council held on the 21st day of August , 1973, by
the following vote:
