HomeMy Public PortalAbout2000/09/20 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor James A. Failace approximately 7:30 P.M. on Wednesday, September 20, 2000, Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: Councilmember Patrick Crilley " James O'Brien " Remy Quinones Also noted present were Business Administrator Nicholas Goldsack and Borough Attorney Craig Coughlin. Noted absent were Council members Fazekas, Santoro and Sohayda. The meeting was opened with a moment of Silent Prayer and the Pledge of Allegiance led by Mayor James A. Failace. The Clerk stated that on September 15, 2000, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News Tribune, The Star-Ledger and posted on the bulletin board. Upon MMS&C, by Councilmembers Crilley and O'Brien and unanimous affirmative vote of the full members present, the minutes of July 13 and 27, 2000 were approved as transcribed and engrossed by the Clerk. Mayor Failace made a presentation to Atlantic Realty Development Corporation for their help with the Chrome Park Improvement Project. ORDINANCE #00-40 was introduced and adopted on the First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held on October 5, 2000, upon MMS&C, by Councilmembers Crilley and Quinones. Upon individual rol1 call vote, Councilmembers Crilley, O'Brien and Quinones voted in the affirmative. Councilmembers Fazekas, Santoro and Sohayda were noted absent. L. Council member Quinones stated she wanted to amend the Ordinance to include the eight thousand dollars for acting Recycling Coordinator put into the Director of Public Works' salary and the extra two thousand dol1ars for the license. ORDINANCE #00-41 was introduced and adopted as amended on the First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held on October 5, 2000, upon MMS&C, by Councilmembers Quinones and Crilley. It was duly published in the Home News Tribune on September 4, 2000 with notice that it will be considered for final passage after Public Hearing to be held on September 7,2000 at approximately 7:30 P.M. Due to a problem with advertising it was again duly published in the Home News Tribune on September 12, 2000 with notice it will be reconsidered for final passage after Public Hearing to be held on September 20, 2000 at approximately 7:30 P.M. the Ordinance was posted on the bulletin board and copies were made available to the general public according to law, she read the Ordinance by title. Upon MMS&C, by Councilmembers Crilley and Quinones and unanimous affirmative vote of the three (3) members present, the Mayor declared the Public Hearing to be open: 3. UBLIC HEARING Upon MMS&C, by Councilmembers Crilley and O'Brien and unanimous affirmative vote of the three (3) Councilmembers present, the Mayor declared the Public Hearing to be open: 4. OMMENTS An unidentified man asked the Council for clarification on the motor vehicle law which reads drivers must have two hands on the wheel. He further stated when using a cell phone he did not see how someone could keep both hands on the steering wheel. Councilmember Quinones stated there are different sections m title thirty-nine that regulate careless driving and reckless driving. She further stated she wasn't sure if the exact wording was that drivers had to have two hands on the wheel but thought they had to use caution when dri ving motor vehicles. An unidentified man said he thought it was two hands on the wheel. Councilmember Quinones reiterated the Council thought that was the proven way to dri ve. Council member O'Brien stated he checked the drivers' manual, which read both hands, should be available to be on the wheel. An unidentified man asked if both hands being on the wheel was a state law. Borough Attorney Craig Coughlin stated he didn't think it was a law but stated he thought it was the appropriate way to drive. He stated there are unfortunately people who don't have two hands and are permitted to drive without violating any laws. He agreed with Councilmember Quinones that there are a number of laws that regulate conduct behind the wheel and regulate careless driving. He further stated he didn't think there was a statute that mandated the use of two hands and agreed with Councilmember O'Brien that the driver manual we remember from driver education classes stated drivers should lock their hands on the wheel at "ten" and "two". Mayor Failace stated most members of the Council agreed that this was something the town should do, but that it might be tested in the courts, but he felt it was something the Council should do. Councilmember O'Brien stated a town in Pennsylvania tested it, he said there was a rumor about Marlboro going to court, but stated he spoke to Marlboro yesterday and they are not taking it to court and are putting signs on state roads concerning cell phone use. There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Crilley and O'Brien and unanimous affirmative vote of the three (3) Councilmembers present. Council member O'Brien said he would like to table this Ordinance until the October 5th meeting. 5. Councilmember Quinones said she would vote yes to table but thought it was a disgrace that several Councilmembers were not present to vote on this Ordinance. She said some of the Councilmembers had previously expressed their approval of the Ordinance and decided to go to a fundraiser for the Middlesex County Democrats. Mayor Failace asked Borough Attorney Craig Coughlin if the Council needed a motion to rescind the Ordinance. Borough Attorney Coughlin stated the Ordinance was just going to die. ORDINANCE #00-39 "AN ORDINANCE TO AMEND ORDINANCE #71-9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" was not adopted because there was no motion made on the Ordinance. A copy of each Resolution was placed upon the table for public review prior to the meeting in accordance with the Rules of Council and upon MMS&C, by Councilmembers Quinones and O'Brien and unanimous affirmative vote of the three (3) Council members present, the meeting was opened for public input on all Resolutions. Pat Tozzi wanted to comment on Resolution #00-306. Mr. Tozzi said many, many people have said that Business Administrator Goldsack has done an outstanding job. Mr. Tozzi said Mr. Goldsack helped the Board of Health by getting the engineers there in a short period of time to put up the handicap ramp. Mr. Tozzi said Mr. Goldsack was well worth his money and should be reappointed. Anna Mae Kolibas wanted to reiterate what Mr. Tozzi said and said she didn't know Mr. Goldsack but said the few times she had to go to him for help he was helpful and courteous. She said she was appreciative. Mrs. Kolibas said she was never for a Business Administrator but things have changed now and everyone doesn't have access like before when Mayor Sica could be here at the drop of a dime and realizes everyone has to go to work today. Mrs. Kolibas commended the Mayor and Council for appointing Mr. Goldsack and asked where the other Councilmembers were when there were such important issues to be voted on. Mrs. Kolibas asked Borough Clerk, Kathleen Barney if she knew where everybody was and said they usually tell her. The Clerk said the Councilmembers told her they were going to a di nner. SEPTEMBER 20, 2000 COMMENTS ORDINANCE 100-39 AMENDING SALARY ORDINANCE 171-9, RE: DIRECTOR OF PARKS & RECREATION/RECYCLING COORDINATOR NO MOTION MEETING OPENED PUBLIC INPUT ON ALL RESOLUTIONS COMMENTS :PTEMBER 20, 2000 IMMENTS :ontinued) Mrs. Kolibas said the newspaper should put that in their article that the Councilmembers were so interested in other things and asked why they weren't at the council meeting tonight to vote on these important issues. Gloria Goodrich said she was at this meeting for one hundred percent support of Nicholas Goldsack and said the Council has been condemned on other things they have done in the past but this wasn't one of them. Ms. Goodrich said as a Borough employee she felt Mr. Goldsack has been fair concerning issues and negotiations and said if the Council does not reappoint Mr. Goldsack, shame on them because Mr. Goldsack is an asset to the community. She continued to say people don't know what Mr. Goldsack does when they see him out on the street, but he is constantly working, his eyes are open and his is here for the Borough of Carteret, and asked the Council to reappoint Mr. Goldsack. Kathleen Buzas, corner of Louis and Jersey Street said Mr. Goldsack was her guardian angel because Mr. Goldsack helped them when the pipes collapsed on Jersey Street; Roto-Router tried to get a permit to fix the problem for two weeks. Mrs. Buzas was told to speak to Mr. Goldsack, she said within a half-hour to an hour after leaving Mr. Goldsack's office the permits were obtained. James Mancuso said he was on the Council when Nick was brought in and said the elected officials who went over the appointment of Mr. Goldsack at Agenda meetings and objected to it many times were not here tonight. He said the people of Carteret elected these Councilmembers the county did not elect them, and added these people should be here. Patricia Ercolino jokingly said Nicholas Goldsack was a pain in the butt, then seriously said he was very good to them. Stan Gutowski said it was refreshing to hear that people are working things out. He said he was also on the Council when Nick was hired and said it was one of the better things that Council had done. Mayor Failace said Nick has been his right hand when he had to work on his regular job Nick takes all the Mayor's phone calls because Mayor Failace isn't able to be in town as often as he would like to. IEETING CLOSED There being no further comments or objections to the Resolutions, the Mayor declared the Public Hearing to be closed upon MMS&C, by Council members Quinones and O'Brien and unanimous affirmative vote of the three (3) Council members present. 10. RESOLUTION #00-304 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Council members Quinones and O'Brien RESOLUTION #00-304 "DIRECTING THE ISSUANCE OF RAFFLE LICENSES TO CARTERET HIGH SCHOOL BAND PARENTS ASSOCIATION AND ST. JOSEPH H.S.A." was adopted. Upon individual roll call vote, Councilmembers Crilley, O'Brien and Quinones voted in the affirmative. Council members Fazekas, Santoro and Sohayda were noted absent. Councilmember O'Brien stated he had some reservations initially but cleared them up with Nick and said anytime he asked Nick to do something it was taken care of. He said Nick has done a great job. Mayor Failace stated he appreciated Nick and everything he does for Carteret. RESOLUTION #00-307 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Council members Quinones and Crilley RESOLUTION #00-307 "APPOINTING TEMPORARY CLERK TYPISTS-RECYCLING" was adopted. Upon individual roll call vote, Council members Crilley, O'Brien and Quinones voted in the affirmative. Councilmembers Fazekas, Santoro and Sohayda were noted absent. 12. RESOLUTION #00-308 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Council members Crilley and O'Brien RESOLUTION #00-308 "URBAN ENTERPRISE FIVE YEAR URBAN ENTERPRISE ZONE (UEZ) PLAN DEVELOPMENT PLAN FOR 2000 THROUGH 2005" was adopted. Upon individual roll call vote, Councilmembers Crilley, O'Brien and Quinones voted in the affirmative. Councilmembers Fazekas, Santoro and Sohayda were noted absent. Mayor Failace thanked John Riggio who spent a lot of time on this and said this was something we needed done but was never done. He said this would put the town in a better position as the Council asks for money and uses the funds they already have in the UEZ to do certain projects. Councilmember Crilley also thanked John for the good job. RESOLUTION #00-309 was introduced by the Mayor and referred to the Council for action. Mayor Failace stated so far this year, because of construction and industry that has come into Carteret the Construction Department has collected $792,000.00. He said the Construction Department is working like crazy and doing one heck of a job and expects by the end of this year to reach one million dollars. BUILDINGS & GROUNDS: Councilmember O'Brien said Red at the Police Department, Arnold at Borough Hall, and Jason overseemg everything are doing a great job. He reported progress. PARKS & RECREATION: Committee Chairperson Crilley said the town wide yard sale is this Saturday and residents can pick up a list in the Clerk's office. He said he spoke to the Mayor and will ask at the Agenda meeting for a Resolution to bid for lights on Veteran's Field, next to the new Recreation Building. He said they bid to redo the basketball and tennis courts in Carteret Park, but the bid came back too high and there wasn't enough funding. He said they were looking to redirect the funding the Council had in place and to take advantage of the money they had left. He said the budget figures given to the Council by the engineer, $75,000.00 should be enough to do lights on Veteran's Field and do Shore Crest Park the same way they did West Carteret Park by the end of the year. He reported progress. POLICE: Committee Chairperson Quinones thanked Officers Gary Guiliano and Tom Stroka they continue to do a great job with the Special Investigation Unit and the recent drug bust on Carteret A venue. BOARD OF EDUCATION: Councilmember O'Brien said there would be a Board of Education meeting next week. He reported progress. OMMENTS Councilmember Clil1ey said he was upset about something that was said to him after the last council meeting when he asked a Board of Education member when construction would begin on Nathan Hale School. He said the Board of Education member said they would start building as soon as the Council stops holding up the permits. Councilmember Crilley said the permits come from the Zoning and Planning Boards and not from the Council. He said this Council would never inhibit the educational opportunities of the children of this town and said his wife teaches fourth grade in Columbus School with thirty-one students in the class. Councilmember Crilley said the number one factor in test scores is class size. Mrs. Crilley took a trip to a school district, which scored high, on the test he said class size was fifteen. He said this Council would not inhibit the School Board's progress. Mayor Failace said he asked Tony Neibert to give the School Board as much leeway as possible so they could move forward. He felt the Board of Education was trying to cover up for the problems they are having. The Mayor said he did tell Tony Neibert to follow the book, make sure it is done right so that everything is safe for our children. Mayor Failace said he received a call from Senator Lautenberg's office telling the Mayor the Senate passed a Veteran's Administration appropriation bill which will give Carteret 1.5 million dollars for sewer work and within a month we will know definitely if Carteret will get it. He said he went to Trenton over the traffic problem with the Turnpike where he asked for a commitment from the DOT that they would continue to meet with the town. He said he received a letter from the Turnpike stating they would be finished with their study at the end of October and said they are moving forward. He said as far as the Industrial Road extension, there is no finalization as of yet, but talks continue with the developers. The Mayor said this would extend Industrial Road into Woodbridge and reduce some of the truck traffic and reminisced about Mayor Sica's efforts in reducing the truck traffic in Carteret. He said they would like to continue the revitalization of lower Roosevelt A venue and asked the residents what they wanted to see down there. He said the next meeting would be October 17th and said he was happy to see sixty residents at the first meeting. Mayor Failace said this was one of the better Ethnic Days the town has had, and will do something for Mr. Manetta and the members of his team at the next meeting and thanked them, he also said the fireworks were great. He said some cars had some soot on them, which the Borough wil1 take care of. 18. Mayor Failace said the Council has been in negotiation with the blue- collar workers for a couple of years the White Collar settled, the Blue Collar did not. He said four times he met with the negotiating committee and four times he thought he had a deal and most of the members of the negotiating committee voted against what was discussed. He said he called Mike Buscak, president of the Blue union into his office last November and asked him to get this done, he said he told Mike the Council would not pay the retro active pay. Mayor Failace said he asked Mr. Buscak what it would take to get the men to agree and Mr. Buscak said retro active, the Mayor agreed, but said the men had a meeting where they voted it down twenty-four to four. The Mayor said he told Mr. Buscak to give him flextime like the white collar gave him and he would give the men their retro. The Mayor said it took the men less than five minutes to say no to the Mayor's request and they also said they would wait until January. Upon MMS&C, by Councilmembers Crilley and Quinones and unanimous affirmative vote of the three (3) Councilmembers present, the meeting was opened to the public for discussion. Daphne Miles, 25 Pulaski A venue, asked Borough Attorney Coughlin if the town had a loitering ordinance. Borough Attorney Coughlin said he knew of a recent case like this Borough ordinance which was stricken down by the court and he advised them not to proceed. Daphne Miles said she wanted to know why the churches were being denied access to the community center. She said the churches use the firehouse for different things and said everyone should be able to utilize it. She said this town is moving backwards and wanted to know who Janet Santoro thought she was the keeper of the bel1 keys. She also said she wanted to address Mrs. Santoro and would be coming back in two weeks to do so. Mayor Failace said he got a copy of the tape because he knew the Council did not say it should be closed. He said he made the statement and said he didn't care if they opened the new center or not, he wanted the old center to be open and to be used. He said there is nothing wrong with having two community centers and there is no reason to close it down. 9. Patricia Rodriguez, 72 Edwin Street, said Carteret public schools are deplorably overcrowded. She also said there was an assault on a sixteen-year-old child Saturday where he bent down to tie his shoe and was assaulted, he was hit in the eye, the boy and her son cal1ed 911. She said there was no ambulance available at four o'clock in the SEPTEMBER 20, 2000 COMMENTS (Continued) PUBLIC DISCUSSION COMMENTS ,PTEMBER 20, 2000 IMMENTS :ontinued) afternoon and said the town should have a first aid squad, this boy had a broken eye socket. Stan Gutowski said last Thursday during the agenda meeting he heard on the Police scanner there was a bar fight. He said there was no ambulance on duty because the volunteer ambulance squad was in Wildwood at a convention with the firemen and left the town with no ambulance service. He said the Council should bring Rural Metro in twenty-four hours a day because the ambulance squad does not meet the town's needs. Mr. Gutowski asked about the pending bond ordinance for a fire truck. He asked the Council which truck would be replaced and said the fire truck in West Carteret sat in front of the firehouse everyday and could be used. He said the fire department needs training which could be done when there is less traffic on the road, and if they didn't want to use the firehouse in West Carteret, they should board it up and only use the one in the PolicelFire facility. Norvell Pendelton, 21 Union Street, said there was only one speed limit sign up and down Roosevelt and Washington Avenue, and wanted to know who he had to see to get speed limit signs posted in town. Mayor Failace said Washington and Roosevelt Avenues were both county roads but that they could request more speed limit signs. Mr. Pendelton said he requested more than a month ago the yellow markings by his church be extended, but it has never been done. He also said he had to mention again about the tree that was lifting the sidewalk on Union Street that he has to constantly remind the Council about, which is still not taken care of but he said someone told him a mason was needed. He said the stump was still there and wanted to know why the Borough machine couldn't lift up the sidewalk and fix it. Mary Fountaine, a life long member of Carteret and member of People's AME Zion Church wanted to know why Mrs. Santoro went around saying things that aren't true and said she was glad Mrs. Santoro did say people could use the community center. Mayor Failace said if the community center is not being used Ms. Fountaine's church was welcome to use it. Ms. Fountaine wanted to know when they would be getting a statement from Mrs. Santoro about her comments regarding the community center. Councilmember Quinones said Ms. Fountaine would have to ask Mrs. Santoro because the fact that this Council made the decision was an absolute lie and said she supports the Mayor when he allows different community groups to use the center. 20. Pat Tozzi told the Mayor and Council there was a critical problem with the price of fuel oil going sky high. He said senior citizens in this town would have to make a choice between buying medication and staying warm. He said some people would be putting in wood and coal stoves, and said this would cause problems. He asked the Mayor and Council to send a letter to the Governor. Mayor Failace said he spoke to the Business Administrator about this and said the Council would do whatever they could to help. Deborah Bialowarczuk asked what the cost of the new fire truck wou]d be. Mayor Failace said the new fire truck the town was looking to get now would be four hundred seventy five thousand dollars and said they were looking for money from the UEZ. Deborah Bialowarczuk asked Mayor Failace why we couldn't use some of the UEZ money for a paid first aid squad if a new truck was not needed right now. Mayor Failace said the Council was looking into extending Rural Metro's hours. Kevin Urban asked about the stump removal process. He commended Mr. Surick and Mr. Carpenter for the excellent job they are doing. He asked who removes the tree roots before the sidewalks could be fixed and the house could be sold. Council member CriJley said a lot of times Teddy will tell the homeowner to get the mason to lift the cement before he will do the stump. KeJly Callazzo asked Councilmember Crilley about the continuation of the park in Chrome for the little children. Councilmember Crilley said the Council has a million-dollar revitaJization for aJl the parks in Carteret with a fi ve-year plan but said they could not do it all at once. Ms. Callazzo said she spoke to a Borough employee who told her there was no money to finish the park and get aJl the equipment and asked the Council if this were true. Mayor Failace said the park was complete for now and there is new equipment but there are plans to do more. Councilmember CriJley said the old swing set will be coming out, and went on to explain other improvements that would be made. He said his plan was to do this as part of this program but that he would be out of office in January. He said he intended to do something in each park and explained his plan. He said in November there would be an open space question on the ballot which he felt could pay for park improvements. An unidentified woman asked if the Council and the School Board know what each other is doing. 21. Mayor Failace said there is a Board of Education liaison, which is headed by Mrs. Santoro, and she comes back to the Council as to what is happening. She said she felt it wasn't fair to parents that had to make choices between their children and other things. Stan Gutowski told the woman he felt she made the perfect choice by choosing her child, but that the three empty seats on the Council chose to go for free food. An unidentified man said the contractor at the new center was taking equipment out, electric conduit, metal door frames and said the town of Carteret paid for these items which belong to the town and not to the contractor. He said the contractor should only take his tools out of the building and nothing else. Mayor Failace said we will find out tomorrow about this.
