TIVE DATE OF SUCH CODE AND A PENALTY FOR THE ViOLA-;: TION THEREOF; PROVIDING FOR THE MANNER OF AMEND- ING SUCH CODE; AND PROVIDING WHEN THIS ORDINANGE SHALL BECOME EFFECTIVE. WHEREAS, it is the intent of the Gity Council of the City of i Lynwood, California to adopt a recodified Municipal Code; and WHEREAS, the publication requirements of Article 2, Chapter 1, Part 1, Division 1 of Title 5, and Section 6066, of the California Government Code, have been met; THE CITY COUNCiL OF THE CITY OF LYNWOOD, DOES ORDAIN AS FOLLOWS: Section 1. That pursuant to the California Government Code, Section 50022. 1, the Gode of Ordinances, consisting of Ghapters 1 to 32, each inclusive and including Volumes I and IiI, of the Uniform Building Gode, 1970 Edition, the Uniform Plusnbing Gode, 1970 Edition, with Appendices A---G and E---G, and sections 110, 508, 510, 511, 534---538, ' 542 of the Public Health Code of the Gounty of Los Angeles, being Los Angeles County Ordinance No. 7583, as amended by Ordinances numbered 7616, 7674, 8095, 8200, 8234, 8425, 8588, 8614, 9375, 10075 is hereby adopted and enacted as the "Gode of the Gity of Lynwood, " and shall be ~- ' treated and considered as a new and original comprehensive ordinance ' which shall supersede all other general and permanent ordinances passed ~ by the Gity Council on or before December 7, 1971, to the extent herein- after provided. I Section 2. That all provisions of such Code shall be in full force and ef£ect on, from and after the 8thday of December , 1972, and all ordinances of a general and permanent nature of the City of Lynwood, enacted on final passage on or before December 7, 1971, and not included in such Code or recognized and continued in force by reference ' therein are hereby repealed from and after the 8 day of December ~ illl 1972, except as hereinafter provided. I I i Section 3. That the adoption provided for in Section 1 hereof I' and the repeal provided for in Section 2 hereof shall not affect any of the following: (1) Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of such Code; (2) Any ordinance promising or guaranteeing the payment of i money for the City, or authorizing the issuance of any bonds ofthe Gity or any evidence ofthe City's indebted- ness; (3) Any contract or obligation assumed by the City; I (4) Any right or franchise granted by the Gity; I ~I (5) Any ordinance dedicating, naming, establishing, locating, j~li relocating, opening, paving, widening, vacating, etc., II any street or public way in the City; (6) Any ordinance relating to specific public improvements or assessments therefor; (7) Any ordinance establishing or prescribing grades for streets; (8) Any appropriation ordinance or ordinance providing for the levy of taxes or for an annual budget; (9) Zoning ordinances of the City; (10) Any ordinance relating to the investment of municipal funds; (11) Any ordinance establishing the compensation of municipal officers or employees, not inconsistent herewith; (12) Any ordinance dedicating or accepting any plat or sub- division in the Gity; (13) Any interim emergency ordinance of the City in effect at the date of adoption hereof; (14) Any ordinances expressly saved from repeal by the terms of the Code; (15) Any ordinance enacted after December 7, 1971. (16) Section 2 of Ordinance No. 862. The repeal provided for in Section 2 hereof shall not be con- strued to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance. Section 4. Any person violating or failing to comply with any provisions of this Code or committing any act or omission to act declared to be an offense or unlawful by this Code, where no specific penalty is provided therefor, shall be punished byfine of notexceeding five hundred dollars ($500. 00) or imprisonment not exceeding six (6) months, or both such fine and imprisonment in the discretion of the court. Each person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this ~ .. Code is committed, continued or permitted by such person; and he shall be punished accordingly. Section 5. Any and all additions or amendments to such Gode, when passed in such form as to indicate the intentions of the City Gouncil to make the same a part thereof, shall be deemed to be incorporated in such Code so that reference to the "Gode of The Gity of Lynwood, California" shall be understood and intended to include such additions and am endme nts . Section 6. A copy of such Code shall be kept on file in the office of the City Clerk preserved in looseleaf form, or in such other form as the City Clerk may consider most expedient. It shall be the express duty of the City Clerk or someone authorized by him, to insert in their proper places all amendments or ordinances which indicate the in- tention of the City Gouncil to make the same a part of such Code when the same have been printed or reprinted in page form, and to extract from the Code all provisions which may be from time to time repealed by the City Council. This copy of such Code shall be available for all persons desiring to examine the same and shall be considered the official Code of Lynwood and any copy of such Code certified by the City Clerk shall be the official Gode of Lynwood, at the date of such certification. Section 7. In case of the amendment of any section of such Code for which a penalty is not provided, the general pena.lty as provided in Sec- tion 4 of this ordinance and Section 1-8 of such Gode shall apply to the section as amended, in case such amendment contains provisions for which a penalty, other than the aforementioned general penalty, is provided in i I another section in the same chapter, the penalty so provided in such other ~ section shall be held to relate to the section so amended, unless such penaltyl~ is specifically repealed therein. . . , t .. ' Section 8. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed, as of the effective date of this ordinance, but shall remain in full force and effect until such date. Section 9. This ordinance shall become effective on the 8th day of December , 1972. Section 10. That the City Clerk of the City of Lynwood is hereby directed to certify to the passage of this ordinance and to cause the same to be published one time within fifteen {15) days of its passage in the Lynwood Press , a newspaper of general circulation, printed and published in the City of Lynwood.
