The Regular Meeting of the Mayor and Council of the Borough of
Carteret was called to order by Mayor James A. Failace approximately
7:30 P.M. on Thursday, October 5, 2000, Municipal CourtlPolice
Facility, 230 Roosevelt Avenue, Carteret, New Jersey.
Upon individual roll call, the following were noted present:
Councilmember Patrick Crilley

Also noted present were Business Administrator Nicholas Goldsack .
and Attorney Douglas Walsh, Esq. representing Borough Attorney
Craig Coughlin.
Noted absent were Councilmember Buddy Sohayda and Borough
Attorney Craig Coughlin.
The meeting was opened with a moment of Silent Prayer and The
Pledge of Allegiance led by Mayor James A. Failace.
The Clerk stated that in full compliance with the Open Public
Meetings Act, a notice of tonight's meeting was sent to the Home
News Tribune, The Star Ledger and posted on the bulletin board on
September 29,2000.
Upon MMS&C, by Council members O'Brien and Crilley and
unanimous affirmative vote of the five (5) Councilmembers present,
the minutes of September 7, 2000 were approved as transcribed and
engrossed by the Clerk.

Mayor Failace read the following Proclamation into the minutes of the
meeting:
"PETER J. SICA DAY"
WHEREAS, October 6, 2000 marks the First Anniversary of the tragic
and untimely death of Former Mayor Peter J. Sica; and
WHEREAS, Peter 1. Sica, fondly known as "Pete" to all who came to
know him, dominated the Carteret political Landscape for twenty (20)
years, through his deep commitment to the community and his
flamboyant nature; and
WHEREAS, Peter J. Sica contributed greatly to the Borough of
Carteret and is deserving of kind thoughts and prayers from the entire
Carteret Community on this sad occasion.
NOW, THEREFORE, I JAMES A. FAILACE, Mayor of the Borough
of Carteret do hereby proclaim:

in the Borough of Carteret and direct that all flags on Borough
Buildings be displayed at half-staff on that day in honor of Peter J.
Sica.
Upon MMS&C, by Council members Fazekas and Crilley and
unanimous affirmative vote of the five (5) Councilmembers present
the meeting was in recess at approximately 8: 10 P.M.
At approximately 8:20 P.M. the meeting was reconvened. Upon
individual roll call, the following were noted present, Council members

Council member Sohayda.
ORDINANCE #00-44 was introduced and adopted on First Reading
and the Clerk authorized and directed to advertise same for Public
Hearing to be held on October 19, 2000, upon MMS&C, by
Councilmembers Quinones and Fazekas. Upon individual roll call
vote, Councilmembers Crilley, Fazekas, O'Brien, Quinones and
Santoro voted in the affirmative. Councilmember Sohayda was noted

Mayor Failace said John Riggio received grant money to hire Youth
Laborers. He said they would be cleaning up graffiti and doing other
things to clean up the town.
ORDINANCE #00-45 was introduced and adopted on First Reading
and the Clerk authorized and directed to advertise same for Public
Hearing to be held on October 19, 2000, upon MMS&C, by
Councilmembers Crilley and Quinones. Upon individual roll call vote,
Councilmembers Crilley, Fazekas, O'Brien, Quinones and Santoro
voted in the affirmative. Councilmember Sohayda was noted absent.

Council member Buddy Sohayda was noted present at 7:45 P.M.
ORDINANCE #00-47 was introduced and adopted on First Reading
and the Clerk authorized and directed to advertise same for Public
Hearing to be held on October 19, 2000, upon MMS&C, by
Councilmembers Crilley and Quinones. Upon individual roll call vote,
Councilmembers Crilley, O'Brien and Quinones voted in the
affirmative. Councilmembers Fazekas, Santoro and Sohayda voted no.
Mayor Failace broke the tie and voted in the affirmati ve.
ORDINANCE #00-47
"AN ORDINANCE AMENDING ORDINANCE #89-18"
Councilmember Santoro asked Attorney Walsh if the existing
Ordinance read only Mayor and Councilor did it include anyone else.
Mayor Failace said it included the Borough Attorney and the Public
Defender.
Councilmember Santoro asked why they would just be eliminating the
Council.
Mayor Failace said this had nothing to do with the Ordinance right
now and said it had to do with eliminating the benefits for the Mayor
and Council. He said he brought this up because he didn't think the
Mayor and Council should be receiving benefits. He said he asked
Business Administrator Goldsack for a list of those included in the
Ordinance and if there were any other employees that they could look
at. He said the Council would be discussing this at the next Agenda
meeting.
Councilmember Santoro asked if the Council could just do a portion of
the Ordinance.
Attorney Walsh said if the Council created the benefits, the Council
could certainly eliminate them.
Councilmember Santoro asked Business Administrator Goldsack what
the Borough was presently paying for the Council's benefits.

Business Administrator Goldsack said approximately thirty four
thousand dollars.
Councilmember Santoro said if the Council eliminated the benefits
they would be saving thirty four thousand dollars not eighty four
thousand dollars.
Mayor Failace said right at this moment the town would be saving
thirty five thousand dollars and said Ms. Santoro's benefits cost was
eleven eight, Jack's cost twelve eight and Buddy and Jimmy were
another ten grand between them. He said in the future any other
Mayor or Councilmember if they choose to take the benefits it will be
there for them. He said the savings actually would be approximately
ninety thousand dollars for family benefits.
Councilmember Santoro said the Mayor said this would be saving a
tax point for the following year. She said that would be true if they
were saving the money that year. She said it was a third of a tax point,
which was four dollars per year.
Mayor Failace said Councilmember Crilley does not take benefits but
next year a new Councilmember might take benefits which would cost
the Borough eleven or twelve thousand.
Councilmember Santoro said Mr. O'Brien has been receiving benefits
for six years.
Mayor Failace said Ms. Santoro was correct in saying the savings
would be thirty four thousand right now. He said if anyone took
family benefits right now it would be approximately ninety thousand
dollars. He said there will be different Council members next year and
the year after that but said he did not take benefits. He said the savings
would be ninety thousand and close to one hundred thousand as it goes
up. He said this would eliminate the possibilities of any elected
officials or public servants in Carteret from taking benefits. Mayor
Failace said this is a great saving for Carteret and said when the town
has to bond for sewers the town could take advantage of these savings.
Councilmember Crilley said he has never taken benefits and told the
Council that the state Board of Education has made it a point to
eliminate these benefits from all municipal school board members
through out the state. He said people do not become Councilmembers
for the salary or benefits he felt they became Councilmembers to help
the town.
Councilmember O'Brien said he has questions and had to speak with
Patrick on concerning this Ordinance.
Councilmember Santoro said benefits have been in effect since 1988
and numerous people have taken them. She said two Councilmembers
were leaving this year and she didn't feel these Councilmembers
should be deciding whether a future Councilmember should be
receiving benefits. She said other districts offer benefits to their
Councilmembers and wanted to clarify that the savings would be thirty
four thousand and not eighty four thousand.

Mayor Failace said the Council would be saving thirty four thousand
dollars and said in the future the savings could be ninety to a hundred
thousand dollars and felt this ensures that this will not happen in the
future.

Upon MMS&C, by Councilmembers O'Brien and Quinones and
unanimous affirmative vote of the full Council present a motion was
made to amend the Agenda so that Ordinance #00-36 could be moved
on the order of business from adoption to before the Public Hearing.
This would allow the Councilmember from Marlboro who initiated
this Ordinance in Marlboro to speak on Ordinance #00-36 because he
had to leave for a Council meeting in his town.
The Clerk stated Ordinance #00-36 was introduced and passed upon
Fir~t Reading at a Regular Meeting of the Borough Council held on
September 20,2000. It was duly published in the Home News Tribune
on September 12, 2000 with notice it will be considered for final
passage after Public Hearing to be held on September 26, 2000 at
approximately 7:30 P.M. The Ordinance was posted on the bulletin
board and copies were made available to the general public and
according to law, she read the Ordinance by title.
Mayor Failace said this Ordinance has already had a First Reading and
Public Hearing but Council member O'Brien has asked that the
Ordinance move up in the Agenda. This would allow the
Councilmember who introduced this Ordinance in Marlboro who was
at this meeting to speak on the Ordinance and had to leave because he
had another Council Meeting.
Barry Dankinson, Vice President of the Marlboro Township Council
said he was the Councilmember that introduced this legislation to
Marlboro Township in June of this year. He thanked Councilmember
O'Brien and the Council for allowing him to speak and said he has
been in contact with Councilmember O'Brien many times concerning
this Ordinance. He said this was a momentous occasion for the town
of Carteret by making the choice to join Marlboro in the effort to get
legislation on a statewide basis. He said this was a state responsibility
but the reason he started this was because he felt the state has not done
its job. He said there are two Bills sitting for two years waiting for the
State Senate and Assembly to act and they have not moved as of yet.
He said he has gotten the support of Majority Leader John Bennett in
the State Senate and said Senator Bennett has assured him that in the
next few months hearings will be held concerning this issue. He said
when towns like Carteret come on board they could persuade the
legislature to take the responsibility and do their job. He said this was
an important public safety issue and said there have been a number of
accidents caused by the use of cellular phones. He said he has heard
all the arguments for and against this Ordinance, which included other
types of distractions but wasn't here to discuss those other things. He
said he did want to address the issue brought up by Assemblyman
Wisniewski who said that there are state statues concerning careless
dri ving and that the state did not need any additional legislation.

Council member Dankinson said those state laws on careless driving do
not deter people who drive while using cell phones and said that was
the reason states have enacted drunk driving laws which have stiff
penalties and act as a deterrent to prevent tragic accidents. He
addressed the Council and said it would be one of the few times the
Councilmembers could make a difference not only locally, but
statewide and nationally. He spoke about a family in Pennsylvania
who lost their two-year daughter while driving due to a person driving
while talking on a cell phone. He said the state had statutes on the
books such as seat belt and drunk driving laws to protect the public
safety. He also spoke about Lynn Kolzecki who was present at the
meeting and had lost a son because of a driver using a hand held cell
phone. He said he wants to prevent tragedies like these from
happening in the future and felt the use of cellular phones was on the
increase. He said all the opposition that Marlboro receives would not
stop them from going forward with this. He urged the Council before
voting on this issue not to vote as a partisan issue, a Republican or
Democrat issue but to join Marlboro Township and show the state of
New Jersey that they need to enact legislation to regulate this kind of
conduct before there are any more tragedies.
Mayor Failace said Attorney Walsh advised him it was in the best
interest of the citizens to allow the Council to open this Ordinance to
the public again.
Upon MMS&C, by Councilmember Crilley and Fazekas and
unanimous affirmative vote of the full Council present, the Mayor
declared the Public Hearing to be open:
Jim from B & L Towing said his company does work for the town and
the Turnpike he said his attorney sent a letter to the Council and he had
also passed out additional information concerning the cost the town of
Marlboro is going through to fight the Ordinance they passed. He
went on to explain various towns that were having problems and told
of different statutes the state has concerning careless driving. He said
the state has something in the works and urged the Council to pass on
the Ordinance and wait to see what the state does about it. He said if
the state does pass a Bill towns would not have to worry about this and
they would be saving a lot of money. He said he has seen more
accidents than anyone in the room and he knew that most of the
accidents were caused by careless driving and not by cellular phones.
He said the town has sewer problems, which will cost the town money
and urged the Council not to cause the town to spend unnecessary
money on legal costs fighting legal matters concerning this Ordinance.

Council member O'Brien said the Pennsylvania Ordinance was on a
traffic-based item and said ours was on a public safety issue. He
named several companies that were in favor of this Ordinance and said
talking on hand held cellular phones has caused accidents and did not
want it to happen again in this town. He said he didn't want to wait
for legislation and hoped he would save someone's life and he hoped
he would push the state into action.

Jim from B & L Towing said this is going to cost Carteret a lot of
money and said Carteret should wait because in the next four months
the legislation could be passed statewide. He said Carteret is going
through the cost of fixing the sewers and shouldn't have this expense.
Councilmember Quinones said she served as a Municipal Prosecutor
for several years and said she has not once seen anyone issued a ticket
for careless driving while using a cellular phone. She said the hands
free phones would not totally eliminate the use of phones while
dri ving.
Jim from B & L Towing said he could bring in a State Trooper who
could tell the Council that he has issued tickets for careless driving
while using a cellular phone and asked Councilmember Quinones how
long ago she was the Municipal Prosecutor.
Councilmember Quinones said it was as recently as a year and a half-
ago and said she spent several years working with local and state
police and not one ticket was issued.
Councilmember Dankinson said he wanted to address the cost issue on
the Ordinance because the gentleman from B & L Towing said he
hadn't addressed it. He said the cost to Marlboro Township was
absolutely zero at this time because Sprint withdrew their suit against
his town and said if this does go to court the town's attorney has
volunteered to defend the town for free. He said the cost to the town
would be twelve thousand five hundred dollars to post signs
throughout the town. He said the Council should not weigh the cost of
putting up signs or the fate of a lawsuit against saving one life. He
said his town has constructed a prototype sign and sent it to the DOT
but said that the DOT didn't approve or disapprove the sign they just
passed on it. He said the town was in the final stages of getting the
signs ready and the DOT would have to approve the size of the letters.
He said the town asked for recommended language and the DOT
decided not to tell his town what the language should be.
Mayor Failace said there was an article in New Jersey Municipalities
Magazine regarding the Marlboro decision and said thirty-three states
have been trying to do something like this since 1995. Thirteen
foreign countries have already passed comparable laws and said we are
so far behind on this issue.

There being no further comments or objections to the Ordinance, the
Mayor declared the Public Hearing to be closed, upon MMS&C, by
the Councilmembers O'Brien and Fazekas and unanimous affirmative
vote of the full Council present.

"AMENDING CHAPTER 168 OF THE CODE OF THE BOROUGH
OF CARTERET BY ADDING A NEW SUBSECTION
REGULATING THE USE OF MOBILE TELEPHONES WHILE
OPERATING A MOTOR VEHICLE"
was finally adopted. Upon individual roll vote, Councilmembers
Fazekas, O'Brien, Quinones voted in the affirmative.
Councilmembers Crilley, Santoro and Sohayda voted no. Mayor
Failace voted yes to break the tie.
Councilmember Crilley said he could not comprehend the loss of a
child but he said he was a pallbearer at the funeral of a two-year-old
child who was killed in a car accident he said that was one of the
hardest days of his life. He said he thought this was wrong because he
felt it singled out one item and didn't feel it would hold out. He said
the state and the police department should strengthen the enforcement.
He said people should keep two hands on the wheel one hundred
percent of the time and not take their hands off the wheel for any
reason like combing your hair, eating a sandwich or adjusting the
radio. He said no one in the room could say they keep their hands on
the wheel and until they do tell him that, he felt he could not support
the Ordinance. He also said he wanted everyone to know for the
record he does not have a cell phone.
Councilmember Fazekas said this has been on the books in many
states but that no one has enacted the Ordinance. He said Jim O'Brien
has brought awareness as well as Marlboro and said awareness doesn't
mean it is totally correct. He said there might be some things in
compliance with other laws that would have to be modified. He said
regular awareness in our society and technology has to merge which
might cause problems but said with different communities looking at
this it has made people aware of the problem. He felt the Council
should enact this Ordinance.

Councilmember O'Brien said he has been pushing for this since he
brought it up in the beginning of the year. He said he has been dri ving
to and from work up and down the turnpike while observing people
who are driving while talking on cell phones who are not paying
attention while going back and forth between lanes. He said in the
passed few weeks at his school in Bayonne several deaths related to
the children were caused by careless driving and said he strongly voted
yes.

Councilmember Quinones commended Councilmember O'Brien for
introducing the Ordinance, which she felt, was a good piece of
legislation and adhering to his passion for this Ordinance regardless of
the criticism. She said she felt it was time to send a strong message to
the state telling them to act on this issue. She addressed Jim from B &
L Towing and quoted some of the letter his attorney sent to the
Council. She assured Jim that his company was protected and told
him according to his letter how this would not affect him. She said she
felt this was a necessary piece of legislation.
Councilmember Santoro said she felt this should be regulated by the
state. She said she has checked with different towns and areas on this
issue and spoke to law enforcement to ask their input. She said she
received a national driving survey that listed the driving habits of a
thousand people. She went on to list some of the results which
included tuning a radio station sixty-two percent of the people had
accidents; eating, fifty-seven percent were involved in accidents;
turning your head around to speak, fifty-six percent; were involved in
accidents; reading, writing, thirty-two percent were involved in
accidents; using the glove compartment, thirty-two percent were
involved in accidents; talking on a cell phone twenty-nine percent
were involved in accidents. She said she felt as Councilmember
Crilley that if the Council wasn't going to regulate all these items, then
she felt the Council should urge the state to pass this and didn't feel it
should be passed on a local level.
Mayor Failace said it was brave of the Councilmember from Marlboro
and Councilmember O'Brien for sticking with this. He said he is an
offender of using a cell phone while driving, but said that he will not
do this anymore. The Mayor said the article from the League of
Municipalities Magazine states Marlboro hopes the state enacts certain
laws on behalf of public health and safety and regulating the use of
mobile phones. He quoted the last line that stated "if not, then it may
have to be done town by town". He said he was very proud of Carteret
for joining the fight. He said he hoped other towns would join in as
well which he felt would tell the state this was what the citizens want
and that was what the state needed to do for the good of the state.
Mayor Failace thanked the Council and said he was very happy this
Ordinance passed.

Mayor Failace said this was very important and said a few
weeks ago he was in New York with former Council president
Stan Gutowski and former Councilmember Jim Mancuso who
went to the Recycling Advisory Board. Mayor Failace said it
was important that Carteret stops this. He said John Riggio
from the Solid Waste Advisory Board and various other
officials from New Jersey municipalities were in attendance.
He also listed the numerous letters received from different
towns who are opposing this trash coming from New York and
going to the transfer station in Linden. He said this was going
to be an uphill battle and felt this was very important and spoke
about the recent accident involving the chemical train.
Councilmember Crilley wanted to amend this Resolution to
send a copy of this Resolution to all members of the State
Senate and Assembly as well as Governor Whitman.

based on speci fications and the second was authorizing
$15,000.00 to Killam Associates. He said there has been some
debate between the Zoning Attorney, Borough Attorney and
the Construction Officials. He said the Borough would have to

BUILDINGS & GROUNDS: Committee Chairperson Santoro
said as of Friday, the local inspectors have signed off on the
Community Center for a CO and the town was waiting for
Killam for the final CO. She said the town was in discussions
with the contractor and the town architects regarding
outstanding issues. She said the Council is doing everything
possible to open the building. She said last week she spoke in
front of the Freeholders in regards to a hundred thousand-dollar
grant which could be used for the downtown area. She said she
spoke to John Riggio who told her the money could be used in
the Washington Avenue area or the West Carteret area and is
waiting for Mr. Riggio to present his proposal at an Agenda
Meeting so that the town could move forward on this grant.
She reported progress.

FINANCE & ADMINISTRATION: Committee Chairperson
O'Brien said the high cost of fuel oil is a problem for the town
as well as for the residents. He said he has served on the
Council for six years and has never been so passionate over
any issue, he said he was nervous on the way home from work
as to whether or not the Cel1 Phone Ordinance would pass. He
thanked the Council for passing the Ordinance and reported
total progress not just in Finance but in everything.
FIRE: Committee Chairperson Fazekas thanked the on and off
duty firefighters for installing a stockade fence around the
firehouse in West Carteret. He said the fire department was

Borough, which would help the men plowing the roads in
snowstorms. He said the Council has applied for another
imagining camera from the state. He said the free CPR classes
for residents of all ages which would be held at 7:00 P.M.,
October 25, 26, and 27th at the firehouse. He thanked Saint
Barnabas for giving third graders of Carteret free batteries for
smoke detectors and a tour. He said the annual open house at
the firehouse would be held on Saturday October 14th from
twelve to three o'clock. He said there was a Fire Truck
Committee meeting held last week so that they could come up
with the specs for the new fire truck. He said he knew the fire
truck would cost four hundred thousand dol1ars, but that this
would be an investment in the future and spoke about the ages
and condition of the fire equipment the town uses and how
much new equipment is needed. He explained to Mayor and
Council the rules and regulations regarding fire equipment for
a town the size of Carteret. He said the Council was looking
into spending money for EMS. He said he had checked out the
surrounding towns and what they do concerning their EMS.
He said the current first aid squad was doing a spectacular job
and has taken Rural Metro in as an outside company and went
over the costs of these services. He said the Borough should
look into EMS services in the near future but said we have a
very good response time because the Fire Department works
with the First Aid and Police Department and we have the
manpower. He thanked the Mayor and Council for keeping the
Fire Department at the top of this and keeping up with
technology.

Mayor Failace commended Councilmember Fazekas who has
stayed on top of the Council for years to make sure the town
has the equipment, the radios, the trucks, etc. that the town
needs to keep the community safe.

PARKS & RECREATION: Committee Chairperson Crilley
said the Council would be lighting Veteran's Field, which
should have had lights when the other field was lighted. He
said both fields are where the Recreation Building is and this
would be beneficial for the Recreation Building and the
concession stand and the cost was already budgeted. He said
he looked forward to seeing the lights installed by the spring
Baseball/Softball season. He said the Soap Box Derby was this
Saturday on Pershing A venue and gave the details as to the

Halloween Parade, which will be held on Saturday, October
28th at 2 P.M. He commended the Recreation Commission for
the great job they do for the town.

Council member Santoro was noted absent at 8:48 P.M.
Councilmember Crilley also mentioned the Carteret High
School band and their involvement in the Halloween Parade
and commended them on the fantastic job they always do for
the town, anytime they are asked he said they would always be
there if their schedule permits.
Councilmember Santoro was noted present at 8:50 P.M.
Councilmember Crilley thanked the volunteer Fire Department
and First Aid Squad for their dedication and work that they do.
He asked the Mayor to appoint a committee, which he felt,
should include the public safety department heads, Business
Administrator Goldsack as well as members of the community
and Council to review this problem and to see what options the
town had. He said he felt volunteerism was at an all time low
and didn't see it increasing anytime soon and felt for the safety
of the residents this needed to be addressed now and no one
should put a cost on saving a life. He reported progress.
POLICE: Committee Chairperson Quinones reported progress.
PUBLIC WORKS: Committee Chairperson Sohayda said he
had no report.
BOARD OF EDUCATION: Committee Chairperson Santoro
said there was a terrible accident at the High School and said
after speaking to the Board of Education they both agreed this
should never happen again.

Councilmember Fazekas said he had met with the Board of
Education concerning technology. He said they discussed the
telephone system, which is the same system installed
throughout the Borough offices as well as the new Library. He
said the Board of Education would be able to save costs since
their system would be a piggyback system, which he felt would
help the Borough as a whole. He said they also talked about
the standardization of the hardware and software, which would
save costs when purchasing these items. He said they spoke

about creating a data center, which would encompass the Board
of Education and the Borough this would make grants available
to the town. He said it would be to our advantage to combine
costs this would save us money. The Council would be
applying for grants to save the town money.

Mayor Failace appointed Tony Neibert to the Planning Board
Class 2, December 31, 2000. The Mayor said Tony and
Charlie Nagy have been doing one heck of a job as
construction officials. He said the town could be getting close
to a million dollars in fees this year and said the construction
department was doing a lot of work and with Tony on the
board it would be a help.

Councilmember Cri1ley said last night he left a message on Mr.
Neibert's answering machine and Mr. Neibert returned the can
to Councilmember Crilley's office six thirty this morning.
Mayor Failace agreed and said he had called the construction
department early this morning and Charlie answered the phone,
the Mayor asked Charlie to have Tony call him back, but Tony
was already there on the phone, he said probably with
Councilmember Crilley.

"FIRE PREVENTION WEEK"
WHEREAS, smoke and poisonous gases are the leading cause
of death in fires and can kill a person long before the flames
will; and
WHEREAS, underestimating the power of fire and the time it
takes to escape a home fire put people at severe risk of fire
death and injury; and
WHEREAS, developing and practicing a home fire escape plan
at least twice a year are critical to escaping a real fire safely;
and
WHEREAS, a complete home escape plan includes working
smoke alarms everyone in the household knowing two ways
out of each room, having an outside location where everyone
will meet upon exiting, and memorizing the local fire
department's emergency telephone number; and

Mayor Failace said he asked Tony Neibert to be at the meeting
with Charlie Nagy to respond to the newspaper articles and
what was happening with the accident involving the High
School but he understood they are in the office six thirty in the
morning.

Tony Neibert said each of the Council received reports
concerning the School Board and the accident at the high
school and the work being done. He said himself and Mr.
Nagy went to the site when he received word things weren't
being done correctly. He said his department issues building
permits based on the uniform construction code, and said his
department is not the health department, or the Borough's
OSHA group. Mr. Neibert said the contractor was in
conjunction with the permit and went on to discuss several of
the details to the Council concerning this. He went on to
explain the requirements needed to receive permits and what
needed to be done. Mr. Neibert said he felt the common sense
approach was to do this work in July.
Mayor Failace said he knew Mr. Neibert and his department
would never do anything but what was required in the code
book and apologized for the rumors and newspaper articles that
said otherwise. He said the Council was doing everything to
help get this done properly.

Mayor Failace said he should know next week if we wi]] be
definitely receiving the HUD Appropriation Bill for one point
five million dollars for the sewer grant initiated by Senator
Lautenberg which passed the House and the Senate's approval.
Mayor Failace said he will be meeting with OENJ Cherokee,
regarding the Woodbridge project and extending Industrial
Road project and finalizing the plans to get the truck traffic off
Industrial Road.
Mayor Failace said he went back to the blue-collar workers for
negotiation and said the negotiation committee said they would
accept flex-time from April through August only. The Mayor
said they accepted that and said the blue collar made the offer
that new hires would work the flextime, the Council accepted
that. He said the blue collar made the offer for reverse
seniority, which meant the newest employees would work first,
in reference to existing employees concerning flextime. He
said the blue-collar committee brought the issues back to their
people and they turned it down. He said he doesn't know what
else he could do and said the blue collar has chosen not to
accept anything.
PUBLIC DISCUSSION
Upon MMS&C, by Councilmember Cri]]ey and Quinones and
unanimous affirmative vote of the full Council present, the
meeting was opened for Public Discussion.
COMMENTS
Joe Lombardi, 26 Dunster Street said he was one of the career
fireman who would be teaching the CPR class and said the
class would be held in Columbus School and said the class
would be held for three days. He gave all the details
concerning certification and said the certification card was
good for two years.
Tom Robbins said he was glad to hear that the sewer bill grant
was passed with the help of Senator Launtenberg and said he
hoped that it really does come to be. He said he spoke to
Congressman Menendez few years back about a two or three
hundred do]]ar tax deduction on your income tax for your
sewer tax and told the Mayor that he should remind
Congressman Mendendez about this credit. He said when the
state passes a Clean Water Act the town should be getting
money from the government for the costs and not take on
loans. He asked why the town wasn't looking into no-interest
loans as other towns have done.
Councilmember Crilley said the state did pass the law but
jokingly stated ridiculous conditions that needed to occur
before money could come back to the town.

Mayor Failace said the town has twelve or thirteen million
do]]ars in sewer projects and the Council is looking into all
available state funds.

Tom Robbins asked if the town has tried to be a needy school
district.

Mayor Failace said the Board of Education has applied.
Councilmember Santoro said the Board of Education applied
years ago. She said the state would not amend the original
speciaJ needs districts.
John Sudia, Cypress Street, said the Mayor should speak to the
Business Administrator to make an emergency appropriation to
purchase the Mayor a gavel.
Mayor Failace said the Gaydos family was kind enough to give
him a gavel but it was stolen.
John Sudia said the Council are temporary appointments and
the premiums would be lost when these people leave. He said
most of the peopJe have family coverage and felt there was no
need to duplicate coverage. Mr. Sudia told the Mayor and
Council to keep up their fight in regard to the garbage
transportation. Mr. Sudia said it was nice to hear the Cell
Phone ordinance has passed and he went on to speak of his
experiences with careless drivers who were on cell phones.
Mr. Sudia praised Sue Ivanitski and Ruthann Donovan for the
terrific job they are doing giving out the leaf bags to the
residents and serving them coffee.
Mayor Failace said he thought maybe they were a little too
nice, because people were starting to hang around there and
said Sue could talk to anyone for hours.
Jim Mancuso, Jackson Avenue said the accident at the high
school should not have happened. He said the Board of Health
notified the Board of Education to stop working but the work
continued. He asked if the Mayor and Council got a report and
said the Board of Education should be held responsible and
should answer to the Council.
Mayor Failace said he spoke to Larry Aleksandrich over the
Board of Health issues and summons.
There being no further business or discussion, upon MMS&C,
by Councilmembers Crilley and Fazekas and unanimous
affirmative vote of the full Council present, the meeting was
adjourned at approximately 9:30 P.M.
