HomeMy Public PortalAbout080-2002 - General Ordinance - Amends Sections 74.22 & 74.27 of the City Code ORDINANCE NO- 80 - 2002 A GENERAL ORDINANCE AMENDING SECTIONZ 74.22 AND 74.27 OF RICHMOND CODE WHEREAS, Section 74.22 of Richmond Code prohibits parking on City streets for certain purposes, which purposes include displaying a vehicle for sale; and WHEREAS, it is difficult to ascertain when a vehicle is parked on the street “for purpose of” displaying said vehicle for sale; and WHEREAS, it is desirable to amend City Code and remove this prohibition; and WHEREAS, Section 74.27 of Richmond Code prohibits the parking of unlicensed vehicles or vehicles with expired license plates on public street with the City of Richmond; and WHEREAS abandoned and junk vehicles are often located on private property throughout the City, and WHEREAS, when such vehicles are located within public view, they have a blighting affect on the neighborhood and the City as a whole; and WHEREAS, it is therefore desirable to prohibit the parking of unlicensed vehicles or vehicles with expired license plates on private property where such vehicles are in public view. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that Sections 74.22 and 74.27 of Chapter 74 of Richmond Code are hereby amended to read as follows except that portions that appear in bold shall appear in normal print and portions that are stricken shall not appear (bold portions represent new additions to Code and stricken portions represent deletions; these are included to facilitate understanding of the changes being made): 74.22 PARKING FOR CERTAIN PURPOSE PROHIBITED No vehicle shall be parked on a City street for the purpose of (a) Displaying the vehicle for sale, or (deleted) (b) Greasing (deleted) lubricating or repairing the vehicle except to repairs necessitated by an emergency. The operator of the vehicle or the owner of an unattended vehicle shall be liable for violation of this section and fined $20.00. (Ord.116-1997 (Deleted) 80-2002 74.27 PARKING UNLICENSED VEHICLES (a) No unlicensed vehicle or vehicle with an expired license plate shall be parked on any street in the City. The operator of he vehicle or the owner of an unattended vehicle shall be liable for violation of this section and fined $20.00 (Ord. 116-1997) (b) No unlicensed vehicle or vehicle with an expired license plate shall be parked on any private property in such a way as to be visible from public property unless such vehicle is less than thee (3) model years old. An enforcement officer shall, in a prominent pace, tag vehicles in violation of this ordinance. This tag shall include the date and time of the tagging and the tagging officer’s badge number. The tag shall further state that the vehicles must be moved to a location not in public view within twenty-three (23) days. Any vehicle not removed within this time period shall be towed, with the owner thereof responsible for the cost of towing and impounding the vehicle. Furthermore, the owner of the vehicle shall be fined (20.00. Legally existing car lots shall be exempt from this subsection.
