HomeMy Public PortalAboutOrd. 08961 ORDINANCE No. 896 2 AN ORDINANCE OF THE CITY OF LYNWOOD PROVIDING 3 FOR THE PROTECTION OF THE PUBLIC HEALTH AND 4 SAFETY THROUGH ADOPTION BY REFERENCE OF THE 5 UNIFORM PLUMBING CODE 1970 EDITION TOGETHER 6 WITH APPENDICES A, B, C, E, F& G THEREIN 7 CONTAINED, PROMULGATED AND PUBLISHED BY 8 THE INTERNATIONAL ASSOCIATION OF PLUMBING 9 AND MECHANICAL OFFICIALS, ESTABLISHING 10 THE BUILDING OFFICIAL AS THE ADMINISTRATIVE 11 AUTHORITY, AMENDING SECTION 25•1, 25•2, 25•3, 12 25.4, 25.5, 25.6 AND ADDING NEW SECTIONS 25.8 13 25.7/TO THE LYNWOOD CITY CODE. 14 15 The City Council of the City of Lynwood does hereby 16 ordain as follows: 17 Section 1. Section 25.1 of the Lynwood City Code 18 is amended as follows: 19 "(a) There is hereby adopted by the City Council for the 20 purpose of providing for the protection of the public health 21 and safety, that certain code known as the Uniform Plumbing 22 Code, 1970 edition, together with appendices A, B, C, E, F& G 23 therein contained, promulgated and published by the International 24 Association of Plumbing and Mechanical 0£ficals, except such 25 portions as are hereinafter deleted, modified, or amended, all of 26 which three copies are on file with the City Clerk and the same 27 are hereby adopted and incorporated as fully as if set out in 28 length herein, and from the date on which this code shall take in 29 effect, the provisions thereof shall be controlling with/the 30 limits of the city. This Chapter of the Lynwood City Code shall 31 be known as the Uniform Plumbing Code, and may be cited as such 32 and will be referred to in this ordinance as 'this code.' -1- 1 "(b) Within thirty days after the building official 2 shall reject an application for a plumbing permit or otherwise 3 make a ruling adverse to the applicant or permittee, the applicant 4 or permittee may file a written appeal with the city clerk 5 stating in detail the reasons why the permit should be granted or 6 the ruling should not be reversed or modified, notwithstanding 7 the building official to the contrary. 8 "(c) Within twenty-four hours of the receipt of the 9 written appeal, provided for by subparagraph (b) of this section, 10 the City Clerk will advise the building o£ficial of the appeal 11 and within the same period will fix the date and time for the 12 hearing of the appeal by the city council, and notify the 13 applicant or permittee by registered or certified mail and the 14 building official in writing, which date must not be more than 15 thirty days from the date the appeal is filed with the city clerk.' 16 Section 2. Section 25.2 of the Lynwood City Code is 17 amended as follows: 18 "Section 2.1 through 2.11, inclusive, and appendix D, 19 of said Uniform Plumbing Code, 19~0 edition, adopted in this 20 chapter, are hereby deleted." 21 Section 3. Section 25.3 of the Lynwood City Code is 22 amended as follows: 23 "1.0. Purpose. The purpose of this code is to 24 provide minimum standards to safeguard life and limb, health, 25 safety, property and public welfare, by regulating and controlling 26 the design, construction, quality ~ materials, use and maintenance 27 of plumbing, drainage, and gas piping systems in the City o£ 28 Lynwood. 29 "l.l. Scope. (a) The provisions of this code shall 30 apply to all new construction, relocated buildings, and to any 31 alterations, reconstruction, repairs, and use of any plumbing, 32 drainage, or gas piping system on any premises within the City of -2- 1 Lynwood except, work located on property owned by the Federal 2 Government, State of California, County of Los Angeles or work $ located primarily in the public way. 4 "(b) Nothing contained in this code shall be construed 5 to require any construction or work, regulated by this code, to g be altered, changed, reconstructed, removed or demolished, if suc 7 construction or work was installed in accordance with all laws an $ all ordinances of this city in effect at the time such work was y done or to require the alteration, changing, reconstruction, 10 removing or demolishing of any construction, or work regulated by 11 this code in any territory annexed to the City which was done 12 in accordance with all laws in effect in such territory at the 13 time such was done; provided, however, that the foregoing 14 provisions shall not apply to any such construction or work 15 when termed a menace to life, health, and property. 16 "1.2. Whenever the term 'administrative authority' is 17 used in this code it shall be construed to mean the building 18 official or his authorized representative. 19 "1.3. Administrative Authority. (a) The administra- 20 tive authority is hereby authorized and directed to administer 21 and enforce the provisions of this code and amendments thereto 22 and to make all inspections pursuant thereto. 23 "(b) The administrative authority shall maintain public ~ office hours necessary to efficiently administer the provisions 25 of this code and amendments thereto and shall perform the 26 following duties: 27 "(1) Accept applications for permits and upon 2$ approval thereof shall issue the permit applied for. 29 "(2) Administer and enforce the provlsions of 30 this code in a manner consistent with the intent thereof and 31 shall inspect all plumbing and drainage work authorized by any $2 permit to assure compliance with provisions of this code or -3- ~. j amendments thereto, approving or condemning said in whole or in 2 part as conditions require. 3 "(3) Issue upon request a Certificate of ¢ Approval for any work approved by him. 5 "(4) Condemn and reject all work done or being 6 done or materials used which do not in all respects comply with 7 the provisions of this code and amendments thereto. g "(5) Order changes in workmanship and/or g materials essential to obtain compliance with all provisions of 10 this code. il "(6) Investigate any construction or work 12 regulated by this code and issue such notices and orders as _ 13 Arovided in Section 25.3, subsection 1.5. 14 "~7) Keep a complete record of all the essential 15 transactions of his office. 16 "(8) Transfer all fees collected by him to the 1? proper authority provided by law to receive such funds. 1$ "(9) Maintain an official register of all 19 persons, firm or corporation lawfully entitled to carry on or 20 engage in the business of plumbing. 21 "1.4. Right of Entry. No person shall hinder or 22 prevent the administrative authority from entering and making a Zg reasonable inspection with or without a warrant where an Zq emergency situation exists. 25 "1.5. Menace to life, Health, and Property. (a) Any 26 Portion of a plumbing system found by the administrative 27 authority to be insanitary as de£ined herein is hereby declared t~ 2S be a nuisance. 29 "(b) Whenever brought to the attention of the departme: 30 having jurisdiction that any insanitary conditions exist or that 31 any construction or work regulated by this code is dangerous, 32 unsafe, insanitary, a nuisance or a menace to life, health or -u- 1 property or otherwise in violation of this code, the said 2 department may request an investigation by the administrative 3 authority who, upon determining such information to be fact, 4 shall order any person, firm or corporation using or maintaining 5 any such condition or responsible for the use or maintenance 6 thereof to discontinue the use or maintenance thereof or to repair 7 alter, change, remove or demolish same as he may consider 8 necessary for the proper protection of life, health or property 9 and in the case o£ any gas piping or gas appliance may order any 10 person, firm or corporation, supplying gas to such piping or 11 appliance to discontinue supplying gas thereto until such 12 piping or appliance is made safe to life, health or property. 13 "Every such order shall be in writing, addressed to the 14 owner, agent or person responsible for the rremises in which such 15 condition exists and shall specify the date or time for 16 compliance with such order. 17 "(c) Refusal, failure or neglect to comply with any 18 such notice of order shall be considered a violation of this code. 19 "(d) When any plumbing system is maintained in viola- 20 tion of this code and in violation of any notice issued pursuant 21 to the provisions of this section or where a nuisance exists in 22 any building or on a lot on which a building is situated, the ~ administrative authority shall institute any appropriate action s 24 or proceedings in any court of competent jurisdiction to prevent~ 25 restrain, correct, or abate the violation or nuisance." 26 Section 4. Section 25.4 of the Lynwood City Code is 27 amended to read as follows: 28 "(a) Permit Required. It shall be unlawful for any 29 person to install, remove, alter, repair or replace, or cause 30 to be installed, removed, altered, repaired or replaced any 31 plumbing, drainage or gas piping work or any fixture or water 32 heating or treating equipment in a building or premises without -5- 1 first obtaining a permit to do such work from the administrative 2 authority. 3 "(b) A separate permit shall be obtained for each 4 building in which construction or work regulated by this code 5 is done. 6 "(c) Al1 plumbing, drainage, or gas piping systems 7 installed without the permit required herein shall be removed or $ made to conform with this code upon written notice from the 9 administrative authority. 10 "(d) Every permit issued by the administrative 11 authority under the provisions of this code shall expire by 12 limitation and become null and void, if the work authorized by 13 such permit is not commenced within sixty days from date of such 14 permit, or if the work authorized by such permit is suspended or 15 abandoned at any time after the work is commenced for a period 16 of one hundred twenty (120) days. Before such work can be 17 recommended a new permit shall be first obtained so to do, and 1$ the fee therefore shall be one-half the amount required for a 19 new permit for such work, provided no changes have been made, or 20 will be made in the original plans and specifications for such Q1 work; and provided, further, that such suspension or abandonment 22 has not exceeded one (1) year. 23 "(e) Work Not Requiring Permit. No permit sha11 be YA required in the case of any repair work as follows: The 25 stopping of leaks in drains, soil, waste or vent pipe, provided, 26 however, that should any trap, drainpipe, soil, waste or vent 27 pipe be or become defective and it becomes necessary to remove 2$ and replace the same with new material in any part or parts, the 29 same shall be considered as such new work and a permit shall be 30 procured and inspection made as hereinbefore provided. No 31 Permit shall be required for the clearing of a stoppage: or the 32 repairing of leaks in pipes, valves or fixtures, when such repairs -6- 1 do not involve or require the replacement or rearrangement of 2 valves, pipes or fixtures. g "(f) To Whom Permits May Be Issued. (1) No permit ¢ shall be issued to any person or firm to do or cause to be done 5 any construction or work regulated by this code except to a s person or firm holding a valid, unexpired and unrevoked, q contractor's license issued to that person or firm pursuant to 8 the provisions of Chapter 9, Division 3, of the Business and y Professions Code of the State of California permitting such 10 work to be done by such person or firm. 11 "~2) A permit may be issued to a properly 12 licensed person not acting in violation of any current contractor 13 licensing law. 14 "(3) Any permit required by this code may be 15 1ssued to any person to do any work regulated by this code in a 16 single family dwelling used exclusively for living purposes, lq including the usual accessory buildings and quarters in 18 connection with such buildings in the event that any such person 19 is the bona fide owner of any such dwelling and accessory 20 buildings and quarters, and that the same are occupied by said 21 owner, provided, that said owner shall personally parchase all 22 material and shall personally perform all labor in connection 23 therewith." ~ Sectibn 5. Section 25.6 of the Lynwood City Code is ~r amended to read as follows: 26 "Violations of Plumbing Code; penalty. Any person, Zq firm, or corporation violating any of the provisions of this ~ code hereby adopted or fail to comply therewith, or who shall 29 violate or fail to comply with any order made thereunder, or any 30 detailed statement of speci£ications or plans submitted and 31 approved thereunder, or any certificate or permits issued there- 32 under, within the time fixed herein shall severally and for each -7- i 2 3 4 5 6 7 8 9 10 11 iz 13 14 15 I'I 16 17 18 19 20 21 22 23 2A 25 26 2'1 28 29 30 31 32 such violation and noncompliance respectively be guilty of a misdemeanor punishable by a fine of not more than five hundred dollars or by imprisonment for not more than one hundred eighty days, or by both such fine and imprisonment. "The imposition of one penalty for any violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time, and when not otherwise specified each ten days that prohibited conditions are maintained shall constitute a separate offense. The application of a penalty for violation of this code shall not be held to prevent the enforced removal of prohibited conditions." Section 6. Section 25.5 of the Lynwood City Code is amended to read as follows: "Before any permit is granted £or the installation or alteration of plumbing equipment, the person making the application for the permit shall pay to the city clerk a fee in the amount specified below: For issuing each permit $ 5.00 For each plumbing fixture or trap or set of fixtures on one trap (including water, drainage_ piping and backflow prevention therefor~. 2.00 For each building sewer 7.00 For each private sewage disposal system 15.00 For each saddle connection to the public sewer 25.00 For each alteration, repair or abandonment of any disposal system of building sewer 5.00 For each industrial waste pre-treatment intercepter, including its trap and vent, excepting kitchen type grease interceptors functioning as fixture traps. 7.00 For each new complete gas piping system 5.00 For each gas fixture or outlet (including alteration to gas piping thereto) 2.00 -8- 1 For each water heater and/or vent 2.00 2 For installation, alteration or repair of water piping system 2.00 3 For each water treating appliance 2.00 4 For repair or alteration of drainage or vent 5 piping 2.00 6 For each swimming pool plumbing system 10.00 7 For each lawsprinkler system including backflow protection devices therefor 3.00 8 For each vacuum breaker or backflow protective 9 device including necessary water piping 3.00 10 For each extra inspection made necessary due to defective materials or workmanship 3.00" ii 12 Section 7. Section 25.7 is added to Chapter 25 of the 13 Lynwood City Code as follows: 14 "Constitutionality, Severance. If any section, sub- 15 section, sentence, clause, phrase or portion of this code is for , 16 any reason held to be invalid or un constitutional by the 17 decision of any court of competent jurisdiction, such decision 18 sha11 not affect the validity of the remaining portions of this 19 code." 20 Section 8. Section 25.8 is added to Chapter 25 of the 21 Lynwood City Code as £ollows: 22 " Inspection. (a) All plumbing, gas, and drainage 23 systems shall be inspected by the administrative authority or 24 his authorized representative to insure compliance with all 25 requirements of this code. No person shall fail, neglect, or 26 refuse to leave open, uncovered, and convenient for inspection 27 any construction or work regulated by this code until such has 28 been inspected and approved by the administrative authority. 29 °(b) Whenever any construction or work regulated by th 30 code is ready for inspection, the administrative authority shall 31 be notified by the person doing such either in writing or by 32 oral communication not less than 24 hours nor more than 72 hours -9- 1 before such inspection is desired. 2 "(c) Whenever any construction or work or materials 3 used does not withstand the tests required or does not conform 4 to the provisions o£ this code, such work and material shall not 5 be accepted until the same has been removed; replaced, repaired, 6 or altered, as the case may be, to conform to such tests and 7 provisions as required by this code." 8 Section 9. The City Clerk shall certify to the 9 adoption of this ordinance and cause the same to be published in 10 the Lynwood Press, a newspaper printed, published, and ii circulated in the City of Lynwood. 12 First read at a regular meeting of the City Council of 13 said City held on the 6th day of July, 1971, and finally adopted 14 and ordered published at a regular meeting o£ said Council held 15 on the 17th day of Au~., 19~1, by the following vote: 16 Ayes: Councilmen BYork, Green, Liewer, ~aor°riS, Stevens 17 Noes: Councilmen None 18 Absent: Councilmen None 19 20 ~ ~V~ t,~.'
