HomeMy Public PortalAboutOrd. 08901 ORDINANCE No. 890 2 3 AN ORDINANCE OF THE CITY OF LYNWOOD REGULATING 4 A PRNATE PATROL OPERATOR AND AN OPERATOR OF 5 A PRIVATE PATROL SERVICE, WITHIN THE MEANING 6 AND CONTEXT OF SECTION 7514 OF THE BUSINESS 7 AND PROFESSIONS CODE TO REQUIRE REGISTRATION 8 OF STATE LICENSE NUMBERS, TO REQUIRE PUBLIC 9 LIABILITY INSURANCE, TO REQUIRE CERTAIN 10 IDENTIFYING SIGNS ON VEHICLES, STANDARD 11 COLORED UNIFORMS, SHOULDER PATCHES, BADGES 12 AND INSIGNIA THEREON. ia 14 The City Council of the City of Lynwood does hereby 15 ordain as follows: 16 Section l. The Lynwood City Code is amended to add 17 Chapter XXV-A thereto to be entitled "Private Patrol Operators," 1$ and to read as follows: 19 "Section 25•50. Definitions. 20 "A private patrol operator or an operator of a private 21 patrol service, within the meaning of this chapter is a person ~ who, for any consideration whatsoever: 23 "Agrees to £urnish, or furnishes, a watchman, guard, 24 patrolman, or other person to protect persons or property or to 25 Prevent the theft, unlawful taking, loss, embezzlement, mis- Qs appropriation, or concealment of any goods, wares, merchandise, 2'] money, bonds, stocks, notes, documents, papers or property of any 2g kind; or performs the service of such watchman, guard, patrolman, Qg or other person, for any o£ said purposes. 30 "Since all private patrol operators and operators 31 of a private patrol service are required by law to have a State 32 License, for the purpose of brevity, a private patrol operator -1- 1 or an operator of a private patrol service will, be referred to 2 herein as a'Frivate Patrol Licensee.' 3 "Section 25.51. Compliance by Private Patrol Licensees 4 Already Operating or poing Business. 5 "(a) All private patrol licensee already operating 6 or doing business within the City upon the effective date of this 7 ordinance which amends the Lynwood City Code to establish 8 Chapter 25Athereof, shall, within 30 days of the effective date 9 of this ordinance file at the office of the police department 10 on forms furnished by the Chief of Police, the following 11 in£ormation: 12 "(1) The name, telephone number and address of 13 the private patrol licensee. 14 "(2) The license number assigned to the private 15 patrol licensee by the State. 16 "~3) The badge number assigned by the private 17 patrol licensee to himself or officer, director, partner, manager, 18 or employee of a private patrol licensee as required by Section 19 z5.54. 20 "(b) The Chief of Police shall cause all such forms to 21 be kept on file in his office until such records can be 22 destroyed in the manner provided by law and shall cause said forms 23 to be properly indexed. 24 "(c) In addition to the requirements set forth in 25 (a) every private patrol licensee shall, at his own expenses, 26 provide public liability insurance covering his operation under 2? this chapter, and the liability of the City of Lynwood and the 2$ private patrol licensee thereunder in liability limits as follows: 29 Personal injury, $100,000 as to any injury to any one person; 30 $300,000 as to any one incident; $50,000 as to damage to property 31 in any one accident; in lieu of the foregoing the private patrol 32 licensee may provide a combined public liability single limit -2- i • ~ lllliability policy in the amount of $1,000,000, and shall maintain 2llthe same in full force and effect during the period he operates 3 or does business in the City. The City of Lynwood shall be made 4 an additional insured on said policy. Such insurance shall be 5 with a company satisfactory to the City. Before the expiration of 6 30 days from the effective date of this ordinance which adopts 7 Chapter XXV-A to the Lynwood City Code every private patrol licens 8 shall file with the City by delivering the same to the Chief of 9 Police evidence that private patrol licensee has procured said 10 liability insurance and that it is in full force and effect. All 11 policies and certificates of insurance shall contain substantially 12 the follow:_ng: 13 "The policy herein referred to is not cancellable or 14 subject to reduction of coverage by the insurer in less than 15 fifteen (15) days after the City has received written notice 16 thereof, as evideneed by return receipt and registered letter. 17 "Before the effective date of this ordinance private 18 patrol licensees shall furnish satisfactory evidence that they 19 have taken out for the period they operate or do business in the 20 City full compensation insurance with the State Compensation 21 Insurance Fund of the State of California or with some company 22 authorized to transact business in this state, and such insurance 23 shall be maintained in full force and effect at the private patrol Q¢ licensees' expense. 25 "Section 25•52• Identifying signs on vehicles. 26 "(a) All automobiles, trucks, or cycled v~l;icles, other 27 than bicycles and motorcycles used or employed by a private patrol 2$ licensee shall have the £ollowing: 29 "Identifying signs on the left and right front door as 30 well as the trunk of any vehicle used for the purpose of patrollin 31 in the City of Lynwood. Such signs must be lettered in not less 32 than 1-1/2" size and shall state the name of the private patrol licensee. -3- i 2 3 4 5 6 7 8 9 10 1i 12 13 14 is is 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~b) Motorcycles or bicycles used or employed by a private patrol licensee shall have the same identifying signs as provided in (a) except the location of the signs and the size o£ the letters shall be as prescribed by the Chief of Police within his reasonable discretion. "Section 25.53• Uniformly colored uniforms. No private patrol licensee, or officer, director, partner, manager or employee of a private patrol licensee shall engage in guard or patrol work in the City unless and until he is clothed in a uniform which is standard slate gray or blue gray in color with shoulder patches on each shoulder containing the name of the private patrol licensee in clearly legible letters visible to a person of normal vision at a distance of 25 feet. "Section 25.54. Badges, No private patrol licensee or officer, director, partner, manager or employee of a private patrol licensee shall engage in guard or patrol work in the City unless and until he is wearing a badge on his chest clearly visible bearing the name of the private patrol licensee and a number which has been assigned by the said private patrol licensee to himself, or to an officer, director, partner, manager or employee of a private patrol licensee. Said numbers shall be recorded or registered by the private patrol licensee in his office or principal place of business as a permanent record and recorded or registered by the Chief of Police as provided in Section 25.51 (a)3. "Section 25.55. Compliance by Private Patrol Licensee Not Already Lawfull Operatin~ or poing Business in the City upon the Effective Date of This Ordinance. The requirements applicable to private patrol licensees not yet lawfully doing business or operating in the City upon the effective date of this ordinance adopting Chapter XXV-A shall be the same as those applicable to private patrol licensees already lawfully operating -4- j or doing business in the City except as follows: 2 "(a) The private patrol licensee shall file a written 3 application in the office of the Chief of Police upon forms ¢ furnished by the Chief of Police containing all of the 5 information required by Section 25.51 hereof and shall be signed s by the private patrol licensee, or officer, partner or manager. 7 "(b) The only purpose of the application shall be to g assist the Chief of Police in determining whether or not the g applicant is in fact a State Licensee and whether or not said 10 Private patrol licensee has complied with, or is prepared to 11 comply with the requirements of this Chapter. 12 "(c) No applicant shall commence to operate or do 13 business in the City of Lynwood until he has paid his business 14 license tax as required by Chapter 20 of the Lynwood City Code 15 and has complied with all of the provisions of this Chapter 16 required as a prerequisite to operating as a private patrol 14 operator or operating a private patrol service in the City. 18 "(d) The Chief of Police shall cause all applications lg to be filed and indexed in his office and to be maintained there 20 until such time as they can be destroyed in the manner provided Z1 by law." 22 Section 2. Provisions Declared to be Unconstitutional. 23 Should any sections, parts of sections, provisions, paragraphs, ~ or parts of paragraphs be declared unconstitutional by a court of 25 competent jurisdiction the sections, parts of sections, provisions Zg paragraphs or parts of paragraphs not declared to be unconstitu- 27 tional are severed from those sections, parts of sections, ~ provisions, paragraphs or parts of paragraphs declared to be 29 unconsitutional and the City Council of the City of Lynwood 30 declares and provides that had they not enacted the sections, 31 Parts of sections, provisions, paragraphs and parts of paragraphs 32 declared to be uncon~itutional it nevertheless would have -5- . , , i. 1 enacted all sections, parts of sections, provisions, paragraphs 2 and parts of paragraphs of this ordinance not declared to be 3 unconstitutional. 4 Section 3.
