An Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting of February 4,1999, was held
on January 28, 1999, 7:00 P.M., Municipal Court/Police Facility, 230
Roosevelt Avenue, Carteret, New Jersey.
The following were noted present:
Mayor James A. Failace
Councilmember Patrick Crilley

Also noted present was Borough Attorney Craig Coughlin.
Noted absent was Councilmember Jack Fazekas.
Statement of Meeting Notice was mailed to the Home News Tribune
and The Star-Ledger and posted on the bulletin board on January 21,
1999.
To Address Governing Body: Andrew Dobrovich, 22 Saint Ann Street.
Mr. Dobrovich said he has handicapped license plates on his van and
had applied for a handicapped parking space on June 16, 1998 to park
in ftont of his home. He said after a period of time there was no
answer to his application, he came to Borough Hall and spoke to
Borough Clerk Barney who told him that the Borough Engineer passed
his house and denied the application because he had a carport on the
side of his home. He said there is only one inch on each side if he
parks the van in the carport and he can not open the doors to get out.
He said there are twenty-three vehicles on his block and he is aftaid to
move his van since he felt he would never get a parking space. He
said he spoke to the Borough Engineer about this.
Mayor Failace said the Council would talk to the Engineer right after
his report.
To Address Governing Body: Albert Beninato, Killam & Associates
Engineering-
Borough Engineer Beninato spoke about Mr. Dobrovich's problem.
He said there were two residents that applied at the same time ftom St.
Ann Street for handicapped parking spaces. He said both properties
had driveways and there is off street parking. He said they have to be
consistent and he does not recommend it. He said Mr. Dobrovich is
asking his request be reconsidered since his van can not fit into the
carport and he could not get out of the van. He said Mr. Dobrovich is
an eligible candidate for a handicapped parking space and the Council
should consider it.

~GINEER REPORT
Borough Engineer Beninato gave his Engineer Report
GENERAL MUNIClP AL PROJECTS:
Underground Storage Tanks-NJDEP Compliance
Borough Engineer Beninato spoke about the plans for the Borough's
Underground Storage Tanks.
Public Works Facility-
He said they would be finalizing the plans for the Underground
Storage Tank closure and the installation of the new tanks.
Police Station-
He said they plan to close the existing Underground Storage Tank and
convert the heating system at the Police Station to gas. He said the
building presently requires a new water heater and they have
coordinated a replacement to operate with gas. He said the gas
company would be installing a gas line to the building on January 29th
He said interior plumbing for the new water heater and future heating
units would have to be installed along with the new water heater. He
said they expect to receive proposals for the installation of the water
heater and gas lines on Friday of this week he would forward to the
Council for consideration and approval.

Waterrront Development Project-
Borough Engineer Beninato said there was a meeting with the NJDEP
to review the file on the DuPont Property to determine if there are any
issues affecting the Waterrront Development Project and the
Borough's property which he is currently preparing a summary report
on. He said there may be some contaminants on this property and
gave some of the Borough's options. He said he expected to present
his findings to the Mayor and Council at the next Agenda Meeting.
SEWER FACILITIES:
Hermaun Street Relief Sewer and Linden Street and Lowell Sewer
Separation Contact No. 98-11
Borough Engineer Beninato said the construction of the Sewer
Separation Project on the Phase I portion of Linden and Lowell Street
have been completed, the Relief Sewer for Herman Street is nearing
completion.

Infiltration/Inflow Reduction Program and System Rehabilitation
Borough Engineer Beninato said a copy of the draft Infiltration/Inflow
Reduction Program that has been forwarded to Middlesex County
Utilities Authority for review and comment. A meeting has been
scheduled with the MCUA for February 9th to discuss the program. He
said he felt in order to effectively proceed with the Sewer System

Project the Borough is considering the Clean Water Financing
program through the NJDEP. He said in order to be considered for the
next fiscal year program a Letter of Commitment has been sent to the
NJDEP to meet the February I, 1999 deadline. He said there was a
pre-application meeting with the Department on January 27th at the
DEP and they are currently preparing the project priorities for
presentation and discussion with the Borough before scheduling a
follow-up meeting with the NJDEP. He explained the program's
submittal deadlines as outlined in his report. He said the preliminary
project budget is in the amount of $8,000,000.00 and explained the
preliminary cost estimate also outlined in his report. He said parallel
with this financing application, the Borough would continue to pursue
funding through the Federal Govemment. He explained the debt
service and the savings, which he would be presenting to the Council
at the next meeting.
Councilmember Mancuso asked where the Borough stood as far as the
Sewer Plant with emergency pumps if the pumps go out.
Borough Engineer Beninato said Hayward Avenue currently has a
generator in place for backup incase of electrical failure. He explained
how it would work. He said there is a need to replace the pumps and
he explained. He said they are not operating at their design levels and
explained.
Mrs. Gaydos asked what happens to the pumps if there is an electrical
power failure.
Borough Engineer Beninato said some stations have back-up
generators and some do not. He explained what would take place in
that situation.
REVEREND GUAL
Mayor Failace told Reverend Gual there might be some problems with
the property on Roosevelt Avenue.
Councilmember Mancuso said he had something rrom the State and
rrom Tony Neibert on that building. He said the building does not
meet code and Tony Neibert has some objections.
Mayor Failace said they would like to try to find another piece of
property for him. He said with the plans for the area, they may need
some of that property.
Councilmember Mancuso said the State requirements and the Code
Enforcement would cost him well over one hundred thousand dollars.
Mayor Failace said he would set up a meeting and go over the
properties. He explained the plans for the area, which were not
definite when they had first talked to him. He suggested there were
other buildings suitable for Reverend Gual's needs.

Reverend Gual said the property they had now was working for him
and he wanted to be part of Carteret. He explained some of what he
did in his programs.
Mayor Failace thanked Reverend Gual and said he felt they would
work something out.

Councilmember Mancuso said he had two things for Closed Session.
Councilmember Quinones said Tony Neibert was asking the Council
to consider fourteen paid holidays for the Subcode Official.
Mayor Failace said they are part-time and he wondered why the
Council would want to do that.
Borough Attorney Coughlin agreed.
Councilmember Quinones said Mr. Neibert was asking for John Soltes
to be appointed as an Alternate Plumbing Inspector for when Mr.
Kaskiw could not do the job. She said there would be no expense to
the Borough since he would only be paid when he does work instead
ofMr. Kaskiw.
Councilmember Crilley said he already is the Electrical Official.
Mayor Failace said okay.
Councilmember Crilley said he had one item for Closed Session.

Councilmember O'Brien said for the next paving project they should
look at Leibig Lane. He said he felt they could possibly vacate it to
have police parking next to Police Headquarters.
Borough Attorney Coughin said he was asked to put together a policy
with regard to wearing uniforms. He spoke about it and said he felt
this was brief and went over some of the issues.
Councilmember Mancuso suggested they wear nametags and said most
of the towns have uniforms in the same color.
Mayor Failace said that was a good idea.
Borough Attorney Coughlin said he got a fax rrom Cindy DeCamp
about the Skate Park Rules.
Cindy DeCamp said they should wear helmets and they should
prohibit bicycles in the Skate Park.
Borough Attorney Coughlin said he would check if there was an
Ordinance on the rules. He said the rules are posted in the Skate Park.
Mayor Failace said he spoke to some companies that would come in
and speak to the Council on time clocks. He felt it was necessary to
have hand time clocks and gave the details. He said they should be
looking at this.
Councilmember Crilley said Borough Attorney Coughlin has the
contract rrom Rural Metro. He said there would be a First Aid
meeting to approve the contract and they would meet with Rural Metro
agam.
Borough Attorney Coughlin said he felt it made better sense to have
the contract be between the First Aid and Rural Metro, not the
Borough of Carteret and Rural Metro.
Councilmember Quinones asked what Borough Attorney Coughlin felt
about the increase in liability.
Borough Attorney Coughlin said the Borough should be named as
additional insured on their insurance policy. He said that would
protect the Borough. He said the First Aid Squad has indicated they
would do that.
Councilmember Crilley suggested Borough Attorney Coughlin write
something up for him to bring to the meeting with him on Tuesday.

RESOLUTION #99-49 was introduced by the Mayor and referred to
the Council for action.
Upon MMS&C, by Councilmembers Mancuso and O'Brien
RESOLUTION #99-49
"RESOLUTION TO GO INTO CLOSED SESSION"
was adopted. Upon individual roll call vote, Councilmembers Crilley,
Gutowski, Mancuso, O'Brien and Quinones voted in the affirmative.
Councilmember Fazekas was noted absent.
At approximately 7:40 P.M. a Closed Session was held.
At approximately 8:20 P.M., upon MMS&C, by Councilmembers
Quinones and O'Brien and unanimous affirmative vote of the five (5)
Councilmembers present, the meeting was opened to the public.
Councilmember Mancuso said he and Ted Surick spoke to Carteret
Bio Remediation about the street sweeper sweepings being
contaminated. He said it would be thirty-four dollars for disposal rrom
this company and it would be over forty dollars at the landfill. He said
if the sweepings were clean they could get rid of it through the
Borough's contract with the County at ten dollars a truckload. He said
they would be testing the soil and gave the details again.
Councilmember Crilley asked if they would have to go to bid for that.
Mayor Failace said they would have to find out.
Councilmember Mancuso said he spoke to Borough Engineer Beninato
about putting the sweepings in the wells at the Sewer Plant, which had
to be filled, closed and sealed anyway.
At approximately 8:25 P.M., upon MMS&C, by Councilmembers
Mancuso and Quinones and unanimous affirmative vote of the five (5)
Councilmembers present, the meeting was adjourned.
