An Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting of February 18, 1999, was
held on February 11, 1999, 7:00 P.M., Municipal CourtJPolice
Facility, 230 Roosevelt Avenue, Carteret, New Jersey.
The following were noted present:

Noted absent were Councilmember Jack Fazekas and Borough
Attorney Craig Coughlin.
Statement of Meeting Notice was mailed to The Home News Tribune,
The Star-Ledger and posted on the bulletin board on February 5, 1999.
To Address the Governing Body-
Tony Abello spoke about a Community Service Program he is
involved in. He said it was run by the State, he gave the details. He
said this program was for people who come into the Borough's Court
and are sentenced to do Community Service. He said these people do
not do their Community Service in the Municipalities that their
offenses take place. He explained how the program worked. He said
the State asked the Borough to look into this program.
At approximately 7:03 P.M., Borough Attorney Craig Coughlin was
noted present.
Tony Abello said usually they do physical labor like working in the
Parks Department planting trees, painting, anything to do with labor.
He said some people work in offices to type or file if they have office
skills. He said the Borough wants to use the program for the town
since they feel the people could be used here instead of hiring people
to do things. He said this would save some money. He said the
Borough does it with Welfare cases and he felt they should do it with
Community Service sentences. He said there are many things that do
not get done because they don't have any people to do certain things.
Councilmember Quinones asked if the Court would be supervising
these people.
Tony Abello said they could not since the Police arrest the individuals
and the Court sentences them. He said in other towns they have the

Public Works Department supervising these people and explained how
it would work. He said the program is administered by the town in
conjunction with the Probation Department.
NOTED ABSENT
At approximately 7:10 P.M., Councilmember Gutowski was noted
absent.
DISCUSSION
Mayor Failace asked ifthis has to be done by Resolution.
Borough Attorney Coughlin said no, but to establish the program he
felt they would have to do a filing with the Probation Department.
Tony Abello said if the Council approves it the Court would have to
get approvals.
Mayor Failace said they would consider this and they would have to
discuss the details.

Engineering-
GENERAL MUNICIPAL PROJECTS:
Police Station-
DISCUSSION
Borough Engineer Beninato said the measurements are being taken to
convert the Police Station heating system to gas with a new water
heater. He spoke about the interior plumbing that needed to be
installed and the proposals for the installation of the water heater and
gas lines. He said he recommended that the Borough proceed with the
lowest proposal submitted by Martin Feeney's Plumbing and Heating
in the amount of $3,500.00.
Waterrront Development Project-
Borough Engineer Beninato said a meeting was held with the NJDEP
to review the file on the Agrico/DuPont Property to determine if there
are any issues affecting the Waterrront Development Project and the
Borough's properties. He said a summary of the findings rrom the file
review was in his report and he explained. He said there is grant
money available to the Borough to undertake preliminary and remedial
investigations of the property through the Hazardous Discharge Site
Remediation Fund. He explained what the Borough had to do to be
eligible for the grant. He said investigation of the property might
identify the sources of the contamination and the responsible parties.
He explained about the contamination and recommended that the
Borough authorize his office to proceed with the application process.
Borough Hall-

Borough Engineer Beninato said there was a question regarding the air
quality in Borough Hall. He spoke about the basement and the areas
affected by water damage and leakage. He said an air quality
specialist has visited Borough Hall to provide a proposal for various
sampling and testing procedures to determine any air quality problems
or conditions that may lead to problems. He said Tiffany-Bader
Environmental, Inc, has submitted their proposal and he gave the
details and costs involved.
Mayor Failace said they would be meeting with Potter next week to
discuss some ideas for getting the water away rrom the building. He
suggested they take a break rrom the Engineer Report for Eric, rrom
97 George Street to talk. He said there are two 97 George Streets and
this has created a problem for the residents. He asked Lisandro
Villalba about this.

Councilmember Crilley asked Eric what house numbers are next to
him.
Eric, 97 George Street said 99 and 95.
Councilmember Crilley asked what house numbers are next to the
other 97 George Street.
Eric's wife said 117, 125, 100, 101,97 is the last house on the left on
the dead-end.
Mayor Failace said the problem is the address was recently changed to
103 even though Eric's house is in between 99 and 95 and asked ifMr.
Villalba knew why. He said he was confused when Eric spoke to him
on the phone so he asked him to come and speak to the Council.
Lisandro Villalba said Eric and his wife bought a house a few years
ago on 97 George Street and there is another 97 George Street. He
said the people at the other 97 George Street say they are not changing
since they have been there a lot longer.
Eric's wife said her house is fifty years old and the other house is
twenty- five years old.
Lisandro Villalba said they can not force anyone to change and they
ran into this problem a few years ago when Fedroff was a
Councilmember. He said they tried to change all of East Oak, Oak,
Oakwood and George Street but they got yelled at and screamed at,
and were told not to change anyone's address. He said last year when
there was a problem Eric agreed to the change of address to 103 since
the other 97 George Street was holding his mail. He said after the
book went in Eric called to ask why his address was changed. He told
Eric he would check it out and felt Eric should not have to change the
other people should change but they could not be forced to change. He
explained how the numbers ran on the other George Street.
Borough Attorney Coughlin said there is a 108 A and B, why couldn't
there be a 97 A.

Lisandro Villalba said they don't want to do it.
Borough Attorney Coughlin said everyone recognizes there can not be
two 97 George Streets.
Eric's wife said they had lived in an apartment they don't want it to
sound like it is an apartment when it is a house.

Councilmember Mancuso said he thought legally it could be changed
and he felt logically if the house is in the one hundred numbers it
should be a continuation of the one hundred numbers.
Unidentified voice said they should just change the name of the street.
Councilmember Mancuso said that would cost money because they
would have to change maps, street signs and it would affect all the
people on that block.
Councilmember Crilley said he always thought it was called George
Court.
Lisandro Villalba said just the bend is called George Court.
Councilmember Crilley asked if this could be researched to see if this
was ever changed over the years. He said he felt when he was a child
the whole thing was George Court. He felt it changed over the years.

Several people were discussing this at once which was inaudible or
they reiterated what they had said before.
Borough Attorney Coughlin said someone would have to decide how
to change it which meant someone would have to be unhappy. He said
this has to be resolved since it is becoming a problem. He went over
the options and felt they had to do what made the most sense. He felt
changing it to George Court would be the most logical.
Councilmember Crilley said it was a safety factor more importantly
than his problem with mail.
Borough Attorney Coughlin suggested they meet with the residents
and try to make it George Court.
Councilmember Crilley said they should send a letter to the residents
about changing the name to George Court.
Mayor Failace said one way or the other they would have to take care
of the problem, and felt this might be the best way.
An unidentified woman said they should do a title search to see who
originally owned the property and ifthe deeds were ever changed.
Eric's wife said everyone would not have to change their deeds
because the lot and block would still be the same.

Borough Attorney Coughlin said when someone sold their house, the
title search would show up that the street name was changed to George
Court and the date.
Mayor Failace said his point is all the other people would not want to
do this because everything is going to George Street.
Eric's wife said the cable company has come to shut off their cable
and it was meant for the other 97 George Street to be shut off. She
said the water company and gas company said they are not responsible
if they came to the wrong address, the homeowner is.
Councilmember Crilley asked Eric and his wife if their neighbors
would protest the street name change.
Eric's wife said her neighbor would protest it.
Eric said the houses are in no sequential order.
Eric's wife said their house is forty five to fifty years old and when she
was a child she used to live on Skitka Avenue which is two blocks
away. She said the other house had to be built twenty to twenty-five
years ago, she remembers when it was being built. She said she spoke
to Mr. Villalba about the numbers when she was trying to buy the
house.
Mayor Failace said they would have to look into the situation since
they couldn't keep everyone any longer but he just wanted to hear
what Mr. Villalba had to say. He said they would remedy this.
Eric's wife said she wanted to say one last thing, they did not consent
to 103 and she has everything written down and does not want to argue
with Mr. Villabla.
Lisandro Villabla spoke about what he believed happened between
him and Eric's wife.
Mayor Failace said they would try to resolve this and make it
applicable to everyone. He suggested the Councilmembers discuss
this and they would get back to Borough Clerk Barney who would
inform Mr. Villabla. He felt it would take a couple of weeks.

Steve Cowan, Times Systems, Int'l
Mayor Failace said Steve Cowan is rrom Times Systems International
and he asked Steve to come to the meeting tonight to talk about the
time clocks and show the Council what they look like.
Steve Cowan spoke about the time clocks and how it would work, it
would not hurt anyone and it does not require radiation. He gave a
demonstration of how the time clocks work. He said Band-Aids or
rings may alter the reading but explained some of the problems and the

solutions. He said this was a foolproof method since you had to be
there to clock in. He explained that the computers could make reports
and what the savings would be and explained the advantages. He
explained what would happen if any parts wore out on the machine.
Councilmember Crilley asked how long the warrantee was on the
machine.
Mr. Cowan said a 90 day warrantee comes with the machine and they
sell a Service Contract that includes the software. He explained how
the whole system works and made some suggestions for the
installation.
He said four units would be $12,000.00.
Borough Attorney Coughlin asked if his company was a State
Contractor since they would not have to go out to bid if they were.
Mr. Cowan said he would have to check and spoke of the towns he had
installed the time clocks in and the success they had with those towns.
He said with technology, the prices drop which would be to the
Borough's advantage. He explained the installation process.
Councilmember Crilley asked what the yearly maintenance and
software fees would be.
Mr. Cowan said approximately $1,500.00 for the maintenance of four
units with one set of software and explained.
Councilmember Crilley asked if that included the training of the staff.
Mr. Cowan said yes. He said he would put everything in writing. He
explained other options for financing.
Borough Engineer Beninato continued with his report:
SEWER FACILITY:
Hermann Street Relief Sewer and Linden Street and Lowell Street
Sewer Separation Contract No. 98-11-
Borough Engineer Beninato said the construction of the Sewer
Separation Project on the Phase I portion of Linden and Lowell Street
is complete as well as the Relief Sewer for Hermann Street. He said
additional services are required to complete the Linden Street area
internal investigation project requiring an additional budget
appropriation of $3,500.00.

Infiltration/Inflow Reduction Program and System Rehabilitation-
Borough Engineer Beninato said they met with Kevin Aiello at the
Middlesex County Utility Authority to discuss the draft
Infiltration/Inflow Reduction Program, which was previously
presented to the Borough. He said Mr. Aiello appreciated the fact that
the Borough is planning to undertake measures to address the sewer
system inrrastructure problems. He said in regard to the issue of
"Construct Only" approvals from the MCUA for any new projects that
would contribute additional flow to the system and they will review
each project on a case-by-case basis. He said the project has to be
"necessary" or causing no additional flow to an area of the system that
exhibits surcharging and is the subject of the proposed Clean Water
Financing Project currently under construction. He gave the details on
the Letter of Commitment sent to the NJDEP by the Borough and gave
the details according to his report. He said to initiate the III Reduction
Program as presented, develop the preliminary engineering for the
program and prepare the Planning Documents which must be
submitted to the NJDEP by June 7, 1999, he is requesting
authorization rrom the Borough and gave the details rrom his report on
the cost estimates.
Beverly Street Temporary Stormwater Pump Station-
Borough Engineer Beninato spoke about the recent field investigation
and corrective measures relating to the temporary stormwater pumping
station. He requested authorization to proceed with the solicitation of
proposals for the repair with an estimated cost of $11,000.00 with
engineering services of $2,200.00
Hayward and Bergen Street Pumping Stations-
He spoke about the report of the findings and recommendations on the
required pump repairs and replacements at the Hayward and Bergen
Street Pumping Stations. He said the proposed pump components
would incorporate corrosion resistant materials and spoke about the
discharge coming from the companies in that area. He requested
authorization of a spare pump, the purchase of two new pumps and
materials to rebuild the four pumps at a cost of approximately
$60,000.00. He discussed the costs for engineering services that
would amount to $12,000.00. He spoke about a pump that is being
delivered to the Borough for a spare and what he would be doing with
that pump and other pumps as detailed in his report.
Sabo Street Pump Station Replacement and Etheridge Drive Pump
Station Abandonment-
Borough Engineer Beninato said based on the review of the documents
in connection with the experienced gained with similar designs at the
Hayward and Bergen Street Pump Stations, he finds it necessary to
redesign the project and prepare the re-bid documents in order for this
project to go forward. He referred to a letter explaining the scope of
work and the cost for the project. He requested authorization for the

engineering services to prepare the re-bid documents and gave the
costs for this as well as the construction costs.
Councilmember Mancuso asked if Borough Engineer Beninato heard
from PSE&G about fixing the roads after they do work since he has
been around town with Ted Surick inspecting the work.
Borough Engineer Beninato spoke about the process and the
Borough's road opening procedures. He spoke about the road
improvement projects that would be taking place this year and the
utility problems that might arrive in the areas.

5. Recreation Commission-appointment.
Borough Clerk Barney said Donna. Antonini was moving rrom the
Subcommittee and asked if they had another replacement for her.
Councilmember Crilley said he would get her another name for the
subcommittee.
6. Senior Bus-Election Training, 4/6/99.
Borough Clerk Barney said she requested this and it is mandatory for
all Poll Clerks since the machines are now computerized. She said she
needed the bus since she did not know how the Poll Workers were
going to get to the class.
7. John Riggio-Requesting Resolution approving UEZ Project Plan,
Re: Town Center.
Borough Clerk Barney said okay.
8. MCUA-Street Sweepings.
Councilmember Mancuso said they would be spending $10.00 a load
and he was working on the details with Ted Surick. He said the
contract is with Patrick DeBlasio and as soon as it was set up, they
would be getting rid of the sweepings. Borough Clerk Barney said
they would put on a Resolution approving this.
9. Office of the Governor-Requesting Resolution endorsing Governor
Whitman's Direct Property Tax Relief Program.
Mayor Failace said okay.

Councilmember Mancuso said there are a lot of junk vehicles at the
Municipal Garage and he is working with Ted Surick and the Police
Department to get rid of them.
Councilmembers Quinones said she had something for Closed Session.
Councilmember O'Brien said he had something for Closed Session.
Borough Attorney Coughin said he felt on the Sprint Spectrum
Agreement they would be putting up a generator and an above ground
liquid propane gas tank and an underground gas line. He said this was
billed as putting in a generator but it was more.
Councilmember Mancuso said they got additional approval but he
does not see anything about a propane tank or underground lines.

Borough Attorney Coughlin said he would find out. He said it was
requested that an Ordinance be written on Skate Park Rules and spoke
about his draft ofthe Ordinance. He suggested the Mayor and Council
look at it and get back to him.
RESOLUTION #99-65 was introduced by the Mayor and referred to
the Council for action.
Upon MMS&C, by Councilmembers O'Brien and Mancuso

was adopted. Upon individual roll call vote, Councilmembers Crilley,
Mancuso, O'Brien and Quinones voted in the affirmative.
Councilmembers Fazekas and Gutowski were noted absent.
At approximately 8:30 P.M. a Closed Session was held.
At approximately 8:58 P.M., upon MMS&C, by Councilmembers
O'Brein and Mancuso and unanimous affirmative vote of the four (4)
Councilmembers present, the meeting was opened to the public.
Mayor Failace said we seriously need to put together an employee
handbook.
Councilmember Quinones said we also need a sexual discrimination
policy.
Mayor Failace agreed.
Councilmember Crilley asked Mayor Failace if that would be the
responsibility of the Business Administrator.
Mayor Failace said yes but he wanted to go on record that the Borough
needs to do this. He said he felt we could not wait any longer and
suggested they look at employee handbooks rrom other towns.
Councilmember Crilley asked what they are doing about the Business
Administrator.
Mayor Failace said they did not do anything. He said he has a few
applications but has to give them to the Finance Committee to review

Councilmember Quinones said she would like a Graffiti Ordinance.
