An Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting of March 4, 1999, was held on
February 25, 1999, 7:00 P.M., Municipal Court/Police Facility, 230
Roosevelt Avenue, Carteret, New Jersey.
The following were noted present:

Also noted present was Borough Attorney Craig Coughlin.
Statement of Meeting Notice was mailed to The Home News Tribune,
The Star Ledger and posted on the bulletin board on February 19,
1999.
To Address Governing Body-Robert Kately, Parks Department
Robert Kately said the paperwork for the dugouts was done and they
should start working on the dugouts soon, he had a meeting with
Daphne on this. He explained what would be done. He spoke about
the geese problem, which he felt, was increasing in Carteret Park. He
spoke about some solutions, the advantages, disadvantages and the
costs involved. He suggested that the Borough buy a Border Collie to
chase away the geese. He said he had a demonstration by the Border
Collie and felt it was the most effective and cheapest way to take care
of the problem. He spoke about the many people he spoke to who had
success getting rid of their geese problems and left their phone
numbers for the Mayor and Council to call if they wanted to speak to
them. He gave the details on the Border Collies and their owners.
Mayor Failace asked if the geese problem was just at Carteret Park.
Mr. Kately said it was at the baseball and football fields as well.
Councilmember Crilley asked if the dog would lose its effectiveness if
used too much.
Councilmember Mancuso said he saw the demonstration and did not
agree with the fact that the dog chased the geese from the football field
and they went to the park then he chased the geese away from the park
back to the football field. He said if they rent the dog it would cost the
Borough twelve thousand dollars a year and if they buy it would be
thirty three hundred dollars. He said he wondered if they would kill
the dog doing the whole town.

Mr. Kately said our dog would be in town all day and work twenty-
four hours, seven to eight months out of the year. He said the geese
would eventually see the jeep and know that the dog is in the jeep.
Councilmember Crilley said he would call the School Board to see if
they would split the cost.
Mayor Failace said they have to do something one way or the other
and they would discuss it.
Mr. Kately said the geese are not leaving.
Alpha Muhammad said he would like to set up a Cultural Exchange
Program. He gave the details of how this program would work. He
said he was looking for one female and one male to help out with his
program. He spoke of several people he would consider for a
committee for the program. He said they would have a contest for the
participants.
Councilmember Crilley said he wanted to understand what Mr.
Muhammad was saying. He said he understood Mr. Muhammad was
proposing a trip with a group of youth from Carteret to Africa. He
asked who was funding this.
Mr. Muhammad said that is why he is addressing the Mayor and
Council, to see if any of the many companies in Carteret would be
interested in chipping in. He said his organization is a nonprofit
organization and if the companies could chip in they could get
something done for the children of the town.

Mayor Failace said he would look into funding and suggested that Mr.
Muhammad put something together about the type of program he is
looking for as far as the funding.
Councilmember Crilley asked how many students Mr. Muhammad
was looking to bring on the trip.
Mr. Muhammad said ten and spoke about the schools the children
would come from.

Engineering-
SEWER PROJECTS:
Linden Street Area Sewer Investigation-

Borough Engineer Beninato said the sewer system investigation for the
Linden Street area, to identify illegal connections has been
substantially completed. He spoke about the findings and the
problems. He said plans are currently being finalized to address these
illegal connections, so the project can be advertised. He said that since
this affected the high school the Board of Education should be advised
of the investigative findings, so they could address the connections
discharging from the school.

Proposed 160 Unit Development (Matzel and Mumford)
Borough Engineer Beninato said he has reviewed the application for
the sanitary sewer connection for the Matzel and Mumford
development on Roosevelt Avenue and he has concluded that there is
adequate conveyance capacity in the downstream facilities and he gave
the details. He recommended the Borough execute the Treatment
Works Approval Application for the project and the application also be
processed through the MCUA and the NJDEP and detailed in this
letter attached to his report.
Report Upon Bids for Annual Contract for Emergency Service-
Contract No. 98-15-
Borough Engineer Beninato recommended that the Borough award the
contract to LBD Contractors, Inc. for the total base bid amount of
$140,017.00.
Report Upon Bids Bergen, Hayward and Harrison Pumping Station
Improvements- Contract No. 98-14-
Borough Engineer Beninanto spoke about the summary of the bid
tabulation for the Bergen, Hayward and Harrison Pumping Station
Improvements, the apparent low bid was submitted by Electric Power,
Inc. in the amount of $74,810.00. He said after reviewing the
documents submitted by Electric Power, Inc. he found numerous
deficiencies which he felt need to be reviewed by the Borough
Attorney before final recommendation can be made to the Mayor and
Council for this award. He spoke about the bids and the price
differences, which they are reviewing to determine if clarification is
needed in the contract documents.
1999 Sewer Improvement Ordinance
Borough Engineer Beninato said he felt as they go forward with the
overall program for sanitary and storm system improvements
throughout the Borough, there is a need to adopt a Sewer Improvement
Ordinance for projects that are anticipated during 1999. He said he
spoke to Patrick DeBlasio regarding this and he broke down the
projects and budgets for the Mayor and Council with his report.
Councilmember Mancuso said there is a problem on Pershing Avenue,
the main sewer may have collapsed.

ROAD PROJECTS
Middlesex County-
Borough Engineer Beninato said there was a meeting with
representatives of the Middlesex County Engineering Department and
their consultant involved in the alternative analysis and studies for the
improvements to the intersection of Roosevelt Avenue extending from
Minue to Harrison Streets. He said he felt the meeting would result in
several alternatives that have been conceptually prepared and would
lead to a more detailed analysis regarding cost and the impact to the
area. He said some alternatives that were presented involve widening
with additional lanes for turning onto the Turnpike entrance,
"flyovers" for the entrance to the Turnpike and cloverleaves and
overpasses. He said he was asked to provide his views of the proposed
concepts on behalf of the Borough, but felt because of the significance
of these projects and the level of impacts on the community, the
County should make a presentation to the Mayor, Council and the
affected residents to receive their feedback. He said there would be
meetings with the Turnpike Authority and he has asked to be part of it
so he could understand their input on the proposed project and any
future plans they may have.
Councilmember Crilley asked where we stood on Louis Street.
Borough Engineer Beninanto explained and spoke about how the grant
money was being spent.

DEPARTMENT
To Address Governing Body- Tony Neibert, Building Department
Tony Neibert spoke about the lowering of fees in the Building
Department and compared the old fees to the new fees. He said the fees
would be lower for all single and two family dwellings. He gave some
examples and explained. He said this was the first attempt to give the
homeowners some relief and felt if done properly the fees could be
lowered in years to come.
Mayor Failace said he felt it was a very good move and knew there
was a lot fees out there, he asked if Mr. Neibert did an estimate of the
amount of fees the Borough would be losing.
Mr. Neibert explained and said he does expect the same amount of
money in fees as last year.

& State Aid. Provisional serving-John Riggio. Date of

Mayor Failace said put it on for Resolution.
2. Francis Hartman, Esq.-Requesting additional appropriation, Re:
Singura ads State.
Mayor Failace suggested Borough Attorney Coughlin send a letter.
3. Historical Commission-Appointment.

Borough Clerk Barney said there would be some openings. Mayor
Failace said John Sudia wanted to be on the commission.
4. Congressman Bob Franks-Asking for Resolution of support for H.
Con. Res. 254 which calls on the Clinton Administration to make
the return of Joanne Chesimard and all other convicted /American
felons a top priority in all future negotiations with Cuba.
Mayor Failace said put it on a Resolution.
5. Senator Vitale-Tuition credit program for Volunteer Fire
Companies, First Aid or Rescue Squads.
Mayor Failace suggested they hold this for further discussion.

6. Seventh Day Adventist Church-Request Borough Building for
Church.
Mayor Failace suggested they hold this for further investigation of
what the Borough's plans would be and what they would be using the
building for.

7. Brian O'Connor-Division of Fire Safety Review.
Borough Clerk Barney said they are asking for several things and there
are fees that need to be changed. Mayor Failace said they would hold
it to look at the information.
8. John Spoganetz, Esq.-South Shore Properties, LLC. Requesting to
purchase Borough-owned property along Industrial Road.
Councilmember Mancuso said he asked why this company would want
to purchase the property and what they were going to do with it. He
said he was advised they might build in the future. He said he felt they
should not sell property for someone to hold to build in the future and
keep as an investment.
9. Grace Strangio-St. George Jacobite Center requesting tax-exempt
status.
Borough Clerk Barney said this was on hold from another time and
Borough Attorney Coughlin was supposed to check into this.
Councilmember Crilley thought it was the building next to the Board
of Education Building. Mayor Failace told Borough Attorney to find
out about this.
10. Men's Softball & Little League-Appointments.
Councilmember Crilley said the umpires were paid according to the
1991 Ordinance. He spoke about the rates and the experience levels.
He said he would like to increase all the rates by one dollar. He said
he would like to increase the stipend from $1500.00 to $1750.00 for
the coordinator since he was getting paid the same amount for a
number of years. Mayor Failace asked if it was within the budget.
Councilmember Crilley said he felt this was well worth it and it was in
the budget.
11. PBA Local #47-Reqesting to hold their Fishing Derby in Carteret
Park on June 26, 1999.
Mayor Failace said okay.

BUSINESS TO BE ADDED:
Councilmember Fazekas spoke about the article in the newspaper
about Woodbridge Y2K Compliance. He said he felt we have to look
at the computer system in the Borough and check the police
Department computers.
Councilmember Mancuso asked if there was any time limit on fixing
up an old building.
Mayor Failace said someone got a nice break in the Hill Section and
they did not do anything with the property.
Borough Attorney Coughlin said only if it was in an agreement. He
said they would have to comply with code no matter what they paid
for the property.
Councilmember Mancuso asked if there could be a Resolution that
says they have a time limit.
Mayor Failace said he did not think it had to be by Resolution but had
to be negotiated when they got the property.
Borough Attorney Coughlin said there was not that many times when
the Borough gives property away, but in those cases there is an
agreement. He explained. He said they could be reminded that they
need to be brought up to code.
Councilmember Mancuso asked how long a boarded up school or
building could stay boarded up before it had to be fixed and the owner
was forced to do something.
Borough Attorney Coughlin said assuming that was a violation of code
they could get a ten-day notice and be fined. He said if they were code
compliant there is no obligation by the Borough.
Councilmember Quinones said the Court employees have been here
until 2:30 A.M. and suggested they add another session once or twice a
month. She said she did not discuss this with Debbie Uhouse yet but
felt it would alleviate some of the burden on the calendar and she
suggested Ms. Uhouse come to address the Council at the next Agenda
Meeting.
Councilmember Gutowski said he had a personnel matter for Closed
Session.
Councilmember O'Brien said he called the State to complain about the
smell from Dauman Pallet. He said the State said they would check it
out but Councilmember Mancuso knew more about it.

Councilmember Mancuso said he spoke to the State and County and
they suggested they set up a meeting and have people call with their
complaints so they could build up records on Dauman. He said they
told Dauman they had thirty days to clean up and stop the smell. He
spoke about the problems with Dauman and what he has tried to do to
stop this.

Councilmember Crilley said the Carteret Royals want to use the Senior
Citizen Bus on Sunday. He said he told Mr. Kately to check into it
and if it was available they have had it in the past and he felt they
could have it now.
Borough Attorney Coughlin told Borough Clerk Barney to check on
the status of a liquor license held by Zaleski and advise him. He said
they started the process of doing the Grade Crossing at Port Carteret.
Mayor Failace said Reverend Gual found a parcel of property across
from Chrome Park and it was good for the Reverend and the town. He
said he felt this was an excellent area for Reverend Gual's needs. He
said he would have Borough Attorney Coughlin check out the details.
Borough Attorney Coughlin said he had something with regard to
Sprint and their request for a lease addendum. He said he spoke to
their attorney and told him the Council was not inclined to approve it
since what they want to do was not in their original plan in the
Resolution that was approved by the Board.
Councilmember Mancuso said he felt Sprint was trying to pull a fast
one saying this was part of the original plan but it was not part of the
original plan. He spoke about other things that they were supposed to
do but did not do.
RESOLUTION #99-84 was introduced by the Mayor and referred to
the Council for action.
Upon MMS&C, by Councilmembers O'Brien and Quinones
RESOLUTION #99-84
"RESOLUTION TO GO INTO CLOSED SESSION"
was adopted. Upon individual roll call vote, Councilmembers Crilley,
Fazekas, Gutowski, Mancuso, O'Brien and Quinones voted in the
affirmative.
At approximately 8:22 P.M., a Closed Session was held.
