HomeMy Public PortalAbout2021 0713 Council PacketRIVERDALE CITY COUNCIL AGENDA PLACE: Riverdale City Hall, 110 Manor Drive, Riverdale, Iowa DATE: July 13, 2021 TIME: 7:00 P.M. The regular meeting of the City Council of Riverdale, Iowa will be conducted according to the following order and actions will be considered on the items listed. The notice of this meeting is not considered final until 24 hours prior to the meeting and may be further modified if 24 hours' notice is impossible or impractical for good cause. In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state laws, all public hearings and meetings held or sponsored by the city of Riverdale, IA will be accessible to individuals with disabilities. Persons requiring auxiliary aids and services should contact City Hall at (563) 355-2511 five (5) days prior to the hearing or meeting to inform of their anticipated attendance. The requirement that an Ordinance be read three times before passage may be waived by council upon an affirmative vote of four (4) of the five (5) council members. The public is advised to take note of this process and be prepared to speak either for or against any ordinance at the time of first reading. Per Chapter 21 of the Iowa Code, more specifically described in sections 21.2 and 21.8, a member of the Council may attend the meeting either in person or by electronic means, as defined in said sections. 1. Frank Grage from Iowa American Water gave a presentation regarding the privization of the City of Riverdale, Iowa sanitary sewer delivery system. 4. NEW BUSINESS 6.1 RESOLUTIONS 6.2.1 Resolution 2021-27-A Resolution Entering into an Agreement with MSA-PS to Design the Emergency Access from Circle Drive/Pleasant Hill 1st Addition to Linda Drive/Woods Estates Phase II. Krell made a motion to amend the resolution by replacing the word "road" with "route" and was seconded by Heddlesten. Roll Call: All Ayes. MC 6.2.2 Resolution 2021-28-A Resolution Establishing a Salary Schedule for Appointed and Hired City Staff for FY22 effective July 1, 2021. Krell made a motion to table the resolution and was seconded by Littrel. Roll Call: All Ayes. MC 6.2.3 Resolution 2021-29-A Resolution Establishing a Procurement Policy. Moved by Heddlesten, seconded by Littrel. Roll Call: All Ayes. MC 6.2 ORDINANCES 6.2.1 Second Reading of Ordinance 02 -2021 -An Ordinance Adopting 657A of State Code of Iowa. Moved by DCamp, seconded by Littrel. Roll Call: All Ayes. MC Krell made a motion to waive the third reading of Ordinance 02-2021 and was seconded by DCamp. Roll Call: All Ayes. DISCUSSION AND COMMITTEE REPORTS -The Mayor and Council would like to thank Brian Ballard for his years of service on the Riverdale Fire Department. The Mayor and Council would also like to thank Bohnsack and Frommelt Accounting Firm for their help this past year. 10. REPORT FROM THE MAYOR -Nothing at this time. 11. GENERAL PUBLIC COMMENT/COMMUNICATIONS TO THE COUNCIL -Nothing at this time 12. ADJOURNMENT Motion to go into closed session was made by DCamp, seconded by Heddlesten. All Ayes. Council went into closed session at 8:39pm "To evaluate the professional competency of an individual whose appointment, hiring, performance, or discharge is being considered when necessary to prevent needless and irreparable injury to that individuals' reputation and that individual requests a closed session." Motion to close the City Council meeting was made by Littrel, seconded by DCamp. All Ayes. The Regular Meeting of the City Council was formally adjourned at 9:40pm. Kensington and Bicentennial Park. I also walked the wooded area on the West and East of Manor Drive. The purpose of the inspection was to establish the current and future tree needs in the city. Initially I looked at the trees at the park off S. Kensington, City Hall, Volunteer Park, and Bicentennial Park. South Kensington Park- There were some clearance issues, broken limbs and general maintenance on a number of spruce trees. The 5 mature trees at the park seemed to be in good health with little to no work neededing completed. (6.25) Completion of this project would be between $2200-$2700 depending on when you decide to do the work. City Hall- Clearance issues over the parking area, mature locust tree near entrance needs to be pruned, 4 crabapples need to be runed for clearance and appearance. (5.0) Completion of this project would be between $1800- $2200 depending on when you decide to do the work. Volunteer Park- The locust on the front corner needs to be pruned. Codominant stems need to be removed from 2 maples to ensure the trees will be able to be structurally sound as they mature. 4 Large hard maples need general maintenance pruning. (6.75) Completion of this project would be between $2500-$3000 depending on when you decide to do the work. Bicentennial Park- 3 Ash Trees need height raised for clearance (it is not recommended to do anything but clearance and hazard pruning on ash trees unless you decide to treat them against EAB) There is a decent size Cherry Tree that needs to be removed on the east side by the woods. There is also a large Oak tree that needs removed in this same genarla area. A mulberry near the grill should be removed and the stump should also be removed from this tree to prevent resprouting. There are also a stand of mulberry trees on the west that need some major pruning. Doing this will allow access to the area that is covered in weeds and overgrowth by a mowing team. The ginkgo tree will also need some structural pruning to remove codominiant limbs. (21.5) Completion of this project would be between $9000-$9500 depending on when you decide to do the work. After inspecting the parks I walked the majority of the wooded area off Manor Drive. Work being done in accordance with ANSIA300 standards Page 1 of 2 semearai VISA $784.26 Np)YUS Credit card payments will incur a 3.5% convenience fee Wooded Area- The wooded area seems to be over grown with buckthorn, tree of heaven, honeysuckle and mulberry. The area has numerous dangerous hangers and limbs that in a wooded lot situation would not be considered a significant risk. However this area could be usable for walking paths if this vegetation was managed properly. If the use for this lot increased then these hazards would need to be addressed. This could be a very useful and enjoyable spot for the comunity! My recommendation is to basically mow down the understory with a machine that will turn the debris into a mulch material. Once that is completed we can remove the hazardous limbs and trees. After that we would mark out the paths throughout the wooded area and apply the mulch product created from the clean up to those paths. The future management of this area would include introducing desirable species and fostering the development of the desirable species that naturally re grow. The initial cost of this project would be $35,000- $37,000. The continued up keep would be dependant on how much you want to develop the remaining wooded areas. Maintenance of the paths should be easily covered with under $5,000 per year. Spending $10,000 per year would allow a budget for tree maintenance, path upkeep and introducing desirable species throughout the greenspace. There is also a chance that it would need to be re -mowed in 2022 or 2023 and this would cost between $7000-$9000. I did not look at the area behind deerbrook. My opinion is that we should complete the project in the wooded lot by Manor drive first and then use what we learn about this area and how it gets used before making a decision with this additional area. The City of Riverdale shall make every effort to contact the Volunteer and the emergency contact provided in this Agreement in the event such care is sought. • The City of Riverdale may share information contained in this Agreement as well as other documents and information related to the Volunteer otherwise in its possession with other City staff, Activity sponsors and volunteers, and health providers in seeking such medical treatment or service for the Volunteer. Assumption of the Risk: The Volunteer understands that the Activities may include work that may be hazardous to the Volunteer, including, but not limited to, construction, loading and unloading, and transportation to and from the work sites. Volunteer agrees to inspect all work sites and the tools for all Activities. The Volunteer shall only perform such Activities as the Volunteer has been properly trained to perform. The Volunteer understands that he or she always has the right to refuse to perform any Activity that the Volunteer feels he or she is unqualified to perform or that the Volunteer deems to be unsafe. The City of Riverdale does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness. Insurance: The Volunteer understands that, except as otherwise agreed to in writing by the City of Riverdale, the City of Riverdale does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. EACH VOLUNTEER IS EXPECTED AND ENCOURAGED TO OBTAIN HIS OR HER OWN MEDICAL OR HEALTH INSURANCE COVERAGE. Photographic Release: Volunteer does hereby grant and convey unto City all right, title, and interest in any and all photographic images and video or audio recordings made by the City during the Volunteer's Activities with City, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings. Conduct: Volunteers are seen as an extension of the City by the public, therefore refrain from using inappropriate language, tobacco products, alcohol, or drugs while volunteering. Failure to comply with training or acting in an inappropriate manner may result in the volunteer being liable for damages to City equipment or property private or public. Groups: Group leaders will follow all directions provided by City, consistently maintain the group and act in the role of caretaker for the Volunteers while on state property. Other: Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Iowa, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Iowa. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. YOUTH VOLUNTEER PARTICIPATION —THE PARENT OR LEGAL GUARDIAN AGREES TO THE FOLLOWING CONDITIONS: GENERAL TERMS AND CONDITIONS: • You are familiar with the Activity and have been provided an opportunity to ask questions about the Activity. • You shall direct the Child: (i) to follow all instructions provided by City of Riverdale or other sponsors of the Activity at all times while participating in the Activity and (2) not to conduct in inappropriate behavior, including without limitation, kicking, biting, hitting, scratching, using abusive language, engaging in sexual behavior, or name-calling. Participants failing to obey directions provided by the City of Riverdale and City of Riverdale, Iowa 110 Manor Drive, Riverdale, Iowa 52722 (563) 355-2511 www.riverdaleiowa.com other sponsors of the Activity or otherwise engaging in inappropriate behavior may, at the sole discretion of the City of Riverdale, be dismissed from the Activity. • You shall direct the Child to maintain contact with the Activity group and/or leader at all times. • You shall ensure the Child is dressed and equipped appropriately for the weather and conditions of the Activity. • The Child shall not possess, consume or be intoxicated by any of the following while participating in the Activity: tobacco products; alcohol; combustible materials including matches, lighters and lighter fluid; subversive or pornographic materials; ammunition, explosives, firearms and other weapons (unless participating on a mentored youth hunt or firearm training class and then only under close supervision of an adult); gambling devices; drugs and or drug paraphernalia; and prescription drugs not specifically prescribed for the youth participating in the Activity. • The Child shall not operate a vehicle or equipment with a motor during the Activity (unless the vehicle or equipment is used due to mobility impairment). • The City of Riverdale shall be permitted to contact the parent/legal guardian and emergency contact(s) provided on this form and release the Child to those persons so identified in this form. ACKNOWLEDGMENTS: By signing this youth participation agreement, you, acknowledge the following: • That the Activity may include activities that may be hazardous to the Child. • That you have the right to prevent or disallow the Child from performing any activity(ies) related to the Activity that you feel the Child is unqualified to perform or that you deem to be unsafe. • That participation in the Activity poses some known and inherent dangers to the Child, as may be described as part of the Activity above, including without limitation: bodily injury, personal injury, illness, death, or property damage. • That the City of Riverdale does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance, in the event of injury or illness of the Child. • That the City of Riverdale has the right to limit or bar the Child from participating in any part or all parts of the Activity for any reason. • That, except as otherwise agreed to in writing by the City of Riverdale, City of Riverdale does not carry or maintain health, medical, or disability insurance coverage for any volunteer or participant, including the Child. • That the ratio of minors involved in the Activity to supervising adults may be as high as ten minors to one adult, depending on the activity.
