The regular meeting of the City Council of Riverdale, Iowa will be conducted according to the following
order and actions will be considered on the items listed. The notice of this meeting is not considered
final until 24 hours prior to the meeting and may be further modified if 24 hours' notice is impossible or
impractical for good cause.
In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state
laws, all public hearings and meetings held or sponsored by the city of Riverdale, IA will be accessible to
individuals with disabilities. Persons requiring auxiliary aids and services should contact City Hall at
(563) 355-2511 five (5) days prior to the hearing or meeting to inform of their anticipated attendance.
The requirement that an Ordinance be read three times before passage may be waived by council upon
an affirmative vote of four (4) of the five (5) council meiombers. The public is advised to take note of
this process and be prepared to speak either for or against any ordinance at the time of first reading.
Per Chapter 21 of the Iowa Code, more specifically described in sections 21.2 and 21.8, a
member of the Council may attend the meeting either in person or by electronic means,
as defined in said sections.

DATE: July 27, 2021 TIME: 7:00 P.M.
NOTE: The Regular Meeting of the City Council was held in -person at the appointed time and day in
accordance with open meeting laws set and defined by the State of Iowa (Sections 21.2 and 21.8).
1. WELCOME -CALL TO ORDER -The meeting was called to order at 7:00 pm by Mayor Mike
Bawden, ROLL CALL -Council Members Present: Adams, Littrel, Krell, DCamp, Heddlesten (via
conference call) Also present: Mayor Mike Bawden, Engineer Chris Cooper, City Administrator Kent
Royster, Riverdale Fire Chief Chris Bernard, George Miller, and other residents and visitors.
2. PUBLIC HEARING REGARDING THE SANITARY SEWER REHABILITATION
PROJECT PHASE II -Mayor Bawden opened the public hearing. Chris Cooper from MSA gave a
presentation on the project. Krell asked if the money was already in the budget and was informed it
was. Krell made a motion to close the public hearing and was seconded by DCamp. Roll Call: All
Ayes. MC. The hearing was closed at 7:12pm.
3. PUBLIC HEARING REGARDING A BUDGET AMENDMENT FOR FY2i-Mayor Bawden
opened the public hearing at 7:12pm. The council and residents would like more information and
more of an explanation on the over spending of the FY21 budget. Krell made a motion to close the
public hearing and was seconded by Littrel. Roll Call: All Ayes. MC. The hearing was closed at
7:25pm.

II. TERMS AND CONDITIONS
This Facility Use Agreement ("Agreement") is made as of the date listed below between the City of Riverdale, Iowa ("Riverdale") and the
undersigned renter (the "Renter"). This agreement shall take effect November 1, 2015. In consideration of the mutual covenants and
promises contained herein, Riverdale agrees to allow Renter to use the City of Riverdale Community Room (the "Room"), located at 110
Manor Drive, Riverdale, Iowa, at the date and time specified above and on the terms and conditions contained herein.
The parties agree as follows:
1. Renter agrees to comply with the Riverdale Community Room Rules and Regulations, a copy of which has been provided to Renter.
2. Renter agrees to use the Roan in compliance with local, state and federal law. The Room shall not be used for any illegal purpose.
3. Renter agrees to pay rent for use of the Room at a rate of $30 per event.
The rental fee iswaived for the following groups: Alcoa, all Riverdale City Government groups including volunteer committees,
boards, and Riverdale Firefighters Association, Nonprofit groups that regularly use the facility may apply for a reduced rate that will
take into consideration if food or drink is served and the number of regular attendees. Reduced Rate Applications and rate will be
considered at a regular scheduled Council meeting.
4. All Renters agree that he/she/they is/are responsible for clean-up and for any damage to the facility and equipment that may result
from use by Renter, his/her/its family and guests. Renter agrees to pay a cleaning/damage depositof$30, Riverdale agrees to return .---
. the full clean-up/damage deposit to Renter after the event, conditioned upon the immediate retum of the Room key and satisfactory
inspection of the Room and equipment, according to the Riverdale Community Room Rules and Regulations. The clean-up/damage
deposit is waived for the following groups but they will remain responsible for damage replacement costs that occurred during their
rentals: Alcoa, Scott Community College, the Pleasant Valley School District, regularly scheduled not for profit groups with approved
separate community room agreement.
5. Renter is responsible for the behavior of his/her guests. Renter must ensure alt people in attendance abide by the Riverdale
Community Room Rules and these Terms and Conditions.
6. IN CONSIDERATION FOR USE OF THE ROOM, RENTER AGREES THAT HE/SHE/THEY WILL USE THE ROOtVI
EQUIPMENT AND FACILITIES AT RENTER'S SOLE RISK. RENTER FURTHER AGREES THAT RIVERDALE WILL
NOT BE RESPONSIBLE FOR ANY OR ALL INJURY, ILLNESS, LOSS, THEFT OR DAMAGE TO RENTER, RENTER'S
PROPERTY, OR RENTER'S GUESTS BEFORE, DURING OR AFTER THE EVENT WHILE ON THE PREMISES.

Greeting all,
1. Grants
We have submitted two grants this week. The first being America Recovery Plan
Act (ARPA). This grant is for infrastructure; in particular water and sanitary sewer
improvements as well as COVID related expenses. The City is set to receive
$65,000; which will be split into two payments of roughly 33,000 each. I will keep
you updated on the receipt and reporting requirements as I receive further
information.
The second grant was CARES Act. This grant was 9,400 worth the free computer
equipment. We are scheduled to receive the equipment in November of 2021. The
only cost will be set up costs. I worked with Twin States to ensure that it was a
quality product and better than what the City currently has.
The order includes 3 Dell Laptop Bundles. Which includes a laptop and desktop.
On A la Carte Product offerings we ordered 1 Logitech webcam and one Dell 3520
Developer.
Please see attached information for what was ordered.
That's a total of 74,000 in total grants this week!
2. Newsletter
Attached is a hard copy of the newsletter that Staff worked on this week. It is
scheduled to be in the mail on Friday 8/6/2021. We are already thinking of bits of
information that Staff can include for the next one. We are open to comments,
suggestions and criticism.

3. Fenno Dr Pre -Construction and Community Meeting
Iowa American Water scheduled a pre -con meeting for Monday August 3rd. I was
able to meet with the contractor which is HAWKEYE WATER AND SEWER (no
relation to Hawkeye Paving). They have scheduled this project for late August. The
City will serve as the point of contact for questions from our residents and
businesses.
The project is scheduled to take up to 6-8 weeks. Valley Dr will be down to
alternating one-way traffic. Fenno will be open for at all times. Republic, LISPS and
Pleasant Valley School District have been contacted.
It has and will be a continued inconvenience for the residents. We (Iowa -American
Water and City of Riverdale) are trying to minimize the impact as much as
possible.
RTM; Bryce Johnson is Iowa American Water engineer on the project. Chris
Cooper has reviewed the plans, and will perform construction observation, and
material and manhole testing at IAW's expense per Agreement.
4. Seal Coating Fenno Rd.
This project has no changes. I will continue to work with the City of Bettendorf to
schedule this project around the larger and more difficult Fenno Drive
reconstruction project.
Brandt Construction is committed to complete the contract until September 10th,
Both the City of Bettendorf Engineering Department and Brandt Construction
have no problem in adding the City of Riverdale to the contract.
5. All -Star Community Award- Meals -to -go program!
Congratulations! You have been nominated for the All -Star Community Award!
Every year ahead of the Iowa League of Cities Annual Conference the League has a
friendly competition between municipalities over the programs they were able to
accomplish for the previous year.
The projections range of Community Centers to water protection projects. This
competition is a bracket. Our first competition is the City of Pierson, IA (pop. 366).

6. Manor Drive and Circle Dr Sump Pump Drainage Project
This project has been scheduled! We have received the final Waiver; with help from
Paul Macek. The project is tentatively for the first half of September.
7. Tree Update
With your guidance I signed the bid with Advantage Tree. I have given them 7 days
to schedule and complete the work. By, August 12th the Tree that has caused the
issue will be removed. It will be possible that Manor Dr may experience brief
intermittent closures during the removal process.
S. Issues with the Downloads on Council Member's Chromebooks
In general, if a City computer/chromebook is left on for at least a single day
Monday -Friday for the entire 8am to 9pm, it will receive updates properly for
Security and Anti -virus updates.
If a computer is unable to be on during the entire time, then if one day during the
work week it is on during the morning, and another day during the work week on
during the afternoon through early evening, that will suffice too.
This schedule is the same for all City computers, Council Members, and Fire
Department EXCEPT for the rebooting of Fire Department laptops.
9. Candidate Packet for Municipal Elections
See Attachment. I have included them in the packet.
10. Sheriff Tim Lane
Earlier this week I requested the Sheriff come to discuss the idea of assisting the
City of Riverdale in Nuisance Abatement procedures and the possibility of
installation of a Red Light Camera/Speed Camera at the Belingham Intersection.
The plan is his attendance at the August 27th Council meeting.
11. Presentation by Scott County Watershed
They requested last month to speak to you regarding watershed month. And,
requested a Proclamation to be adopted.

12. Emma Hupp Presentation regarding Entrance to City Hall/Fire
Station
Emma Hupp is here to request your permission and funding to install three new
flagpoles and landscaping near the concrete feature in the front of City Hall. She
has been working with Anthony Heddlesten and myself. During budget
discussions this item was eliminated from the budget. The Mayor had placed
20,000 for this as well as other projects.
However, if you wish we have other funding that wasn't or willing not be
completed that was budgeted for (ie facade program).

13. Resolution 2021-36 A Resolution Approving the Final/ Preliminary Plat for
Woods Subdivision Phase III
This is ready to be adopted. We have the Letter of Credit, Hold Harmless
Agreement. Planning & Zoning has given its conditional approval; that condition
was that the City Engineer Chris Cooper adequately reviewed all materials.

✓ Road Construction ALERT! Iowa American and the City
of Riverdale have finally awarded the Fenno Road
reconstruction contract. The contract will allow for the
replacement of sanitary sewer, water, storm sewer, curb
and gutter, and full depth asphalt replacement.
Construction is scheduled to start the week of August 2381
✓ The Sanitary Sewer relining project is a joint project
between the City of Riverdale and the City of Panorama
Park. This project also includes fixing the erosion problem
on the westside of Manor Drive Hill. The purpose of this
project is to eliminate Inflow and Infiltration. It will start
in September and end in December.
✓ The emergency access route between Pleasant Hills and
the Woods Subdivision 3' Addition will stay towards the
Eastside of Bicentennial Park, close to the existing field
access road. Stay tuned in for further updates regarding
this project.
✓ The City recently contracted with MSA-PS to design the
Parking Lots at City Hall and the Fire Station. The City
plans to re -design the City Hall lot to improve the
Handicapped Accessibility of City Hall and improve
Council Meetings

Cascade: Cascade Swimming Pool Project
The pool was 50 years old and was deteriorating and was not accommodating for small children or older adults
due to no steps to exit the pool. The pool in its current state was not able to meet the needs of every person. The
city council strongly supported the project to enhance the quality of life amenities that Cascade has to offer. >

plant knowledge and encourage a sense of stewardship
for the environment among our visitors.
< During the pandemic shutdown, the community's
only restaurant was shut down and in dire need of
assistance. At the same time, the city's largely elderly
population was home -bound and lacking easy and safe
access to supplies. Seeing an issue and also a solution,
Riverdale's mayor reached out to the restaurant, the
Duck Creek Pancake House, and developed an online
application system for residents who were either LMI
or senior citizens to apply for meal delivery from the
restaurant.
Pierson: Source of Water Protection
Native Plant Park
The city was looking for a way to create a multi-
functional area. Located at City Park on Maple
Street, around a shallow water well, native grasses
were planted, their extensive root systems help filter
contaminants before they reach the water aquafers. A
cement path circles the area for the public to walk and
exercise. Two pollinator gardens with benches were
placed in the area to enjoy and provide butterflies and
bees with food. This area aims to be a resource for

Wayland: West Park Wetlands
Upgrade to the largest city park with new ADA

Marshalltown: Renovation of the Veteransl
Memorial Coliseum
The Coliseum is a 92 -year -old building with a
new interior and will serve as the host for events that
positively impact Downtown Marshalltown by bringing
people to the area and supporting local businesses.

Washington: Washington Municipal Campus
The City Hall -Police Building Project was the
completion of nearly eight years of study and planning.
Four separately let capital projects and over $6 million
in public and private investment on the Municipal
Campus.
La Porte: Main Street Rehabilitation and
Redevelopment Project
The Main Street Rehabilitation and Redevelopment
Project consisted of the reconstruction of four
blocks of Main Street and the development of a trail
and park at Wolf Creek. The project included the
replacement of the community's historic brick streets
with new brick, backed by concrete to allow for easier
maintenance and longevity while maintaining the
historic aesthetic of the downtown area.
Hills: Community Stage
In addition to summer concerts, the new stage will
be used to show outdoor community movies and host
elementary school concerts. The stage is a tremendous
improvement to the park and has become an amenity
for everyone in the community to enjoy.
Clinton: Jurgensen Sports Complex
Upgrades
The project includes excavation of the complex and
flattening the space into one universal playing area and
eliminating the 3 -tiered elevation. This project included
the expansion of the SW corner that had previously
been undeveloped. This allowed the city to streamline
programming into one location that now features 11
playing fields.
Stanton: Residential and Commercial
Building Benefits Packages
The Stanton City Council unanimously passed a
resident and commercial benefits package to use as a
tool to encourage both home and commercial growth
in the community.
Monticello: Outdoor Pickleball Courts
The desire for outdoor pickleball courts amongst the
community grew and thanks to a generous donation,
the city was able to get the project completed in the
spring of 2020. Pickleball in the community has
given individuals of all ages another opportunity for
recreation, specifically retired community members.
Carroll: New Library and City Hall
With the library outgrowing the facility and the need
to make both the library and city hall more accessible,
a number of attempts were made to renovate or build
new facilities for more than a decade. The new library
finally opened to the public on June 3, 2020.
Johnston: Johnston City Hall
The Johnston City Hall and adjoining infrastructure
are a catalyst for the development of the Johnston
Town Center. City hall's conjoined amphitheater and
greenspace create a cause and space for community
gatherings, which sets the stage, so to speak, for
commercial development in the Johnston Town Center.
Ottumwa: Ottumwa Downtown Streetscape
The plan featured a perfect balance of long -sought
amenities with sustainable design and added safety.
The plan addressed three blocks of Ottumwa's Main
Street and included permeable pavers for intersections
and crosswalks, mid -block crossings, bioswales, public
art, a tree -lined street, added seating, beautiful new
streetlamps and mid -block gardens.
Hiawatha: Hiawatha Public Library
Renovation and Expansion Project with
Willman and North Center Point Road
Improvement Project
In the city's efforts to provide the necessary service
to its growing community and the continued desire
to create a Village Center, it was time for the city and
its citizens to reinvest money into its community. The
Public Library Renovation and Expansion Project was
a combination project that created a new library space
as well upgraded the Willman and North Center Point
Road intersection adjacent to the library to meet the
traffic needs of the community. •

which is the date of enactment of the CARES Act;
• Were incurred during the period that begins on March 1, 2020, and ends on
December 31, 2021; and
• Have not been reimbursed from another source.

Overview
What is the City Election?
The city election is held in odd -numbered years on the first Tuesday after the first Monday in
November to elect city officers and vote on public measures. All cities will hold a regular city
election. It is held in conjunction with the regular school election, so the election is known as the
city —school election.
As part of the election process, a city may hold a city runoff after the regular city election if set
by city ordinance.

Candidate Qualifications
A candidate must be an eligible elector in the city and city ward (if any) at the time of filing
nomination papers and at the time of the election.

An eligible elector meets all requirements to register to vote but does not have to be registered to
vote. An eligible elector must be:
• A citizen of the United States
• A resident of Iowa
• At least 18 years old
An eligible elector may not:
• Be a convicted felon (unless voting rights have been restored by the president or
governor, including via Executive Order)
• Be currently judged incompetent to vote by a court
• Claim the right to vote in any other place

Controlling County Auditor
When a city, school district, or merged area (community college) crosses county lines, the
auditor whose county has the largest taxable base is the "controlling auditor". The controlling
auditor is responsible for receiving candidate nomination papers and public measures,
developing summaries, and certifying names and the text of public measures and summaries to
all auditors for that political subdivision.
Each auditor is responsible for administering elections for cities, school districts, or portions
thereof, for all voters within the auditor's county. In a situation where a city or school district lies

in multiple counties, each auditor will print ballots and service voters for the portion within the
auditor's county.
For city primary and runoff elections or special elections for cities, schools or merged areas, the
non -control county auditor may designate the control county auditor to conduct the election if
fewer than 125 registered voters of the shared jurisdiction reside in the non -control county.

Nomination Papers
Candidates for the regular city election in cities without primary election provisions may be
nominated by two methods:
1. Circulating nomination petitions (Chapter 45 nominations or runoff provisions)
2. Holding a non-party political organization (NPPO) nomination convention (Chapter
44 nominations)
A NPPO is a political organization that is not a political party as defined by Iowa law.

Check with the city clerk or controlling auditor to determine which nomination method is allowed
and whether the city has a runoff provision.
Each candidate must file nomination papers with the county auditor or the city clerk, if
designated by the controlling auditor. Check with the controlling auditor to determine the proper
office for filing nomination paperwork. The affidavit of candidacy and nomination petitions or
convention certificate must be filed together or they will be rejected.

Copies of nomination papers are available at the city clerk's office, county auditor's office, or on
the Secretary of State's website:

filed before or after the filing period. The filing period is:
First day: Monday, August 23, 2021

There are no filing fees in Iowa.

Preparing Nomination Papers
Affidavit of Candidacy
Each candidate must complete and file an affidavit of candidacy. The affidavit of candidacy form
is available on the Secretary of State's website:

The affidavit should include the following information:
• Candidate's Name
The candidate's name should be printed exactly as the candidate wishes the name to
appear on the ballot. No parentheses, quotation marks, or titles (e.g. Dr., Mrs., etc.) may
be included. Please provide the phonetic spelling of the candidate's name. This is helpful
when producing audio ballots for voters who are visually impaired. Be as clear as
possible. For example, Eisenhower = "EYES-in-how-er."
■ Office Sought and Ward (if any)
The name of the office and the city and city ward (if any) that the candidate is running for
must be included.
■ Vacancy Information
Is the candidate running to fill a vacancy due to the death, resignation, removal, or
temporary appointment of an office holder?
The "yes" box must be checked if the candidate is running to fill the remainder of an
unexpired term. This happens when an incumbent office holder resigned, died, or was
removed from office before the end of the term and another officer was appointed (not
elected) to fill the remainder of the unexpired term.
Contact the city clerk or county auditor with questions about whether you are running to
fill a vacancy.
■ Type and Date of Election
The 2021 Regular City —School Election will be held on Tuesday, November 2.
• Candidate's Home Address
Candidates must provide their house number and street name. Mailing address, phone,
and email are optional but do assist the county auditor, city clerk, and the public in
contacting the candidate.

• Candidate's Affirmation, Signature and Notarization
The affidavit must be notarized. A notarial officer must be present when the candidate
signs the affidavit and the notarial officer will complete the verification on the bottom of
the affidavit. Once an affidavit is notarized, the affidavit cannot be altered.
Affidavits missing any of the information listed below must be rejected:
• Candidate's name
• Office sought and ward (if any)
• Candidate's signature
• Signature of notary public

Nomination Petitions
Candidates must collect signatures on nomination petitions and file the petitions at the same
time the affidavit of candidacy is filed. The nomination petition form is available on the Secretary

Candidate Information
Before anyone signs the petition, the required information in the candidate header of every
petition page must be completed.
Best Practice: Complete the header on one petition page and make copies of that page so all
petition page candidate headings are identical.
The information listed below must appear on each petition candidate header. Signatures cannot
be counted on petition pages missing the following information:
■ Candidate's Name
The candidate's name should be printed exactly as the candidate wishes the name to
appear on the ballot. No parentheses, quotation marks, or titles (e.g. Dr., Mrs., etc.) may
be included.
■ Office Sought
■ City Ward (if any)
The candidate must provide the city ward if there are any. Signatures on petition pages
that do not provide the applicable city ward when required cannot be counted.
■ Type and Date of Election
The 2021 Regular City —School Election will be held on Tuesday, November 2.
Signers' and Candidate's Affirmation of Residence
The following statement must appear on each petition page:
"We, the undersigned eligible electors of the appropriate county, city, school district,
school or community college director district, or other district as established by law,
hereby make the nomination outlined above. If the candidate named above accepts
the nomination, we believe the candidate is or will be a resident of the appropriate
county, city, school district, school or community college director district, or other
district established by law as required by law."

Signature Requirements for Cities without Primary or Runoff Provisions (Chapter 45
nominations)
The minimum number of signatures needed is dependent on the size of the city.
• For cities with a population of 3,500 or greater: at least 25 signatures
• For cities with a population between 100 and 3,499: at least 10 signatures
• For cities with a population of 99 or less: at least 5 signatures

Elected by Ward
In cities where council members are voted on only by the residents of the ward, petition signers
must live within the ward.
Elected At -Large
In cities where council members must be residents of a ward but are voted on by the entire city,
petition signers may live anywhere in the city.
Signature Requirements for Cities with Runoff Provisions
The minimum number of signatures needed is at least 10 or two percent of the number of
people who voted for the office at the last regular city election, whichever is greater.

Ask the city clerk or controlling auditor for the minimum number of signatures needed.
Elected by Ward
In cities where council members are voted on only by the residents of the ward, petition signers
must live within the ward.
Elected At -Large
In cities where council members must be residents of a ward but are voted on by the entire city,
petition signers may live anywhere in the city.

Collecting Signatures
Eligible electors of the city and ward (if applicable) may sign nomination petitions. See page 1
for the definition of an eligible elector.
Candidates may sign their own petitions assuming they are eligible electors of the city and ward
(if applicable).
Candidates may begin collecting signatures at any time. However, the signers still must be
eligible electors when the papers are filed for the signatures to count.
All signers must include the following information:
• A signature (the signature may be printed)
• The address of their residence
This must include a house number, street name, and city. Providing a post office box
only is not sufficient. A signer who is homeless should describe where the signer lives or
write "homeless".

There is no limit on the number of nomination petitions one elector may sign for different
candidates.
Important Note: Petition signers often use "ditto" marks (" ) when appropriate (e.g. when the
name of a city or the date of signing the petition is the same as the previous signer). The use of
ditto marks alone does not invalidate a signature.

Convention Certificate (Chapter 44 — Nominated by NPPO Convention)
Non-party political organizations (NPPOs) may make nominations by convention in some cities.
Candidates who are not members of any political organization may not be nominated by
convention.
Important Note: Candidates nominated by NPPO convention will not have the name of the
NPPO follow their name on the ballot because the city election is a non-partisan election.
Minimum Number of Convention Attendees
At least 20 eligible electors must attend the convention and at least half of the precincts in the
city must be represented by those electors. See page 1 for definition of eligible elector.
If the minimum attendance requirements are not met for the specific office for which a
nomination is being made, the nominations made at the convention cannot be included on the
ballot.

Completing the Convention Certificate
The convention certificate must include the following information:
• Name of NPPO
The name of the organization may not exceed five words and no part or version of the words
Democratic or Republican may be used as part of the NPPO's name.
• Candidate's Name
• Office Sought and Ward (if any)
• Candidate's Home Address
Candidates must provide their house number and street name.
• Names and Addresses of NPPO's Executive or Central Committee Members
• Method for Filling Ballot Vacancies
NPPOs may specify the organization's provisions (if any) for filling vacancies in
nominations. If it wishes to make a substitution for a ballot vacancy, the NPPO must file
these provisions with the nomination paperwork filing officer.

• Affidavit and Addresses Chairperson and Secretary
The chairperson and secretary of the convention must certify the certification of
nomination from the convention. They also must include their places of residence.
• Names and Addresses of Each Delegate in Attendance at Convention
The convention certificate also should include the following information:

• Type and Date of Election
The 2021 Regular City —School Election will be held on Tuesday, November 2.
• Vacancy Information
Is the candidate running to fill a vacancy due to the death, resignation, removal, or
temporary appointment of an office holder?
The "yes" box must be checked if the candidate is running to fill the remainder of an
unexpired term. This happens when an incumbent office holder resigned, died, or was
removed from office before the end of the term and another officer was appointed (not

When more than one candidate has been nominated at the same convention, those
nominations may be added to the certificate by including the required information and using a
separate sheet of paper.

Filing Checklist
n Review affidavit and nomination petition headers or convention certificate.
Nothing can be added to a notarized affidavit, a petition header, or a convention
certificate if there are signatures on the page. Nomination papers can be returned only to
the filer if they have been rejected.
Count the signatures.
Best Practice: File more than the required number of signatures since it is possible for
signatures to be challenged. If there are signatures on a petition that should not be
included, simply draw a line through the name. Those signatures will not be counted.
Make a copy of nomination papers for your own records.
Bind your nomination papers together.
Nomination papers may be rejected without examination if not bound together.
Best Practice: Use staples or a three-ring binder.
File both the affidavit and nomination petitions or convention certificate at the
same time.
File as early as possible.
Nomination papers will be inspected for completeness before they are accepted for
filing. If nomination papers are filed early, candidates may have time to correct any
errors in rejected papers and resubmit them.
Nomination papers may be filed in person or by mail. When filing by mail, postmark
dates are irrelevant. The controlling auditor or the city clerk, if designated by the
controlling auditor, must receive the papers by 5:00 p.m. on the filing deadline. If
candidates would like to be contacted when their nomination papers have been
received, they should indicate that when they mail their papers and include a daytime
phone number at which they can be reached.
Important Note: It is the responsibility of the candidate to ensure the nomination papers
are received by the controlling auditor or the city clerk, if designated by the controlling
auditor, before the deadline. Check with the controlling auditor to determine the proper
office for filing nomination papers.

After Regular City Election Day
Cities without Runoff Provisions
Who Wins?
Candidates who receive the most votes, up to the number of seats to be filled, are declared
elected. If there is a tie, the board of supervisors must draw lots.

Write -In Votes
Write -In Candidate Wins and Accepts
If a write-in candidate wins and accepts, the candidate is declared elected as if their name had
been printed on the ballot. The person does not need to file an affidavit of candidacy.
[§376.11(1)]
Write -In Candidate Wins and Declines
When a write-in candidate wins a city election and does not want the job, the winning candidate
may submit a letter of resignation to the city clerk by 5:00 p.m. on the 10th day after the final
county canvass. If the write-in winner does not resign within 10 days after the canvass, the
office is vacant if the write-in winner fails to take the oath of office by the beginning of the next
term.

If a letter of resignation is submitted within 10 days of the county canvass, the city clerk then
notifies the person who received the next -highest number of votes. If there is a tie vote for the
next highest number of votes, the board of supervisors draws lots to determine the person who
received the next highest number of votes.
[§50.44, 376.11(2)]
If the next highest vote -getter accepts, the person is considered the duly elected officer.
Exception: A petition may be filed requesting a special election if the next highest vote -getter
takes office. The petition must be signed by eligible electors of the city equal in number to 25%
of the people who voted for the office in the election. The petition must be filed within 10 days of
the city clerk notifying the next highest vote getter.

If the next highest vote -getter declines, the person must do so in writing within 10 days of the
notice from the city clerk. If this occurs:
• The office is vacant at the end of the term.
• The vacancy must be filled pursuant to §372.13(2).
• If the council chooses to appoint, the appointment may be made before the end of the
current term.

Cities with Runoff Provisions
Who Wins?
It depends. If a city has a runoff provision, all candidates must receive a majority of the votes
cast to be declared elected at the regular city election.
Majorities in "Vote for No More Than One" Races
A simple majority is needed to be declared elected at the regular city election in a city with a
runoff provision. A simple majority is at least one vote more than 50% of the total votes cast.
If no candidate receives a majority in this type of race, a runoff must be held between the two
highest vote getters. For example, a runoff for the office of mayor will have two candidates on
the runoff ballot.

If there is a tie, the board of supervisors must draw lots.

Maiorities in At -Large Multi -Member Body Races
A majority is found by dividing the total number of votes cast for all candidates for that body by
the number of positions to be filled then dividing that by 2 and adding 1. Total votes cast equals
the votes cast for all candidates plus write-ins (do not include over and under votes).
If no candidate receives a majority in this type of race, or if not enough candidates received a
majority to fill all the seats, a runoff will be held to fill the remaining seat(s). The number of
candidates on the runoff ballot will equal twice the number of seats to be filled.

Example: Happytown has a five member at -large city council and a runoff provision. At the
regular city —school election, three at -large seats are on the ballot. There were eight candidates
on the ballot and 15,876 total votes cast (TVC).
To determine the majority:
1. Divide the TVC by the number of seats to be filled: 15,876 + 3 = 5,292
2. Divide that result in half: 5,292 - 2 = 2,646
3. Increase that result by one: 2,646 + 1 = 2,647 (always round up if necessary)
The majority votes a candidate needs to win one of these three seats is 2,647.
The highest vote -getter, Tom, received 8,215 votes, so Tom won this council seat with a
majority of the votes. A runoff is not necessary for this seat.

The second highest vote -getter, Nancy, received 2,488 votes. The third highest vote -getter,
Mark, received 1,774 votes. Neither of these candidates received a majority (2,647), so two of
the three council seats require a runoff between the highest vote -getters. The number of
candidates on the runoff ballot will equal twice the number of seats to be filled. There are two
seats left to be filled in Happytown so the four highest vote -getters who did not receive a
majority will appear on the runoff ballot.

Write -In Votes in Cities with Runoff Provisions
Write -In Candidate Receives Majority at Regular City Election and Declines
1. The winner must file a notice of resignation with the controlling auditor by 5:00 p.m. on
the day following the final canvass.
2. All remaining persons who received write-in votes and who want to be on the run-off
ballot must file an affidavit of candidacy with the controlling auditor by 5:00 p.m. on the
fourth day following the final canvass. The auditor should notify the write-in candidates of
this requirement.
3. The runoff election still must be held even if one of the remaining candidates has a
majority of the votes after the write-in votes of candidates who fail to file an affidavit are
disregarded.

Runoff Election Necessary and Write -In Votes were Cast for that Office
1. Everyone who received write-in votes and who wants to appear on the runoff election
ballot must file an affidavit of candidacy with the controlling auditor by 5:00 p.m. on the
day after the final canvass. The write-in votes received by a person who does not file an
affidavit will be disregarded. The auditor should notify the write-in candidates of this
requirement.
2. The runoff election still must be held even if one of the remaining candidates has a
majority of the votes after the write-in votes of candidates who fail to file an affidavit are
disregarded.

Frequently Asked Questions
Can I run for more than one office?
Yes. If a candidate files nomination papers for both city and school office, then the candidate's
name can appear under both offices on the same ballot. Separate sets of nomination paperwork
must be filed with the appropriate filing officer for each office.

Can I hold more than one office?
Statewide elected officials, state senators, and state representatives cannot hold more than one
elective office at time.
All other elected officials cannot hold more than one elective office at the same level of
government at a time. For example, a person could serve on the school board and county board
of supervisors, but a person could not serve on the county board of supervisors and serve as
county auditor.
Exception: This prohibition against holding more than one office does not apply to:
• County agricultural extension council members
• Soil and water conservation district commissioners.

This project is out for bid. There is a pre -bid meeting on August 12, 2021, Two Contractors have
requested if the completion date for the sewer lining could be extended to February 1, 2022. The
Riverdale City Administrator has indicated this is acceptable. I am waiting to hear from Panorama
Park,
MSA made initial contact with Scott Community College. They were to get back to us with some
suggested dates for meetings,

MSA has received and reviewed the final plans and plat. MSA has no issues with that was

SOUTH BELLINGHAM STREET INTAKE
MSA worked with Brandt Construction to have them submit a price quote for the work. The price
they submitted seemed high. Another Contractor declined to quote a price. After some thought,
MSA thinks that the City Administrator's suggestion of adding this work as an addendum to the
Sanitary Sewer Rehabilitation work has merit. Therefore, MSA will prepare an addendum to
include this work as part of the sanitary sewer work.
WATER MAIN BREAK ON FENNO ROAD
Because of short notice, only the City Administrator participated in the Pre -Construction meeting.
MSA will review any minutes from the August 5 meeting with City Resdents.

I am going to lead a team to put up 3 flagpoles in front of the Riverdale Fire Dept, as well as add landscaping around them.There I
are going to be four flags; American flag, Iowa state flag, City of Riverdale flag, and a Riverdale Fire Dept. flag. The purpose is to
honor retired firefighters who pass away by lowering the Riverdale Fire Dept. flag to half staff. The flags will be visible to the
highway next to it.

Briefly describe your project.
I am going to lead a team to put up 3 flagpoles in front of the Riverdale Fire Dept, as well as add landscaping around them. There
are going to be four flags; American flag, Iowa state flag, City of Riverdale flag, and a Riverdale Fire Dept. flag. The purpose is to
' honor retired firefighters who pass away by lowering the Riverdale Fire Dept. flag to half staff. The flags will be visible to the I

A RESOLUTION APPROVING THE PLAT FOR
PHASE 3 OF THE WOODS ESTATES OF RIVERDALE SUBDIVISION
WHEREAS, The City of Riverdale, Iowa ("City") is a Municipal Corporation, organized and
operating under the laws of the State of Iowa, and;
WHEREAS, the City's Planning & Zoning Commission has recommended the conditional
approval of the plat for Phase 3 of the Woods Estates of Riverdale Subdivision, and;
WHEREAS, Chris Cooper, MSA-PS, has presented a letter certifying the construction
drawings and drainage calculations submitted by the Developer and his engineer, and;
WHEREAS, the Developer's financial institution, BankORION, has confirmed their intention
of issuing an Irrevocable Letter of Credit in the amount of $2.3 million to serve as a
financial guarantee the public improvements will be completed, and;
WHEREAS, the Developer has agreed to not proceed with any construction activity until
that final letter of credit has been delivered and accepted by the City.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE,
IOWA.
Section 1. The City Council of Riverdale hereby approves the plat for the third phase
of the Woods Estates of Riverdale Subdivision with the following condition;
Section 2. The Mayor is not authorized to sign the plat document officially accepting
the plat until executed copies of the revised Irrevocable Letter of Credit (EXHIBIT A) and
the Hold Harmless Agreement (EXHIBIT B) have been received and reviewed (as
required by the municipal code of the City of Riverdale, Chapter 27 (EXHIBIT C)); and

27.02, Review by City Officials. Within fifteen (15) working days of
raneipt of materials from the Chairman, the several county officials
or departments shall complete their reviews of the plat materials
and shall submit their written comments to the City Council of
Riverdale, Iowa.
27.03. Public Hearing. Before consideration of a Final Plat by the
Planning and Zoning Commission or the City Council of Riverdale,
Iowa a public hearing in compliance with the Code of Iowa will be
held with notice given by publication In a newspaper in general
circulation In the City and by the written notification to all property
owners within one thousand (1,000) feet of the subject property.
27.04 Recommendation by Planning and Zoning Commission. The
Planning and Zoning Commission shall review the Final Plat and
application materials and the technical review comments,
Including Information on the status of implementation of the
erosion and sediment control plan at its next meeting and within
forty-flve (45) days shall recommend to the City Council of
Riverdale, Iowa that the Final Plat be approved or disapproved,
If the Planning and Zoning Commission recommends disapproval,
a statement setting forth reasons for disapproval shall be
submitted to the City Council of Riverdale, Iowa and to the
subdivider.

The City Council shall approve or disapprove the Final Plat within
sixty (60) days after receipt of the Final Plat from the Chairman of
the Planning and Zoning Commission. If the Planning and Zoning
Commission did not recommend approval of the Final Plat, the
City Council may approve said plat and accept the public area and
easements thereon only by a not less than four -fifths (4/5)
favorable vote of the entire membership of the City Council of
Riverdale, Iowa.
27.06 -Status of Approval. Approval by the City Council authorizes the
filing of the Final Plat with the County Auditor and Recorder, In
accordance with the provisions of existing statutes and following
procedures as required by said Auditor and Recorder, and
acknowledges the acceptance of all roads, streets, alleys,
easements, parks or other areas reserved for or dedicated to the
public along with the required surety bonds or checks
guaranteeing that the improvements required herein shall be
Installed.

27.07 Materials to ba Suttriltted Before Reccrdirng Plat. Prior to
recording, the developer shall submit a. copy of the following:
Signed certificates as required by Chapter 354 of the Iowa Code
of the land surveyor, attorney, Treasurer, and property owners
and protective covenants and performance bond, If applicable for
review and approval by the City Engineer and City Attorney.
A hold harmless agreement protects the City from any damages,
claims, or suits, including all costs, expenses and attorney's fees
relating thereto, resulting from the construction and development
by the owner and/or subdivider. Said agreement shall be subject
to approval of the Citya Attorney and recorded with the Final Plat,
27.08 `buration pfApproval. Approval of the Final Plat may become
null and void if the plat is not recorded within ninety (90) days of
the City Council's (Riverdale, Iowa) approval. After the ninety (90)
days, the Chairman shall place on the agenda of the Planning and
zoning Commission the Final Plat to consider whether It should be
nullified or granted an extension. The subdivider shall be notified
of the hearing and provided time to explain why the Final Plat was
not recorded within the ninety (90) days. After a hearing, the
Commission shall recommend to the City Council to either nullify
or extend the recording time for the Final Plat. The City Council
shall review the recommendation and act to either nullify or grant
an extension.

We hereby establish in favor of the City of Riverdale (hereinafter "City"), upon application of and for the
account of. Woods Construction and Development, Inc., 309 Madison Dr, Bettendorf, IA 52722,
Attention: Seth Woods, President (hereinafter "Woods") this irrevocable letter of credit (hereinafter
"Letter of Credit") in the amount of $2,371,000.00 (which is the "Maximum Available Credit"), subject to
reduction as hereinafter set forth.
This letterof credit is issued with respect to: guaranteeing the completion of public improvements
within and related to a subdivisionof land in the City of Riverdale, Scott County, Iowa, known as. "Woods
Estates of Riverdale Second Addition", dated March 13, 2020 and stamped by Dan J. Kuehl, Iowa
Professional Land Surveyor, License No. 19959 (hereinafter "Second Addition Plat"). Specifically, the
improvements subject to this. Letter of Credit are for the completion,of the public improvements to
Phase 3. The public improvements are those improvements which will be dedicated to and become the
property of the City upon their acceptance by the City Council including the road and infrastructure
associated with Phase 3.,
This Letter of Credit is submitted in lieu of a performance or surety bond, which is so stipulated in Article
IV, "Bonding and Assessment Waivers"., Section 40 of the Subdivision Ordinance of the City, as a
requirement for approval of therecording of a subdivision plat, and shall be submitted and maintained
in anamount equal to the cost of the public improvements required for completion of Phase 3.
With the intention of reducing the MaximumAvailable Credit as the public improvements are
completed by Woods, all advances will be reported to city along with an accounting of remaining work
to be completed, and with the approval of the City Engineer, and the approval of the City Council by

Resolution, we may reduce the Maximum Available Credit by that amount, in the manner set forth
herein. The Letter of Credit will be maintained at 125% of the remaining work to be completed.
In the event Woods does not complete the public improvements so as to allow building permits or
occupancy permits to be issued to houses to be constructed or constructed in Phase 3, or he fails to
complete grading, erosion control, or the public improvements as required, upon recommendation by
the City Engineer, the City Council shall cause Woods to be sent notice of the deficiency by mail at his
address of notification. If. Woods does not respond to remedy the deficiency within the time established
by the Council in its notice, the City Council may request a draw upon the Maximum Available Credit.
The Maximum Available Credit or a portion thereof shall be paid upon presentation -of the following
documents:
1 A signed certificate, dated not more than ten days prior to its presentation to us, signed by the
Mayor and attested by the City Clerk.
2 The description of the deficiency or deficiencies of the grading, erosion control or the Public
Improvements which have not been completed or are not to specification, according to the
Construction Plans.

the amount demanded shall be made in immediately available funds not later than 1:00 p.m. on the
next succeeding Business Day.
Payment under this Letter of Credit shall be made of immediately available funds by certified bank
check, wire transfer or as agreed by. the City of Riverdale City Clerk/ Treasurer.
Only the City of Riverdale, by its City, Clerk / Treasurer or their designee may make drawings under this
Letter of Credit.; Upon payment as provided above of the amount specified hereunder, the Maximum
Available Credit of the Letter of Credit shall be reduced by the amount of the payment.

If demand for payment does not conform to the terms and conditions of this. Letter of Credit,'wewill
promptly notify you thereof and of the reasons thereof, such notice to be promptly confirmed in writing
to you, and we shall hold all documents at your disposal or return the same to you, if directed by you.
This. Letter of Credit is effective immediately and shall not expire (i) until the completion of the public
improvements and the dedication, of the public rights -of -way related to Phase 3 of Woods Estates of
Riverdale and their acceptance by Resolutionof the City Council of the City of Riverdale; or, (ii) when
you have drawn and we have paid to you the^Maximum Available Credit to the City of Riverdale; or (iii)
when all public improvements to Phase 3 are complete as specified, the City's Engineer agrees and upon
their recommendation, the City Council has, approved and accepted all public improvements by Council
Resolution, and all requirements of the City's Subdivision Ordinance have been fulfilled, and the Mayor
so attests; or, (iii') after 12 mohths of the date of issuance but will be automatically extended for
additional consecutive one year terms if you have not received by certified mail notification of our
intention not to renew 30 days prior to the original expiry date and each subsequent expiry date; At
such time as (i), (H) or (iii) above have been fulfilled, any funds remaining of the Maximum Available
Credit shall be released by the City Council and this Letter of Credit shall expire.
This Letter of Credit is governed by the Uniform Customer and Practice for Documentary Credits, 2007
Revision, International Chamber of Commerce. Publication No. 600 (UCP), of any later version or
amendment.

MSA has received and reviewed the revised plans for the aforementioned project dated July 23, 2021.
Based upon our understanding of the resolution of some of our previous comments (see Meeting Minutes
dated July 7, 2021) and our review of the current plans, we find that our comments have been addressed.
Therefore, MSA recommends the City of Riverdale find the plans for this project acceptable.
MSA has received and reviewed the revised plat for the aforementioned project dated July 22, 2021.
Based on our review of the plat, we find that our comments have been addressed. In addition, the
comment from the City's Planning and Zoning Committee that the difference in the side setbacks for
different lots within this project be noted on the plat has been addressed in Note Number 4 on sheet 1 of
3 on the plat.
Therefore, MSA recommends the City of Riverdale find the plat for this project acceptable.

A RESOLUTION TO ALLOCATE FUNDS FOR THE MAYOR'S TRIP TO THE
MISSISSIPPI RIVER CITY AND TOWNS INITIATIVE
WHEREAS, the City Council of the City of Riverdale, Iowa must approve the allocation of funds
for travel costs, and;
WHEREAS, Mayor Michael Bawden is a member of the Executive Committee of the Mississippi
River Cities and Towns Initiative and will be representing the City of Riverdale and the State of
Iowa at the meeting held in Baton Rouge, Louisiana from September 13-16, 2021 with national
legislators and key administration officials on matters related to flood relief and recovery,
stormwater management and transportation infrastructure, and;
WHEREAS, among the issues to be discussed at this meeting a cooperative approach to
stormwater management of the drainage way off of Fieldcrest involving the City of Bettendorf and
other federal agencies that may be able to provide technical and/or financial assistance, and;
WHEREAS, Mayor Michael Bawden will also be among a delegation of mayors meeting with
Senator Jodi Ernst (tentatively) and leadership from the U.S. Army Corps of Engineers, FEMA
and EPA.
WHEREAS, the estimated costs for attending the conference include parking at the Quad City
Airport, meals while in transit, Uber/cab fare in Baton Rouge, Louisiana, Hotel and Airfare. Actual
expenses (documented with receipts) will be billed to the City and costs will not exceed $1,400.00.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE,
IOWA
The City Council of the City of Riverdale, Iowa hereby authorizes the reimbursement to Mayor
Michael Bawden for the expenses incurred while representing the City of Riverdale and State of
Iowa at the MRCTI trip

We are back! After hosting the last two meetings virtually, we are pleased to announce the MRCTI Executive
Committee has unanimously voted to gather live and in -person for Baton Rouge's 300th Anniversary this
September 14-16.
Recovery of the Mississippi River Corridor is strong. After the 2019 floods followed by a global pandemic,
our corridor has certainly been tested, but our Mayors have showed epic leadership in working collectively to
move and keep the region intact —ready to build -back -better.
Capstone the recovery of your city with us in Baton Rouge. The American Rescue Plan is stabilizing our
budgets, the vaccine is rolling out smoothly, earmarks are back, and now we're poised to realize significant
investment in restoring our infrastructure —join us in Baton Rouge to ensure your city is taking advantage of
all the resources becoming available; and place your town in a proactive position to take advantage of new
opportunities developing.
Mayors from ten states will gather with industry, federal leadership, and global investors. The MRCTI An-
nual Meeting begins on September 14 with a special infrastructure summit with industry leaders, global in-
vestors, and federal agencies. We then proceed through September 15 and 16 featuring discussions with
parks organizations, state emergency managers, and land management specialists to unveil how Mayors can
participate in and benefit from corridor -scale disaster protection partnerships.
Major announcements will take place on September 14, 15, and 16. Our Infrastructure Summit on Septem-
ber 14 will include announcement of a tremendous new resource for our Mayors; during the Annual Meeting
press conference on September 15, Mayors will reveal the potentially transformative results of our plastic
waster initiative pilot; and on September 16, MRCTI will elect new co-chairs and executive committee.

The water quality of Scott County's streams, lakes, and rivers directly contributes
to the human health and wellbeing of the County's citizens and it's ecosystems;
and
the water quality of our streams directly contributes to the quality of our drinking,
recreation, and fishing waters; and
since 2003 Partners of Scott County Watersheds has been at the forefront of
monitoring water quality in Scott County and is the only organization organizing
monitoring events in the county; and
Partners of Scott County Watersheds' has engaged thousands of community
volunteers to participate in Snapshot water quality monitoring and education
events; and
The City of Riverdale recognizes that the Environmental Protection Agency
founded National Water Quality Month in 2005 to promote conservation of our
natural water resources.
