AT THE COMMUNITY CENTER PRESENT: Chairman Jerry Hansen, Board members Brain Stutzman, Adrian Beazer, Secretary Betty McKinlay VISITORS: Dennis and Linda McArthur, Joshua Baird, Jackson Stearman, Samuel Cooper, Jake Santana, Daniel Gubler, Eric Seneff Chairman Jerry Hansen called the meeting to order and the Pledge was led by Jerry Hansen. The Commission reviewed the Minutes from the previous month's meeting. Brian Stutzman approved the Minutes and Jerry Hansen seconded. Dennis McArthur had applied for a Conditional Use Permit to have an apartment in the basement of his home. Brian Stutzman explained to the citizens what a Conditional Use Permit is and the conditions that need to be followed. Eric Seneff said he feels that Dennis needs to live up to his agreement. As long as Dennis is living there and not making two apartments out of his home Mr. Seneff is okay with it. Mr. Seneff wants that stipulation put in the Conditional Use Permit. He just does not want two rentals. If he sells the property the Conditional Use Permit is not transferable. The Conditional Permit is a guideline as to what Dennis has to live with. If Eric feels that Dennis has not lived up to the guidelines in the permit then Eric can come back to the Planning and Zoning and voice his concerns and terminate it. Dan Gubler asked if Dennis was being charged for two separate water bills. He is not at this time but will be charged when he rents it. Brian Stutzman explained that the Planning and Zoning Commission make a recommendation and then it goes to the City Council for the final approval. Eric Seneff had concerns about Dennis getting the cart before the horse. It is not zoned for an apartment. Dennis had his family living there while they were building their homes. He would just like to rent out the basement now. A discussion followed. Eric was satisfied along as he followed the stipulations as mentioned earlier. Brian Stutzman mentioned that we might want to get with the attorney and write up a document that goes with the deed, so if the property does come up for sale then the document will need to be looked at. Brian Stutzman motioned to make the recommendation to the City Council for Dennis McArthur to go ahead. Adrian Beazer seconded. It will be presented to the City Council Tuesday, March 11t' at 7:00 p.m. The City Council will make the final decision. Adrian discussed the Environmental Impact area. He still has not found a suitable map. The Commission discussed the impact area and where to go to get a map. Adrian will get it drawn up to present to the City Council on March 11t. Dan Gubler said he knows Steve Serr and will talk to him about a map. Dan feels the Commission needs to talk to the County about the road that will go in when the development on the hill starts. A Code Enforcement Officer was discussed. Brian said "We could form an Iona Legion. I just got through reading about the Nauvoo Legion". Dan feels Police Officer SanDee Knowles just needed more support from the Council and the P/Z. Jerry asked to have some help in writing up the proposals to recommend to the City Council and he will present it to the Council on March 11 t. Meeting was adjourned at 9:05 p.m.
