The regular meeting of the City Council of Riverdale, Iowa will be conducted according to the
following order and actions will be considered on the items listed. The notice of this meeting is
not considered final until 24 hours prior to the meeting and may be further modified if 24 hours'
notice is impossible or impractical for good cause.
In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and
state laws, all public hearings and meetings held or sponsored by the city of Riverdale, IA will be
accessible to individuals with disabilities. Persons requiring auxiliary aids and services should
contact City Hall at (563) 355-2511 five (5) days prior to the hearing or meeting to inform of
their anticipated attendance.
The requirement that an Ordinance be read three times before passage may be waived by
council upon an affirmative vote of four (4) of the five (5) council members. The public is
advised to take note of this process and be prepared to speak either for or against any ordinance
at the time of first reading.
Per Chapter 21 of the Iowa Code, more specifically described in sections 21.2 and

NOTICE IS HEREBY GIVEN A public hearing to award the project will be held at 6: coo
p.m. on the 14th day of SEPTEMBER 2021, at CITY OF RIVERDALE CITY HALL
COUNCIL CHAMBERS, 110 MANOR Dr, Riverdale, Iowa 52722. The meeting agenda will
be available at https://riverdaleiowa.com
Comments from citizens will be heard at the hearing. Written comments must be filed at
the City Clerk's Office no later than 4:00 p.m. on Tuesday, September 14th, 2021.

3. Newsletter
Went out on August 31St. We are continuing to look for ways to improve it.
4. Fenno Dr
Finally, Iowa -American started Fenno on September .7th. Hawkeye Sewer started
with the water connections under Valley Dr and are working their way up the hill.
The issue this week was traffic patterns.
5. Seal Coating Fenno Rd.
I have asked for an addendum to the contract with Iowa American Water to seal
coating Fenno Rd. I would look for that to be on the agenda on the September 28th
meeting.

6. Le Claire Fire Department Memorial (per Fire Chief)
The LeClaire Fire Department's 9/11 remembrance procession will be stopping
here around 3:45 this coming Saturday. They will have a commemorative flag,
and a piece of the Twin Towers that will be installed at their memorial. They will
only be here for a short time. They are stopping at every city in area before
heading back to Le Claire for the memorial ceremony.
7. Coyote Update (per Jason Harkness)
With the uptick in Coyote sights, I asked for update.
To the residents that have recently spotted coyotes in Riverdale, we wanted to give
you all a summary of this year's activities. We deployed cameras for 2 weeks on
the Woods property. We then deployed traps on the Woods property. Two days
after that, we were made to pull the traps. If that hadn't happened, there would be
no coyote sightings right now. We had to then go to where we had access and the
coyotes were frequenting. That is at the property the tower sits on. That property
is currently covered in soybeans. Those soybeans will not be out until the first
week of November. The entire process of deploying cameras and then equipment
will have to start again per the protocol for safety. We have obtained permission to
trap on that property and a private citizens property on the Bettendorf side. Those
are the same coyotes that are being sighted in Riverdale and were on the Woods
property. Our proposal was to trap on the Woods property. Through no fault of
our own, that plan was killed immediately before coyote removal began. We are
committed to catching them and are unfortunately bound by the situation.
As an aside, two foxes were trapped and released in those two days before the
coyote trapping had a chance to be successful.

9. Resolution 2021-39 A Resolution Temporarily Opening the Locked
Gate Between the Mississippi River Trail (MRT) and Kensington Street
on the City of Riverdale's Property.
This resolution is up for your consideration because of the request from My Place
and Tour de Brew organizers. We have sent letters out to all residents of Riverdale
for their input regarding this issue.

Construction Contract for the Joint Sanitary Sewer Rehabilitation
Project
This project has a couple of interesting pieces that you should keep in mind as the
year progresses. First, is Manor Hill Drainage issue should be fixed. The other is
the Bellingham manhole that needs to be repair. These two -side projects are
included in this proposal.
11. Resolution 2021-42 A Resolution Authorizing the City Administrator
to Solicit Multi -year Quotes for Snow and Ice Management Services for
Streets and Public Areas for the City of Riverdale, Iowa
Well, here we are once again. The current contractor is having staffing issues and
is no longer able to service the City of Riverdale. I am moving quickly on this RFP
process.
12.Resolution 2021-43 A Resolution Establishing City of Riverdale's Bow
and Arrow Deer and Coyote Hunting Rules and Regulations for the
2021-2022 Season
The key point is the City of Bettendorf is taking over the administration and the
oversight of the hunt. The administration and oversight of the last hunt in
Riverdale was performed by Kingsley.
13. Resolution 2021-44 A Resolution Establishing Riverdale, Iowa's
Tobacco Free and Nicotine Free
At our last meeting we discussed placing this resolution on the agenda. Staff
drafted a resolution for your consideration. Enforcement in our community will be
always be an issue. The Resolution does not establish a penalty. And, attempts to

SANITARY SEWER REHABILITATION PROJECT— PHASE 2
A Review of MSA Projects in Your Community
City of Riverdale, IA
The apparent low bidder is Visu-Sewer. It appears that the Riverdale contract with Visu-Sewer
will be for about $190,000. MSA made an error on the quantity of bollards. Therefore, the City
will have to execute a change order for one additional bollard after the Contracts are executed.
It is MSA's understanding that Public Hearing will be held prior to the September 14, 2021 City
Council Meeting for purposes of awarding a Contract. The City of Panorama Park is also holding
their public hearing the same date.
WOODS ESTATES - ADDITION 3
MSA has sent a final invoice to the City for this project.
WOODS ESTATES EMERGENCY ACCESS ROUTE
MSA met with Fire Chief Chris Bernard and Administrator to discuss an alignment in the area of
some aging and failing oak trees. MSA is coordinating a tie in location with RTM Engineering.

RESOLUTION 2021-39
A RESOLUTION TEMPORARILY OPENING THE LOCKED GATE BETWEEN THE MISSISSIPPI RIVER
TRAIL (MRT) AND KENSINGTON STREET ON THE CITY OF RIVERDALE'S PROPERTY
WHEREAS, The City of Riverdale, Iowa ("City") is a Municipal Corporation, organized and
operating under the laws of the State of Iowa; and
WHEREAS, the owner of a local business (My Place) and the organizer of an annual
event (Tour de Brew) are asking the City of Riverdale to consider unlocking and
opening the gate between the Mississippi River Trail and the City's property at the south
end of S. Kensington Street to allow riders to use the neighborhood street to connect
between the Mississippi River Trail (MRT) and Duck Creek Bike Trail (DCBT); and
WHEREAS, petitioners are requesting the gate be open from 10:30am to 4:30pm on
Saturday, October 2, 2021; and
WHEREAS, unlocking the gate for this special event would be a modification of the
City's current policy with regard to when circumstances might warrant the opening of
the gate and permitting foot, bike or vehicular traffic from the MRT to South Kensington
Street (and vice versa); and
WHEREAS, modifications to established policies of the City require consideration and
consent of the City Council of the City of Riverdale.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA,
Section 1. That the City's current policy regarding the circumstances allowing for the
gate between the MRT and South Kensington Street shall be modified to allow for the
unlocking and opening of the gate between the hours of 10:30 am and 4:30 pm on
Saturday, October 2, 2021. After the designated time, the gate shall be closed and re -
locked, in accordance with City policy established in Resolution #2020-49 (attached,
Exhibit "A").

WHEREAS, The City of Riverdale, Iowa ("City") is a Municipal Corporation, organized and
operating under the laws of the State of Iowa, and;
WHEREAS, residents of the City have expressed concern with bicycle and pedestrian
traffic in Haven's Acres since the Mississippi River Trail was extended through the City
and in several open meetings from January 2018 to present; and,
WHEREAS, Kensington Street is not a designated bicycle or pedestrian trail, nor is there a
designated bicycle or pedestrian lane of travel, nor is there a sidewalk; and,
WHEREAS, bicycle and pedestrian traffic on Kensington Street between the Mississippi
River Trail and the Duck Creek Bike Path trailhead represents a safety hazard (ref.
EXHIBIT "A"); and,
WHEREAS, the residents of Haven's Acres have expressed overwhelming support of the
installation of a locked barrier between the Mississippi River Trail and Kensington Street
(ref. EXHIBIT "B"); and,
WHEREAS, a temporary barrier has been erected at said location, and the City is in the
process of installing said barrier; and,
WHEREAS, per the City's attorneys, the City is within its legal rights to install a locked
barrier on its own property; and,
WHEREAS, per the City's attorneys, there is no violation of the Americans with Disabilities
Act for said locked barrier to be installed; and,
WHEREAS, it is not a violation of City ordinance, or state or federal law, to install said
locked barrier.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA,
Section 1. That the current temporary barrier at the intersection of Kensington Street
and the Mississippi River Trail on the City's property shall remain intact and not removed
aside from an emergency situation in which emergency vehicles need to enter Haven's
Acres via the Mississippi River Trail.

A Resolution Setting a Standard of a Locked Gate between the Mississippi River
Trail (MRT) and Kensington Street on the City of Riverdale's Property
Section 2. That if an emergency situation occurs and the temporary barrier must be
taken down, that, at the conclusion of the emergency, or as soon thereafter as can
reasonably be expected, the temporary barrier will be reinstalled to the same
specifications as it was when it was taken down.
Section 3. That once installed, permanent gates at the intersection of Kensington
Street and the Mississippi River Trail on the City's property shall be set and kept in a
locked position.
Section 4. That the locks on said gates will be accessible for emergency personnel
only and only in the event of an emergency in which emergency vehicles need to
enter Haven's Acres via the Mississippi River Trail.

A RESOLUTION AUTHORIZING EXECUTION OF A CONSTRUCTION CONTRACT FOR THE JOINT
SANITARY SEWER REHABILITATION PROJECT WITH PANORMA PARK
WHEREAS, the City of Riverdale, Iowa ("City") is a Municipal Corporation, organized and
operating under the laws of the State of Iowa;
WHEREAS, the City Council has properly advertised for and accepted bids for the Joint
Sanitary Sewer Rehabilitation project; and;
WHEREAS, the City's Engineering Firm MSA and Engineer Chris Cooper have reviewed
the bids and found the three bidders to be qualified, responsible bidders, and;
WHEREAS, the City Council has determined it is in the best interest of the community to
approve the lowest bid from Visu-Sewer in the amount of $189,427.55.
WHEREAS, work is commence. in November of 2021 and end in April 2002; and
NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Riverdale, Iowa
authorizes the Mayor, Clerk and City Administrator to execute contract documents and
proceed to complete the Joint Sanitary Sewer Rehabilitation project with Visu-Sewer in
the amount of $189,427.55.

endorsing and pledging support for Emma Hupp's Eagle Scout rank through Scouts BSA
and;
WHEREAS, Emma Hupp has proposed placing three flagpoles at Riverdale City Hall
located at 110 Manor Drive ("project"), Riverdale and;
WHEREAS, Emma Hupp has requested financial support from the City of Riverdale City
Council and;
WHEREAS, City Council realizes that this project benefits the Community;
WHEREAS, the project honors veterans, the Riverdale Volunteer Fire Department and
others who have served and;
WHEREAS, the City Council will provide a location at 110 Manor Drive, Riverdale, Iowa
and monetary support not to exceed three thousand dollars ($3,000.00) and;
WHEREAS, the City of Riverdale and Emma Hupp would like to see this project completed
on Veterans Day 2021; November l I 1 and;
WHEREAS, the City Council will provide planning and any expertise as requested by Emma
Hupp and;
WHEREAS, Emma Hupp will serve as Project Manager, fundraiser and point of contact for
all questions, and recruitment of volunteers;

WHEREAS, the City Council of the City of Riverdale, Iowa ("City") is desirous of providing
for snow and ice management services for its streets and public ways by multi -year
contract and;
WHEREAS, Council member Anthony Heddlesten has prepared a first draft request for
proposals document for further development collaboratively with the City Administrator
and others and;
WHEREAS, It is imperative that the City Council be provided with proposals for snow and
ice management for its streets prior to the beginning of the winter season.
NOW THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF RIVERDALE,
SCOTT COUNTY, IN THE STATE OF IOWA:
Section 1. That the draft request for proposals ("RFP") is attached to this resolution for
the purpose of information only and that the City Administrator and Council member
Heddlesten shall refine the RFP and advertise it according to City policy and law and
obtain quotes as expediently as possible.
Section 2. That pending approval by the Council, and completion of the final draft
of the RFP, the City Administrator shall advertise for and seek quotes to return to the
Council for their future consideration.

A RESOLUTION ESTABLISHING THE CITY OF RIVERDALE'S BOW AND ARROW DEER
AND COYOTE HUNTING RULES AND REGULATIONS
2021-2022 SEASON
WHEREAS, Bow and arrow deer and coyote hunting is allowed in the City of
Riverdale during the period from September 18, 2021 through January 10, 2022,
in areas of that City of Riverdale that are designated as a 'Special Hunt Area'
by the Iowa DNR; and,
WHEREAS, Each hunter must comply with the Iowa Department of Natural
Resources (DNR) regulations covering bow hunting of deer and coyote as well
as the City of Riverdale deer and coyote hunting rules and regulations outlined
below; and,
WHEREAS, The hunter must:
1. Obtain a Riverdale Hunting Permit (cost $0);
2. Successfully complete an Iowa Department of Natural Resources bow
h-unter safety education course and a proficiency test. The proficiency test
most be taken annually;
3. Hunt on a parcel zoned agricultural or divided in a parcel of not less than
three acres, obtain the expressed permission of the owner of the parcel,
and follow the rules and guidelines of the property owner. Council may
approve on a case by case situation properties of less than 3 acres;
4. Maintain a minimum distance of 100 yards from any residence, occupied
building, church, city park, street and/or roadway, other municipal
property, or school property {exclusive of Scott Community College
property, where the hunter must maintain a minimum distance of 100 yards
from the College's buildings and parking lots), except with the permission
of an owner of a residence or occupied building to allow hunting nearer
than 100 yards of said building.
5. Hunt during the hours and days when such hunting is allowed by State or
City of Riverdale for the Bettendorf/Riverdale Special Deer Management
Zone. Hunters must abide with state, county and City laws and regulations.

In addition to Riverdale's Resolution 2021-44 hunters will use the Bettendorf
rules and regulations for the Bettendorf and Riverdale hunting areas.
6. Use proper field dressing techniques and not leave entrails;
7. Possess all licenses or permits required by the State, County, or City to hunt
deer with a bow;
8. Demonstrate compliance with these requirements to any police or DNR
officer upon request; and
9. Harvested deer will be checked in at Spruce Hills Dr. Bettendorf Are Station
AFTER 7:30 AM and BEFORE 9:00 PM.
10.Only IA DNR Deer Management Zone licenses will be allowed. (Note:
Statewide licenses are invalid); and,
WHEREAS, the City of Bettendorf Police Department will provide deer hunting
services for the City of Riverdale this year past and will provided satisfactory
service; and,
WHEREAS, City of Bettendorf Police Department will provide the City of Riverdale
with its expertise and administration of the 2021 - 2022 season, again at no
charge.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
RIVERDALE, SCOTT COUNTY, IN THE STATE OF IOWA:
Section 1. Through participation in the bow and arrow season, the City of
Bettendorf agrees that the property owner and/or the City of Riverdale are not
liable for stolen deer stands or other equipment and items. The hunter agrees to
hold harmless, indemnify and defend the property owner and/or the City of
Riverdale in any action or claim resulting from participation in the bow and
arrow season in the City of Riverdale.
Section 2. Any violation of the agreement may result in the revocation of
permits and/or criminal charges under state and local law, as appropriate.
Hunters are encouraged to have a safety plan in case of emergency.
Section 3. These rules and regulations may be amended or modified by
further resolution of the City of Riverdale at any time.

I apologize for any confusion or inconvenience the incident on Monday may have caused. I
took over as the administrator of the "Urban Deer Hunting Program" for the Bettendorf Police
Department in February and I am still trying to learn all the processes. I assumed that the
established hunting zone (#32) in Riverdale was managed the same as the zones that are located
in Bettendorf I sent Mr. Britton to the Riverdale City Hall in order to gain written petuuission
from you or your staff. I did not intend to cause any conflicts, I believed I was following the
proper procedures.
I have had a lengthy conversation with Chief Kimball regarding how to proceed in the future. If
it is acceptable to you I will follow these protocols:
• Register hunters interested in harvesting deer from zone #32 (see attached map).
o Be cognizant to restrict the number of hunters based on the acreage available in
relationship to neighboring residences.
o The City of Bettendorf will notify neighboring residences via mail of the "Urban
Deer Hunting Program".
• Ensure that each registered hunter follows the rules outlined in the "Regulations for Bow
Deer Hunting within the City of Bettendorf' (see attached document).
o I will conduct a site visit to ensure that each deer stand is positioned in a
location/manner that is safe.
• I will track and submit the statistics of harvested deer to the Iowa Department of Natural
Resources (DNR).
Lastly, I will maintain an open line of communication with you regarding the identity of each
hunter who is granted permission to hunt within the City of Riverdale. I will also submit the
statistics of harvested deer to your office.

This letter is an update on the 2021/2022 Deer Management Zone Hunt within the city limits of
Bettendorf.
The Iowa Department of Natural Resources has made available 125 antlerless deer licenses for
archery only, from September 18, 2021 through January 10, 2022, for the cities of Bettendorf
and Riverdale. Antlerless deer licenses may only be purchased at B & B Shooting Supplies
located at 2152 State Street in Bettendorf or R & R Sports located at 3250 Fields Drive in
Bettendorf.
Each antlerless deer harvested must be checked in at the Bettendorf Fire Station located at
1933 Spruce Hills Drive, no later than 9 p,m. This includes deer harvested in the City of
Riverdale. Parking is available in the east parking lot next to the alley. DO NOT PARK IN
FRONT OF THE BAY DOORS. If fire personnel are unavailable, please call Bettendorf Police
Dispatch at 344-4015, select option 9. Dispatch will radio a police officer to respond to the fire
station.
The City of Bettendorf will issue a check for $20.00 to each hunter for every antlerless deer that
is harvested in Bettendorf/Riverdale and checked at the Spruce Hills Fire Station.
All city regulations must be followed to hunt within the city limits of Bettendorf and Riverdale. A
copy of those regulations can be obtained at the Bettendorf Police Department, Riverdale City
Hall, B & B Shooting Supplies, or R&R Sports.
The Iowa Department of Natural Resources is also recommending an `Either Sex Incentive
License' for the 2021/2022 hunting season. If you decide to take the $20.00 incentive from the
City of Bettendorf, you will not be eligible for the any sex tag incentive for the 2022/2023
season.
The City of Bettendorf appreciates your assistance in helping thin the deer herd population
within our city. The increasing deer population is a problem that cannot be solved without your
effort and support.

Regulations for Bow Deer Hunting Within the City of Bettendorf
> All hunters, hunting on private property not owned by that hunter and/or property owned by the
City of Bettendorf must obtain a 'Land Owners Permission to Hunt' form from the Bettendorf Police
Department. Submit the completed form to the Bettendorf Police Department, The Bettendorf Police
Department will then issue a `Permission to Hunt Urban Deer' form to take to B & B Shooting Supplies
or R&R Sports where a proficiency exam will be performed. Upon successful completion, a permission
to hunt card signed by the Chief of Police will be issued and license sold by B & B Shooting Supplies or
R&R Sports.
Each urban deer hunter must give contact information to the Chief of Police or his designee.
> Neighboring property owners will be notified by the Police department that deer hunting will be taking
place in their area.
If objection to hunting is received by an adjacent property owner, the deer advisory committee will
review the request to hunt.
> Certain hunting areas may have a time restriction of when hunting is allowed.
> All hunting areas will have a sign posted, provided by the Police department, that bow deer hunting is in
progress.
> All deer must be checked at the Spruce Hills Fire Station no later than 9:00 p.m. If after 9:00 p,m.,
contact the Bettendorf Police Department at 563/344-4015.
> No obvious remains of harvested deer shall remain at site of hunt.
> If deer is shot with arrow and flees into residential or commercial area, notify Chief Kimball at
563/320-6187.
> When tracking a shot deer in darkness, hunter must use a flashlight.
> When tracking a shot deer, hunter must wear a reflective vest.
> If deer is located after tracking, and deer has fallen on a residential or commercial property, an attempt
to notify the property owner, prior to removal, must be made. If unsuccessful, a door hanger must be
placed on door with hunter's information.

A RESOLUTION ESTABLISHING RIVERDALE IOWA'S PARKS TOBACCO FREE AND NICOTINE
FREE
WHEREAS, The City of Riverdale, Iowa ("City") is a Municipal Corporation, organized and
operating under the laws of the State of Iowa; and;
WHEREAS, the City of Riverdale, Iowa maintains public parks and facilities for the use
and employment of its citizens, their families and people who visit our community, and
wants those who use our parks to get the maximum enjoyment and benefit for its use;
WHEREAS, the use of tobacco, nicotine products in the presence of, and in proximity to,
those utilizing these parks, particularly children, serves to diminish the enjoyment derived
from the use of our public parks;
WHEREAS, the use of tobacco and nicotine products in public parks presents various
health risks to persons using the parks, including the dangers of secondary smoke and
the discarded material which can be handled and ingested by children;
WHEREAS, it is the believe that all citizens should be good role models for those children
to see adults publicly enjoying the parks without the use of tobacco products;
WHEREAS, the City of Riverdale has administrative protocols in place at all indoor
recreation facilities, and spectator areas in outdoor facilities, which comply with the
Iowa Smoke Free Air Act;
WHEREAS, the prohibition of tobacco and nicotine use at the City's recreational
amenities serves to protect the health, safety, and welfare of the citizens engaging in or
watching outdoor recreational activities at City -owned or operated park grounds.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA,
Tobacco and nicotine use, including but not limited to cigarettes, cigars, chewing
tobacco, snuff, pipes, snus, Electronic Smoking Devices, (ESD) and nicotine products
that are not Food and Drug Administration (FDA) approved for tobacco cessation, is
prohibited on these listed city -owned, outdoor recreational facilities and parks at all
times, by all people: Bicentennial Park, Volunteer Square Park, VanGundy Park, Peggy's
Park, and the Bellingham Parking Lot.
BE IT RESOLVED that any person violating this policy will be instructed either to
discontinue the use of tobacco products on the property or to leave said property. If
the person fails to discontinue the use of tobacco and nicotine products or leave the
fir
property, then said person's right to be present on said property will terminate and a
trespassing or violation/complaint can be made to law enforcement.
Enforcement:
A) Appropriate signs shall be posted in appropriate areas.
B) The community, especially users and staff or park grounds, will be notified
about this policy.
C) City officials, city employees, parents, coaches, volunteers, and citizens of the
community are asked to help enforce compliance.
D) Any person found in violation will be asked to refrain from tobacco, nicotine,
or ESD use or will be asked to leave the grounds.
E) If the violator refuses to leave, the staff may contact local authorities.
