The regular meeting of the City Council of Riverdale, Iowa will be conducted according to the following order and actions will be considered on the items listed. The notice of this meeting is not considered final until 24 hours prior to the meeting and may be further modified if 24 hours' notice is impossible or impractical for good cause. In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state laws, all public hearings and meetings held or sponsored by the city of Riverdale, IA will be accessible to individuals with disabilities. Persons requiring auxiliary aids and services should contact City Hall at (563) 355-2511 five (5) days prior to the hearing or meeting to inform of their anticipated attendance. The requirement that an Ordinance be read three times before passage may be waived by council upon an affirmative vote of four (4) of the five (5) council members. The public is advised to take note of this process and be prepared to speak either for or against any ordinance at the time of first reading. Per Chapter 21 of the Iowa Code, more specifically described in sections 21.2 and 21.8, a member of the Council may attend the meeting either in person or by electronic means, as defined in said sections. 1. Kent Royster gave an over view of the project. Visu-Sewer won the bid at $189,427.55. The money for this project is already in the budget. Littrel made a motion to close the public hearing and was seconded by Heddlesten. Roll Call: All Ayes. MC. The hearing was closed at 6:22pm. 3. Grants List of opportunities that I am attempting to complete: A) Derecho Tree Replacement through the IADNR. B) RDA Grant for Fire Equipment 2. Fenno Dr Two issues came up this week. First, is we found a storm sewer that the city didn't know it had. It is across the street from the project area. And it is full of rock and was cleaned out on Friday September 24th. We will be invoicing Iowa American Water for this expense. The second issue is connecting Fenno Dr to Fenno Rd watermains. The contractor will need to close the intersection on September 27th and September 28th. The southside of Fenno Rd will be closed on September 27th. And the northside of Fenno Rd on the September 28th. The northside is more problematic. However, the residents will be able to move freely. 3. Meeting with Frank Grage and Randy Moore The analysis for possibility for the sale of the City's sanitary sewer collection system will NOT be completed for 6-7 months. We published and sent out RFPs for snow plowing. We received three quotes back. Murfs Turf, S & R, and Holst Trucking. Murfs Turf was the lowest bidder. As part of the RFP the City requested that the contractor stop by City Hall so we could clarify the routes, set expectations, and open a dialogue. Murfs Turf did that. I am hopeful that this contractor will be able to a good job for us. If you wish to set-up a meeting with the contractor, I will be glad to do that. However, at this time I recommend awarding the contract to Murfs Turf. The zone captain will ensure each hunter for that zone is listed on the completed permission form submitted to the Bettendorf Police Department. The Bettendorf Police Department will then issue a 'Permission to Hunt Urban Deer' form to take to B & B Guns where a proficiency exam will be performed. Dangerous Weapon Defined: A dangerous weapon is any instrument or device designed primarily for use in inflicting death or injury upon a human being or animal, and which is capable of inflicting death upon a human being when used in the manner for which it was designed, except a bow and arrow when possessed and used for hunting or any other lawful purpose. Additionally, any instrument or device of any sort whatsoever which is actually used in such a manner as to indicate that the defendant intends to inflict death or serious injury upon the other, and which, when so used, is capable of inflicting death upon a human being, is a dangerous weapon. Dangerous weapons include, but are not limited to, any offensive weapon, pistol, revolver or other firearm, dagger, razor, stiletto, switchblade knife, knife having a blade exceeding five inches (5") in length, or any portable device or weapon directing an electric current, impulse, wave, or beam that produces a high voltage pulse designed to immobilize a person. 2. Underage Persons: a. No person shall sell, give or otherwise supply dangerous weapons, as defined in subsection Al of this section, to any person, knowing or having reasonable cause to believe that person to be under eighteen (18) years of age, and no person under eighteen (18) years of age shall individually or jointly possess or control a dangerous weapon. b. Nothing contained herein shall be deemed to prevent possession of dangerous weapons by a person under eighteen (18) years of age while in the home with the consent of that person's parent or guardian, nor shall it be a violation of this section to possess a dangerous weapon in conjunction with martial arts training, when such possession is limited to a properly licensed martial arts school or facility and when the person's parent or guardian has given written authorization to participate in such training. - 3. Penalty: The penalty for violation of this subsection A shall be as provided in section 1-4-1 of this code for each violation. Additionally, any use in violation of this section is hereby declared a public nuisance, and may be abated in any manner consistent with law. (2008 Code § 19-16; amd. 2015 Code) B. Discharge Of Weapons And Projectiles: 1. Prohibited Acts; Exceptions: It shall be unlawful to: a. Discharge any cannon or firearm of any description without first having obtained permission in writing from the mayor, unless the person discharging the firearm is a peace officer acting pursuant to the duties of his office. b. Discharge or propel any object by means of an air or spring loaded gun, slingshot, blowgun, bow or crossbow. c. Throw any stick, stone or other object at a vehicle, residence or auxiliary structure thereto without permission of the owner. 2. Penalty: Any person violating this subsection B shall be subject to the general penalty provisions of section 1-4-1 of this code. 3. Bow And Arrow Use; Conditions: It shall not be deemed a violation of this section to use a bow and arrow to hunt deer on land zoned agricultural and divided in a parcel of at least three (3) acres, with the following conditions: a. The person is the owner of the property or has permission from the owner to allow for bow hunting; b. The person bow hunting must successfully complete an Iowa department of natural resources bow hunter safety education course, or the equivalent, and a proficiency test must be taken annually; c. The person has any license or permit required by the state or county to hunt deer with a bow; d. Hunting will be done in accordance with all state or county laws or regulations; e. Hunting does not occur within one hundred (100) yards of any residence, church or occupied structure or park ground; f. Hunting takes place from an elevated position of at least four feet (4'). Elevated stands must have hunter's name and phone number on the stand; g. The person hunting can demonstrate compliance with these requirements to any police officer upon request; and h. As an alternative to subsection B3e of this section, any person may hunt on such terms and conditions approved by the chief of police and with the recommendation of the deer advisory committee for the sole purpose of deer control, including land zoned other than agricultural and parcels less than three (3) acres. It is unlawful to feed, provide feed or other attractants, to wild deer, raccoons and coyote within the city limits. 2. This section shall not apply to naturally growing grain, fruit or vegetable material, gardens, and ornamental plants. (Ord. 26-13, 9-17-2013) B. ICE CONTROL PROCEDURES: Ice Control Procedures are used to break and/or prevent the bond of ice to pavement. The Contractor will have the discretion to modify the rates and types of ice control based upon weather and street conditions. If possible, anti -icing is defined as the application of ice control materials prior to a winter weather event. The intent is to delay or prevent the bond of ice and/or melted snow to pavement surface. The Contractor may utilize anti -icing procedures when weather forecast, and pavement temperatures indicate that their use will help prevent the bond of ice to the pavement. The ant -icing materials and/or chemicals maybe applied. When pavement temperatures are low and the pavement is initially dry, the use of salts should be delayed as long as possible to avoid the formation of ice re -freezing on the roadway surface. Salt and Sand will be contracted for and purchased directly by the City of Riverdale in quantities recommended by the Contractor. At the City of Riverdale's discretion, salt and sand will either: (i) delivered to designated area specified by the Contractor; or (2) hauled by Contractor from the vendor's location or another designated area specified by the Contractor. Riverdale shall pay Contractor hauling salt and sand in the amount per dump truckload. SNOW CONTROL PROCEDURES: The depth and timing of accumulations, weather forecasts and traffic volumes, will normally dictate when snow plowing operations will begin: Plowing will take place during, a storm as needed to keep the accumulation on the pavement surface less than desired guidelines. It is important to remember that plowing while a. winter weather event is ongoing will not necessarily leave the street in a finished state, It is common for snow 611 rates to be high enough to give the appearance that a street has not been plowed even through the plow may have made a pass very recently. Only after the winter weather event has ended can final cleanup commence, and the streets begin to be returned to normal conditions. There may be several passes of plow equipment required to fully plow a street curb to curb. Snowplow will need to maintain certain speeds while plowing in order promote efficient movement o: snow movement of snow and to ensure that snow does not adhere to the plow blade. If weather forecasts indicate a significant increase in pavement temperatures during or after a storm event, the contractor will have discretion regarding plowing and/or deicer applications. If forecasts indicate that the snow and/or ice will dissipate in a time period deemed reasonable by the Contractor applied procedures will be implemented. 9. EMERGENCIES Emergencies arc defined es follows, but not necessarily limited to: • Immediate need for Police, Fire and/or Emergencies Medical Assistance. If the Emergency personnel must leave the public right-of-way to respond to an emergency, snow removal crews may provide necessary assistance such as opening a driveway or parking area to give access to them • Isolated problem areas where access is urgently needed before all other areas are handled • Icy conditions due to a water main break or cleaning of streets clue to debris blocking streets or access. io. DRIVEWAYS & PRIVATE PROPERTY During snow and ice control, it is common for plowed snow to be pushed and/or thrown back onto the driveways and aprons and especially around corners this unfortunate event results from the need to maintain certain speeds and plow angles to provide efficient and safe snow and ice control. While the City strives to minimize the effects of this thrown snow, it is inherent to snow and ice control activities. Removal of this additional of material on driveways and aprons is the responsibility of the abutting propertyowner. 11. DAMAGES TO PRIVATE PROPERTY The Contractor is wholly responsible for damage due to deicing chemicals and/or snowplow blade. This activity will include but not limited to landscaping (IIar'dscaping, plants, irrigation systems, or accessories such as lighting). The Contractor is responsible for replacing all mailboxes. The City of Riverdale will NOT repair or accept damages that result for snow plowing activities. 12. The Contractor will, at Contractor's sole cost and expense, obtain and maintain during the Term (and any renewal or thereof): (a) a commercial general liability policy insuring the Contractor (and naming the City of Riverdale as an additional insured against liability arising out of the work in the amount of not less than $goo,noo combined single limit, bodily injury and property damage per occurrence and $1,goo,000 in the aggregate; and. (b) workers' compensation insurance in the applicable statutory limits. Such insurance policies shall name the City of Riverdale, Iowa as additional insured under the policy. The policies will insure performance by the Contractor of the indemnity provisions below. The limits or coverage of such insurance will not, however, limit the liability of the Contractor hereunder, 2. HOLD HARMLESS AGREEMENT Contractor shall indemnity, defend and hold harmless the City of Riverdale and its officials and employees and agents from and against any and all losses, liabilities, claims, damages, actions, fines, penalties, expenses or costs (including court costs and reasonable attorneys' fees) ("Losses") arising out of the negligence, recklessness or willful misconduct of Contractor or its employees, officers or directors in performing the. work. 2. Notwithstanding any other provision of this Contract or anything to the contraly that maybe provided for by operation of law, neither party for lost profits, lost revenue, loss of anticipated business or any other form of indirect, incidental, special, consequential exemplary, or punitive damages, even if that party has been informed of the possibility of such damages and even is such damages are foreseeable, whether as a result of breach of contract, breach of warranty, tort, negligence, or otherwise. The indemnities the Section shall be the sole and exclusive remedy available to each party hereunder. 17• TERMINIATION: Upon yo (ninety) days written notice, the City of Riverdale may cancel this contract without cause. The City of Riverdale may terminate the Contract prior to the expiration of the Term for cause, such early termination being effective immediately upon written notice to the Contractor. "Cause" shall mean: (1) any act by Contractor of personal dishonesty, embezzlement, or misappropriation of the City of Riverdale assets; (2) unlawful possession or use by the Contractor of narcotics or any illegal substance at any time, legal intoxication of Contractor when performing work, or use of drugs or alcohol in any way that impairs Contractor's ability to perform the work for the City of Riverdale; or (3) neglect by the Contractor of any of its duties under this Contract; or (q) negligent or willful conduct by Contractor that is materially and demonstrably injurious to the City of Riverdale or the public or creates a danger to the public.
