HomeMy Public PortalAbout1999/07/07 The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding in the Regular Meeting, July 15, 1999, was held on July 7, 1999, 7:00 P.M., Municipal Court, police Facility, 230 Roosevelt Avenue, Carteret, N.J. The following were noted present: Mayor Failace Councilmember Crilley " Gutowski " Mancuso " O'Brien " Quinones Noted Absent was Councilmember Fazekas. Also noted present was Borough Attorney Craig Coughlin. Mailed to The Home News Tribune, The Star Ledger and posted pm the bulletin board on July 1, 1999 and also published The Home News Tribune on July 4, 1999. Borough Engineer - Al Beninato, gave his report on Borough Hall Microbial Testing Report, Restricted Handicap Parking - Application Reviews, Waterfront Park Project - Brownfields Funding, Bergen, Hayward and Harrison Pumping Station Improvements - Contract No. 98-14, Linden Street, Hermann Avenue and Cypress Street Sewer Separation - Phase II, Report Upon Findings - III Reduction Program Preliminary Investigation and File Review, NJDEP Administrative Consent Order, Year 2000 NJDOT Project Closeout, Improvements to Louis and Fillmore - Contract No. 99-11, Road Opening Procedures and Utility Company Meeting. At approximately 7:18 p.m., Councilmember Fazekas was noted present. Mayor Failace then said he wanted to have a five (5) minute recess. At approximately 8:05 p.m., the Mayor and Council returned from the recess. Public Hearing: #99-23 Amending Salary Ordinance #71-9, Re: Youth Corps Laborer. At approximately 8:08 p.m., Councilmember Fazekas and BC'mugh Attorney Coughlin were noted present. Mayor Failace then said since the Borough Attorney was back he would introduce the First Aid. Attorney Spoganetz was present, 2 representing the First Aid Squad saying they are requesting to be put on the LOSAP Program and asked if it could be put on for next week's meeting on an ordinance. Directing the Issuance of Various Raffle Licenses. Directing the Issuance of Various Amusement Device Licenses. Cancellation of Tax Overpayments. Budget Insertion - Library Technology. Budget Insertion - Urban Youth Corps. Budget Insertion - Municipal Court DWl. Cancellation of Grant Balances. Approving Handicapped Parking Space -G5 Bergen Street. Carteret Mobile Park - License Renewal. Tower Trailer Park - License Renewal. Carteret Jewish Community Center - Amend BL-15632 by adding dates. Clerk's Office - July 1999. Inspection of Buildings-June 1999. Treasuer-June 1999. MATTERS FOR DISCUSSION: NJ Department of Personnel - Certification of Eligibles for Appointment -Police Captain Date of Disposition, 9/18/99. Provisional John Pieczyski. A resolution will be put on for this. Carteret Library Board - Requesting removal and replacement of member. Attorney Coughlin said this is a personnel matter and a Rice Notice may have to be given before they make any decision. This was put on hold. James Clarkin, Esq. - Recommending Ordinance #98-21 be adopted as written, Re: Soil Removal and Fill Replacement. This was okay. Peter Wasko - Requesting representation in legal matter. Attorney Coughlin said the allegations are that he did something that arose out of the performance of his duties, so he believed that our indemnification ordinance would cover him. He said the Borough has not been named. He commented that we need a summons and complaint and asked for it to be sent to the Borough's carrier. O'Connor Volunteer Fire Chief Bucsak BUSINESS TO BE ADDED Y2K User Fee Waterfront Carteret Board of Education - Requesting two (2) additional Handicapped Parking Spaces in front of Carteret Middle School. The Clerk said she would give this to Al Beninato. Barry Albin, Esq. - Requesting additional appropriation, $440.92 - Re: Mariano v. James Connolly, et.al. Attorney Coughlin will review this. Francis Hartman Esq. - Requesting additional appropriation, $2838.32 - Re: Singura v. State. Attorney Coughlin will review this. Howard Mankoff, Esq. - Requesting payment of liability deductible, $2611.60 - Re: Nagy v. Borough of Carteret. Attorney Coughlin will review this. B. O'Connor - Personnel Matter. This will be discussed in a Closed Session. Volunteer Fire Chief Bucsak - Asking for assistance with radio problem. The Clerk said that Brian O'Connor is already taking care 0 fthat. BUSINESS TO BE ADDED: Councilmember Fazekas said they had some problems with the Y2K issues in the Police Department. He said they are going to obtain new equipment and they have to re-do the network so it will comply with the other network and the rest of the network of the Borough. He had asked that the company that we are working with, their state agent, their state contract, they are going to review the entire department. Chris Elg is currently looking at a Police System. He said we will take the Y2K information from our meetings and the problems that we have, to address the upgrade of the of the equipment and also the networking ofthe entire Borough together and put a total cost together. He said to address the issue with the Police Department it has to be done by the end of the year. He wants to put together a total package and cost and address everything to the Borough. Mayor Failace asked Councilmember Fazekas if he talked to Mr. Riggio about Grant monies. Councilmember Fazekas said he gave him a contact person's name. He explained they would move ahead. Councilmember Mancuso suggested having a User Fee for garbage. He also spoke about trailers parking by the waterfront and blocking it off. Mayor Failace said there is a "Right of Way" and he does not believe they can block it. 4 Attorney Coughlin said the first thing to do is send them a letter. Councilmember Gutowski said he had a brief meeting with the Governor on Sunday and he and the Mayor will be going down to speak with her in two (2) weeks. Attorney Coughlin said he was sending the Towing Ordinance out for review. He also spoke about the Carteret Redevelopment Ordinance. He will be giving it out to the Mayor and Council to review and it will have to be sent to the Local Finance Board for adoppon. Mayor Failace said they got a letter from St. Demetrius Church to use the Grant Avenue Playgound for their carnival. . He also got request from Robert Magella, for commendations for Firefighters Reynolds and Biel. Mayor Failace then asked for a motion to go into Closed Session to discuss Litigation and Personnel. Upon MMS&C by Councilmembers Gutowski and Fazekas RESOLUTION #99-235 "RESOLUTION TO GO INTO CLOSED SESSION" was Adopted. Upon individual roll call vote, Councilmembers Crilley, Fazekas, Gutowski, Mancuso, O'Brien and Quinones voted in the Affirmative. At approximately 8:30 p.m., A Closed Session was held. Upon MMS&C by Councilmembers O'Brien and Fazekas and unanimous affirmative vote of the five (5) Councilmembers present this meeting was opened at approximately 9:50 P.M. Upon MMS&C by Councilmembers O'Brien and Fazekas and unanimous affirmative vote of the five (5) Councilmembers presu't at approximately 9:51 P.M., after no further discussion, this meeting was Adjourned.
