SUBJECT: Thornewood Lease Parameters
Introduction: At the July 23, 1980 meeting of the Board of
Directors, staff presented a proposal to exchange the Thornewood
house and lot for adjacent land (see report R-80-43, dated July 17,
1980) . The proposal was not accepted, and the result of that
meeting was to direct staff to prepare parameters for a proposal
solicitation to seek parties interested in a lease arrangement.
Discussion: Staff has prepared a set of parameters which would
allow a long-term lease of the Thornewood house while preserving
the integrity of the house and leasehold area. These parameters
have been reviewed by the Thornewood Lease Parameters Committee
(Directors Hanko and Wendin) and are attached for your consideration.
One area of concern expressed by the Board was the disposition of
the barbecue area. In order to preserve and maintain the barbecue
area without District effort, it should be part of the leasehold
area. However, use of the barbecue area by the public could impact
the private use and enjoyment of the Thornewood house and grounds
by the lessee. The Board committee for the Thornewood grounds
(Directors Bishop and Turner) had not reached a decision on the
disposition of this area at the writing of this report. The para-
meters can be modified to include the decision of the Board after
hearing from the Grounds Committee. The assignment to the Grounds
Committee was to recommend the minimum level of public use of the
grounds (not just the barbecue area) which is acceptable to the
District.
Recommendation: It is recommended that, after deciding on use of
the barbecue area, the Board of Directors approve the Thornewood
lease parameters and authorize staff to solicit lease proposals. If
the Grounds Committee has not completed its assignment by September 24,
then you may consider continuing the matter for two weeks.
LEASE PARAMETERS FOR THORNEWOOD
The District' s goal is to preserve the Thornewood house, built
in the 1920 's and a unique example of summer estate life in the
foothills which has survived virtually intact. Proposals will be
evaluated as to the extent that they meet the specific requirements
and desirable characteristics listed below.
SPECIFIC REQUIREMENTS FOR PROPOSALS
1. Historic Renovation
A. The building's exterior must be rehabilitated to a reasonably
historically accurate degree. The interior entry and living
room must be maintained in a reasonably historically accurate
condition.
B. The Thornewood house must be reconditioned to a safe condition
to allow for limited public access. Auxiliary buildings must
be stabilized to meet local codes or they must be demolished.
C. All rehabilitation activities will be subject to all appli-
cable health, safety, building, and zoning codes, and the
lessee will be required to secure all permits necessary
to meet these codes.
D. A mutually agreed upon committee will advise on, review and
approve all plans for building rehabilitation and landscaping
of the grounds.
E. Within 24 months of the start of lease, lessee must complete
rehabilitation of the exterior of the Thornewood house and
grounds. An additional 12 months will be allowed for in-
terior rehabilitation.
F. Once rehabilitation is completed, lessee may not make any
alterations, additions, or improvements without the written
consent of District.
2. Leasehold Area
A. The lease area to be considered is approximately 3 acres
(subject to survey) , including the house and auxiliary
buildings, existing landscaped grounds area,* and the
drive access.
B. The grounds within the leasehold area must be maintained
in a presentable manner at all times.
3. Public Access
Public access is to be provided for as follows :
A. Limited public access to the leasehold area, including the
Thornewood house.
B. Provision for at least four District-sponsored "open houses" ,
all of which will be tours of the grounds and exterior of
the Thornewood house. Two tours will also include portions
of the interior of the Thornewood house.

4 . Financial
A. Proposal must contain provisions for the rehabilitation of
the leasehold area without District financial involvement.
B. Lessee must maintain liability insurance in an amount
satisfactory to the District. The lessee will maintain
special insurance so that the buildings would be histori-
cally reconstructed in the event of a catastrophic accident.
5. Terms
The lease will have a maximum term of 25 years.
6. Miscellaneous
A. Any addition to the Thbrnewood house or any buildings
constructed by lessee must be designed to be architec-
turally compatible.
B. Lessee will be responsible for all costs associated with
hook-up to the domestic water supply as part of the re-
habilitation.
C. Lessee's maintenance of domestic animals will be restricted
to the leasehold area.
D. The District would consider allowing the construction of
amenities such as a swimming pool, stable area, or a garden
area for lessee 's use.
E. Lessee's vehicles and guests ' vehicles will be restricted
to the leasehold area.
F. Lessee will be responsible for coordination with adjacent
inholder for the sharing of responsibility and costs for
maintenance of the private water supply and access road.
G. District will reserve the right to pass over the access road
for patrol and maintenance purposes, open house tours , and
public trail crossings.
DESIRABLE CHARACTERISTICS
1. Although it would be desirable not to expand the Thornewood
house, any expansion must be to the rear and must conform with
existing design and construction.
2. Accurate rehabilitation of the complete interior of the house
and inclusion of the complete interior during the open house
tours would be desirable.
3. Rental income to the District would be desirable.
4 . It would be desirable to demolish existing cottage buildings
and landscape the area.

SUBJECT: Summary Review of Use and Management Plan for Planning Area X
(Stevens Creek Shoreline Nature Study Area)
Introduction: The Land Management Planning Process, as revised and
approved in July 1980, provides for a summary review of planning
areas on alternate years when planning areas are not being reviewed
in detail. This summary report is in accordance with the recently
adopted Schedule of Reviews (R-80-37, dated April 28, 1980) . The
more in-depth review of Planning Area X will be presented to the
Board in September, 1981.
Site Use and Management
The 54 acre Stevens Creek Shoreline Nature Study Area has received
little use since acquired on July 9, 1980 . As discussed in the
acquisition report (R-80-38, dated June 27, 1980) , public access
is restricted to the site by a locked gate at the end of Crittenden
Lane.
In the past, the Environmental Volunteers have utilized this site
and adjacent lands for environmental education purposes. They have
secured permission from the Santa Clara Valley Water District (SCVWD)
to gain access on the levees along Stevens Creek. This use is con-
sidered compatible with site use and management plans and will be
encouraged to continue. It is anticipated that approximately 150
children per month will benefit from their visits to this preserve.
The site is patrolled infrequently, and currently there are no signs
of use or management problems occurring.
Existing Use and Management Recommendations
There are no changes in the status of recommendations contained in
the acquisition report. For the next year, staff will emphasize
the efforts which pertain to increased public access of the area.
The adopted use and management recommendations are:

1. Public access and use of this land should be limited to the
levee via the easement access across the Stevens Creek channel
when public rights have been obtained from the Water District.
2. Boundary marks and preserve signs should be installed as appropriate.
3. Because of the remoteness of the site from other District properties,
land management activities would be limited to a random patrol
frequency. Efforts would be made to effect a mutual assistance
agreement with NASA/Ames and the U.S. Navy (Moffett Field) to
provide perimeter security and patrol surveillance.
4. Staff would continue to coordinate with Santa Clara County Water
District, Mountain View Parks and Recreation, NASA/Ames, and the
U.S. Navy to plan a levee configuration and bridge location con-
sistent with the Bayfront Trails Plan.
New Use and Management Recommendations:
1. The District should work with the Environmental Volunteers,
Santa Clara Valley Water District, NASA and Leslie Salt Company
to continue the existing environmental education program conducted
in this area.
Recommendation: It is recommended that the Board reaffirm and adopt
the use and management recommendations contained within this report.

SUBJECT: Arming of Santa Clara County Park Rangers
At their September 29 meeting, the Santa Clara County Board
of Supervisors will decide whether or not to allow the arming
of park rangers.
If they decide in the affirmative, there is a significant
impact on the District's rangers and on the public who uses
our open space preserves contiguous to County parks . The
joint powers agreement we have with the County would be affected.
There would be a change in the image of parklands and enforce-
ment of ordinances. It would require substantial training,
yet even then there are many safety factors to be dealt with.
The implications are many.
It is my feeling that our Board should discuss this possibility
and hear what concerns our land management staff might have.
We can then decide whether we want to provide any input to the
Board' s decision, and to what degree.

SUBJECT: Report on Volunteer Program
At the Board meeting of September 24, 1980 , Kathy Blackburn, the
Coordinator of Volunteer Programs, will make a presentation to you
on the activities for the 1979-80 and 1980-81 volunteer programs.
The volunteer program not only provides regularly scheduled docent
tours and walks, but responds to requests for special events. The
volunteer program is growing in scope and has provided the District
with assistance in handling daily office functions, legal assistance,
preparation of special reports , slide shows, and publicity. The
volunteer program has also provided the field staff with assistance
in development and maintenance of District preserves.
A copy of Kathy' s June 1980 newsletter to the docents is attached
.for your review and enjoyment.

JUNE 1980
Hello -
As the summer approaches, I can feel an audible sigh of relief.
We 've had an extremely full and busy year and are looking forward to
a break. June, July and August are meant to provide that break .
The docent work schedule is lighter and we will have a couple of
get-togethers just for fun.
There are, however, a few priorities. They are identified for
you on the sign-up sheet with a star (*) . June priorities are:
Grad Hike (6/21) , and a Waterwheel
Creek tour requested by Charlotte MacDonald. July and August priorities
are: regular LT and regular RSA duty. These are things that, I
feel, visitors have come to expect and enjoy. You can make all
the difference in someone 's open space experience. So - check your
schedule for summer and plan an outing or two!

MY SUMMER PLANS
During the normal work week this summer, I will be working as a
naturalist for the City of Cupertino. I will still work for MROSD,
but not in the office very often. Please feel free to call me anytime
at home (evenings and weekends are your best bet) . My phone number is :

Of course, there will be the regular newsletter and other corre-
spondence as well as summer fun activities. Beginning in September,
I will be back to normal.
DOCENT NEWS-JUNE Phge Two
GRADUATION HIKE - JUNE 21
A very important date for all docents. For trainees, it marks
the culmination of formal training. For experienced docents, it is
a time to especially thank you for contributing so generously to
open space preservation.
The grad hike will be at 10 :00. It will be so meaningful and
enjoyable to have you all there to help and participate. Meet at
Los Trancos at 10,:00 and we'll divide into small groups of old and
new docents, sharing ideas as we walk the trail.
UPCOMING. ACTIVITIES
Here are some details on our two summer activities and a
possibility of another. If you mark on your sign-up sheet that you
are interesting in coming, I 'll send you information when the date
approaches. Both of these activities mix fun with learning and
your friends or family are welcome to join us!
July 11 and 12: Camp out on Friday evening at Sanborn-Skyline County
Park. Bring your own dinner, sleep under the stars, and watch for
night creatures. On Saturday morning, we will meet those who didn't
want to rough it at the Saratoga Gap parking lot for our famous
slow walk up Stevens Creek Canyon to Page Mill Road. This will take
a lot of organizing, so as the time draws near, I will need fairly
firm commitments from both campers and hikers. For now, just mark
your sign-up sheet if this interests you.
August 9: Tim Hall will explore the geology of the Waterwheel Creek
area of Monte Bello with us. (For new docents, this was where we
went with Mabel Crittenden. ) After our walk, we will drive to
Ridge Winery for lunch and tasting. We will meet at Stevens Creek
Park at 9:00 and probably be all done by 2:00 that afternoon.
Another great idea: Ernie Ramires has offered to schedule an evening
swim for us at his pool club. We could have a potluck dinner and
then swim from 7-9. Since there is a fee for pool use, we would
like an idea of how many would like to come before we reserve the
pool. Show your interest on the sign-up sheet.

SITE WALKS
When you walk on a site, call another docent trainee, or take
friends and family with you. Wear your nametag, greet people
along the way, and then either send or phone in your report.
You can sign up to walk a site on any day, but preferably week-
ends, since they are most crowded. Walk at Rancho San Antonio
or Monte Bello (or any other place you want to explore) . When
you sign up, I will send you maps, report forms, etc.
Walking is great exercise!

SUBJECT: Review of Permit Procedures and Liability Implications
Introduction: At your August 13 , 1980 meeting,you concurred with
the request of Director Kay Duffy that a discussion of permit
procedures and liability implications be placed on a future agenda.
This decision was reaffirmed on August 27. Attached are copies
of the two Board policies that define permit procedures . Legal
Counsel made some comments earlier regarding liability implications
and will be prepared to comment further on September 24 .
Discussion: The present permit procedure involves issuing a permit
to an individual or group upon request. The permits are only re-
quired if parking is restricted or access to a particular area of
a preserve is controlled. Aside from minor areas, all sites are
open to the public without permit. When an individual or group plans
a special activity, such as an environmental study project where
plant material or wildlife habitat would be disturbed, a special
permit is granted for the specific activity.
Permits may be secured by visiting the office or by phone, in which
latter case the permit is mailed.
The majority of permits which are issued are for parking at the
Rancho San Antonio Open Space Preserve and for parking at the
Picchetti Ranch and being allowed to enter the controlled area at
Picchetti. Some special permits have been granted for parking at
Black Mountain, and for special activities by groups such as Nature
Explorations for moonlight walks and environmental education programs.
With the exception of permitting users to be near the Picchetti
buildings, there does not appear to be a liability problem specifi-
cally associated with the permit process. The permit process controls
use in an area where hazards may exist, provides direct notification
to users of possible hazards and restrictions on a site, and provides
field staff with knowledge of the numbers, location, and planned
activities of permit users .
Staff does not see a reason to change the present permit procedures.
The existing permit standards currently allow enough flexibility
to handle permit requests .

10 . 1 Sh-o-r-t Title- The rules and rcqulaLtions contained herein,
including any amendments hereto, may be referred to as
"Perra-it Standards. "
20- 0 Purpose. These Permit Standards are adopted pursuant to
"Regulations for Use of Midpeninsula Regional Park District
Lands" (Ordinance No. 75-1) . to provide for aL syst-em. of
permits for the entry on or use of District lands and the
issuance -thereof, the exemption of certain lands or classi-
fications of persons therefrom, and establishing other
policies in connection with the administration of a permit
syster.a.
30. 0 Exempt Lands. No permit is required for the entry
upon or use of District lands except as may be pro-
vided by resolution, regulation or rule of the Board,
or unless otherwise stated in site use and management-
plans adopted by the Board.
40. 0 Exempt Classes of Persons- No permit is required for the
entry upon or use of District lands by the following classi-
fications of persons:
a. officers and employees -of federal, State, County, city
and other local public agencies while acting in the
course of their official duties -
b. Any person entering upon District lands in an emergency
for the immediate preservation of the life, health or
safety of persons or wildlife or for the protection of
property-
C. Persons crossing District lands on an easement, when
they are legally entitled to use of that ease-iment-

to provide for the issuance of permits in the following

Lands, or any federal, State, County or municipal law or
ordinance.
70. 1 Hearing; Reinstatement. Any person who has had a permit
so revoked or suspended may, within ten (10) days demand
a hearing and review thereof. Upon receipt of such re-
quest, the General Manager shall establish a time and place
for hearing .and give reasonable written notice thereof to
all interested persons, including the person requesting
review. At the hearing the General Manager shall' receive
evidence -in such form as he or she sees fit. The General
Manager may continue the hearing from time to time_ Within
three (3) days of the close of the hearing the General
Manager shall render a decision and give notice thereof to
all, interested persons. His or her decision may include _
an order of reinstatement, conditional reinstatement, or
an order confirming the revocation or suspension. The
General Manager' s decision shall be final_
70.5 Permits; Termination for Goad Cause. For good cause, such
as threat of fire or other hazard, administrative diffi-
culties, overuse of District lands or facilities , or the
existence or threat of similar conditions or hazards, the
General Manager may without a hearing order the revocation
or suspension of any outstanding permit or permits as to
specific lands or classifications of persons_ He/she may
reinstate the permit (s) when the condition or hazard has
ceased to exist.
80 .0 Fees_ The Board may from time to time adopt a schedule
of fees for types of use of District land when additional
management or operational cost is associated with that
particular use.

Budget: The policy of the Midpeninsula Regional Park District
IS that the budget for land management costs will be
permitted to grow approximately linearly from next
year's budget (1967-1977) to 18% . of tax revenue at
the end of ten years, such percentages to be reviewed
annually.
Phasing: Staff shall prepare site-specific plans which allow
for open public access as soon as possible after ap-
proval of the site plans. For each site, the plan
shall include the phasing' necessary to protect the
# environment as the use increases, including protection
of both the site 's ecology and of the neighborhood,
and to measure the impact of such use. The plan shall
detail how all aspects of public access will be handled,
including signing, patrol and -parking. The phasing
shall be consistent with the limitations of open space
management budget, workloads and priorities.
Permits : A permit system may be used as a tool to control access
. to environmentally sensitive sites and to keep track
of group usage. Otherwise, permits for individuals
will not be required. On sites where a permit is re*-
quired, permits will be given out on site unless the
r individual is having an adverse impact on the site or
on others using the site.
Signing: The District will provide signs to protect the site,
users and neighboring properties and to indicate owner-
ship* at the entrance or entrances of sites. Hocgever,
in certain cases where special environmental protection
or other special site specific circumstances make it
necessary, the Dig>trict will provide signs only as re-
quired to protect the site , users and neighboring
properties. This policy will be reviewed yearly as to
specific sites.
Publicity: For the next year, information about District sites
will be made available in the form of informational
j brochures through the office only_ This policy t.,,ill
be reviewed at the end of the year.

SUBJECT: NRPA Meeting and Management Training
I am planning on attending the annual National Recreation and
Parks' Association meeting the week of October 19 and would miss
the October 22 Board meeting. I am also planning to participate
in an intensive week-long management training institute sponsored
by the California Parks and Recreation Society in cooperation with
the University of California the week of November 9 . 1 plan on
returning for the evening Board meeting November 12 . Please let
me know if this schedule would cause any inconvenience.
