The Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting, August 19, 1999, was held
on August 12, 1999, 7:00 P.M., Municipal Court, Police Facility,
230 Roosevelt Avenue, Carteret, New Jersey.
The following were noted present:

NJ Department of Personnel - Certification of Eligibles for
Appointment, Re: Firefighter. Date of Disposition: 9/2/99. The
Clerk said that Councilmember Fazekas had interviewed
candidates and he will send in his recommendation prior to the
next Council Meeting.
Sue Pezza -= Requesting donation on behalf of Boy Scout Troop
389. Attorney Coughlin said by law you are not allowed.
Ordinances for Review-
a) Towing - Put on Hold.
b) Sexual Harassment Policy. Okay to be put on for meeting.

Holiday Inn -Request for the traffic light. Attorney Coughlin
suggested they go to the County.
NJ Division of ABC - Special Ruling to permit renewal of license,
Re: Carpatho Russian Amercian Citizens Club Inc. Mayor Failace
agreed.
ADA . Representative. The Clerk said that John Riggio had asked
for a resolution for someone to be put on making them the
representative for the town. The Mayor said to make it Mr. Riggio.
Bid - Replacement of Trees. Okay for a Resolution.
Marcial & Silvia Retamoza - Request to purchase property, next to
34-36 Pershing Avenue. This was put on hold.
BUSINESS TO BE ADDED:
Counrilmember Quinones said that GA TX wants to have a "truck
waslllllg" on Ethnic Day.
Mayor Failace asked what the name of the charity was where the
money will go.
Councilmember Quinones asked to have certificates handed out at
the next meeting for the Softball Game.
Councilmember Crilley said that Councilmember Gutowski has
been talking to the YMCA about some programs they would like
to get started. He questioned how the Borough will fund this and

where will the facilities be. He said they would have to get
someone to be the Coordinator of Teen Night and that both the
YMCA and Teen Night can be done in conjunction with each
other. He spoke further on this.

At approximately 7:30 P.M., Councilmember Fazekas was noted
present.
CDL Drug Testing
Councilmember Crilley then brought up the CDL Drug Testing. He
said they would need an ordinance to establish it and a policy for it
and we need to set up the parameters on how the testing is going to
be done. He said they will hand it over to Attorney Coughlin to
make up the laws. He said another thing he wanted to discuss is a
letter they got in the mail from an attorney saying they would be
sending their Clerks down to go through our information in the
Police Departments, such as tickets, which is public information.
He said it is a "Right to Know" and he said it looks like they are
looking for business.
MCUA Charge
Attorney Coughlin said he has seen in other communities where
they get a list and mail out to people who got tickets. He said there
can be a time limit and restrictions on it. He went on to say he was
putting a memo together that will be going to everyone in the
Borough and some draft forms for equipment acquisition and
injuries. He said this will formalize this with the insurance
company. He then spoke on that we received a ADA Transition
Plan. He said the request will go to John Riggio. He then went on
to speak about the MCUA charge per gallon, that it will be going
up, explaining that there will be a hearing on 8/26/99 and he and
the Governing Body decided to send a letter opposing it. He then
mentioned the Energy Deregulation is coming, a service through
the New Jersey League of Municipalities.
SWAC
Councilmember Mancuso spoke on the subject if our Planning or
Zoning Board passes anything and apply to SW AC, the County
can charge up to 90% without going for a new license.
Councilmember Qui_nones Councilmember Quinones said Woodbridge asked for a statement
opposing a sexual facility they are building there.
Attorney Coughlin said they could do that.
Mayor FaHace
Mayor Failace said on August 30'\ in regards to the Electric
Aggregation Company, the County recommends that we join with
them or someone else. He said they would save money. He then
went on to say he received a letter trom Charles De Carteret,
inviting him over to France for a thousand year celebration. He

said he would not be going but would like to put on a proclamation
for their one thousand years of unbroken history and send it to
them. He then spoke on signing a contract on the County police,
they are sending us. There will be a resolution put on to authorize
the execution ofthis contract.
Atton~ey Coughlin spokes on the specifics ofthis agreement.
Councilmember Mancuso asked Attorney Coughlin where we
would stand if the trees we charged $80.00 for having them cut
down and replaced, started dying.
Attorney Coughlin said he thinks they can water the new ones.
Councilmember Crilley said that was correct. Then he asked for
the contract they have for bids, with sixty (60) days to award it,
asking if they can request an extension trom the lowest bidder
because ofthe hot weather conditions. He said they do not feel it is
an appropriate time to plant. A letter will be sent to the lowest
bidder requesting this.
May'" Failace then spoke on 97 George Street. He said the house
that was between 95 and 99 will be 97 and not 103 and the house
that is in the hundreds will not be 97, it will be 103.
Councilmember Fazekas then said the Library is looking at a new
telephone system. He said we have requested that Lucent
Technologies evaluate our telephone system. He spoke on some of
the systems and said for the services we have now it costs the
Borough $40,000.00 a year and we are spending close to $6000.00
a month on telephone calls. He said what he is proposing is for a
system for the entire Borough to operate. He said the payback
would be three (3) or four (4) years and then there would be a
savings of about $25,000.00 and said when he gets the cost he will
send it to each council person. The next subject is Y2K.They have
been gathering disclosure statements trom companies stating that
their produce is Y2K compliant. He told the Council to make sure
that .ç department heads show up at the meeting. He went on to
say that that the Police Department has computers that are not Y2K
compliant, that we have to purchase. He said the whole package
with communications and network will cost about $400,000.00 and
they would speak with Patrick DeBlasio to see how they would
obtain the monies for this. He then went on to speak about the
Keep Kids Alive - Drive 25. He asked Councilmember Gutowski
to give the information to Chris Elg at the Police Department and
get him involved in it. He then asked the Mayor to take a look at
the Fireman's Contract that was put on his desk..
Mayor Failace asked for a motion to go into a Closed Session to
discuss Litigation and Personnel.

was Adopted. Upon individual roll call vote, Councilmembers
Crilley, Fazekas, Gutowski, Mancuso, O'Brien and Quinones
voted in the Affirmative.
At approximately 8:15 P.M., this meeting was Closed
Upon MMS&C by Councilmembers Mancuso and O'Brien and
unanimous affirmative vote ofthe full Council present this meeting
was opened at approximately 10:20 P.M., with the same people
present.
Upon MMS&C by Councilmembers Mancuso and Quinones and
unanimous affirmative vote of the full Council present, at
approximately 10:21 P.M., after no further discussion, this meeting
was Adjourned.
