HomeMy Public PortalAboutMinutes_Planning & Zoning Meeting_06042008PLANNING AND ZONING MEETING JUNE 4, 2008 IONA COMMUNITY CENTER PRESENT: Chairman Jerry Hansen, Board members Bruce Case, Adrian Beazer, Clerk Robyn Keyes ABSENT: Board member Jared Wight VISITORS: Larry Call, Terry Call, Ryan Loftus, Curtis Larsen, Jane11 Fullmer, Elissa Hayward, Colleen Mann, Mr. Mann, Nancy Long Jerry Hansen called the meeting to order and the pledge was said. Minutes from last months meeting were reviewed and approved. Jerry announced that Brian Stutzman had resigned as Board member. Larry and Terry Call are asking for a variance so they can build a fence directly on their properly line in the front of their property. Jerry asked if the fence obstructed on coming traffic, they said it did not. Bruce was advising them that at some point the road may widen and they would have to remove the fence. Jerry asked how high the fence would be, they said 6 foot. Jerry also asked what material would be used on the fence; they replied cedar with a stain. Bruce asked if they had contacted all their neighbors they said they had. Mr.Call explained that the fence would be placed 30 feet from the center of the, road toward their property and there would be 12 feet from the edge of the road to their fence. Mr. Call asked how they would go about getting a business licsence, Jerry said to talk to Robyn, and Mr. Call said Officer Knowles said they needed a parking license. Jerry asked if anyone in the audience had a problem with the request. No one did. Bruce was commenting that by building the fence, anyone driving by would not see the cars they have parked for removal, which is in compliance with our ordinance. Bruce proposed that they recommend the City Council accept the variance. Adrian seconded. All were in favor. Elissa Hayward is asking for a conditional use permit to run a day care in her home. She stated that her sister had passed away and had operated a daycare. The families that took there children to her sister no longer had a babysitter and were in jeopardy of losing their jobs, so she was trying to open a daycare to take in these children. Jerry is asking how many children she would have, she said 4 plus her own children. Jerry asked if parking would be a problem, she said no. Adrian asked if her yard was fenced, she said she was. Arian also asked how long it would take to become licensed and she said this was the last step. Bruce asked if she had a copy of the code for daycare, Elissa said that Betty had faxed her over a copy. Jerry asked if she had talked to adjacent property owners, she said she had and that notices have been sent out to neighbors and that no one has had a problem. Jerry said that this conditional use permit was for Elissa Hayward only and if she moved or sold the property that permit would be revoked. Jerry is reminding her that this decision tonight was only a recommendation and that the City Council had the final say. Jerry said the proposal has been set forth that at 2977 Olsen Street a conditional use permit for a daycare with the stipulations stated previously. Arian motioned that they approve the recommendation to the City Council. Bruce seconded. All were in favor. Elissa told the board she owned the home, not renting it, Jerry asked Robyn to look into county records to make sure that was true. Ryan Loftus is discussing the entrances to the new church on Iona Rd. Since Iona Road is considered a main arterial then the requirements state that there must be at least 240 feet between access on the same side of the road and 150 to 200 feet distance on opposite sides of the road. It has been requested that there be one entrance for the church that line up with Quaky Aspen Dr. across the road leading to the new development. Ryan is asking P/Z opinion on the matter. It is decided that since single access tends to create congestion that two separate entrances would be a better choice. It was also requested that the two entrances be moved 20 feet to the west to create the required 20 foot variance between the church and the adjoining property owner. Bruce proposed that they send this to City Council with their recommendation, Arian seconded. All were in favor. Ryan also asked P/Z about a water issue and Jerry explained he would have to talk to the City Council or the water committee. Colleen Mann is asking for a 5 foot variance so she can build a garage. Jerry asked if she had contacted her neighbors she said she had. No one had a problem with proposal. The P/Z board looked over pictures Colleen took of her property and where the garage would be located along with the garage plans. Arian moved that they recommend to City Council approval of a 5 foot variance. Jerry seconded. All were in favor. Curtis Larsen is discussing the possibility of renewing a conditional use permit for an apartment in his home. He bought the house from Brenda Denning; Brenda was awarded a conditional use permit for an apartment in her house due to financial hardship. The permit was revoked upon selling of the home. Jerry told Curtis the procedure involved with obtaining a new permit and advised him to return for a public hearing. Curtis asked the board what they thought his chances were of being awarded the permit, Jerry told him that sometimes if even one person objects then the permit is denied but he would have to leave that up to the public hearing. Janell Fullmer was. inquiring about possibility building a shop in her back yard and teaching dance lessons in there. P/Z gave her information from the code book about conditional use permits and advised her of setback and variance requirements. Bruce would like to discuss with City Council the amount of requests for variances and make decision to either change the code or stop granting so many variances. Jerry speaks his concerns with codes not being enforced enough. Jerry wants Robyn to look for some pictures taken at a property on East Hansen two years ago so they can make comparisons and look for any improvements. The request is to open a daycare at her residence, located at 2977 Olsen Street, Iona, Idaho. If you have any questions or comments concerning this matter they will be heard at the public hearing.
