Christy Municipal Building 320 E. Donna Deetz moved to adopt the agenda as printed and reordered. Doug Record seconded the motion. Motion passed unanimously Approval of Minutes Donna Deetz moved the minutes from the January 8, 2019, Regular Meeting and January 23, 2019, Special Meeting Minutes be approved as printed. Alan Wheat seconded the motion. Motion passed unanimously. Communication Received Jayme Abbott stated no communications have been received. New Business a. Demolition Clearance — 1328 E. Miller Street. The property owner submitted a demolition application to demolish subject building that was constructed in 1910 which makes it 109 years old. After Jayme Abbott presented city staff report the owner, Dennis Newman spoke about the condition of the property and the infeasibility of rehabilitating the property. Doug Record made a motion to approve the demolition clearance application. Alan Wheat seconded motion. Motion passed unanimously. b. Demolition Clearance — 901 Swifts Hwy. The property owner submitted a demolition application to demolish subject building that was constructed in 1900 which makes it 119 years old. Jayme Abbott presented the city staff report which contained information as to who lived in the property and what the property was used for during its history. Representatives of Trinity Lutheran Church, Carol Fischer and Doug Young, spoke about the acquisition of the property, the problems that they have had with the property and the impracticality of rehabilitation. Laura Ward, Council Liaison, spoke about her experience looking at the property. Discussion continued after which Donna Deetz made a motion that the demolition clearance application be approved by the commission, Doug Record seconded the motion. Motion failed with Doug Record, Gail Jones, Angela Lucera, and Alan Wheat voting against, and Donna Deetz abstaining. Other Business a. Historic Preservation Plan Update. City Planner, Ahnna Nanoski, discussed what the consultants, Heritage Strategies, accomplished on their last visit, requested that any material the commission members may find relevant for the consultant's research be provided, and outlined what the agenda is for their next visit in March. b. Accepting Landmark Designation Applications. Jayme Abbott spoke about the Landmark Designation application process, the criteria for nomination, and the selection and award process. c. Gregory Stockard Award. Jayme Abbott spoke about the Gregory Stockard award process and requested that the commission start thinking about possible nominees. d. Designation of Facade Improvement Committee member. The Commission voted Donna Deetz the next HPC representative member of the Fa9ade Improvement Committee. e. Staff Updates. Request was made for an update regarding the School Street Local Historic District regarding recent FEMA's correspondence. FEMA determined that the School Street Local Historic District does not meet the FEMA NFIP regulatory definition of Historic Structure. The School Street area will continue having to meet the substantial improvement requirements of the floodplain code. Jayme Abbott discussed other means that a property owner can take such as hiring consultant to complete a National Register submittal or hiring a survey engineer for determination if structure is above flood base elevation which would include submittal for a "Letter of Map Amendment" (LOMA). Middle bay entrance (off -center to right/south) with small raised 1/1 double hung sash to the right end. Broad Lintel over wide 1/1 to left with two evenly spaced 1/1 sash above. Hip roof dormer with two single light fixed sash. Lower side elevation windows have double rowlock segmental arches. Second floor windows are topped by cornice line of house. Rock -faced limestone sills. Interior end chimney front north elevation. Nearly full -facade porch with Doric columns with raised plain wood balustrade. Front porch base infilled with wood venting on front only; lattice retained on sides. Cornice band missing on north side, exposing flat arches behind. Shed patio cover, rear. History and Significance: Appears on 1923 Sanborn Map. According to the 1982 survey of black historic sites, the first occupant of this house was P.H. Prenger, a local white barber. The 1915 Directory lists Martin L. Hayes, chief clerk to the division superintendent at Missouri Pacific Railroad (wife - Nell) as occupants. The 1982 survey identifies every house on the "Lafayette -side of this block" as being occupied by blacks by the mid -1940s. Professor James Seeney, a long-time principal of the Lincoln University Laboratory School and Head of the Department of Education at Lincoln University until his death in the early 1970s, was an occupant of this house in the mid -1940s. This building would contribute to a potential National Register historic district. D. Private Owner. Applications for nomination of a private landmark shall be made by one hundred percent (100%) of the owner(s) of the property or structure. Sec. 8-46. Procedure for review following designation of landmark or historic districts A. Building Permit Standards. After a landmark or historic district is designated by ordinance each, application for building permit within the area so designated shall be referred to the CJHPC for review at a regularly scheduled CJHPC meeting. Applications shall be submitted a minimum of ten (10) days prior to the meeting of the Commission. If the CJHPC makes no report within forty-five (45) days of receipt of the application, it shall be considered to have made a report approving the application. B. Design Criteria. The CJHPC shall prepare and adopt specific design criteria as it deems necessary to supplement the provisions of this ordinance. Within each of the designated categories, the design criteria will be applied more stringently to properties of greater significance than those with lesser significance as determined by their respective designation. The CJHPC may from time to time amend and supplement to the criteria used for review of historic districts and landmarks. The CJHPC must first approve additional design criteria not listed in this chapter, and any changes thereto, before the criteria or changes shall become effective. (Ord. No. 12794, § 1, 8-17-98). Sec. 8-47. Public Hearing Procedures. A. Public Hearing. the following notification requirements and public hearing procedures shall apply for matters requiring a public hearing before the Historic Preservation Commission and such matters forwarded by the Historic Preservation Commission and requiring a public hearing before the City Council: 1. Notification Requirements. a. Property Sign. The Director shall post one or more distinctive signs, with minimum dimensions of 24" x 24" giving notice of the date, time and place of the hearing and of the action requested. The signs on the subject property shall be posted at least ten calendar days but not more than 15 calendar days prior to the hearing in conspicuous places visible from every street along the frontage of the subject property. The signs shall remain posted on the property until after the close of the public hearing. The failure to post signs upon the property or retain notification signs upon the property shall not be grounds for invalidating any action taken by the responsible decision making body. b. Agenda Notice. Notice of all public hearings shall be posted at City Hall at least 24 hours prior to any public hearing. 2. Public Hearing Procedures. a. Purpose. The purpose of a public hearing is to allow the applicant and all other interested parties a reasonable and fair opportunity to be heard, to present evidence relevant to the application, and to have input into the process. b.
