The Re-Organization Meeting of the Governing Body of the Borough of
Carteret was called to order by Council President Stanley Gutowski on
Friday, January I, 1999,at the Carteret High School Auditorium, 199
Washington Avenue, Carteret, New Jersey at 12:00 Noon.
Upon individual roll call, the following were noted present:

Also noted present was Borough Attorney Craig J. Coughlin.
BUILDINGS & GROUNDS Committee Chairperson O'Brien said
various improvements are being made in and around Borough Hall.
There is a new Council Office. New wiring has been installed for a new
computer system. We have retained Potter Architects to oversee the
improvements. They are doing one building at a time. He reported
progress.
FINANCE & ADMINISTRA nON: Committee Chairperson Failace said
this was a great year. He spoke to Patrick DeBlasio, who told him the
Borough's tax collection rate was the highest it has been in the last
decade. We've accumulated a fairly good surplus and regardless of what
anyone has said, we have reached 1999 and we are not broke. He
reported progress.

FIRE: Committee Chairperson Fazekas said for over 5 years, the roofs
at the firehouse and the police building required fixing. In 1998 the roofs
have been replaced. He thanked the Borough Engineer Albert Beninato.
For over eight years, the radios for the Fire Department and the Office of
Emergency Management needed to be replaced. In 1998 a new radio
system was purchased and is currently being installed. He thanked the
Radio Committee, John Schon, Drew Packard, Larry Aleksandrich as well
as members of the Carteret Fire Department. For years they have been
talking about getting a new fire truck. A new fire truck was delivered in
December. He thanked the Fire Truck Committee and the members for
making this a reality. A contest is being set up to select a name for the
new fire truck. The name will be picked at the next Council Meeting. In
1998, this Council approved the referendum to be placed on the ballot
this past election that will allow the borough to pay Volunteer Firefighter's
benefits for their service. He thanked Bob Hedesh and the Volunteer
members, as well as members of this Council for their efforts. He said the
Council hopes to do the same this year for other volunteer services and
organizations in the borough. He wished everyone a healthy and happy
new year. As always, he and the duck are moving right along.

PARKS & RECREATION Committee Chairperson Crilley said they have
accomplished quite a few things this year. The summer youth program has
been expanded. A Teen Night for High School age teen-agers has been
started on Monday nights at the Recreation Center. They have increased the
amount of work being done in the park themselves by taking some of the men
¡¡-om other departments. He thanked Bob Kately and Ted Surick for doing an
excellent job in getting work done and he is looking forward to 1999 to seeing
a great deal of progress. A note of personal thanks, he thanked his family, his
wife and his kids for their support He also thanked the Council for working
with him and getting things done this past year. He thanked Cindy DeCamp
for her help with the Skate Park. He reported progress.
POLICE: Committee Chairperson Gutowski said,with humor, it was a very
uneventful year in our Police Department He said he didn't think they needed
to rehash all that has been going on in the Police Department. The
department is in good hands and in another month or two there will be a new
Police Director in place. Everything is going very well at this point. This
Council is most proud that they were able to hire six new police officers One
of them, in the first time in the borough's history, is a woman. This Council
also made a pledge to the municipality that they would diversify the Police
Department and they have a Puerto Rican gentleman, Mr. Rivera on the force.
He congratulated Mr. Rivera who was in the audience. Hopefully, it will be
an uneventful year.
PUBLIC WORKS: Committee Chairperson Mancuso said there aren't too
many glamorous things he can say about sewerage. There is a very bad
problem in the town with the sewers and they are being worked on. There are
a lot of streets that have to be fixed. They are working on that Ted Surick
has been most cooperative. They have been going all over the town. Anyone
that has any big problems can contact him or Ted Surick. In the near future,
they will see a lot of changes as far as sewers and streets with the help of
Congressman Menendez and Senator Joe Vitale who have been very
cooperative. He thinks the appearance of the town will change and he thinks
everyone will be proud to say that they live in Carteret.

There being no further business, the Borough Council of 1998 adjourned Sine
Die upon MMS&C, by Councilmembers Failace and Mancuso and unanimous
affirmative vote of the full Council present.
Council President Gutowski thanked the Board of Education for allowing
them to hold the Re-Organization Meeting at the High School. At this time
Color Guard made the flag presentation.
The pledge of allegiance was led by Mr. William Nix and the Carteret
Specials.

Mr. Louis Occhiuto led the audience in the National Anthem.
The invocation was given by Reverend Edward Puleo of St. Joseph's
Roman Catholic Church.
The history of Carteret was given by Daphne Miles. Ms. Miles said the
Borough of Carteret is located in the northern section of Middlesex
County on the Staten Island Sound. It was part of Woodbridge Township
until 1906 when by active legislature it became the Borough of Roosevelt.
In 1922 the name changed to the Borough of Carteret.
The history ofCarteret dates back to the pre-Revolution era. As a naval
Captain, Sir George Carteret had gained a heroic reputation against North
African pirates. liberating English, French, Dutch and Spanish captives.
He had fought against the Parliamentarians under Cromwell, yet sought
the aid of parliament when royalty wished to sell the Isle of Jersey to the
French. He became a Knight and a baron. In February, Charles I was
executed. Carteret ordered Laurens Hamptonne to proclaim Charles II
King When the King rode in state into London on the day before his
coronation, Carteret was with him. In 1664, King Charles II granted to
James, Duke of York, land in the New World. James, in deeds oflease
and release on June 23 and 24, 1664, gave the land now called New Jersey
to Sir George Carteret and John Lord Berkeley. They published "The
Concessions and Agreement of the Lords Proprietors of the Province of
Nova Caesarea", granting the inhabitants representative government and
religious rreedom. Sir Philip Carteret was appointed the First Lord
Governor.
At the founding of Nova Caesarea in 1664, the Amerindians called this
land Smoky Point. The Lenni-Lenape, in their farther wanderings, came
here to hunt, fish, bathe, relax, hold pow-wows. Oldest maps revealed
orchards, farms, meandering streams, clean beaches along the Arthur Kill.
Hear was peace among the Indian and White Man.
On a direct route between New York and Philadelphia, Carteret became
a favorite excursion area. It is likely that George Washington traveled
along the Blazing Star Trail, the main route through this town in past
centuries.

Earlier settlers in the area included the English, Dutch, Swedes and Scots.
The early history of New Jersey was marked with considerable confusion
and quarrels over land and trade rights and trouble with the Dutch.
Nevertheless, the population continued to increase and there was notable
progress. Many farms were developed and they produced a variety of
fruits, vegetables, poultry and cattle. The green crop was important
enough to make New Jersey one of the "bread colonies" In 1686 Perth
Amboy was the port of East Jersey and was selected as its capital. The
County of Middlesex was one of the first counties created and a system
of courts and grand juries was established.

Prior to the outbreak of the Revolution, the population of New Jersey was
estimated at 138,000 The founding of the College of New Jersey, later
Princeton University, and Queens College, now Rutgers University, made
New Jersey the only colony with more than one college. The Revolutionary
Was proved a stimulus to agriculture, industry and commerce and a handsome
profit was made trading with both the Continental Army and the British. In
the early 1800's Carteret was an important community because of its roads
leading inland along the water fj-ont. It was the landing place for ferries which
provided transportation to and fj-om New York.
This district was once known as Rahway Neck and was mostly a farming
section, inhabited by 15 or 20 families. The splendid water front of Staten
Island Sound began to attract manufacturing enterprise and soon a settlement
of sufficient importance was developed to warrant the location of a Post
Office, which was called Carteret In 1906 there were two post offices
established in the Borough. One in Carteret and the other in the Chrome
Section. In Roosevelt the first was located at 575 Roosevelt Avenue. In
Chrome, the first was located at 89 Chrome Avenue. In 1922 the two post
offices were merged at 66 Cooke Avenue. It is now located on Pershing
Avenue. When the borough was being incorporated in 1906 cows were still
driven to pasture along Roosevelt Avenue, then known as Rahway Avenue.
The ancestor ofthe bus was the trolley which entered the Carteret scene in the
1900's, the trolley appearing first as a horse-drawn vehicle, in turn supplanted
the stage coach. The Carteret school system had its beginning as the first red
brick schoolhouse which still stands in West Carteret
In 1906 Carteret was a community with fj-ont flower gardens surrounded by
a countryside with charming scenery and reached by roads on which horse-
drawn "roadwagons" and family carriages was the mode of traffic. It was in
1906 when the borough became incorporated that the first banking institution
was established. The First National Bank, later known as Perth Amboy
National Bank (now Fleet Bank) opened its doors in the Chrome Section
where it did business during the greater part of its existence. They have built
their own building on Cooke Avenue, which is the Fleet Bank today. The
second banking institution was formed in 1923. The Carteret Bank and Trust
Company began operations in a small store and a few years later erected its
own building on Cooke Avenue. This building is now the Borough Hall
Annex.
In 1906 the Borough Council approved an ordinance creating a police
department. Eight men were appointed. Henry 1. Harrington, one of the
eight was elevated to Sergeant on July 8, 1908. He became the borough's first
Police Chief. Chief Harrington retired in March 1954 and George Sheridan,
Jr. succeeded him In the 1920's the Fire Company had horse drawn
apparatus. These same horses were used daily to haul garbage wagons in the
course of the day. If the fire whistle blew, they unhitched the horses and
raced to the fire.
For years the steamboat, Thomas Hunt, made a daily trip between New
Brunswick and New York stopping at Blazing Star and Union Landings in
Carteret Later, the Central Railroad Company of New Jersey extended a
branch of their road from Elizabethport through Carteret to Ambov This
became the favorite route of travel. After several important manuf~cturing
concerns located here and the town exhibited a natural growth, the Central
Railroad saw the advantage of having a spur into the heart of a thriving center
of trade, Chrome. Hence, the Sound Shore Road was built from Bay Way
through Carteret to Chrome.

Ms. Miles said it was an honor for her to read this. She thanked the Mayor
and Council and said in all the states in the world to live, that when the
21 st century comes in, she has a Mayor that she can be proud to say is her
Mayor. She hopes that when her daughter comes home from college,
she'll come back to Carteret and be proud to say she was born and raised
in Carteret She wished the Mayor good luck.
Council President Gutowski said he would like to take this time to
introduce some special guests in the audience. He introduced
Congressman Menendez, State Senator Joseph Vitale and Assemblyman
John Wisniewski. He introduced Mrs. McGreevey who was representing
her son, Mayor James McGreevey of Woodbridge.
KatWeen M. Barney, Municipal Clerk administered the Oath of Office to

Councilmember Mancuso thanked everyone for making the election a
success. There are so many people sitting here who helped. He thanked
them all for all the hours and hard work. He hoped they knew this
Council and Mayor appreciated everything they did. Last night he was
sitting home thinking about what he would like to see for Carteret. He
came across a quote rrom President John Adams that said "That fear is the
foundation of government." He disagrees with this quote. He wants the
people in the audience and the people of Carteret to believe that anything
they want to say to this Council will be accepted, whether good or bad,
whether they act on it or don't act on it. He thinks there will be an open
door policy that anyone can come to them. He got involved with this
because of his grandson. He wants to see this town become a people
town again. He wants to see things improve for his grandson and other
children in this audience. There is so much to be done and with the
cooperation of the people of Carteret backing the Mayor and Council to
do these things, he thinks they can accomplish this. We have a Mayor and
Council that will do everything they can. He thanked Jean Comba for all
she has done for them. He thanked Stan Gutowski. He is sure they will
see Carteret go far in the next year. He thanked everyone.

Councilmember Quinones said all across the state of New Jersey in the
568 communities, men and women, just like her, are approaching
microphones to express their exhilaration at having taken the oath of
office to serve their community. Many are doing this for the first time,
just like her. In fact, there might be hundreds who on November 3rd,
when the voters essentially said "Okay, you asked for it and now it's
yours." "The responsibilities that you promised would have your highest
priorities are yours." Voters might have said "I cherish my vote and I
have given it to you as a final trust that you will represent me the way I
might have represented myself." "That you will represent me with honor,
integrity, energy and dignity".

Councilmember Quinones continued "most of all you will represent me with
dignity. She wants everyone to know when she took her oath of office, she
not only heard the words, but the meaning of the words. The oath of office
is not the ending of a ceremony, but the beginning of an exciting new chapter
of her life. A3 corny as it sound, right now she is very proud of herself Her
goal is to make sure the citizens are just as proud of her as her current office
untolds. At the outset, she had said there might be people just like her making
comments, just like she is, but here in Carteret she had three significant
running mates. In the audience are people who have invested in us. Despite
all of this fj-aternity, she feels very much alone. She feels responsible for all.
It is quite clear to her that her decisions will be hers. Her decision to commit
herself to represent those who feel under represented when all is said and
done, the record she has established as an elected member of the Governing
Body is hers. Ultimately there are several principles that will guide her work
and the outcome. She knows she will be judged equally for the perception as
well as the reality of her acts. She knows she will be fully responsible for
what she says as opposed to what they hear, for what she writes as opposed
to what they read, for what they understand as opposed to what she means.
for those she may hurt unintentionally and for those she may offend
unnecessarily. She is confident that she and her colleagues can and will be the
best possible governing body there is. They can and will serve (inaudible).
Finally, she hopes that they realize that none of them, singularly, possess all
the answers and that only by working in unison can we (inaudible)
Councilmember Quinones told the audience that they have honored her by
electing her to this office. It is in fact, a thrill of a lifetime. She knows how
lucky she is to have received the opportunity serve the people of Carteret and
to have her family, friends and supporters. She knows how lucky she is to
have the opportunity work with our new Mayor Jim Failace and our Council
President Stan Gutowski, Jack Fazekas, Pat Crilley, Jim O'Brien, Jim
Mancuso, our fellow elected officials and our Chairwoman Jean Comba. She
is most certainly aware that she is the only woman among the
Councilmembers, a fact which leads her to this conclusion, as she joins her
colleagues in wrestling with budgets, (inaudible) and other policies and for the
quality of life in our borough, she promises that she will not be one of the
boys.

Councilmemoer Fazekas thanked the special guests, Stanley and friends as
well as everyone else for being here today to take part in this special occasion.
He thanked the Democratic Party and Jean Comba, especially the voters of
Carteret who have given him the opportunity to serve a second term. He is
most proud of the accomplishments ofthe Fire Department. He is also proud
that they were able to establish an Inter-local Agreement with Woodbridge for
library services. It is the first inter-local agreement of its kind. Under this
ab'feement, Carteret residents will be able to use the resources of Woodbridge
Library and when our library is completed, Woodbridge residents will be able
to use ours. He thanked both Calieret and Woodbridge Library Boards for
working together to accomplish this.d

Gutowski. He thanked them for putting up with him. He thanked
Congressman Menendez for enduring Carteret politics. It's very hard. He

Mayor James Failace thanked the audience. Fellow citizens, honored
guests, family and fiiends, I stand before you very proud to be the Mayor
of this great town. Very proud to join the ranks of the Mayors of the
surrounding towns and past Mayors of Carteret. Jim McGreevey of
Woodbridge, Joe Vas of Perth Amboy, Jack O'Leary of South Amboy and
George Spadoro of Edison, all of whom have offered their assistance if
he needs it and he will gladly take it. If he can do for Carteret what these
men have done for their towns we will truly be a proud community on the
move.

Mayor's Mayor Failace thanked his Council colleagues. They have had some very
Remarks rough times.

Mayor Failace thanked his Mom and Dad and said he stand here as Mayor
because of their values, because they taught him not only with words, but by
example, which as a parent he knows is sometimes a lot harder to do. Their --
fairness, work ethic, compassion and their love brought him to where he is
today. He told his mother he thought a big part of it were her Tuesday
morning Novenas to St. Jude, the Patron Saint of Hopeless Cases. He is
standing here as Mayor so it must have worked. He asked his mother to keep
going and thanked her and told her he loved her very much.
Mayor Failace thanked his wife, Carol. He told her he could have never done
any of this without her by his side. With the incinerator battles and Yes for
Change she has had to put up with so much over the years in my absence.
Yet, when I told her that I think I would like to run for Mayor, she said "if its
what you really want to do, go get' em". And we did, didn't we Her support
has never wavered, she is my strength. He told her he loves her.
To his daughters, Danielle and Sherri, he knows it hasn't been easy with him
not being around as much as he used to. They knew how important it was
to him to do this and they supported him every step of the way. He told them
he loves them.
To his son Matthew, who is in the Air Force, but is here with us today. He
told him how proud he was of him and his decision to serve. They have come
a long way. He told him about the times they used to go out in the cold and
snow putting up signs for one of his can~paigns or for Speakout. He is so tall,
they needed him because he was the only one who could put the signs high
enough so they couldn't be torn down. Most of the time he did it willingly.
He told him he loved him.
Speaking of Speakout, he would like to take a moment to give them a long
overdue thank you. The citizens of Carteret have no idea of the abuse and
harassment they went through to keep Carteret's air clean and our streets clear
of sludge carrying trucks. I will never forget the march on Borough Hall.
700 to 1,000 citizens making it quite clear to our governing body that we did
not want Passaic Valley sludge in Carteret. Were it not for these people we
would be burning sewer sludge in Carteret today. So again, I say a long
overdue thank you to Jim and Loretta Witanek, Nancy and Andy Garcia,
Rafaet Espinal, Mariano Santana, Sophie Cherepon, Ann Janis, Eldo Mangani
and the leader, the one who kept it all together, was the most abused and the
most harassed, Bobby Witanek He is proud to have worked so closely with --
Bobby. It's where he realized his love of politics and what a group of
dedicated people can do. I'm even prouder to have him as his friend. He
thanked them all. He told Bobby Witanek if he still has his phone list to keep 8
it ready, they may need it soon in their fight against Mayor Guiliani's New
York City garbage plan and he would sure welcome his help.
To the citizens of Carteret, thank you for your support. By electing him
and his colleagues they have told him that they approve of what they are
doing. They approve of the direction in which they are trying to move
Carteret. He promised them that they will continue to move Carteret
forward. In the past Carteret has been a laughing stock of Middlesex
County and the State. Carteret was only good for garbage, sludge
incinerators, garbage composters and that type of filthy polluting industry.
Not any more. With their help they can and will make Carteret a jewel in
Middlesex County. Our Library and Community Center with its beautiful
street scape will be completed this year. Our new Waterfront Park project
will begin this year He is happy to say that the long awaited rebirth of
Chrome will begin this year. Ladies and Gentlemen, it is not that far
fetched. Look what Jim McGreevey did on the Sewaren waternont.
Look what Jack O'Leary did on Main Street in South Amboy. Look what
Joe Vas did on the Perth Amboy waterfront As far as he knows they did
it with free money. Look what Carteret has done. Do you see it? He
doesn't either. They will go to the county, the state and the federal
government. They will take whatever steps are necessary to ensure that
Carteret gets its fair share and more. We deserve more to make up for all
we haven't gotten in the past, but he guarantees they will get in the future.
Please keep them in your prayers, they have a lot of work to do and can
use all the help they can get. Rest assured that he and this Council will do
everything in their power to move Carteret into the next millennium with
hope, pride and dignity. He thanked them.

The Clerk stated that on December 23, 1998, in full compliance with the
Open Public Meetings Act, a notice of to day's meeting was sent to The
Home News and Tribune, The Star Ledger and posted on the bulletin
board
Mayor Failace asked for a motion to nominate a Council President.
Councilmember Quinones said she was very honored as her first official
act to nominate Stanley Gutowski for Council President. Upon MMS&C,
by Councilmembers Quinones and Fazekas, Stanley Gutowski was
nominated. Upon unanimous affirmative vote of the full Council present,
Councilmember Stanley Gutowski was named Council President.

Mayor Failace called for a motion to adopt the 1999 Rules of Council.
Amended
Councilmember Crilley said they wanted to amend Section V, Standing
Committees to include Board of Education Liaison to the Rules of Council.

affirmative vote of the full Council present, the amendment was adopted.

BOROUGH OF CARTERET
ARTICLE I
The deliberations of the Council shall be governed by "Robert's Rules of
Order" .
ARTICLE 11
MAYOR
SECTION 1. The Mayor shall preside over the deliberations of the
Council and shall conduct the meetings thereof. He/she shall see that the
laws of the State and the ordinances of the Borough are faithfully
executed and followed He/she shall recommend to the Council such
ordinances, resolutions or actions that he/she shall deem necessary or
expedient and in the best interest and the welfare of the Borough. He/she
shall maintain peace and good order and have power to suppress all
tumultuous assemblies in the Borough. The Mayor shall oversee the daily
departmental and agency responsibility of the Borough. In his absence
this duty shall be assumed by the Council President. (See R.S. 40:87 et
seq. and 40:88-1).
SECTION 2. He/she shall, on all occasions preserve the strictest
order decorum, and he/she shall cause the removal of all persons who
interrupt the orderly proceedings of the Council.
SECTION 3. He/she shall decide all questions of order subject to an
appeal to the Council.
SECTION 4. In the absence of the Mayor, or if he/she is unable to
pelform hislher duties, the Council President (or, in his/her inability to act,
the Councilmember having the longest term as such in consecutive years)

ARTICLE III
ßOROUGH CLERK
SECTION 1. The Clerk shall perform the duties enjoined upon him/her by
revised Statutes of New Jersey and these By-Laws. (See R.S. 40:87-·54 et
seq.).
SECTION 2. He/she shall keep the minutes and ordinance books properly
and fully indexed and shall perform all the duties usually devolving upon such
officer; and in addition, such other duties or services as the Mayor or Council
may direct.
SECTION 3. He/she and/or the Deputy or Assistant Clerk shall be the
liaison oftìcer between the Civil Service Commission and the Borough of
Carteret.
ARTICLE IV
MEETINGS
SECTION 1. The Council shall hold an annual meeting on January First
at Twelve O'CLOCK Noon, or, during the first seven days of January in any
year (See R.S. 40:88-1).
SECTION 2. That at the aforesaid meeting the Council shall fix the time
and place for holding regular meetings during the ensuing year, which time
and place shall be the first and third Thursday of the month, with the
exception of July and August, which time shall be the third Thursday of the
month, 7:30 PM., at the Municipal Court/Police Facility, 230 Roosevelt
Avenue, Carteret, New Jersey. In the event of a holiday the meeting shall be
held on the Tuesday of the same week. The public shall receive due notice of
the meetings pursuant to the "Open Public Meetings Act".
SECTION 3. At the annual meeting, the Council will elect one of its
members as Council President to serve for the calendar year. (See R.S.
40:88-2 and 3).
SECTION 4. The Mayor shall, when necessary, call special meetings of 12
the Council, in case of his neglect or refusal, and four members of the Council
may call such meetings at such time and place in such Borough as they may
designate, and in all cases of special meetings reasonable advance notice
considered to be of forty-eight hours except in case of emergency shall be
given in person to all members of the Council, or left at their place of
residence (See R.S. 40:28-24)
SECTION 5. On the Thursday preceding every regular Council
Meeting, the Council shall meet at the Municipal Court/ Police Facility
at 7:00 PM.. This shall be known as the official Agenda Meeting. At this
meeting the agenda of that week's regular Council Meeting shall be
planned. Resolutions, ordinances or other items of business being
proposed by a Standing Committee or member of the Council shall be
considered by the whole Council. If the majority of the Council agrees to
put the proposal on the agenda for the business meeting, it shall then be
turned over to the Borough Attorney to be put in its proper legal form.
The Council shall be polled in alphabetic order to determine if any new
business will be proposed and the nature of its subject matter. Any
business not placed on the agenda shall be out of order and prohibited.
Where, however, the majority of the Council present at a regular, special
or adjourned meeting of the Council approve the matter not previously
listed on the agenda, such matter may then be considered. The public
shall receive due notice of the agenda meetings pursuant to the "Open
Public Meetings Act". Discussion at the agenda meetings shall be limited
to those invited to participate by the Mayor and Council.
SECTION 6. A quorum shall be provided by the Revised Statutes of
New Jersey, viz.; three Councilmembers and the Mayor, and in the
absence of the Mayor, four Councilmembers (See R.S. 40:88-1).
SECTION 7. If no quorum be present at any meeting, those
assembled shall have the power and are hereby authorized to set a new
meeting date, and then adjourn.
SECTION 8. The following order of business shall be observed viz.:
1. Call the roll
2. Moment of silent prayer
3. Pledge of Allegiance
4. Approval of minutes
5. Introduction of Ordinances
6. Public Portion on Resolutions
7. Introduction of Resolutions
8. Payment of Bills
9. Presentation of communications, petition, etc.
10. Reports of committees and department heads
11. Greeting of public and invitation of discussion
12. Adjournment
SECTION 9. The public shall be afforded the opportunity to speak on
the contents ofthe proposed resolutions. The public shall not be allowed
to address the Council while they are taking action on the resolutions. No
one may be allowed more than five (5) minutes when addressing the
Council.

SECTION 10. Reports of committees shall be presented by alphabetic
order of the members of Council.
SECTION 11. During the last public discussion portion of a Council
Meeting, each person recognized by the Chair shall be permitted to discuss
matters of public concern at said meeting limiting their speaking to five (5)
minutes per person.
SECTION 12. The aforesaid order of business at any meeting may be
changed by a majority vote of the members of the Council present at such
meeting.
SECTION 13. Except as otherwise required by the Statutes, or specially
provided in the By-Laws, all action of the Council shall be by a majority vote
of those present.
SECTION 14. Upon demand of one member of the Council, or when
ordered by the Mayor, or when directed by Statute, a roll call vote shall be
taken and the yeas and nays entered in the minutes of the meeting.
ARTICLE V
STANDING COMMITTEES
SECTION 1. The Mayor shall name all committees with such appointment
subject to the concurrence of a majority of the Council. The Mayor shall see
that all matters referred to the committees are acted upon and reported
promptly. Should a majority of the Council not concur in the appointment by
the Mayor of any Councilmembers to any committee, a majority of the
members of said Council are hereby empowered to make such appointment
SECTION 2. The following Standing Committees of the Council
consisting of three Councilmembers, with the first named Councilmember to
act as Chairperson shall be proposed at the annual Meeting, viz.:
1. Buildings and Grounds
2. Finance and Administration
3. Fire
4. Parks and Recreation/Shade Tree Commission
5. Police
6. Public Works
7. Board of Education Liaison
Committee members shall meet and/or consult during the first and fourth
weeks of each month as the need arises in order to conduct their respective
committee business. They also shall coordinate their common efforts, so as
to adhere to requirements of all local Ordinances and Resolutions, as well as
purchasing practices and procedures for the benefit of the Borough. Each
Councilmember shall be a member of at least one committee, and will be a
committee head of at least one committee, as an obligation of his council
duties. Failure of a Councilperson to assume these responsibilities may result
in appropriate action by the Council as a whole, e.g., withholding of pay and
benefits.

SECTION 3. In addition to other responsibilities, the Standing

1. DEPARTMENT OF BUlLDING~A.ND GROUNDS:
This committee shall be responsible for the proper
maintenance and janitorial service of all Borough owned
buildings.
2. FINANCE AND ADMINISTRA nON
The primary function of this committee is to assist the
Mayor and Council in the preparation ofthe annual
budget to be prepared on or before February 15, of
each year as well as providing assistance for the proper
coordination of purchasing functions and needs of the
departments and agencies which the Standing Committee
of the Borough represents
This committee shall be responsible for the personnel
and equipment ofthe offices of the Borough Clerk,
Assessor, Collection-Treasurer, Building Inspector,
Department of Welfare, Engineer, Auditor and Attorney.
In addition, the Chairperson of this Committee shall
also serve on the Welfare Board.
3. FIRE:
This Committee shall be responsible for the personnel
and equipment of the Fire Department, including all
fire houses.
4. PARKS AND RECREAnON/SHADE TREE
-COMMISSION
This Committee shall be responsible for the personnel
and equipment of the parks, playgrounds, senior citizens'
transportation and all recreation activities.
This Committee shall also be responsible for the
implementation and administration of the Shade Tree
Program.
5. POLICE:
This Committee shall be responsible for the personnel
and equipment of the Police Department and facility.
6. PUBLIC WORKS
This Committee shall be responsible for the personnel
and equipment of the Streets and Roads Department,
Municipal Garage Services, Recycling Department,
Sewerage Department, including street cleaning and
the borough dump.

SECTION 4. Standing Committees are appointed to expedite and
facilitate the work of the Council, but only within statutory, Borough
Ordinance and Rules of Council limits as the entire Council is held responsible
for any or all of its acts.
SECTION 5. A Standing Committee shall:
1. Plan, study and control within budgetary and statutory
limitations; carry on the routine activities for which it
has primary responsibility.
2. Perform such acts as may be assigned to it by the Council.
3. Report and make recommendation to the Council
regarding its responsibilities and activities.
SECTION 6. The Mayor shall not:
1. Make promises or commitments to anyone which
directly or by inference bind the Council.
2. Act in such manner or make decisions which set
a precedent or violate established Council policy.
3. Expend any money whatsoever, except with the
approval of the Council.
SECTION 7. Special committees shall be appointed for purposes other
than those included in the duties of the Standing Committees by a majority
vote of the Council.
SECTION 8. The Chairperson of each Standing or Special Committee
shall be prepared to report to the Council at each regular meeting on the
principal activities and achievements of his/her Committee.
SECTION 9. All department heads in charge of Direct Supervision of
Borough Employees, shall prepare and submit a monthly report on his/her
department activities and achievements and a report on the conduct of his/her
employees including sick leave, overtime and attendance. The report is to be
submitted to the Department Chairperson and the Clerk for proper filing.
ARTICLE VI
BILLS. CLAIMS & VOUCHERS
SECTION 1. All bills, vouchers, or claims against the Borough shall be
in writing and certified by the vendor, fully itemized and on such forms as the
Borough shall promulgate for that purpose through the Finance Department.
As required by Statute, said forms shall be sworn to by the claimant before
submission for approval and payment, verifying that the work or materials
have been supplied, or services rendered, to the Borough, in accordance with
specifications, plans or order. Borough Ordinance #45-1, et seq., sets forth
the specific procedures in connection with bills, claims and vouchers, and the
requirements thereto.

SECTION 2. Pursuant to the Borough's Purchasing Agent Ordinance,
Resolution #89-300 and other formerly adopted resolutions of Council
and State Statute, no vendor's request for payment, supplies or services
rendered shall be honored unless properly completed. No Borough
Officer, Official, Agency Head or any other Borough employee, may
purchase any article, item, material, service or equipment for use by the
Borough, except in accordance with the provisions contained in Borough
Ordinance 45-1, et seq. - Purchasing Agent.

SECTION 3. The route of purchasing requisitions, purchase orders,
vouchers, bills or claims to be paid by the Borough shall be in accordance
with the Purchasing Agent Ordinance 45-1, et seq., which shall govern all
purchasing within the Borough, and shall be the sole guide, subject to
requirements of State Statute. The Finance Department, having
confirmed compliance with the provisions of the Purchasing Ordinance,
shall refer all verified bills, claims and vouchers recommended for payment
to the Council. The Finance Department shall prepare a list of the total
amount of the individual vouchers approved by each committee, and
subsequently recommend for payment by the Financing Committee,
according to budgetary appropriations. The Finance Department shall
keep an accurate running total as to any appropriation for payment of any
particular account or accounts, or for any particular services or supplies,
so as to be available to provide this information readily. The Finance
Department shall also maintain costs and/or a voucher trail as to all
vouchers which have been paid and shall be paid. Authorization to draw
checks and pay the amount of the approved vouchers by the
Councilmembers shall be made by formal resolution of the Council, in
compliance with applicable State Statute. The Chief Finance Officer may
delegate the above duties/functions but in all cases shall be responsible for
compliance.
SECTION 4. Corresponding vouchers, invoices, or bills shall
accompany all checks drawn in payment thereof, when the said checks
are presented to the Chief Financial Officer, Mayor and Borough Clerk for
original and/or mechanical signatures.
SECTION 5. All bills, vouchers, invoices and paychecks shall be filed
in a safe place in the Finance Department Oftìce.
ARTICLE VII
AMENDMENTS
SECTION 1. The Mayor and any member of the Council may propose
amendments to these By-Laws, at any regular meeting or adjourned
regular meeting.
SECTION 2. The proposed amendment shall be considered for
adoption at the next regular or adjourned at a regular meeting of the
Council, after its introduction. The proposed anlendment shall be adopted
by a majority vote of the Governing Body present at the meeting and
shall become effective immediately

ARTICLE VIII
ADOPTION AND TERM
SECTION 1. The By-Laws shall be adopted by a resolution of Council
concurred in by a majority of the Members of Council. The By-Laws shall
become effective immediately after adoption and shall remain in effect for no
longer than December 31st of the calendar year in which the By-Laws were
adopted.
ARTICLE IX
SECTION 1. Any Borough Employee violating any of these rules shall
be subjected to disciplinary proceedings and may be suspended or removed.
ARTICLE X
The Borough Engineer, Borough Attorney, Borough Collector-Treasurer,
Borough Auditor and Chief of Police shall submit the following written
reports to the Mayor and to the members of Council:
I. A montWy report summarizing the progress of all matters being
handled or worked upon by each. This is a monthly "Progress
Report" to be submitted prior to the first meeting of the next
month.
2. Project or Case Report - Reports that will give in detail all facts
about the projects or cases completed by either or both the
Borough Attorney, Borough Engineer, Borough Auditor and
Chief of Police, to be presented before the meeting next
following the completion of the case or project.
3. Special Reports - To deal with any special information the
Borough Council may need to be informed on any new case or
project of either the Attorney, Engineer, Collector-Treasurer,
or Auditor. To be presented as soon as needed and requested
by majority vote of Borough Council.
4. Year End Reports - These will summarize work for the year by
the Borough Attorney, Borough Engineer, Borough Auditor
and Chief of Police. They will be presented to the Mayor
and Councilmembers prior to the first regular meeting of the
Council in the next succeeding year. They will serve to
acquaint new officials with prior and continuing activities of
the Borough Attorney, Borough Auditor, Borough Engineer
and Chief of Police.

Councilmember James Mancuso again thanked everyone. He said he was
a little nervous before and he forgot the most important thing in his life,
which was his wife He told her he loved her very much and thanked her
for her support. He thanked his daughter, Jamie and son-in-law Richie.
Councilmember Remy M. Quinones said (inaudible) predecessor, they
won't go broke in 1999. She wished everyone a Happy New Year and
thanked them.
Councilmember James O'Brien was inaudible. He thanked everyone.

Council President Gutowski said four years ago there were three people
sitting in the diner in West Carteret. Having coffee and talking about things
they thought should be done for the town and how they would like to go
about doing those things. It's hard for him to believe, but those three people
are sitting before them today. One of them is the new Mayor, one is the
Council President and the other one is Councilmember Fazekas. They had a
vision four years ago. They spent a lot of time and everyone has joined them
and it has been a lot of fun. These people work very hard. Their vision has
come true today. This is just the beginning of it. They know they have a lot
of work to do and they have begun to do it. He just want to remind them all
that that vision was very important to the three of them. They are all a team
and he asked that they not lose sight of that vision. The vision was what was
right and what was best for Carteret and they will never lose sight of that
vision. He thanked everyone.
Mayor Failace wished everyone a healthy and happy New Year and told
everyone that they will do whatever is necessary to move Carteret forward
Carteret will soon be a proud community on the move. He hopes he will
make them proud that they elected him.
BENEDICTION
Reverend Edward Puleo of St. Joseph's Church gave the benediction.
