Failace at approximately 7:30 P.M., on Thursday, March 18 ] 999 at the Municipal CourtlPolice Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll. call, the following were noted present: Councilmember Patrick Crilley Stanley Gutowski James Mancuso James O'Brien Remy Quinones " " " " Noted absent was Councilmember Jack Fazekas. Also noted present was Borough Attorney Craig J. Coughlin. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor James A. Failace. The Clerk stated that on March ]2, ]999, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News Tribune, The Star Ledger and posted on the bulletin board. Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, the minutes of May 2], ]998, January 21, February 4, ]8 and 25, ]999 were approved as transcribed and engrossed by the Clerk. This was the night advertised to receive bids for the sale of the Snorkel Fire Truck and the Mayor called for all bids. Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, the Clerk was directed to open and read all bids received which were as follows: BIDDER 1. Upon MMS&C, by Councilmembers Crilley and Gutowski RESOLUTION #99-104 "RESOLUTION TO READ BUDGET BY TITLE ONLY" was adopted. Upon individual roll call vote, Councilmembers Crilley, Gutowski, Mancuso, O'Brien and Quinones voted in the affirmative. Councilmember Fazekas ,vas noted absent. Upon MMS&C, by Councilmembers Gutowski and Quinones and unanimous affirmative vote of the five (5) Councilmembers present, the Public Hearing on the 1999 Municipal Budget was opened. There being no comments or objections, upon MMS&C, by Councilmembers Gutowski and Mancuso and unanimous affirmative vote of the five (5) Councilmembers present, the Public Hearing on the 1999 Municipal Budget was closed. Mayor Failace thanked Councilmember Quinones, Patrick DeBlasio, Gary Higgins and members of the Finance Committee for their time and effort on this budget. There are a lot of things to be done this year. He mentioned the roads had to be fixed, the sewer project has to be done. We have the mandate regarding the Underground Storage Tanks. We have severance pay that has to be paid out. It's higher than it has been in the past, but with all the things they had to do with this budget they did a good job. The Clerk stated that Ordinance #99-7 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough ofCarteret held on March 4, 1999 It was duly published in The Home News Tribune on March 9, 1999 with notice that it will be considered for final passage after Public Hearing to be held on March 18, 1999 at approximately 7:30 PM.. Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, the Mayor declared the Public Hearing to be open. JOHN McNULTY asked what the salary would be? Mayor Failace said it was the creation of a position. The salary $22,000. It's the same salary as the person has now. Councilmember Fazekas was noted absent. 10 The Clerk stated that she was in receipt of a resolution from the Township of Old Bridge requesting the FAA institute a live trial of ocean routing that could result into jet noise and air pollution reduction Upon MMS&C, by Councilmembers Gutowski and Crilley and unanimous affirmative vote of the five (5) Councilmembers present, it was ordered to be received and placed on file. The Clerk stated that she was in receipt of a resolution from the Monmouth County Board of Chosen Freeholders opposing a plan by New York City to ship its garbage to transfer stations in Northern New Jersey. Upon MMS&C, by Councilmembers Gutowski and Crilley and unanimous affirmative vote of the five (5) Councilmembers present, it was ordered to be received and placed on file. The Clerk stated that she was in receipt of the following reports: 1. Air Pollution - December 1998 and January 1999 2. Board of Health - February 1999 3. Inspection of Buildings - February 1999 4. Office for the Disabled - 1998 Annual Report 5. Sewage Collection System - February 1999 Upon MMS&C, by Councilmembers Gutowski and Crilley and unanimous affirmative vote of the five (5) Councilmembers present, all reports were ordered to be received and placed on file. Mayor Failace said they were going to move the committees around again. BOARD OF EDUCATION: Committee Chairperson Crilley said they have another meeting on Tuesday regarding shared services. They met a month ago and they are going to continue that dialogue. He reported progress. - PUBLIC WORKS: Committee Chairperson Mancuso said the water main break was fixed. They had another break yesterday and they are working on that. He mentioned the sewers and said there has been a lot of neglect so a lot of money has to go towards fixing them. He spoke about the smell coming from Dauman Pallet and he said even if a complaint is made, the organization is allowed to resolve it within four or five days and when the State goes back, that's the end of it. He said he would advise anybody to wlite to the State and hopefully they can get the law changed. He also told the people in the audience to call the County to complain. The inspectors go out there and give them a fine and that's it. He said he told Mr. Malek what he had to do. He told him to call the county every time the smell was there. He reported progress. .1 POLICE: Committee Chairperson Gutowksi said the interviews for the Police Director are proceeding They have interviewed five candidates and will have the selection made next week. Jet Noise Monmouth Board of Chosen Freeholders NYC Garbage REPORTS Departments Standing Committees t\ARCH 18, 1999 Standing Conmittee Police Continued Committee Chairperson Gutowski said he had some questions about the fence at Roosevelt and Carteret Avenues where Matzel and Mumford are building their new project. That road is private property owned by the people who are constructing the apartments. He said he was concerned when he found out the fence was being put there because there are a few apartments on that road People need access to their apartments, but there is a driveway on Roosevelt Avenue. His main concern about blocking that road was the safety of the kids at Columbus School and the parents parking their cars on the street when they come to pick up their children. There was an accident last week when a dump truck pulled out of their lot. He forgot he had his bucket up and he tore the wires and the poles down The people who owned the property were concerned there might be another accident of that nature, so they blocked the street off He said the police have been provided with a key to the Industrial Road side in case emergency access is needed. If need be, the fire trucks can knock the fence down. Committee Chairperson Gutowski said he will be addressing the situation of the bus stop on Blair Road with the Council at the next Agenda Meeting. There have been summonses issued for passing the bus. It is a concern of the Governing Body One of the Captains of the Police Department will be making recommendations to the Council. Committee Chairperson Gutowski said since he has been elected and sat up here he has basically left politics at the door. He doesn't discuss partisan politics He doesn't think this is the place to do it. Yesterday they had their second contract negotiation session with the Carteret P.B.A. It didn't go very well as far as he is concerned. The first meeting they gave us their proposals for their contract which the Council accepted. The meeting held yesterday was for the Council to give their proposals to the P .B.A. They weren't very well accepted That's understandable. We have to start somewhere. They come in with their proposals and they might think they are fair and he might think they are not and vice-versa. They will sit down like ladies and gentlemen and work it out. He doesn't like to hear what he heard on the street and that's threats. Political threats. He said he leaves politics at the door. He said threats have never bothered him. He has been in politics for 30 years. He doesn't listen to them, if someone wants to target him that's fine. He has a life outside of the Council. He has a lot of fun doing this and while he is here he is going to do what is right and what is best not for himself but for the citizens of Carteret He said the citizens are the home team and he represents the home team and the visitors are the employees. The Council has to represent the home team's needs They have to be concerned with their needs which are basically their wallets and taxes. They have to sit here and make decisions that effect them They are going to do what is right and best for the citizens of Carteret, not for a particular union. He will never bow to the threats. Ifit's the right thing the citizens will let him know, not some union He is here to serve the home team. 1: PARKS & RECREATION: Committee Chairperson Crilley said the Three-on-Three Basketball Tournament is running now at the High School. They might be able to finish up tomorrow night. They are charging $1 00 admission for adults and that will be donated to the Food Bank in town. The Easter Egg Hunt will be held on March 28, 1999 at 2:00 P.M. at Carteret Park. The Middle School Basketball Program ended this weekend. There were over 100 6th, 7th and 8th Grade children involved in the program. The kids had a lot of fun We're getting into the Spring baseball-softball season, so a lot of the work in the Parks Department will be on the ball fields ready and getting the parks in shape. Shorecrest Park's basketball court was finished this week. They will be putting a moratorium on tree cutting. If anyone wants a tree cut, they will have to bring $80.00 to the Borough Hall Annex and that's for the replacement tree. From the Spring until the early summer they will not be cutting trees unless it's an emergency. He reported progress FIRE: Committee Member Gutowski said there have been a couple of house fires in town in the last couple of weeks. He said he has been privileged to watch our Fire and Police Departments in action and he said they do one heck of a job. No one was seriously hurt and they managed to save the structures and get everyone out. He commended both the paid and volunteer firemen and the police department for doing a fabulous job. With that, they are doing well. . 3 FINANCE AND ADMINISTRATION: Committee Chairperson Quinones said with regard to the budget, Pat DeBlasio has submitted our application for discretionary aid and we anticipate hearing something on that within the next several weeks. The budget is not in its final form tonight and they are looking to cut it prior to adoption. Hopefully, they can do more than they expected depending on how much discretionary aid they receive. They are through with the hiring the Police Director and they will be looking to hire a Business Administrator which she feels they need to move forward with their plan to professionalize services in the borough. She said she was very personally disappointed in some of the things she heard today. She said she was the Borough Prosecutor in town and felt she had a very good relationship with members of the Police Department and the P.B.A. When she heard that threats were being made, whether they were direct or indirect on one Councilmember , then she feels they are being made against all of them because they work as a team. She said those that know them, know they do so. She would also like to say to everyone, not just these people making these threats, that people have a real short memory When she was the prosecutor, many police officers confided in her about the nightmare that many of them individually experienced under the prior administration when they were threatened, harassed, targeted and a host of other things. Then they come to her and tell her things are so much better in the last year or two then they had been in a long time. So, when she hears these threats, quite fi'ankly, she doesn't get it and she doesn't know what people are thinking. She said they work for the taxpayers in town. Not for one union, not for every union. As long as they are all here they will continue to do that. HARm 18, 1999 Standing Committees Continued t1ARŒ 18, 1999 Standing Corrrnittees Continued BUILDINGS & GROUNDS: Committee Chairperson O'Brien said the purchase order for the water heater and gas lines for the Police Building has already been signed and work has begun. They have worked with the generator in transferring power and that has been looked into. At the Fire Building, the generator for the West Carteret Firehouse is being checked. The bathroom on the first floor of the main firehouse is being worked on. The electrical upgrade in the Annex is complete. At the Annex II (Toth's) the Local Assistance Office, Recycling and Recreation are located there. The Recreation and Recycling Offices are on the 2nd floor.. He thanked Councilman Mancuso for overseeing the move and having some of the guys from Streets and Roads help Ray and Jason move everything. Finally, Borough Hall. Right now it is still standing. For how much longer, he doesn't know. With the condition of the building we now only have a dozen or so employees left in Borough Hall. The first problem we have to deal with is the health factor with the air. The air quality was tested last Friday. They are expecting a preliminary report by next Wednesday on that. Due to the impact that this could have on the (inaudible), they are trying to deal with the water and mildew problem first. Besides the health problem, water is causing major damage to the walls and floors of the old Agenda Room, the Mayor's office and various other offices. Potter Architects was in last Friday to check the water problem which has gotten worse in the last few weeks. There are currently two quotes to repair the gutter damage that is inside the walls causing a lot of water problems within the walls and seepage. They also found out last Friday that the roof that is currently on the building is a 20 year roof that is in its 30 years of existence is also ready to go. We are getting quotes for that and will suggest it at the next Agenda Meeting. To deal with the water problem and dampness on the basement floor, which is currently empty, they have gotten some prices on dehumidifiers to try to lessen the dampness. In order to best serve the public is to have everyone located in one building. The problem they have with Borough Hall is it is falling apart. Literally. You can see the cracks in the walls ITOm water. These problems didn't occur overnight. They have been there. The problem is that past administrations always did patch work problems and never wanted to undertake massive projects of repair and now we have to. We have to seriously discuss what has to be done. He again mentioned everyone centralized in one building. Whether it's renovations to Borough Hall or maybe a brand new building. State Senator Vitale is keeping his eyes out of grants. He has spoken to John Riggio who will speak to the State about grants and find out what is the best and most cost effective way to handle these problems He reported progress. ~1ayor Mayor Failace said he would like to say Borough Hall is a mess and he would take anyone over there to look at it. The old Council Chambers' floor is coming up. At one of the hearings, parts of the ceiling were falling down while people were in there. He said they will look at the most cost effective way to look at the problem. In the paper he said that he favored a bond and that makes everybody nervous, but the bottom line a bond will be the last resort We will see exactly what we have to spend on that building and see if it's prudent to spend $100,00 to $300,000 on a building that is that old. We may be able to retrofit it at a cheaper price. We may have to move all the borough employees out. That's the main concern. The safety of the Borough Employees. Number one We have to service the people and don't want them to drive all over town in order to pay taxes or see the Borough Clerk. We will have a feasibility study done and see what we can do with it. Mayor Failace said he received some good news today. They didn't get any money, but we received a letter from the State in reference to Y2K. He said Councilmember Fazekas mentioned it briefly. We are in a bit of a fix with that also. There could be hundreds of dollars necessary to put our computers in the right frame for the year 2000. We were fortunate that we put in a new accounting system last year that is in compliance with Y2K. People won't have any problem paying their taxes. We also have millions of dollars of sewer work that is necessary. We have streets that have to be fixed. That's part of the increase in our budget. We didn't create the problem, we inherited the problem. The best way we can do this for the borough without putting the burden on the taxpayers, we will do, but there are millions of dollars worth of projects that have to be done. The problem with the tanks was known in 1990. He doesn't know why nothing was done back then, but it will probably cost 5 times as much to do it now. Some of the sewer problems were known in 1988. Why they are being addressed now, he doesn't know They are addressing them and looking for money Al Beninato has filed for some money from the State. Congressman Menendez has put in a bill where they might get some money. Whatever they can do they will and they will try to be most cost effective. The bottom line is these things have to be done. Not only is the Borough Hall crumbling, there are a lot of parts of town crumbling and we must address them. Councilmember Mancuso addressed the audience and told them if anyone has pot holes in front of their homes to please call Mr. Surick at the garage. Mayor Failace said they have spent some money on fixing the roller so they can do the pot holes and do them well. They are looking to get a used backhoe so they can fix the larger pot holes themselves. They are looking at every way to save money. To do it the most cost effective. Upon MMS&C, by Council members Gutowski and O'Brien and unanimous affirmative vote of the five( 5) Councilmembers present, the meeting was opened for public discussion. UNIDENTIFIED WOMAN said on behalf of all the Mobile Home Residents in Carteret they are really grateful for all that has been done in opposing the gas station expansion. She thanked Mayor Failace. Councilmember Gutowski went to the meeting where the gas station withdrew it's application. A lot of Carteret residents were there. It was nice to see our government was behind them They appreciate it. L5 Mayor Failace said it was a quality oflife issue for all of them and he was glad they could help. He said they will have to stay on top of it because they will not know when it will come back. HARŒ 18, 1999 Mayor Continued Pot Holes PUBLIC DISCUSSION Hetro Gas Station Expansion tlARŒ 18, 1999 Borough Hall UNIDENTIFIED MAN said he read the article in the paper about the Borough Hall having to be redone. He said he found it strange that they took a falling down ShopRite and spent 5 million dollars on that instead of building a new one and now he hears talk that we need a new borough hall. Mayor Failace said not necessarily new. The man said that is what it said in the paper. Mayor Failace said that doesn't mean new. It could be retrofitted, if that is the way to go. The bottom line is the condition of the building itself. The gutters are inside the building and the water is running and leaking into the walls and they are deteriorating. They would love to salvage that building. It's a beautiful old building and he is in favor of that. If they can salvage that building they will. The whole building has to be gutted and retrofitted. If it can be done. If not they will tear it down. They will have to do it the most cost effective way Street Repair The man said he would like to salvage his street. He has been living in town for 40 years and paid taxes for 40 years and his street has never been resurfaced once. He said they spend money on a lot of things and the roads in town are falling apart. It's a disgrace to drive through this town. One time they had a sign on his street that they were going to resurface it and then they found out Councilman Umansky didn't live on that street. They took the signs down and resurfaced his street. Mayor Failace said they have a program to do x amount a streets a year. He said the streets in Carteret are an embarrassment. The man said lip service doesn't get them done. Mayor Failace said last year they spent $300,000 on streets. The man said Post Blvd got resurfaced and it was resurfaced 9 years ago Mayor Failace said it was done for ftee and it couldn't be done anywhere else He said he doesn't disagree with the man, but they have a comprehensive program. The engineers went around and checked the streets. He said they are trying their best to rectifY it. They didn't create the problem. Councilmember Mancuso said it is not the Council's fault that he was waiting ten years. He sat in the audience for many years and didn't hear any complaints. People call every day. If they could do everyone's street they would do it. There will be more streets resurfaced, sewers fixed, manholes corrected than what has been done in this town in 15 years. We can't do it overnight. We're trying the best they can. He went around with the engineer and Ted Surick and he went. The streets were prioritized. There are a lot of bad streets and they will be fixed. Roosevelt Avenue ALPHA MUHAMMAD said if something needs to get done, get it done. They speak of the sewer problem. It doesn't matter when it had to be done, just get it done. His second concern is Roosevelt Avenue. He said the Police do a good job, but there is a lot going on on Roosevelt Avenue. They had a meeting with neighborwatch The citizens want to help law enforcement, but they need help. When the kids get off from school and see a drug dealer something has to be done He said a lot of communities have a camera That's a suggestion He said it's really disgraceful and they see it He asked the Council to help them 1 Councilmember Gutowski said they have started Police negotiations and one of the things he hears is we should have a better police department. These negotiations will give us a better police department. That is the goal here. The director is here The adoúnistration is doing a good job. Chief Barany and the two Captains working under him are moving in the right direction. It's not should be, or could be, . but would be. They are looking for any help they can get. There are six new officers coming in June. They are going to have retraining in the Police Department. A lot ofthings weren't done in the past, but they will be done now. The roads and sewers weren't done in the past, but they will be done now. We need more police in every part oftown and we will supply them. That's what these negotiations are about They understand the feelings and we need more help from the police in all parts of town. Ms. GAYDOS questioned the speed limit on the Industrial Road. Councilmember Gutowski said it was 45 MPH.
