AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING SANITARY SEWER EASEMENTS OVER PORTIONS OF PROPERTY LOCATED IN CAPITAL CITY HIGH SCHOOL SUBDIVISION. WHEREAS, it has been shown to the City Council of the City of Jefferson, Missouri, that the owners of Capital City High School Subdivision have petitioned the City Council to vacate certain sanitary sewer easements; and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue the sanitary sewer easements for public use as described in Section 1 of this Ordinance. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1 . The City Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue sanitary sewer easements in portions of property contained within Capital City High School Subdivision, in the City of Jefferson, Missouri, and forever vacate the following described sanitary sewer easements in said City: A portion of the 10' wide sanitary sewer easement of record in Book 245, Page 291, Cole County Recorder's Office, being situated in the Southeast Quarter of the Northeast Quarter of Section 15, Township 44 North, Range 12 West and the Northeast Quarter of the Southeast Quarter of Section 15, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri, more particularly described in Exhibit A. Also; all of a 15' wide sanitary sewer easement of record in Book 496, Page 70, Cole County Recorder's Office, being situated in the Southwest Quarter of the Northwest Quarter of Section 14, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri. Section 2. The statutory right of reversion in the owners of the abutting property is hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the reversionary rights of the owners of property abutting on the area vacated, as described in Section 1 of this ordinance, in the right-of-way vacated. Section 3. This Ordinance shall take effect and be in full force from and after its passage.
