HomeMy Public PortalAbout1999/05/06 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor James A. Failace on Thursday, May 6, 1999 at approximately 7:30 P.M, at the Municipal Building/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: Councilmembers Stanley Gutowski James Mancuso James O'Brien Remy Quinones " " " Noted absent were Councilmembers Jack Fazekas, Patrick Crilley and Borough Attorney Craig J. Coughlin. Also present was Douglas Walsh, Esq. The meeting was opened with a minute of silent prayer and the Pledge of Allegiance led by Mayor James A. Failace. Mayor Failace asked everyone to remember Phil Reibis in their prayers. Mr. Reibis passed away. He was a valued member of our Community and worked with our children with Little League for a long time. The Clerk stated that on April 30, 1999, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News Tribune, the Star Ledger and posted on the bulletin board. Upon MMS&C, by Council members Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, the minutes of July 16 and 27, 1998 and April 1, 1999 were approved as transcribed and engrossed by the Clerk This was the night advertised to receive bids for the sale of the Snorkel Fire Truck and the Mayor called for all bids. ORDINANCE #99-16 "ORDINANCE AMENDING CHAPTER 160 OF THE CODE OF THE BOROUGH OF CARTERET" The Clerk stated that Ordinance #99-13 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough of Carteret held on April 1, 1999. It was duly published in The Home News Tribune on April 15, 1999 with notice that it will be considered for final passage after Public Hearing to be held on May 6, 1999 at approximately 7:30 P.M.. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the four (4) Councilmembers present, the Mayor declared the Public Hearing to be open. There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Gutowski and Mancuso and unanimous affirmative vote of the four (4) Councilmembers present. FRED GERSTLER asked why they were amending the salary? Are they giving him more money. Mayor Failace said absolutely not. He said with the creation of that it is not any more money. Mr. Gerstler asked about the thing about continuing the Police Director's education? Mayor Failace said that was part of the contract. As we pay for education for any member of the Borough that wants to go to school Mr. Gerstler asked if that was basically the rule of thumb if someone works for the borough wants to go to school Mayor Failace said not to take Tennis 101. Councilmember Quinones said it was part of the Police contract. Mr. Gerstler asked ifMr. Elg would be residing in the borough? Borough Attorney Coughlin said he could ask that during the Public Portion of the meeting, not at this time. There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the four (4) Councilmembers present. The Clerk stated that she was in receipt of an application for membership for Volunteer Fire Co. # 1 for Joe Prado. The Clerk stated that she was in receipt of a resolution and a Notice of Public Hearing from the Middlesex County Board of Chosen Freeholders, to be held May 20, 1999 in New Brunswick, New Jersey regarding Open Space. Upon MMS&C, by Councilmembers Gutowski and Manêuso and unanimous affirmative vote of the four( 4) Councilmembers present, it was ordered to be received and placed on file. 10 The Clerk stated that she was in receipt of an ordinance from Woodbridge Township regarding Land Use and Development. Upon MMS&C, by Councilmembers Gutowski and Mancuso and unanimous affirmative vote of the four (4) Councilmembers present, it was ordered to be received and placed on file. The Clerk stated that she was in receipt of a resolution from the Borough of Highland Park endorsing the return of the USS New Jersey to a New Jersey site. Upon MMS&C, by Councilmembers Gutowski and Mancuso and unanimous affirmative vote of the four (4) Councilmembers present, it was ordered to be received and placed on file. The Clerk stated that she was in receipt of a resolution form Old Bridge Township urging the State of New Jersey to maintain state aid to municipalities at the current level. Upon MMS&C, by Councilmembers Gutowski and Mancuso and unanimous affirmative vote of the four (4) Councilmembers present, it was ordered to be received and placed on file. The Clerk stated that she was in receipt from ENSR a Notice that Transcontinental Gas Pipeline Corporation is applying to the NJDEP for Various Wetlands Permits Re: Woodbridge and Raritan River Loops. Upon MMS&C, by Councilmembers Gutowski and Mancuso and unanimous affirmative vote of the four (4) Councilmembers present, it was ordered to be received and placed on file. The Clerk stated that she was in receipt of a proposed resolution from the Carteret Planning Board amending Chapter 78-24 of the Carteret Zoning Ordinance. It looks great. The only area there is a problem with is right outside of the Police Building. People have a tendency to throw garbage and cigarette butts. If anyone sees that happening, please ask them to stop. At the Fire Building they are looking at stripping and refinishing the floor. The job is almost done on the bathroom. The generator is almost ready at the West Carteret Firehouse. He will check out the lights at the Senior Building. We received some quotes previously and it will cost between $6,000 and $7,000 to replace the ballasts. He has spoken to Tony Niebert who has a few ideas to do it cheaper. At the Toth Building there was some electrical work that was request that has been completed. At Borough Hall the lining of the gutters were done. The roof should alleviate any further water problems. Tiffany-Bader was retained this evening to do the air quality work and Eric Betz will be helping them plus a few different contractors will take a walk through Borough Hall next week to take a look at the work and submit quotes the following week. Councilmember Mancuso has a friend of his doing some work. He is putting in a gate in the Clerk's Office which is saving us quite a bit of money. Potter Architect has some specifications regarding the number of employees that will be put back into Borough Hall after it is retrofitted They are putting together some possible costs and layouts currently at no charge. Ray Tobias is doing a lot better. He is home. He is itching to come back. Our prayers are still with him. With that the buildings are still standing. FINANCE & ADMINISTRATION: Committee Chairperson Quinones said she spoke to Patrick DeBlasio earlier this week and he advised her that they probably wouldn't hear anything about the discretionary aid until early June. On Monday night she asked those interested to attend the School Board Meeting at 7:00 P.M.. They intend to conduct a review and hopefully we can provide a tax relief to our citizens without adversely attacking the educational program She welcome Chris Elg, the Police Director and wished him good luck in his new position. She made a correction to a letter to the Editor regarding the amount paid for the dog. The letter said we spent $1,000 to purchase the dog and $3,800 to train the dog. That is absolutely incorrect We spent $3,800 for the total package which included training of the dog and handling of the dog People may not agree with everything they do and that is okay, but they as a Council made a decision that this was the most humane and efficient way to resolve the problem. Another point that has to be reemphasized is that these animals (geese) are federally protected. We don't need another government agency imposing fines on us similar to the one that was imposed on us for $50,000 by the DEP because of illegal sewer hook- ups. She reported progress. FIRE: Committee Member Gutowski said he wasn't aware he would have to give a report. He reported progress. 12 PARKS & RECREATION Committee Member O'Brien said the dog is doing fine and the parks are being used. He reported progress. POLICE: Committee Chairperson Gutowski welcomed Mr. Elg and said it was great to finally have him here. He said there have been bomb scares in the schools. On Thursday, he met with Acting Chief Barany and there were a number of problems that were supposed to take place. They held over the shift Friday morning and Friday afternoon and it worked very well. There was a bomb scare yesterday at the High School and also one at the Middle School. The Police Department has a suspect in the first incident. He met with Dr. Vitta today and told him if this is the person that made this threat, we as a Council and the Police Department will pursue this as far as we can. Legally we can charge the parents for all these overtime cost that we have incurred. Overtime for the Police Department and for the dogs when they come. Luckily we haven't been charged for the dogs yet. We have incurred about $3,000 in overtime so far. Plus an additional cost of $4,000 if we paid for the dogs. Right now we are standing about $7,000 for these three incidents. We will go after these people and prosecute them. We are more concerned with the safety of the children. This has to stop. We have to set an example. We have been very lucky. Our Police Director said 99.99% of the time nothing happens, but that one tenth of one percent, God forbid something happens. We are going to go after the kids and the parents. We have to hold someone responsible for this. He told Mr. Elg it was good to have him here and he reported progress. PUBLIC WORKS: Committee Chairperson Mancuso said talking about State mandates and fines, we are under mandate to get rid of all the water at the Recreation Center, to put in pipes and pave it. It will cost about $70,000. With the help of Teddy and Bob Kately and their men, it ran us $20,000. We saved about $40,000. We are going over everything and if we find there are things that our people can do, we will do it instead of paying someone else. In the park we had a water main break right under the playground and a completely new line has to be put in. We don't know what the cost will be on that, but we will do it ourself and save a great deal of money. He reported Progress and wished Mr. Elg good luck. BOARD OF EDUCATION: Committee Member James O'Brien said they are meeting with the School Board on Monday to review their budget. As a teacher, he is definitely in favor of keeping as many programs as possible, but he knows it can be done in a very cost effective way. He received a grant of$10,000 ITom the Mobil Foundation for our Library to use any way we choose. Since we appropriated for furniture, he would like to see them pick up a few more computers for the library. Between the library and Senior Center they will probably have 25 to 30 computers. That's a move in the right direction. The Library is starting to take some shape. The windows are in and they will be making it water tight in the next few days. They are working on the roof. Skylights are going in and they are going to be gorgeous. He wanted to know if that was true or not? Mayor Failace said Mr Elg would not be living in Carteret. Mr. Gerstler asked if they felt bad about that? Council President Gutowski said there is a state statute that says Police Officers don't have to live in the town they work in. The best case scenario would be to have every Police Officer that works in this town live here, but they don't Mr Gerstler said they could have negotiated it in the contract. Council President Gutowski asked Mr. Gerstler if he was telling him he wanted them to dictate to the new director where they want him to live? Mr. Gerstler said no. He wants to make sure they have someone that wants to be part of our community. Council President Gutowski said he thinks they have found him. Mayor Failace asked Mr Gerstler ifhe believed that our Police Officers don't want to be part of our community? Mr Gerstler said most of the Police Officers live here in town. Council President Gutowski said two out of the three last Police Chiefs we had didn't live in town. He asked him how did he explain that? Mr. Gerstler said it is their administration now. He said he would like to see more people who are working in this town, living in this town. Council President Gutowski said there is a Police Officer in the back that doesn't live in town, but yet when the PEA., sponsors the Fishing Derby or whatever they sponsor, Lt. LaPoint is here. He is part of this community although he doesn't live here. That doesn't mean he doesn't want to be active in this community. Mr. Gerstler said even though there is a law, it would be nice to have people involved in Carteret, living in Carteret. Councilmember Quinones said they agree with him, but she believes the officers that don't live here are part of the community and they don't see t being separate. You can live outside of a community and still have an interest here because you work here. Mr. Gerstler said he understood all that. Officer LaPoint was born and raised in this town and he lives three blocks from Carteret in Port Reading, so that is kind of close 16 Council President Gutowski said Mr. Gerstler asked a question about education of our Police Director and they will certainly pay for his education because they feel it will benefit the department. Prior to 1998 they paid any police officer $15.00 a credit for every police credit that they take Anybody that came on after 1998 we give them a tuition reimbursement and their books. If they achieve a degree, we pay them an additional stipend on top of that We want them to go to school. Mr. Gerstler asked ifthere was anything in there saying if they are taught on the borough's money that they have to at least stay around for a certain period of time so at least we can benefit from the knowledge. Council President Gutowski said he didn't think the Police Officers are going to retire any time soon. Council President Gutowski said it is in the Police Contract and in the Fire Contract. If they go to school and learn about their profession, we are willing to pay for that because it will only help us in the long run. Mr. Gerstler said he had no problem with that. Council President Gutowski said they are taking the same stance with our Police Director. Counci1member Quinones said she knew of some Police Departments that are requiring their officers to undergo continued education in order to be considered for promotions. We certainly don't have a problem with that. Mr. Gerstler said he didn't either. TOMMY SICA said he gave the Mayor a letter showing that the Housing Authority has received another million in grant money and they have had a confirmatory audit from HUD. He will make a copy available to everybody else. On the audit, Carteret is the only ones that they know of in the State of New Jersey that got 100%. Your Housing Commissioners are doing a great job. They audited our books, our dwelling structures and everything else. Our modernization funds, etc. A couple of weeks ago some members of the Council said the Housing Authority was giving themselves accolades. It appears that the Federal Government thought that the Housing Commissioner did the same good job. Our Main Stream Program will be going online on May 15th and it will be taking care of elderly handicapped people also. That's the $700,000 grant. In the past three years the Housing Authority has come up, in grant money, approximately $3,000,000 more per year. That's a continuing program that goes on each and every year. P AT TOZZI said the state law now has energy deregulation beginning sometime on August 1 st. He attended a meeting given by Senator Vitale yesterday and he hopes the Council works together with other communities to receive the best deal we can get on energy coming into Carteret. The communities are going to try to consolidate in regard to getting the best figure for the people of Carteret He asked them to advise them what direction they were going to go into. The possibility will be that we will be able to save quite a few dollars with deregulation. 17 Mayor Failace said the bottom line is if Woodbridge, Carteret, South Amboy, Perth Amboy, etc get together along with the Board of Education, that is the way to save money. Council President Gutowski said he didn't understand what she meant. Ms. Bialowarczuk said more or less for college credits. Council President Gutowski said Mr. Elg has his own contract. Ms. Bialowarczuk asked how much does he get for each credit. Council President Gutowski said he isn't getting per credit. We are reimbursing him his tuition. The same thing we do for the officers. Ms. Bialowarczuk asked if that was in the new contract? Council President Gutowski said that's in the last contract, the one that is in effect right now. All employees hired after January 1, 1998 in addition to tuition reimbursement provided here and above shall receive...... it goes into what they get for their degrees. All new officers hired after 1998 got tuition reimbursement instead of getting $15.00 per credit per year. Ms Bialowarczuk asked if we moved the Police Director and his family out here and who bore the cost of that. Council President Gutowski said we pay for some of his expense. We paid for all the people that interviewed for the job. Ms. Bialowarczuk asked if we were paying for his upkeep until he purchases a home for him and his family? Or is he paying for that. Council President Gutowski said no. We are paying for him. It's part of his contract. Ms. Bialowarczuk said as part of his contract until he finds a home for him and his family? Council President Gutowski said not necessarily until he finds a home. He is staying at the Holiday Inn this week. He has relatives he will be staying with and he is already looking at homes he might be purchasing in the near future. Ms. Bialowarczuk said so up until that point, we pay? Council President Gutowski said we are paying for him for this week. Ms. Bialowarczuk asked what was the Police Director's total salary? Council President Gutowski said $85,000. 18 NICK MIRANDI said he didn't think they paid the Police Officer's tuition. They get money for credits. Council President Gutowski said for all officers hired after January I, 1998, the borough will pay tuition reimbursement to each affected employee. Mr. Mirandi said they never received reimbursement of books. Mayor Failace said under the new contract if they take a Police related college course, we pay for tuition refund. Mr. Mirandi said he just wanted to correct them that everyone does not get tuition reimbursement. Prior to 1998, they received $15.00 for every credit Council President Gutowski said and he still does. Mr. Mirandi said the majority of the Police Officers do live in town. JOHN SUDIA said the Director looks like a pretty capable young man. He read his resume and he looks like he might have something to do with the department. He said he is police oriented and he hates it when somebody bothers his cops. He hopes that Mr. Elg will be able to do his job without any interference from anyone. In addition to that, now that we have a director that seems to be capable enough to run the department, do we now get rid of Stowell? Mayor Failace said the Council is using Gary Stowell as far as negotiations. He stated they have said if the police will get rid of Simon Bosco as their professional negotiator, we will get rid of Stowell as a negotiator. Mr. Sudia said $85,000 sounds like a big salary, but with a man with Mr. Elg's background and education deserves that salary.
