CITY OF TEMPLE CITY
FEBRUARY 18, 1969
INITIATION:
1. Mayor Briggs called the regular meeting of the City Council to
order at 7:35 p.m.
2. Bishop Rexford Christensen, Church of Jesus Christ of Latter Day
Saints, 6249 N. Kauffman Avenue, Temple City, gave the invocation,
following which

5. APPROVAL OF MINUTES - Regular Meeting February 4, 1969
Councilman Harker moved to approve the minutes of the Regular
Meeting of February 4, 1969, as mailed. Councilman Merritt
seconded and the motion carried unanimously.
UNFINISHED BUSINESS:
6. PLANNING COMMISSION RECOMMENDATIONS - Meeting of February 11, 1969 .
OFF- STREET PARKING REQUIREMENTS: The City Manager presented the
report of the Planning Commission re off- street parking requirements
for commercial and manufacturing uses. The City Council concurred
with the Commission's findings that no changes be made at this time
since present regulations are adequate. It was unanimously
approved to accept and file the report.
NEW BUSINESS:
7. PARKING COMMISSION RECOMMENDATIONS - Meeting of February 12, 1969
The City Manager presented a request from the Chamber of Commerce
to conduct a safety program for youth, utilizing a portable safety
town. The program,which would be conducted in a public parking
lot three times during the year, had been recommended for approval
by the Parking Commission. It was moved by Councilman Merritt,
seconded by Councilman Beckley and unanimously carried to approve
the request of the Chamber of Commerce to conduct a safety
program as recommended by the Parking Commission at the following
times:
1) prior to the start of school
2) prior to summer vacation
3) one other time as selected by the Chamber of
Commerce, with the approval of the Parking Commission
8. TRAFFIC COMMISSION RECOMMENDATIONS - Meeting of February 5, 1969
A. Item 5. LAS TUNAS DRIVE AT MUSCATEL - Review of Left Turn
Pocket.
Traffic Engineer Envall advised that in the past a broken line
had existed at this location with no hazard, but at present a
solid double yellow line existed. Traffic Commission recommended
modification of the left turn pocket for westbound traffic on

Las Tunas Drive by shortening the pocket from the present 147 feet
to ,94 feet and breaking the existing solid double yellow lines,
delineating the median island to permit left turns into Lamb's
Ambulance Service and Pickering Realty. It was moved by Council-
man Merritt, seconded by Councilman Harker and unanimously carried .
that the recommendation for this item be approved as recommended
by the Traffic Commission.
B. ITEM 6 - POLICY STATEMENT Re. IMPLEMENTATION OF TRAFFIC ORDIN-
ANCES.
Traffic Engineer Envall reported that for a period of time the
Traffic Commission has reviewed the present Traffic Ordinance as to
how they might more fully fulfill their responsibilities as an
advisory body and alleviate the need for the City Council to
review each and every item relating to traffic signing and controls.
As an information item it should be noted that Council action is
required on matters relating to regulator signs or markings with
the exception of red curb markings adjacent to intersections,
driveways, or fire hydrants. Some of the other basic Council
responsibilities are: traffic signal installation, stop signs,
speed limits, parking restriction, street closure, and crosswalks
between intersections. Prime areas of responsibility for the
Traffic Commission would be: warning and directional signs; curb
markings adjacent to intersections, driveways, fire hydrants, and
post office; placement of crosswalks at intersections; placement
of parking space markings; and placement of temporary "No Parking"
signs. Upon review of the present policies, the Traffic Commission
has recommended that. the following policy be implemented:
1. All requests for traffic controls be investigated by the
Traffic Engineer and a report submitted to the Traffic Commission
2. Traffic Commission, upon review of the Traffic Engineer's
report, will make recommendations as follows in accordance
with the Traffic Ordinances:
a. To the City Council regarding all regulatory traffic
matters.
b. To the City Manager, with an information copy to the
members of the Council, regarding all other traffic matters.
It was moved by Councilman Merritt, seconded by Councilman Harker
to approve the recommendation of the Traffic Commission relative
to the implementation of Traffic Ordinances. The motion carried
unanimously.
C. ITEM 7. CLOVERLY AVENUE SOUTH OF LAS TUNAS DRIVE. Parking
Revision.
Traffic Entineer Envall advised that investigation of visibility
from Ralph's parking lot disclosed the need for the removal of
parking stalls adjacent to Ralph's Market on the west side of
Cloverly Avenue and placement of red curb markings as follows:
1) one stall immediately south of Las Tunas Drive
2) one stall north of the driveway
3) one stall south of the driveway, adjacent to the
fire hydrant
Following discussion, it was moved by Councilman Merritt, seconded
by Councilman Beckley, and unanimously carried that the parking
revisions on the west side of Cloverly Avenue adjacent to Ralph's
market be approved as recommended by the Traffic Commission.
Councilman Merritt requested a study relative to the parking con-
ditions on the Oak Avenue entrance to the Ralph- Thrifty Complex where
a similar condition exists, which request was referred to the Traffic
Commission for their consideration.

D. ITEM 9 - BUS ZONE REVIEW
Traffic Engineer Envall presented the recommendation from the
Traffic Commission relative to bus stop revisions, to allow
for bus stops at every third block rather than every second
block, and to locate the bus zone where it would least affect
local parking requirements. It was moved by Councilman Tyrell,
seconded by Councilman Harker and unanimously carried that the
bus stop revisions be accomplished as recommended by the Traffic
Commission, with the following locations designated as bus stops:

9 ORDINANCE No. 69 -280: 1st. read. Re. ESTABLISHING A POLICE
COMMISSION
City Attorney Martin presented Ordinance No. 69 -280 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW SECTIONS 2750 -2
TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO A POLICE COMMISSION.
Councilman Tyrell added a phrase to the first paragraph of
Section 2752, relating to termination, to state "The City Council
may terminate the Police Commission and all of its functions at
any time upon a 4/5 vote." The addition of the requirement of the
4/5 vote was•acceptable and Councilman Tyrell moved to waive
further reading as amended. The motion was seconded by Councilman
Harker and unanimously carried.
10. ORDINANCE No. 69 -281: 1st read. Re. CIVIL DEFENSE AND DISASTER
City Attorney Martin presented Ordinance No. 69 -281 entitled AN
ORDINANCE OF THE CITY OF TEMPLE CITY ADDING SUBSECTIONS (f), (g),
(h) and (i) TO SECTION 27.30 OF THE TEMPLE CITY MUNICIPAL CODE
RELATING TO CIVIL DEFENSE AND DISASTER. Councilman Tyrell
recommended revision to Section 1, paragraph (f) to include the
words "except in cases of extreme emergency." and paragraph (i),
relating to weapons, to state "unauthorized persons" instead of
"persons ". Councilman Tyrell moved to waive further reading
as amended., seconded by Councilman Merritt and unanimously carried.
11. ORDINANCE NO. 69 -282: 1st read. Re. REGULATION OF NEWSRACKS
ON PUBLIC RIGHT -OF -WAY
City Attorney Martin presented Ordinance No. 69 -282 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING SECTIONS 3911.1
AND 3911.2 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO NEWS -
RACKS UPON PUBLIC SIDEWALKS. Councilman Tyrell recommended
the deletion of paragraph (a),- Section 3911.2, relative to newsracks
placed on facilities installed by the City above the public side-
walk. The deletion was acceptable and it was moved by Councilman
Tyrell to waive further reading as amended, seconded by Councilman
Merritt and unanimously carried.

12. SET P.UB.L I C,..:=H,EAR I NG. = EX.T.EN.STON OF. URGENCY ORDINANCE No. 68-271,
EXTRACTION OF NATURAL RESOURCES
City Attorney Martin advised that Urgency Ordinance No. 68 -271,
AN ORDINANCE OF THE CITY OF TEMPLE CITY ENACTING AN INTERIM
ZONING ORDINANCE PURSUANT TO PROVISIONS OF SECTION 65858 OF THE
CALIFORNIA GOVERNMENT CODE RELATING TO A ZONING CLASSIFICATION
FOR EXTRACTION OF NATURAL RESOURCES, adopted June 18, 1968 for
a 90 -day period and extended by Ordinance No. 68 -274, adopted
September 3, 1968, would expire the 31st day of March, 1969.
Since a revised ordinance is not yet available, he recommended
extension of Urgency Ordinance No. 68 -271 to March 18, 1970.
Councilman Tyrell moved to set Public Hearing for March 18, 1969,
seconded by Councilman Harker and unanimously carried.
13. RESOLUTION No. 69 -894: Warrants and Demands
Councilman Harker moved to adopt Resolution No. 69 -894, A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING
CLAIMS AND DEMANDS IN THE SUM OF $28,888.16, DEMAND nos. 12199
to 12258. Councilman Beckley seconded and the motion carried
unanimously.
14. City Manager Koski presented a request from the American Missionary
Society to conduct charitable solicitation. A report from the
Sheriff's Department indicated that 60% to 70% of funds collected
by this organization were retained by the solicitors for their
own use, with the remainder going to the organization; and further
that contributions were not recognized as deductible by the
Internal Revenue Service. Following discussion, Councilman Tyrell
moved that the request by the American Missionary Society for
charitable solicitation be approved, with information on their
permit indicating that this donation was not deductible, as
determined by Internal Revenue Service, and that investigation had
disclosed that from 60% to 70% of the funds were being retained by
the solicitors. The motion was seconded by Councilman Harker and
unanimously carried.
It was moved by Councilman Merritt, seconded by Councilman Harker
and unanimously carried to approve the request of the Friends of
Temple City Library for use of the Library Patio for an annual
sale of books to be held on Saturday, March 22, 1969, from 9 a.m.
to 4 :30 p.m.
A request from Leiland Shaw for an extension of time to complete
certain work on property located at 6329 N. Sultana Avenue, which
had been declared a public nuisance, was received. Following
discussion, it was moved by Councilman Merritt, seconded by Council-
man Harker and unanimously carried, that the public nuisance that
has existed in the past has been adequately abated and that the
request be received and filed.
15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK
No one came forward at this time.
16. MATTERS FROM CITY OFFICIALS
City Manager Koski presented a request from Martin and Flandrick
for an additional amount of $169.51 for settlement of right -of -way
acquisition, Parcel 10, Temple City Improvement Project. It was
moved by Councilman Merritt, seconded by Councilman Harker and
unanimously carried to authorize the preparation of a warrant in
the amount of $169.51 in settlement of this right -of -way acquisition.

City Manager Koski advised that previously the Council had
authorized the attendance of Parks and Recreation Commissioners,
the Recreation Director and the City Manager at forthcoming
conferences, and that warrants would now need be authorized to
cover necessary expenses. It was moved by Councilman Merritt,
seconded by Councilman Beckley and unanimously carried to
authorize the preparation of the warrants in connection with
the expenses that would be incurred by Commissioners Adams,
Greenberg, Villar and Walker and Recreation Director Kobett in
attending the California Parks and Recreation Conference; and
for the City Manager to attend the Spring Meeting of the City
Manager's Department to be held in. Monterey, which will appear
on the next warrant resolution.
City Manager Koski presented a salary resolution amendment
whereby more equitable pro- rating of salary would be accomplished
for beginning and terminating employees. It was moved by Council-
man Harker, seconded by Councilman Beckley and unanimously carried
to approve an amendment to Salary Resolution No. 68 -837 as follows:
"For purposes of computing the salary of full -time employees, at
the time of original appointment or termination only, and working
less than a full pay period, the following formula of computation
shall be used: Total days worked, divided by total working days
in month, times the monthly rate of pay."
City Manager Koski presented a request from Victory Escrow
Company for change of closing date of escrow from July 9, 1969
to March 1, 1969, for property at 9229 Pentland, currently being
purchased by the City for a Corporation Yard. He advised that
Mrs. Nelson wished to continue to occupy the property through
the month of June, 1969; however she had need of the revenue from
the sale of the property at an earlier date. It was moved by
Councilman Tyrell, seconded by Councilman Merritt and unanimously
carried to close escrow by March 1, 1969, with rental to be
set at $125 per month, during which time the existing insurance
will be maintained by the seller until termination of occupancy,
which is to be physically completed by July 9, 1969; and to
appropriate additional funds in the amount of $30,000 from
the unencumbered reserves, and amend the Adopted Budget accordingly.
It was moved by Councilman Tyrell, seconded by Councilman Merritt
and unanimously carried to authorize the attendance of the
Planning Director to attend the Department Heads Seminar to be
held at the University of Southern California, on Friday afternoons,
from February 28 through May 16, 1969, from 1 p.m. to 5:30 p.m.,
and the payment of tuition in the amount of $250.
Councilman Harker presented a proposed budget for the Southern
California Association of Governments, in which the dues for 1970 for
the City of Temple City would be $251. Following discussion,
Councilman Tyrell moved acceptance of the Southern California
Association of Governments' proposed budget, and the City of
Temple City's contributing membership in the amount of $251.
The motion was seconded by Councilman Beckley and unanimously
carried.
Councilman Merritt inquired as to the status of Mr. Riggert's
claim as to damage caused to his tree, on private property,
by the demolition contractor working on Temple City Boulevard,
as part of the demolition work on Temple City Improvement
Project. Claim has been filed with the City where it will
be expedited.

Councilman Tyrell was advised that his request from the previous
meeting re. reflector buttons for traffic safety was referred to
the Traffic Commission; that the Planning.Commission had been
apprised of the concern of philosophies in granting variances
and a joint session will be scheduled with that Commission; and
that the Chamber of Commerce had been apprised of the need to
review and follow up on complaints as to service from local
merchants.
17. ADJOURNMENT
Councilman Tyrell moved to adjourn to a study session at
8:47 p.m., seconded by Councilman Merritt and unanimously
carried. The next regular meeting of the City Council will be
held on Tuesday, March 4, 1969, at 7:30 p.m. in the Council
Chambers of the City Hall, 5938 North Kauffman Avenue, Temple
City.
