A Regular Meeting of the Mayor and Council of the Borough of
Carteret was called to order by Mayor James A. Failace at 7:30
P.M.,Municipal Building, 230 Roosevelt Avenue, Carteret, New
Jersey on July 15, 1999.
Upon individual roll call vote the following were noted present:
Mayor James A. Failace
Councilmember Patrick Crilley
" Stanley Gutowski
" J ames Mancuso
" James O'Brien
" Remy Quinones
Noted absent was Councilmember Jack Fazekas.
Also noted present was Borough Attorney Craig Coughlin.
The meeting was opened with a minute of silent prayer and the
pledge of allegiance by Mayor James A. Failace.
The Clerk stated that on July 9, 1999, in full compliance with the
Open Public Meetings Act, a notice of tonight's meeting was sent
to The Home News Tribune, The Star Ledger and posted on the
bulletin board.
Upon MMS&C by Councilmembers Gutowski and O'Brien and
unanimous affirmative vote of the five (5) Councilmembers
present the Minutes of June 29, October I, 15, November 5 & 7 &
December 3,1998, June 10 & 17,1999 were approved, transcribed
and engrossed by the Clerk.
This was the night advertised to receive bids for Replacement of
Trees and the Mayor called for all bids. Upon MMS&C by
Councilmembers Gutowski and O'Brien and unanimous
affirmative vote of the five (5) Councilmembers present, the Clerk
was directed to open and read aloud all bids received which were
as follows:

Upon MMS&C by Councilmembers Gutowski and O'Brien and
unanimous affirmative vote of the five (5) Councilmembers
present, the bids were held for study.
Mayor James Failace presented a Certificate of Merit to Daniel
Biel, Nathaniel Reynolds and Mark Virag. Daniel Biel and
Nathaniel Reynolds were given a Certificate of Merit for their
quick reaction to a very serious motor vehicle accident on
Industrial Road and Roosevelt Avenue with their common goal of
saving lives. Mark Virag was given a Certificate of Merit for his
response to an alarm to an overturned truck with the driver trapped
and diesel fuel spilling from it. He used a pry bar, with the help of
EMTlFirefighter's Joe Lombardi and Tom Reynolds and they
pulled the driver out. Mark Virag also responded to a three (3) car
accident on the corner of the Fire House and administered First
Aid until help arrived. One of the victims wrote a letter to the Fire
Department in which she stated her faith in humanity was restored.
For these actions Mark Virag was awarded "Firefighter of the
Year."
ORDINANCE #99-24 was introduced and adopted on First
Reading and the Clerk authorized and directed to advertise same
for Public Hearing to be held August 19, 1999, upon MMS&C by
Councilmembers Gutowski and Crilley. Upon individual roll call
vote, Councilmembers Crilley, Gutowski, Mancuso, O'Brien and

ORDINANCE #99-26 was introduced and adopted on First
Reading and the Clerk authorized and directed to advertise
same for Public Hearing to be held August 19, 1999, upon

The Clerk stated that Ordinance #99-23 was introduced and
passed upon First Reading at a Regular Meeting of the
Borough Council of the Borough of Carteret held on July 7,
1999. It was duly published in The Home News Tribune on July
8, 1999 with notice that it will be considered for final passage
after Public Hearing to be held on August 19, 1999 at
approximately 7:30 P.M. The Ordinance was posted on the
bulletin board and copies were made available to the general
public and according to law she read the Ordinance by title.
Upon MMS&C by Councilmembers Gutowski and Quinones
and unanimous vote of the five (5) Councilmembers present
the Mayor declared the Public Hearing to be open.

Upon MMS&C by Councilmembers Gutowski and O'Brien and

BUILDINGS & GROUNDS: Committee Chairperson O'Brien
said in the Police Building they did basic maintenance, in Fire
there is a problem with the air conditioning in the Volunteer
Section. In Annex number one (I), basic maintenance and in Annex
number two (2) a door is needed and in the Welfare Office there is
a problem with the air conditioning unit which is being taken care
of. In Borough Hall the air quality work has been completed and
the air quality is in an acceptable range. We are also looking to
maybe preserve Borough Hall. Progress.
FINANCE & ADMINISTRATION: Committee Chairperson
Quinones said we did receive $300,000.00 in Discretionary Aid
and that coupled with budget cuts we made with the School Budget
will reduce the rates two (2) cents, or approximately $24.00 per
household. She also referred to an article in the newspaper stating
that the Council should stay out of the School Budget, but
statutorily we have to do that when the voters turn the budget
down. Progress.
FIRE: Committee Chairperson Fazekas was absent so
Councilperson Gutowski spoke on his behalf. He congragulated
the Firefighters on their successful Wetdown. Progress.
PARKS & RECREATION: Committee Chairperson Crilley said
the Friday night Band Concerts that started will TUn from now
until the end of August. The Senior Citizen Bus will be available
for transportation to and from them. The Soap Box Derby has been
planned for August 28th Beverly Hedesh is working with
Middlesex County College to try to set up a Babysitting Education
Seminar. The Summer Work Program with the High School kids
has started He said the different Recreation Programs for Football,
Basketball and Tennis, etc. He said the Tennis Program is the first
week of August. He said July 3rd they had their first annual Town
Picnic and Car Show and it was a success. He thanked everyone.
He then spoke about the Yankee Bus Trip on July 24th.
POLICE: Committee Chairperson Gutowski congragulated the
new Captain. He mentioned that this Council is determined to
come up with a solution to what they feel is a manpower problem
on the streets. He said he and the Mayor have sat with the Police
Director and they still have come to no decision. He said their
number one concern is safety.

POLICE Continued: Councilman Gutowski said his main concern
is when our policemen are out there working as police, not doing
some job somewhere else. He said in our Personnel Policies in a
Borough Ordinance, there is a policy in a ordinance that says any
one in this Borough needs permission to go out and have another
job. We have never enforced it. He feels if it is the opinion of the
police that they need these four (4) days as down time to
recooperate from the stressful job they have then maybe we will
start to enforce that policy of not allowing our officers to have
those jobs. He said we were literally accused of trying to kill our
police officers by changing their schedule. He explained that is
totally not true. He said for the next five (5) months he is here he
will work on getting their schedule changed for their safety and our
safety. He said they will continue to find ways to deter crime.
Progress.
PUBLIC WORKS: Committee Chairperson Mancuso said getting
back to the funding that we got ftom the state, $5000.00 is going
for testing at the waterftont. He said they will be having meetings
with the Utility Companies and contractors about street paving.
They want them to give us five year schedules for paving and five
year guarantees on it.
Councilmember Gutowski said he ran into the Governor on July 4,
1999 at Fort Dix and spoke to her about the Turnpike problems
with the Interchange and traffic, etc. He spoke with her office on
July 6th, with the Department of Transportation Administrator and
we are setting up an appointment with them go down and meet
with them so we can see if we can get something done.
BOARD OF EDUCATION: Committee Chairperson Crilley said
he has sent them letter to come up a date to meet with them, but so
far they haven't come up with one. The Lease Purchase has been
put off in the High School and now they will be setting up
meetings in July and August to review the Nathan Hale portion of
that, which he believes can be done without costing the taxpayers
any money. The first part of that program would relieve the
overcrowded conditions in Columbus School. He spoke briefly on
this.
Mayor Failace then spoke about the Waterfront Project and that it
is still alive. The problems there are great but we received some
extra funds for it .
Mayor Failace said the Wetdown was a success and they had a
great time.
Mayor Failace said with the assistance of John Riggo they gave out
some of that C.O.A.H. money to six (6) homeowners to fix their
home, averaging about $15,000.00 and if there is more money to
get for this they will. He said they have wonderful offers for the

old Library property from some developers, who want nothing
from Carteret but to pay their share. He then spoke favorably
about our Engineers and all the work that is being done and said
there has been a very small increase in our taxes over the last three
(3) years. He also spoke briefly on some other improvements he
would like made in Carteret like a small amphi theater in the park.
He thanked Patrick De Blasio and Gary Higgins, our auditor for
the work on the budgets and then he spoke briefly on the DEP fine.
Mayor Failace then read the following Proclamation into the
minutes of the meeting:
NATIONAL NIGHT OUT
WHEREAS, the National Association of Town Watch (NATW) is
sponsoring a unique nationwide crime, drug and violence
prevention program on August 3, 1999 called "National Night
Out"; and
WHEREAS, the "16th Annual National Night Out" provides a
unique opportunity for the Borough of Carteret to join forces with
thousands of other communities across the country in promoting
cooperative, police-community crime prevention efforts; and
WHEREAS, the Borough of Carteret plays a vital role in assisting
the Carteret Police Department's Crime Prevention Unit through
joint crime, drug and violence prevention efforts in the Borough of
Carteret and is supporting "National Night Out 1999" locally; and
WHEREAS, it is essential that all citizens of the Borough of
Carteret be aware of the importance of crime prevention programs
and the impact that their participation can have on reducing crime,
drugs and violence in the Borough of Carteret; and
WHEREAS, police community partnerships, neighborhood safety,
awareness and cooperation are important themes of the "National
Night Out" program.
NOW, THEREFORE, WE THE MAYOR AND COUNCIL, do
hereby call upon all citizens of the Borough of Carteret to join the
CARTERET POLICE DEPARTMENT'S CRIME PREVENTION
UNIT and the National Association of Town Watch is supporting
"16th Annual National Night Out" on August 3, 1999.
FURTHER, LET IT BE RESOLVED THAT, WE THE MAYOR
AND COUNCIL, do hereby proclaim Tuesday, August 3, 1999 as
"National Night Out" in the Borough of Carteret.

community-wide recreation and social interaction through
organized activities, providing valuable social experiences among
individuals as well as groups; and

parks in the health and fitness of its residents, in the benefit of well
spent leisure time and in the conservation and preservation of open
space; all of which play important roles in the lifestyle of the
Borough of Carteret residents.
Upon MMS&C by Councilmembers Gutowski and O'Brien and
unanimous affirmative vote of the five (5) Councilmembers
present the meeting was declared open to the public.
Greg Denton, President of the PBA then spoke. He said in
reference to the work schedule Councilman Gutowski mentioned,
he wanted the town to know that they are under contract with the
Borough of Carteret to work a four day on, four day off schedule
and any change of that by the Borough would result in an Unfair
Labor Practice charge, which would result in going to court and
would cost the town money. He questioned why fix something that
is not broken. He said that since Mr. Elg has taken over there has
been no scheduling problems.
Mayor Failace said they are looking at a work schedule that will
put as many police officers out on the street as possible.
Greg Denton said between the hours of 5:00 and 3:00 a.m. you
may have as many as sixteen (16) police officers on the street and
that is the peak hour of crime committed in the town.
Mayor Failace said they have not agreed on any schedule yet.
Greg Denton urged the Mayor and Council to reconsider and look
at the overall picture and the guys should be given credit for the
jobs they have done in opposed to being attached.
Mayor Failace said he didn't think that was true, that they gave
them credit when credit was due.
Greg Denton said as President of the PBA he wanted to let the
people of the town know that they did demote two (2) sergeants,
McFadden and Andy Tarrant, who were probably the two (2) best
sergeants in the department and they were demoted for no just
cause and that is sad.
Mary Sue Cipiora spoke on behalf of Paul Wolfe and said what
happened to him in the Library. It was character assassination. He
made a mistake and go pornography on the computer and he told
the Librarian but was still escorted out by the police. She asked the
Mayor to try to get his Library Card back.

Mayor Failace said he could not speak on this III public
because it is in litigation.
Linda Pino, President of the Library Board said that Ms.
Cipiora was not r~sent when that happened and she commented
the the Library doesn't go after anyone.
Mrs. Gazdas asked where on Sabo Street was the pumping
station going to be.
Attorney Coughlin said it will be where the existing pump
station is.
Rose Alice Capp spoke on behalf of Sergeant Mc Fadden
saying he is a very good police officer and should not have
been demoted. She asked them to recind his demotion.
Councilmember Quinones asked Director Elg to thank Officer
Denton, for her personally, for acknowledging that things have
improved since Mr. Elg has been here. She agrees.
Susan Loutfy then spoke, saying Councilmember Crilley had
just detente a bomb here saying that they could do Nathan Hale
without it costing us a penny. She said the Board of Education
is trying to kill us.
Councilmember Crilley said he suggested to do a plan that
didn't cost us anything, but they had a plan already. This
should be discussed at the July 21st meeting.
Ms. Loutfy and Councilmember Crilley spoke back and forth
about the Lease Purchase.
Mayor Failace told Ms. Loutfy that her argument was with the
Board of Education not the Mayor and Council.
Councilmember Crilley suggested that the Board of Education
have two (2) people on their committee that oppose the Lease
Purchase.
Ms. Loutfy then spoke on the need for more police officers.
She said the schedule is not bothering her but she feels the
Mayor and Council are leaving out the public about the
increase they are asking for.
Mayor Failace said they cannot discuss negotiation with her.
He said the police filed for arbitration.
George Irwin asked Councilmember Mancuso about the
Hoboken schedule for the Police Department.
Councilmember Mancuso said 5/2 and 5/3.

Mr. Irwin coot:
Mr. Irwin then asked if Guiliani is elected senator will that
stop the garbage dumping in Carteret.
Mayor Failace said it would not get past this Council.
Mr. Irwin the asked how they were doing with the Library.
Mayor Failace said the new Library is on schedule and they are
looking for something like September, give or take a few
weeks.
Mr. Irwin asked ifthere was anything in their contract that they
would be fined if they were not done on time.
Mayor Failace said they had a Library Construction Meeting a
week and one half ago and as of then we were right on time,
but if there was a delay he would expect maybe two (2) or
three (3) months.
Pat Tozzi
Pat Tozzi spoke against Lease Purchase of any sort. He said
they want the Lease Purchase put on the ballot for the
November election so the people can vote on it.
Marie Miller
Marie Miller spoke on the Shade Trees, that they should be
removed when the engineer does the sewer work or the tree
roots will grow back and cause sewer problems again. She
complained that the engineers don't do an efficient job.
Mayor Failace told her if there is a problem with her tree they
will take it down.
Saad Radwan
Saad Radwan said Councilmember Crilley is protecting the
Board of Education and he spoke on this for a while. He asked
Councilman Crilley how they could do Nathan Hale School
without raising the taxes.
Councilmember Crilley said he believed they could do it
because of the state aid and continuing to pay the same taxes
we are paymg.
Mr. Radwan and Councilmember Crilley spoke about this for a
short while.
paul Wolf
Paul Wolf then spoke saying he felt it is a disgrace about what
is being done to the police in town. Then he went on to say that
about the Library incident, he has been advised from two (2)
different attorneys to be quiet about it and speak to the Board
of Trustees and try to work it out and if it doesn't work out
then there is a litigation problem. He then thanked the Mayor
for returning his phone calls and that it showed him that he
not only cares for the town, but also for the people.

Mr. Rosario then spoke saying he felt in the two (2) years he
has lived here and the previous years he had visited here the
park has not changed at all. He asked the Governing Body what
plan they had for the park.
Councilmember Crilley said they had lots of plans and he
mentioned the possibility of getting an ampitheater and they
would start upgrading the ball fields. He said he is hoping to
convince this Council to appropriate $100,000.00 a year for ten
(10) years, a million dollars, starting with next years budget for
the parks. He thinks that we could have a very good park
system at the end of ten (10) years.
Mr. Rosario then asked what kind of curfew they would be
having. He said he had a bad experience in the park the other
night, he was chased out at approximately 8:30 p.m. by a police
officer.
Councilmember Quinones said she would speak to the Police
Department
An unidentified lady said it is a pleasure to walk through the
park without the geese.
Kathy Quito then spoke saying she was there to present, for
the Governing Body's inspection and hopefully approval, an
ordinance to limit and control the way funds are raised for
political groups in the town. This ordinance is presented by a
group called the New Jersey Common Cause and they are
trying to eliminate any kind of political fundraising on public
property other than parks and public streets. They would like to
see Carteret adopt this ordinance.
Mayor Failace handed the paperwork over to Borough
Attorney Coughlin.
Cindy De Camp spoke about a National Night Out and getting
a list together for it.
A citizen of the town Judd Fields welcomed the Mayor and
Council and said he was looking forward to participating in
what will be going on in the town.
Chris Elg the Police Director said last Tuesday night was the
first night the police went out in force and had some plain
clothesmen in the parks for three (3) hours where eight (8)
arrests were made. He said there are some gray areas and they
are working on them. He suggests if you are going to be in the
park after dark, let it be in a close proximity to a sporting
event.
