HomeMy Public PortalAbout1999/09/02 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor James A. Failace at approximately 7:30 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: Councilmember Patrick Crilley " Stanley Gutowski " James Mancuso " James O'Brien " Remy Quinones Noted absent was Councilmember Jack Fazekas and Municipal Clerk Kathleen M. Barney. Also noted present was Borough Attorney Craig J. Coughlin. The meeting was opened with a moment of silent prayer and the pledge of allegiance led by Mayor James A. Failace. The Assistant Clerk stated that on August 27, 1999, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News Tribune, The Star Ledger and posted on the bulletin board. Mayor Failace administered the Oath of Office to: Police Officer Frank Sisko Fire Fighter Russell T. App Fire Fighter Frank T. Welch. Mayor Failace said Frank Sisko came to Carteret from the County because they abolished the County Police. In order for him to enforce the ordinances of Carteret, he was sworn in and the Mayor welcomed him and presented him with his badge. Mayor Failace asked Fire Fighter Russell T. App to come forward and he was sworn in. Mayor Failace congratulated him and presented him with his badge. . Mayor Failace asked Fire Fighter Frank T. Welch to come forward, swore him in, congratulated him and presented him with his badge. 1 Mayor Failace said the county will pay Officer Sisko's salary for the 1 st year and a portion of his salary every year thereafter and we got a police car also. ORDINANCE #99-30 "BOND ORDINANCE PROVIDING FOR A TECHNOLOGY UPGRADE FOR Y2K COMPLIANCE AND OTHER PURPOSES IN AND BY THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY, APPROPRIATING $500,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $476,000 BONDS OR NOTES OF THE BOROUGH TO FINANCE PART OF THE COST THEREOF" The Assistant Clerk stated that Ordinance #9~24i was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough ofCarteret held on July 15,1999. It was duly published in The Home News Tribune on July 20, 1999 with notice that it will be considered for final passage after Public Hearing to be held on August 19, 1999. The Public Hearing was adjourned on August 19, 1999 and reconvened on September 2, 1999 at approximately 7:30 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. -- Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, the public hearing was reconvened and the Mayor declared it open to the public; Peter Sica asked if this ordinance had anything to do with the communication from Beazer, Inc. Mayor Failace said no. They had this done last year and sent it to Bellmead to make sure that what came in would not be detrimental to Carteret. Mr. Sica said there are all kinds of statements about no dredge soils being put in Carteret. Mayor Failace said their intention was if there were some things that were necessary for them to do. Mr. Sica said six acres of Beazer East belongs to Carteret. He went to court many years ago against Woodbridge and got those 6 acres. That is going to be a soil dredging operation and he didn't know if this ordinance was going to allow it. He said he wasn't against it. He said before they do anything they should look into it and find out exactly what was going to go on there. There is a drainage ditch that goes right through there and he owns the property on this side of it. 2 Councilmember Crilley asked if the Beazer East property was the property behind the abattoir? Mr. Sica said yes, there are 60 acres there and it goes back to the river. They are taking exceptions in their ordinance to docks, bulkheads, etc, that they can dredge and put it there. There are old docks that aren't used any more, but technically they are still docks and as long as there is one pile left, you can rebuild your dock. Councilmember Crilley asked if the docks were on Woodbridge side or our side? "Mr. ~g.i.ca said part of it is on our side. Many, many years ago, the City of Woodbridge and the Borough of Carteret agreed to allow something to be built there. When he looked into it, it was LNG Tanks. Liquid Natural Gas tanks. Two are on the other side of the river and 9 were going to go on this side of the river. They fought to stop that. That is how he discovered they owned 6 acres of it. Woodbridge took us to court and the court said if they were paying the taxes to Carteret all these years, it's Carteret's land. He said he has a railroad easement that goes through there, so he told them they should be careful. There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Gutowski and Quinones and unanimous affirmative vote of the five (5) Councilmembers present. Tom Stiglic, 40 Charlotte Street, asked for an explanation. Mayor Failace said there will be no fundraising on public property. Councilmember Gutowski said no use of the telephones, fax machines, anything that is owned and operated by the borough. Mr. Stiglic asked if that applies to everybody. Councilmember Gutowski said everybody. All employees and elected officials. There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present. Greg Denton, President of P.B.A. Local 47 had a question on Resolution #99-293. 5 Councilmember Gutowski said the appropriation for Mr. Stowell for this year was $100,000. Mr. Denton asked for what? At this point there is $43,000 left in Mr. Stowell's appropriation. Most of the work he was hired to do is finished or near completion, so they are canceling $15,000 ofthat appropriation. Mr. Denton asked about Resolution #99-294 regarding Mr. McGovern. Mayor Failace said that was for various police matters, arbitration and things that he is in the middle of right now. There are personnel matters, that he doesn't want to go into right now. There are a couple of hearings that have to be finished. Councilmember Gutowski said Mr. McGovern IS working on the Terebetski, Hundeman case. Mr. Denton asked if they refused to hire those two back? Councilmember Gutowski said he didn't refuse to hire anyone back. It's still in litigation. If the courts tell us to bring them back, they will come back. Mr. Denton said he thought they were spinning their wheels on that. Councilmember Gutowski said that was Mr. Denton's opinion. Mr. Denton said he thought they should be brought back. William Kolibas, Jr. asked about Resolution #99-293. He said they are taking $15,000 away, but they are spending $35,000 on another guy that will do the same work Mr. Stowell did, so they are actually losing money. Mayor Failace said they didn't lose money. They are in arbitration and there is nothing they can do about that. Most of the people said "let's get rid of Stowell", so they have done that. Mr. Kolibas said they are making McGovern Stowell. Mayor Failace said absolutely not. There are some things that have to be done whether we like it or not that we have to continue on with. Mr. Kolibas said Mr. Coughlin could do them. Mayor Failace said no. Councilmember Quinones asked Mr. Kolibas if he ever hired an outside counsel? Mr. Kolibas said he asks the questions here. Councilmember Quinones said she didn't care, she was responding. 6 Mr. Kolibas said Councilmember Gutowski brought up the two police officers that were fighting the appeal to come back. He said he believes it stated in the newspapers that of August 21 st they were going to start getting paid? Mayor Failace said absolutely not. Councilmember Gutowski said what is going on is very clear. They got an interpretation from the State that there is no back pay whatsoever. They originally thought they were entitled to back pay when they were originally put back to active service which was September 1997. They are not entitled to that. Nor are they entitled to any back pay until they are appointed. Then they start getting paid. There is no way they will get any money. Mr. Kolibas asked if McGovern was handling that. Councilmember Gutowski said it has already been done. There being no further comments or objections to the resolutions, upon MMS&C, by Councilmembers Gutowski and Mancuso and unanimous affirmative vote of the five (5) Councilmembers present, the Mayor declared the meeting closed. RESOLUTION #99-289 was introduced by the Mayor and was referred to the Council for action. The Assistant Clerk stated that she was in receipt of an application to amend Bingo License for St. Demetrius Ukrainian Church. Upon MMS&C, by Councilmembers Gutowski and Quinones and unanimous affirmative vote of the five (5) Councilmembers present, it was ordered to be received and processed. 10 The Assistant Clerk stated that she was in receipt of a resolution from Highland Park urging the state to review the requirements in the law regarding Automatic Teller Machines. Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, it was ordered to be received and placed on file. The Assistant Clerk stated that she was in receipt of a resolution from Milltown urging transfer of Roosevelt Care Center to Middlesex County Improvement Authority for future sale to private entity be abandoned. Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, it was ordered to be received and placed on file. The Assistant Clerk stated that she was in receipt of a notice of application to be submitted to NJDEP for a Statewide General Permit for the Remediation of Former Koppers Co., Inc.from Beazer East, Inc. Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present it was ordered to be received and placed on file. The Assistant Clerk stated that she was in receipt of the following reports: 1. Clerk's Office - August 1999 2. Sewer Collection System - July 1999 3. Treasurer's Report Upon MMS&C, by Councilmembers Gutowski and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, all reports were ordered to be received and placed on file. BUILDINGS & GROUNDS: Committee Chairperson O'Brien said Jason Abello and his crew are doing basic maintenance on the buildings. They took care of the problems at the Senior Center. An exterminator will come out monthly for the Senior Center and the Recreation Facility. He reported the buildings are still standing. FINANCE & ADMINISTRATION: Committee Chairperson Quinones said the borough is still not broke. The budget is doing fine and the numbers are where they should be. She welcomed Nick Goldsack on board as the new Business Administrator. She reported progress. FIRE: Committee Member Gutowski congratulated the new fire fighters App and Welch and he reported progress. PARKS & RECREATION: Committee Chairperson Crilley said he would like Beverly Hedesh to speak about the Borough wide yard sale on September 25,1999. 11 Ms. Hedesh told audience about the yard sale and the procedure to register for same. REPORTS: Departments Standing eoomittees SEPTEMBER 2, 1999 Standing Committees Continued MAYOR: Proclamation World population Awareness Week POLICE: Committee Chairperson Gutowski said the borough will be sending a few police officers to the Middlesex County Drug Task Force. Four officers over a two year period with one officer going for six months at a time. It's a good opportunity for these officers to help out. There's a problem in town with drugs. We also get things back. We get a vehicle and part of any seizure money that is obtained. The Director came to him and he approved it. He thanked the Director for a good job. He reported progress. PUBLIC WORKS: Committee Chairperson Mancuso said there were two water main breaks this week and one sanitary sewer break. He received a fax from John Dowd, the Sanitary Inspector. He had a meeting with Comail yesterday. They have agreed to clean up all the property in Carteret. They are going to trap for muskrats and other vermin. They are going to take all the electrical poles out. This is supposed to start in two weeks. He reported progress. BOARD OF EDUCATION: Committee Chairperson Crilley reported progress. Mayor Failace read the following proclamation: WORLD POPULATION AWARENESS WEEK OCTOBER 10-16, 1999 WHEREAS, world population is projected to reach six billion this year, a trebling of the planet's human numbers within this century and an event that will be symbolically recognized on the Twelfth of October; WHEREAS, state and local jurisdictions, including the Borough of Carteret are confronted with environmental and societal challenges such as water shortages, traffic congestion, inner city deterioration, curtailment of basic services, climate change and the spread of infectious diseases; WHEREAS, these challenges are inextricably linked to patterns of considerable demographic change, such as areas west of the Mississippi River doubling in population size as rapidly as Africa, the world's fastest growing region; WHEREAS, urban areas historically have served as centers of trade, transportation, industry and markets, providing the economic and cultural diversity and vitality that often define the very nation or region in which they are located; WHEREAS, the detrimental aspects of urbanization are most severe in developing countries, where grinding poverty and lack of resources compound their impact, but industrialized countries, with their consumptive lifestyles, are also extremely vulnerable to their consequences; WHEREAS, urban areas of the industrialized world are expected to absorb over one billion additional people in the final quarter of the 20th century and another two billion in the first quarter of the 21 st century; WHEREAS, over 50% of the world's more than six billion people are expected to live in urban areas early in the next century and by the year 2020 urban population is projected to exceed five billion or 61 % of the world total; WHEREAS, the challenges of rapid population growth and urbanization call for innovative leadership to ensure resource conservation, protection of open space, waste prevention, sanitation management and a higher quality of life; NOW, THEREFORE, I, JAMES A FAILACE, Mayor of the Borough ofCarteret proclaim the week of OCTOBER 10-16, 1999 As WORLD POPULATION AWARENESS WEEK and urge all citizens thereof to participate appropriately III its observance and to reflect upon urban population challenges. PETER J. SICA, former Mayor, said many years ago, he formed a committee called the Carteret Anniversary Committee. He started it with a couple of thousand dollars of his money and he was supposed to take it back. He never took it back. It's not a borough account. It was just an account that had the Borough of Carteret on it. Subsequently the bank changed hands many times and they sent him a check for $950.50. It says on it Carteret Anniversary Committee, but he is the only signatory on it. There is no record of it in the borough, because it was his account, but because it has the Borough of Carteret on it, he didn't want any improprieties or someone to think that the money belongs to the borough when it is actually his. He wanted to come here to tell them that on Monday he will be donating that money to the Carteret Specials.
