HYMAN,Chairman WWW.HOPKINTON.GOV JOHN COUTINHO, CLERK ZBA@Hopkintonma.gov Minutes of the Board of Appeals Minutes: June 9, 2021 Called to Order: 7:05 PM Remote Zoom Meeting Adjourned:7:45 PM Members Present:Mark Hyman,Chairman;John Coutinho;Clerk;Michael DiMascio;Walter Garland; Jerry Tuite Members Absent:John Savignano; Ria McNamara Others Present:Elaine Lazarus,Assistant Town Manager;Michael Shepard,Assistant Building Inspector; Adina DePaolo, Administrative Assistant Mr.Hyman called the name of each Board member,and each responded affirmatively that they were present and could hear him.Mr.Hyman then called the names of each staff member who responded affirmatively that they were present and could hear him.Mr.Hyman also called the names of anticipated speakers on the agenda, Timothy Nealon & Peter Lazott,who responded affirmatively. Mr.Hyman stated that the meeting is being conducted remotely consistent with Governor Baker ’s Executive Order of March 12,2020,due to the current State of Emergency in the Commonwealth due to the outbreak of the COVID-19 virus.He noted that in order to mitigate the transmission of the virus,the Board is complying with the Executive Order that suspends the requirement of the Open Meeting Law to have all meetings in a publicly accessible physical location.He stated that the Executive Order allows public bodies to meet entirely remotely as long as the public body makes provisions through adequate, alternative means to ensure that interested members of the public are provided reasonable access to the deliberations of the meeting.He noted that for this meeting the Board is convening by video conference via Zoom App as posted on the Town’s web meeting calendar and the Board’s agenda identifying how the public may join.He noted that the meeting is being recorded and attendees are participating by video conference.Mr.Hyman stated that all supporting materials that have been provided to the Board are available on the Town website via the web meeting calendar, unless otherwise noted. 7:10 PM Administrative Session of the Board of Appeals Minutes The Board reviewed the minutes of May 26, 2021. Mr. Coutinho moved to adopt the minutes of May 26, 2021 with changes. The motion was seconded and passed 5-0. The votes were: Mr. Hyman: Yes; Mr. Coutinho: Yes; Mr. DiMascio: Yes; Mr. Garland: Yes;Mr. Tuite: Yes. Documents Used: Draft minutes from May 26, 2021 Vice Chairman Mr. Hyman asked the Board to think about which full member would like to be the next Vice Chairman. 7:15 PM Application for Special Permit 44 Hayden Rowe – Lazott Members Sitting: Mr. Hyman, Mr. Coutinho, Mr. DiMascio,Mr. Garland, Mr. Tuite Other Members: Timothy Nealon - Attorney Peter Lazott - Applicant Atty. Nealon stated Mr. Lazott has owned and resided at the property since 1996 and operated his printing business there since 1997. He stated the property is located in the residential A district and the lot meets the requirements in area and frontage and the house meets the side and rear line requirements but it doesn’t meet the front setback requirement on Maple Street. He stated they are here to ask for 3 special permits. He stated the applicant would like to remodel part of the structure. He stated he would like to add a porch along the side of the building that faces Maple Street. He stated they would like to demolish the shed style addition and replace it with a 2 story structure in the same footprint. He stated they are filing under 210-128b and 210-128d.1 as a non-conforming structure. He stated the change would not be substantially more detrimental to the neighborhood.He stated the addition of the 2nd floor requires a special permit under 210-128d.1. He stated this property was once a grocery store prior to 1940 until early 1960. He stated in 1971 the Zoning Board of Appeals issued a variance to allow the owners at the time to convert the store into 2 offices. He stated Mr.Lazott would like to continue the office for his Village Printing on the 2nd floor and his personal living space and then the 1st floor would be available for rent to a tenant. He stated it would not be substantially more detrimental to the neighborhood because the changes would make the building look more like a home than how it looks like an office now. Mr. Lazott stated the barn at this time is 30 feet from the road and the change would bring it to 32’ just for clarification. Mr. Tuite asked about the square footage on the first floor being 1,100 square feet and Atty. Nealon stated yes. Mr. Tuite asked about the 2nd floor square footage. Atty. Nealon stated the living space on the second floor would be 441 square feet. Mr. Hyman asked if there were any public comments. Jim Callery, 4 Maple Street stated he is in support of the project. He stated he thinks it is a great idea. Mr. Hyman asked about if the smokes and carbon monoxide detectors would be tied in with the whole property. Mr. Lazott stated the barn part is not tied in. Board of Appeals June 9, 2021 Page 2 of 3 Mr. Lazott stated the property has been in his family for a long time. He stated he wants the property to look more residential. Mr. Coutinho moved to close the public hearing. The motion was seconded by Mr. Garland and passed unanimously. The votes were: Mr. Hyman: Yes; Mr.Coutinho: Yes; Mr. DiMascio: Yes; Mr. Garland: Yes; Mr. Tuite: Yes. Mr. Coutinho moved to grant a special permit under 210-128b and 210-128d.1 on a finding the change would not be substantially more detrimental to the neighborhood and consistent with the plans submitted. The motion was seconded by Mr. DiMascio and passed unanimously. The votes were: Mr. Hyman: Yes; Mr. Coutinho: Yes; Mr. DiMascio: Yes; Mr. Garland:Yes; Mr. Tuite: Yes. Documents Used: Uniform Application for Special Permit/Petition for Variance with supporting documents Mr.Garland moved to adjourn the meeting.The motion was seconded and passed unanimously.The votes were: Mr. Hyman: Yes; Mr. Coutinho: Yes; Mr.DiMascio: Yes; Mr. Garland: Yes: Mr. Tuite: Yes.
