1. MINUTES OF JULY 14, 1998
Lenny Leuer corrected on page 1 under David Jackson comment - excited about
relocating not relocated.
Carolyn Smith - delete awful - page 2 on her 2nd comment.

2. GARY BOSTER - SOUTH OF HAMEL RD/PINTO DRIVE - SUBDIVISION -
TABLED FROM JULY MEETING - 7:36 P.M.
Lenny Leuer asked if condition #1 from the June meeting was appropriate to put in as a
condition.
Loren Kohnen said he had talked to the surveyor and a 27' easement would put it in the
middle of the neighbor's garage. He said he would meet with Jim Dillman and Glenn
Cook and see if maybe something less that 27' would work and it would be a given that
the existing garage would be given a variance.
L. Leuer wanted to know if the neighbor was reluctant to give any easement at all,
would the project be doomed. He said he had talked to a couple of council members
and he thinks that Loren should talk to the council on what we do in a case like this with
a reluctant participant.
Carolyn Smith said that she and Elizabeth had talked about this and said this did not
seem as wide as a road and were private drives not as wide.
L. Kohnen said that there are some standards.
L. Kohnen said that he would meet with the applicant.

Bruce Workman said he thought that we should let the landowner work out what he can
first.
L. Kohnen said that we were not sure where the 27' would be and now we do and will
work on it.
L. Leuer said maybe that we should soften the intent in condition #1 and asked Loren to
negotiate the point with the applicant, Glenn Cook and Jim Dillman.

THE APPLICATION UNTIL THE SEPTEMBER MEETING.

3. KEVIN GILLETTE- 3365 MILL DRIVE - CONDITIONAL USE PERMIT FOR
OFFICE/MANUFACTURING - PUBLIC HEARING - 7:45 P.M.
Loren Kohnen read his memo to the planning commission and put up an overhead of
the site. He said that we should talk about the exterior of the buildings.
Kevin Gillette said that the west side of the existing building has been started to be
resided with steel siding and he would continue it.
L. Kohnen said that steel siding was not permitted. He said that on the 3 sided building
20% could be steel.
There were no public comments.
Carolyn Smith said that one of the old buildings has pretty shingle siding - can that be
left.
L. Kohnen said yes that was permitted - it is cedar shingles.
Frank Mignone said it looks like the structure needs to be sealed up , too many holes
now - kids could get in, etc.
Jerry Brost asked if the building was insulated.
K. Gillette said they are working on it, there would be an office area and a garage
probably heated with the back area unheated - not sure if he will heat that area.
J. Brost asked about Loren's #6 recommendation - the garbage area being inside.
L. Kohnen said there is limited space outside and if it were outside it would take away
from the parking area - this will not be `food' garbage, just papers, etc.

Bruce Workman asked if the building was sound. He said he was concerned with the
look of the building.
L. Kohnen said the siding was rotted, but no sags in the roof.
K. Gillette said that he thought aluminum for the outside when he remodeled.
C. Smith said why not use the shed.
K. Gillette said that he will. The signs are worth a lot and are usually delivered within a
week, but would keep them under cover when they are on site.
B. Workman asked if the zoning was appropriate for this use and Loren said yes. Bruce
also asked if there were adequate utilities for the site.
K. Gillette said yes, there is only one person in the shop.
Lenny Leuer said he was confused - 2 lots?
L. Kohnen said that technically there were more than that. They would all be combined
into one lot with a re -plat.
L. Leuer asked if the house was lived in and Loren said yes. Lenny said he was
confused with the shed and the house.
C. Smith said why couldn't there be a mix of uses in the area- so houses could be re-
built.
The question came up as to where the lot buts up against the city street (Mill Street) and
there was discussion of this city street.
L. Leuer wanted to know if this was landlocked.
L. Kohnen said Mill Street was on the east side.
L. Leuer wanted to know if they would see a more definitive plat.
L. Kohnen said yes when they did the re -plat and we would get what easements we can
at that time.
L. Leuer wanted to know where the sewer line was - was it under the building.
L. Kohnen said it was beside it.
L. Leuer said that the main building has no foundation and on the west wall the cross
beams are rotted - is the building structurally sound?

L. Kohnen said that he has not been in the building lately, but was 8 years ago and it
appeared to be o.k. - he said that it could be made structurally sound.
L. Leuer seems to have unique drainage pattern, water from the parking area goes
under the building - he also asked if the 3 sided building to the west would have to be
enclosed.
K. Gillette said possibly down the road.
C. Smith asked what the 3 sided building was used for.
K. Gillette said that he was an electrical contractor also and they carry a lot of fittings,
conduit, etc. and they will put some of that there - he said that in the main building they
will keep the truck and when they receive signs they will put in the 3 sided building.
F. Mignone said that is outside storage.
L. Kohnen said not if it is under a roof.
C. Smith said it is not open to the park or houses.
L. Kohnen suggests that trucks or things that can be locked are what is left in the open
sided building.
L. Leuer asked if we will require that the 4th side be closed.
B. Workman said that the roof means it is inside. At what point does it become outside
storage.
L. Kohnen said that we would not allow it other places if the open side faced the road.
B. Workman asked if it was in good shape.
K. Gillette said that the roof is fairly new.
There was discussion of putting overhead doors on, etc. maybe sliding doors
L. Leuer asked if the applicant is buying all of the lots.
K. Gillette said yes.
L. Leuer asked about condition #9 - where is the parking located.
L. Kohnen put up an overhead of the site and pointed out the parking.

L. Leuer said we have required other commercial applicants to pave the street also -
why is it not required here?
L. Kohnen said we will have to research who owns the street
L. Leuer said there are enough unanswered questions not to act on this

3. How to enclose the 3 sided building
4. Paving that we have required of others.
5. Not all building shown on site plan
6. Have applicant give thought to the conditions in Loren's memo
Lenny asked the applicant if he would like the planning commission to act on this tonight
or have it tabled.
K. Gillette said that they are a smaller company and their lease is expiring this year. He
would like to make a decision on buying this and remodeling the building. He said he
has every intent to clean it up.
L. Kohnen said that a time frame could be put on the improvements so they would not
have to be done all at once.
C. Smith asked if the 3 sided building were not used for storage, would we require it to
be enclosed. She said could we put on condition that if they wanted to use it, it would
have to be upgraded to city code.
The applicant said he would rather this wasn't tabled, but agreed to it.

4. JOSEPH AND DARCIE MALCHOW - 3087 LAKESHORE DRIVE - FRONT AND
SIDE YARD SET -BACK VARIANCES FOR DETACHED GARAGE - PUBLIC
HEARING - 8:22 P.M.
Loren Kohnen read his memo to the planning commission and put up an overhead of
the site. He stated that Jim Dillman would move the stop sign so that it would not be in
front of the proposed garage.
Bruce Workman asked if there were other structures in the neighborhood that close.
The applicants said yes.

Lenny Leuer said that many of the garages that are that close to the line are older
garages and he did not remember recommending variances in his time on the planning
commission.
Anne Theis, 4651 Walnut Street, said there are a number of garages 10' from the road,
some are old, especially on Walnut and down toward Lakeshore there are some that
are fairly close, but she does not know how old they are. She said Independence
Beach is an old plat and have never been able to comply with the ordinances.
Darcie Malchow said that she measured the parking area now and it is 22' from the
pavement and it has never been a problem with the snow plowing - she said that 10'
from the ROW gives 20' from the balcktop - she said there is also a spot farther down
for guests to park and will keep that.
A. Theis said that is needed, especially on Lakeshore.
D. Malchow said there are two major trees and she hates to lose those - she said there
is also a steep hill and if the garage was pushed back the back yard - play area -
becomes very small.
L. Kohnen said again that the stop sign would be moved the other way.
L. Leuer said that people don't stop at the sign, they do it where they can see the
intersection.
Frank Mignone asked if the building could be made shorter.
D. Malchow said they had talked about it, but they feel strongly they have not overbuilt
their lot, they do not have a huge house and if they move the woodworking shop to the
garage it would give them more living space in the house.
A. Theis said look at the age of the plat, most lots are 60'x100' - she said the Malchow's
bought 2/3 of the lot next to them to make their lot bigger and the other neighbor bought
the other 1/3 to make their lot bigger - this improved the area a lot.
F. Mignone said that variances are not granted with hardships that people have created.
B. Workman said he felt it appropriate to match the garage next to it.
Carolyn Smith asked if the garage was moved back and got to close to the maple tree 0
what would happen.
L. Kohnen said it would probably kill the tree.
C. Smith asked why the garage could not be closer to or attached to the house.

D. Malchow said they never considered attaching it, they liked free standing garages.
L. Leuer said that the topography of the lot calls for a detached structure. He said that
1/2 of the request sits will with him, but would like to see that garage moved back and be
creative with the shape of the garage in the back for the shop and still save the tree.
Darcie and Joe said they liked that idea and it would be o.k.
L. Leuer said that the jog in the building could not get too close to the lake.
MOVED BY FRANK MIGNONE AND SECONDED BY BRUCE WORKMAN TO
RECOMMEND A 15' FRONT YARD VARIANCE WITH THE HARDSHIP BEING THE
TOPOGRAPHY OF THE LOT, THE TREES AND THE LAKE SET BACK
REQUIREMENT AND ALSO THE VARIANCE WOULD BE CONSISTENT WITH
OTHERS IN THE AREA.

5. ROLLING GREEN COUNTRY CLUB - 400 EVERGREEN ROAD -
CONDITIONAL USE PERMIT FOR NEW CLUB HOUSE - PUBLIC HEARING -
8:45 P.M.
Loren Kohnen read his memo to the planning commission and put up an overhead of
the site. He pointed out the area for the calming circle - showed where trees could be
planted - also mentioning that the barn on County Road 116 should be screened.
There was discussion of each of the conditions listed in Loren's memo.
#1 - Barn on County Road 116 - berm - trees
Bruce Workman wanted to know why they needed to keep the old barn.
Harry Hunt, Rolling Green, said they needed it for storage. Mr. Hunt, the president of
Rolling Green introduced the other present: Bill Soule, on the board and Cherry Hill
resident, Ken Gullickson, manager Rick Christensen and Ho-Youl Chang with Partners
& Sirny Architects. Mr. Hunt stated that 88% of the membership had approved building
a new club.
Rick Christensen said that in the future they would move the maintenance building to a
more central location.
Lenny Leuer stated that the trees etc from the storm damage were placed around the
barn, the berm was full of thistles and there was also construction debris dumped on the
116 side. Everything else is so well maintained, why this pit?

H. Hunt said there is more outside when the equipment is being shifted and he could
not say why the other things were there.
Bill Soule asked why the existing barn that has been there for 30 years and not part of
this application, why does it have to be talked about now.
B. Workman said that when a request is made, we try to bring the entire property up to
grade.
L. Kohnen said that the conditional use permit if for the entire parcel, the request opens
up everything.
L. Leuer said that the barn is not the issue, it is what is outside the barn.
H. Hunt said that they would get everything inside or off the property.
R. Christensen said that would be no problem.
L. Leuer asked Loren about the need for trees on the bern.
L. Kohnen said they do the screening.
Carolyn Smith said if there is no outside storage, the screening is not needed.
#2 Barn maintenance
Applicants stated that it soaks up a lot of paint and is painted on a regular schedule
#3 - Parking lot screening
Applicants stated that they had a meeting with the Cherry Hill residents and 4 families
came - they had no sight issues with the club.
C. Smith said she noticed several large trees when she visited the site on the north side
and others on the south side. She felt that the parking was adequately screened.
H. Hunt said that the families that came to the meeting had no objections to how it looks
now.
L. Kohnen said this is something that we ask for all the time.
B. Soule said that people didn't want to look at a church, but we like to see the golf
course and there is no problem with the parking lot.
C. Smith again stated that on the north side there are huge trees.

H. Hunt said that on the south side of the parking the trees are only nominal. He said
that with doing the new building, they will not be able to do everything all at once and
the trees will cost a great deal - might ask for a time table if the city sticks to wanting all
the trees.
R. Christensen said that we need to satisfy the landscaping of the boulevard closer to
the building and if time frame can be worked out.
B. Workman said he did not think that a time table would be unacceptable.
B. Soule said that spruce trees were not trees of choice for our gold cource.
L. Kohnen said that a 6' spruce is about $150.00 and they only need about 16 trees.
#4 - Lighting
Applicants said that they would like a time frame to upgrade the existing lighting and
would upgrade as needed - all new lighting will be correct.
L. Kohnen said that would be o.k.
B. Workman asked if there had been any comments from residents on the lights and
Loren said no.
R. Christensen said that they would hire someone do to both the short range and long
range landscape plan.
#12 - Speed
H. Hunt agreed that the speed is too high - he does not know what affect a calming
circle would have - speed seems to get out of hand in the middle of Evergreen, between
the entrance to the club and 101.
B. Soule maybe a speed limit sign a little sooner and maybe a slow children sign.
Frank Mignone said that it is not all country speed.
B. Workman said that a calming circle may have the opposite effect.
Ken Gullickson said that the kids play on the Par 3 - why the speed bump is there.
F. Mignone said that he does not support the calming circle - Carolyn Smith agreed.
There was further discussion of Evergreen Road - speed
B. Workman said put signs up and enforce it - it is a city issue, not the clubs.

C. Smith suggested a sign as you are leaving the club - Thank you - please drive slow -
#14 - Exterior loudspeakers
Both F. Mignone and C. Smith said they are not allowed at Baker golf.
K. Gullickson said they do not have them now and do not plan on having any
There was discussion on the time frame for construction.
R. Christensen said that the area would be fenced off during construction - he said they
would like to start right after the council meeting and getting the council approval for
their application.
There was discussion of the use of water and of re -using water.
L. Leuer said that one draining of the pool would use more water than would be saved
in a year.
MOVED BY CAROLYN SMITH AND SECONDED BY BRUCE WORKMAN TO
RECOMMEND APPROVAL OF THE CONDITIONAL USE PERMIT FOR ROLLING
GREEN COUNTRY CLUB FOR A NEW CLUB HOUSE AT 400 EVERGREEN ROAD
WITH THE CONDITIONS AS NOTED IN LOREN'S MEMO.
MOTION PASSED.
Chairperson, Lenny Leuer, stated that it was embarrassing not to have a quorum here
at 7:30.. He urged everyone to be on time.
