HomeMy Public PortalAbout1999/09/20 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor James A. Failace at approximately 7:30 P.M., on Monday, September 20, 1999 at the Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: Councilmember Patrick Crilley " Jack Fazekas " Stanley Gutowski " James Mancuso " Remy Quinones Noted absent were Councilmember James O'Brien and Borough Attorney Craig J. Coughlin. Also noted present was Attorney J. DUfek. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor James A. Failace. The Clerk stated that on September 10, 1999 and September 18,1999, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News Tribune, The Star Ledger and posted on the bulletin board. Upon MMS&C, by Councilmembers Gutowski and Quinones and unanimous affirmative vote of the five (5) Councilmembers present, the minutes of August 19th and September 2, 1999 were approved as transcribed and engrossed by the Clerk. Mayor Failace asked Patrolmen Juan Rivera and Robert Spolizino to come forward to present them with Certificates of Merit. Council President Gutowski, also the Police Commissioner, read the following: "On July 11, 1999, Police Officers Juan Rivera and Robert Spolizino were notified of an armed robbery that just occurred at a gas station in Woodbridge Township. The officers were also advised that a suspicious vehicle had entered the borough from Woodbridge. Spolizino Continued ORDINANCE #99-30 Bond Ordinance Re: Y2K Compliance and Other Purposes PUBLIC HEARING HEARING CLOSED Council President Gutowski continued "The officers stopped the vehicle and after removing five individuals, they discovered they were indeed the suspects wanted for the robbery. It is because of the officers quick and decisive action, these suspects were apprehended and turned over to the Woodbridge Police Department. Both officers demonstrated their dedication to their duties and brought credit upon themselves and the Carteret Police Department. I commend you both and appreciate YOUf commitment to ensuring the public safety of the citizens of the Borough of Carteret. Thanks for a job well done." He said that was from the Mayor. He said he especially wanted to thank Officer Spolizino because he had an officer that was still in training with him. By doing this, he showed Officer Rivera what a police officer should do. As long as there are more guys like him, there shouldn't be any problems. He thanked him. Mayor Failace said this was great, they had a new officer and a veteran officer. He thanked them. The Clerk stated that Ordinance #99-30 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough of Carteret held on September 2, 1999. It was duly published in The Home News Tribune on September 7, 1999 with notice that it will be considered for final passage on September 16, 1999. Due to a rescheduling of the September 16th meeting, notice of Public Hearing was again published on September 18, 1999 with notice that it will be considered for final passage on September 20, 1999 at approximately 7:30 P.M.. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS&C, by Councilmembers Gutowski and Crilley and unanimous affirmative vote of the five (5) Councilmembers present, the Mayor declared the Public Hearing to be open: There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Gutowski and Quinones and unanimous affirmative vote of the five (5) Councilmembers present. 2 Upon MMS&C, by Councilmembers Gutowski and Quinones ORDINANCE #99-30 "BOND ORDINANCE PROVIDING FOR A TECHNOLOGY UPGRADE FOR Y2K COMPLIANCE AND OTHER PURPOSES IN AND BY THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY, APPROPRIATING $500,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $476,000 BONDS OR NOTES OF THE BOROUGH TO FINANCE PART OF THE COST THEREOF" BE IT ORDAINED by the Borough Council of the Borough of Carteret, in the county of Middlesex, New Jersey (not less than Two- thirds of all members thereof affirmatively concurring) as follows: Section 1. The improvement described in Section 3 of this bond ordinance is hereby authorized to be undertaken by the Borough of Carteret, New Jersey as a general improvement. For the improvement or purpose described in Section 3, there is hereby appropriated the sum of $500,000, including the sum of $24,000 as the down payment required by the Local Bond Law. The down payment is now available by virtue of provision for down payment or for capital improvement purposes in one or more previously adopted budgets. Section 2. In order to finance the cost of the improvement or purpose not covered by application of the down payment, negotiable bonds are hereby authorized to be issued in the principal amount of $476,000 pUfsuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pUfsuant to and within the limitations prescribed by the Local Bond Law. Section 3. (a) The improvement hereby authorized and the purpose for the financing of which the bonds are to be issued is a technology upgrade for Y2K compliance and other purposes by the acquisition and installation of a phone system and all related equipment, the acquisition and installation of computers and a computer networking system, including equipment, hardware and software, and the acquisition and installation of a police computer Y2K compliance software package, including all costs necessary therefor or incidental thereto. (b) The estimated maximum amount of bonds or notes to be issued for the improvement purpose is as stated in Section 2 hereof. (c) The estimated cost of the improvement or purpose is equal to the amount of the appropriation herein made therefor 3 SEPTEMBER 20, 1999 ORDINANCE #99-33 Bond Ordinance Continued SEPTEMBER 20, 1999 ORDINANCE #99-30 Bond Ordinance Continued Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the Chief Financial Officer; provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer. The Chief Financial Officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the Chief Financial Officer's signatUfe upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A:2-8 (a). The Chief Financial Officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the pUfchasers thereof upon receipt of payment of the pUfchase price plus accrued interest from their dates to the date of delivery thereof. The Chief Financial Officer is directed to report in writing to the Governing Body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name ofthe purchaser. Section 5. The capital budget of the Borough of Carteret is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available there for public inspections. Section 6. The following additional matters are hereby determined, declared, recited and stated: (a) The improvement or purpose described in Section 3 of this Bond Ordinance is not a current expense. It is an improvement or purpose that the Borough may lawfully undertake as a general improvement, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby. (b) The period of usefulness of the improvement or purpose within the limitations of the Local Bond Law, according to the reasonable life thereof computed from the date of the bonds authorized by this ordinance, is five (5) years. (c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and file din the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Borough as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $476,000 and the obligations authorized herein will be within all debt limitations prescribed by that Law. 4 (d) An aggregate amount not exceeding $50,000 for items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein for the purpose or improvement. Section 7. Any grant moneys received for the purpose described in Section 3 hereof shall be applied either to direct payment of the cost of the improvement or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used. Section 8. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Borough, and the Borough shall be obligated to levy ad valorem taxes upon all the taxable real property within the Borough for the payment of the obligations and the interest thereon without limitation ofrate or amount. Section 9. This bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law. was finally adopted. Failace Advertised as finally adopted: September 24. 1999 Mayor Failace said with this ordinance, oUf Business Administrator is going to apply for a technology grant of approximately $250,000, which will help cut down dramatically any costs to the citizens of the Borough ofCarteret. A copy of each resolution was placed upon the table for review prior to the meeting in accordance with the Rules of Council and upon MMS&C, by Councilmembers Gutowski and Quinones and unanimous affirmative vote of the five (5) Councilmembers present, the meeting was opened for public input on all resolutions. 5 There being no comments or objections to the resolutions, the Mayor declared the public hearing to be closed upon MMS&C, by Councilmembers Gutowski and Quinones and unanimous affirmative vote ofthe five (5) Councilmembers present. Mayor Failace said they were applying for the New Jersey Transit Grant, where we will get a new bus. John Riggio is taking care of it. The bus will be used to go to the train station in Woodbridge, then the bus will be OUfS for the rest of the day. 6 RESOLUTION #99-305 was introduced by the Mayor and was referred to the Council for action. If they saw some of the areas like Beverly, John, Christopher and others, they would know why they have to spend this money. We have to straighten out the problems with the sewers. He received numerous phone calls people whose basements were flooded with human waste. It's just horrendous. These problems should have been taken care of a long time ago, but they weren't and we have to do it now. RESOLUTION #99-309 was introduced by the Mayor and was referred to the Council for action. The Clerk stated that she was in receipt of an application from the Carteret Jewish Community Center concerning an amendment to BL #1532AA by adding dates. Upon MMS&C, by Councilmembers Gutowski and Fazekas and unanimous affirmative vote of the five (5) Councilmembers present, it was ordered to be received and processed. The Clerk stated that she was in receipt of an application from St. Elizabeth's HNS to amend BL #1518A by adding workers. Upon MMS&C, by Councilmembers Gutowski and Fazekas and unanimous affirmative vote of the five (5) Councilmembers present it was ordered to be received and processed. The Clerk stated that she was in receipt of a communication from Comcast regarding a notice of additional channels. Welfare - July & August 1999 Upon MMS&C, by Councilmembers Gutowski and Mancuso and unanimous affirmative vote of the five (5) Councilmembers present, all reports were ordered to be received and placed on file. BUILDINGS & GROUNDS: Committee Member Mancuso read Committee Chairman O'Brien's report. He said during Hurricane Floyd the Annex had a problem. The roof is leaking on the Welfare Dept. and they had to buy a new sump pump for there. There was a small area in the Recreation Building that was leaking. The Office of Emergency Management had a lot of water. Jason and Arnold worked on the buildings and tried to keep up with everything. They were around all day and all evening. He reported progress. 9 FINANCE & ADMINISTRATION: Committee Chairperson Quinones thanked the Councilmembers who assisted people during the storm. The Mayor was very heavily involved, as was Council President Gutowski, Councilmember Mancuso, the Police and Fire Departments and all the borough workers. She reported progress. SEPTEMBER 20, 1999 PAYMENT OF BILLS APPLICATIONS: Carteret Jewish Community Center St. Elizabeth COMMUNICATIONS: Comcast REPORTS: Departments Standing Committees SEPT~1BER 20, 1999 Standing Committees Continued FIRE: Committee Chairperson Fazekas said in the Open House is in October. Moving on. PARKS & RECREATION: Committee Chairperson Crilley said the Town Yard Sale is on SatUfday from 9:00 AM. to 4:00 P.M. There are 115 homes registered. The Halloween Parade is scheduled for October 31, 1999 at 1 :00 P.M. They will line up at the CWV and march down Carteret Avenue to the end, then come back up Washington to the High School. This Saturday is a Skate Park Competition at the Civic Center Park. It's on Saturday and Sunday. He said Ethnic Day was this past Saturday and he wanted to thank Vince Manetta and his crew. They did a great job. He also wanted to thank Bob Kately and the Parks Department. They did a great job. As far as Tropical Storm Floyd flood, he wanted to relay his thanks to all the departments that cooperated. The Police Department, the Fire Department, Streets and Roads, Office of Emergency Management, Parks, Welfare. It was a nice effort by the people in town and we learned some things. They did a great job. The employees did a great job helping the citizens of the town. In particular, the volunteer fire department did a whale of a job putting in a lot of man hours, helping the people get out of their homes. He reported progress. POLICE: Committee Chairperson Gutowski said everyone did a fantastic job during the storm, from start to finish. PUBLIC WORKS: Committee Chairperson Mancuso said they had some calls and he thanked the guys for doing a hell of a job. He thanked Teddy and Bobby and everyone else. They worked well together. He also thanked Vince Manetta for Ethnic Day. All he has heard on good comments on it. BOARD OF EDUCATION: Committee Chairperson Crilley reported progress. 10 Mayor Failace read the following proclamations: 50th Anniversary of the Association for Retarded Citizens of Middlesex County WHEREAS, the Association for Retarded Citizens of Middlesex County, New Jersey is celebrating their 50th Anniversary; and WHEREAS, the ARC/MC is a not for profit organization dedicated to promoting equal life opportunities for people who have developmental disabilities; and WHEREAS, the ARC/MC provides support for individuals and their families and encourages their participation in the community; and WHEREAS, the ARC/MC offers family support services, residential services and vocational services which include adult training services; and WHEREAS, the ARC/MC is committed to serving people with developmental disabilities and has maintained a stable funding and administrative structUfe, thereby allowing the agency to grow and meet the challenging needs of oUf citizens. NOW, THEREFORE, I, JAMES A. FAILACE, Mayor Borough ofCarteret, New Jersey 11 SEPTEMBER 20, 1999 Mayor: Proclamation 50th Anniversary Association for Retarded Citizens Of Middlesex Cty SEPTEMBER 20, 1999 Fire Prevention Week PROCLAMATION "FIRE PREVENTION WEEK October 3-9, 1999 WHEREAS, smoke and poisonous gases are the leading cause of death in fires and can kill a person long before the flames will; and WHEREAS, underestimating the power of fire and the time it takes to escape a home fire put people at severe risk of fire death and injury; and WHEREAS, developing and practicing a home fire escape plan at least twice a year are critical to escaping a real fire safely, and WHEREAS, a complete home escape plan includes working smoke alarms, everyone in the household knowing two ways out of each room, having an outside location where everyone will meet upon exiting, and memorizing the local fire department's emergency telephone number; and WHEREAS, the Fire Prevention Week 1999 theme - "Fire Drills: The Great Escape!" - emphasizes the extreme importance of not only having a home escape plan, but physically practicing it regularly; and WHEREAS, the fire service of the Borough of Carteret is dedicated to the safety of life and property from the devastating effects of fire; and WHEREAS, the members of the fire service are joined by other concerned citizens of this borough, as well as other emergency service providers and safely advocates, businesses, schools, service clubs and organizations in their fire safety efforts; I, JAMES, A. FAILACE, Mayor of the Borough of Carteret, in cooperation with the non-profit National Fire Protection Association (NFP A) do hereby proclaim the week of OCTOBER 3-9, 1999 as FIRE PREVENTION WEEK This week commemorates the Great Chicago Fire of 1871, which killed more than 250 persons, left 100,000 homeless and destroyed more than 17,400 buildings. I call upon the people of the Borough of Carteret to participate in fire prevention activities at home, work and school and to execute "The Great Escape" to enSUfe their safety and the safety of their families in the event of fire. FAILACE, Mayor Borough ofCarteret, New Jersey Mayor Failace said he would like to add to the accolades given by the other Councilmembers. Last Thursday could have been a disaster here in Carteret. We were fortunate that the horrible rain that was predicted for around 7:00 P.M. didn't get here. He wanted to thank Councilmembers Gutowski, Crilley and Mancuso. When he went down to John Street and Beverly Street and those people were evacuated, it is heart wrenching. They don't want to leave. Some went to family members an some went to the Fire House. They were there as late as 11:00 P.M., trying to find rooms for some people. They took one family back in a rowboat because they wanted to be in their house, because that is all they have. She couldn't stay there, so they found a motel room for her. When people complain about what is being spent on engineering and sewers, if the quality of life for these people deteriorates any more, he doesn't know what it could possibly be like. We have to do the work, we must do it. He thanked the Office of Emergency Management, the Fire Department, paid and volunteers, the Police, Teddy Surick, Bob Kately. These guys did one heck of a job. If you don't go out you don't realize how terrible it really is and how these people suffer. We had the engineers down for the day and they documented everything. He spoke to Congressman Menendez on Friday and he explained to him what happened. He knows our sewer needs, but he wanted to emphasize it even more. He has a petition from 45 residents from John, Christopher and Charles Street because of what happened to them. The Industrial Road was great, but they didn't put the proper sewerage in. The sewer line goes to a dry well. It doesn't help. They put money aside to do the sewer on Industrial Road only to find out that what fill was used was toxic. We have a terrible problem. Now we have to go out and look for $400,000 to $500,000 more to do the job. It has to be done. They spent $3,000,000 in the last two years without raising taxes and next year they will look for more money. Something has to happen. He hopes they don't have to raise taxes, but if something isn't done for the quality of life for these people than we are not doing what we are supposed to be doing.
