AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING A SANITARY SEWER EASEMENT OVER A PORTION OF
PROPERTY ADDRESSED AS 2511 EAST SCHELLRIDGE ROAD, IN THE CITY OF
JEFFERSON, MISSOURI.
WHEREAS, it has been shown to the City Council of the City of Jefferson, Missouri,
that the owners of 2511 Schellridge Road in the City, have petitioned the
City Council to vacate a sanitary sewer easement; and
WHEREAS, it has further been shown that it would not inconvenience the public or the
citizens of the City to discontinue the sanitary sewer easement for public
use as described in Section 1 of this Ordinance.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue a sanitary sewer easement in the area
described as a portion of property addressed as 2511 East Schellridge Road in the City
of Jefferson, Missouri and forever vacate the following described sanitary sewer
easement in said City:
All that part of the 6' wide sanitary sewer easement of record by the plat of
the Schellridge Subdivision, recorded in Plat Book 6, Page 21, Cole
County Recorder's Office, being situated in the Southwest Quarter of the
Section 2, Township 44 North, Range 12 West, and being also situated
within the eastern 50' of Lot 11 of said Schellridge Subdivision, in the City
of Jefferson, Cole County, Missouri, more particularly described and
shown in Exhibit A.
Section 2. The statutory right of reversion in the owners of the abutting property
is hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor
and the Clerk of the City are hereby authorized to execute all necessary instruments
required to confirm the reversionary rights of the owners of property abutting on the
area vacated, as described in Section 1 of this ordinance, in the vacated sewer
easement.
Section 3. This Ordinance shall take effect and be in full force from and after its
passage.
