Dunklin Street Bridge Design Elements (David Bange) Mr. Bange explained this project will be starting at the top of Dunklin Street rather than at the bridge due to needing time to order the girders for the bridge itself. Bids for the project are scheduled to be opened March 19 with the intention to bring a construction contract before the Council at the meeting on April 1st. 1. Mill and Overlay Project List (Britt Smith) Minutes/Jefferson City Public Wo rks an d Planning Committee 2 Ma rch 14 , 201 9 Mr. Smith explained staff is requesting the committee's endorsement of the street resurfacing for the coming year. There was discussion among Comm ittee members , staff, and Councilman Mihalevich regarding St. Mary's Boulevard being moved to 2020 and those residents deserving consideration since they have waited since 2018. Mr. Smith explained staff would continue to investigate option and repair need for St. Mary's Boulevard, but at this time resurfacing is not recommended . The Committee endorsed the street resurfacing list for the coming year. 2 . Single Axle Snow Plow Truck Status (Britt Smith) Mr. Smith expla ined the City was not awarded the grant offered through the Department of Natural resources. Staff is requesting the committee's approval to request a supplemental appropriation from the general fund to replace this snow plow truck. There was discussion among Committee members , staff, and Councilman Mihalevich regarding setting priorities for items and the time frame to order and receive the truck. Councilman Schreiber moved and Councilwoman Ward seconded to refer the request to the Finance Committee , motion carried . 3. Snow Report (Britt Smith) Mr. Smith ex plained the snow operations involve 50 plus staff members , with 20 routes and three tandem routes . He stated staff uses rock salt and liqu id calcium and the cost so far for this year has been $644,000 . Committee members agreed that staff has done a great job with snow removal this year. 5. Jefftran Recommended Route Modifications (Mark Mehmert) Mr. Mehmert e xplained minor modifications to Jefftran routes . The modifications will require public hearings. Councilman Kemna moved and Councilwoman Ward seconded to forward the modifications to the City Council for public hearing , motion carried . 4. Other Topics • Ohio Street Bridge Closure Lt. White with the Salvation Army asked th e Committee to look into replacing the bridge as they have had a drop in revenue from the Salvation Army Store . There was discussion among Committee members, staff and those present regarding the cost of design and building, fire department access, and other funding options. Councilwoman Ward moved and Councilman Schreiber seconded to send the request to the Finance Committee for additional review, motion carried . 5. Citizen Opportunity to address Council/Staff on Stormwater and Other Public Works Issues Minutes/Jefferson City Public Wor1<s and Planning Committee March 14, 2019 • Roger Whittier of 614 Hobbs Road and Jim Rathert, his neighbor, spoke regarding a storm drainage pipe and ground water issue on Hobbs Road. He requested a cost share agreement between the City and property owners in order to solve the issues. There was discussion among Committee members, staff and those present regarding Hobbs Road crumbling due to ground water, homeowners responsibilities, clay soil, and surrounding businesses having large impervious surfaces. *Councilman Kemna left the meeting at this time (8:28a.m.). Councilman Fitzwater stated he would get Mr. Whittier information and visit the site. • Councilwoman Ward asked about the Monroe Street C~nridor Project. Mr. Bange explained it was not included on the 2019 Project List due to lack of funding. • Councilman Schreiber asked about the East High Street Projept. In September of 2013 the City and County entered an agreement with the County to share in the cost of a sewer extension and a rail spur extension to serve the Morris Packaging fac ility on Algoa Road. The orig inal agreement outlined an even cost share between the City and County, however, a later amendment to the agreement set the limits of the total contribut ions to $10,000 for the sewer and $250 ,000 for the rail spur. The City's share would be one ha lf of those amounts being $5 ,000 and $125 ,000 respective ly . In the intervening time modifications were required for the rail spur to meet the requirements of Union Pacific resulting in cost that were higher than originally considered . Ultimately the project was advertised and bids were received by the County on March 29 1h . The low bid was submitted by Railworks Track Services, Inc. for a total cost of $373,210 . Per the agreement Morris Packaging is responsible for $79,801 .92 leaving the City/County portion of the construction contract at $293,408.08 . In addition to th is amount $41 ,935 has been spent for the design of the project bringing the total City/County contribution to $335,543.08 . Splitting this evenly would create a City liability of $167 ,771 .54 , however, because of the limits set forth in the agreement addendum and because the County has unspent joint City/County project funds from the previous sales ta x cycle amounting to $212,171 .78 , the County has proposed to cover all costs of t he project above the C ity's $125,000 contribution . Th e City's portion will be funded by monies that were taken from the contingency f unds of sales tax E. A resolution requesting the Council 's concurrence in awarding the bid for this project to Railworks Track Services , Inc. will appear of the April 151h Council Agenda . I. Morris Development Project. This project is identified as a cooperative City/County project for the purpose of economic development. 2. Development Agreement. Attached herewith and incorporated by reference is the development agreement between the City, County, ROAR Real Estate 2, LLC and Morris Converting, LLC which provides the obligations to be divided by this agreement (hereinafter uthe development agreement"). 3. Sewer Extension. For purposes of extending the sewer line as provided in the development agreement. a. The City Director of Public Works and the County Director of Public Works, hereinafter called the Project Administrators, shall administer the project. b. The City of Jefferson shall establish a separate special Joint City & County Cooperative Project Fund Account for the administration of this project and extension of the sewer line. c. All project costs shall be paid from the fund, except any uin house" services provided by the City or County. d. The Project Administrators shall follow normal City governmental purchasing and contracting procedures as adopted by the City. e. The Project Administrators shall jointly review the bids and recommend the lowest and best contracts to the Jefferson City Council and Cole County Commission for approval. The recommended bid shall be approved by the Cole County Commission prior to execution of a contract by the Jefferson City Council. f. Financial Contribution: The County shall contribute one-half the estimated cost of the project on or before construction begins. At the conclusion of the project the City shall provide the actual cost to the County. The County shall either pay to the City additional amounts to pay their share or be refunded any unexpended funds remaining in the Joint City & County Cooperative Project Account, as well as any interest accrued by the funds in Joint City & County Cooperative Accounts shall be apportioned to the City and County in direct proportion to the amount of funds deposited. g. Timing: This project shall be constructed within the time frames provided in the development 4. Rail Spur Extension. For purposes of possibly extending the Rail Spur in the future, as provided in the development agreement. a. The City Director of Public Works and the County Director of Public Works, hereinafter called the Project Administrators, shall administer the project. b. The County of Cole shall establish a separate special Joint City & County Cooperative Project Fund Account for the administration of this project and extension of the sewer line. c. All project costs shall be paid by from the fund, except any "in house" services provided by the City or County. d. The Project Administrators shall follow normal County purchasing and contracting procedures as adopted by the County. e. The Project Administrators shall jointly review the bids and recommend the lowest and best contracts to the Jefferson City Council and Cole County Commission for approval. The recommended bid shall be approved by the Jefferson City Council prior to execution of a contract by the Cole County Commission. f. Financial Contribution. Per the attached development agreement, the Developer will contribute to the cost of the rail spur extension an amount that is equal to Twenty Cents ($.20) times the number of square feet contained in the Property. This contribution will be deposited into the Joint City & County Cooperative Project Fund Account. The City shall contribute one-half the estimated cost of the project after deduction of the Developer's contribution, on or before construction begins. At the conclusion of the project the County shall provide the actual cost to the City. The City shall either pay to the County additional amounts to pay their share or be refunded any unexpended funds remaining in the Joint City & County Account as well as interest accrued by the funds in Joint City & County Accounts shall be apportioned to the City and County in direct proportion to the amount of funds deposited. g. Timing. This project is a potential future project contingent upon the Developer's desire to have the rail spur extended on his property and upon the Developer meeting requirements as outlined in the development agreement. 5. Notices. All notices required or pennitted hereunder and required to be in writing may be given by first class mail. If to City, notice shall be sent to the City Administrator at 320 East McCarty, Jefferson City, Missouri 65101. If to the County, notice shall be sent to the Cole County Commission at the Cole County Courthouse Annex, 311 East High Street, Room 200, Jefferson City, Missouri 651 01. The date of delivery of any notice shall by the date falling on the second full day after the day of its mailing. 6. Agreement Binding. This agreement is to be binding on the successors and assigns of the parties hereto and is not to be assigned by either party without first obtaining the written consent of the other. 7. Applicable Law. The Laws of the State of Missouri shall govern the validity, performance, and enforcement of this agreement. This funding is subject to accounting officer certification in the future for the rail spur project, after appropriation and encumbrance of the funds. Public Works & Planning Council Committee -April 11, 2019 Proposed Bill for Electrical and Plumbing Licenses Modifications This bill is being presented to the committee for their consideration for approval to present it to the full City Council. The bill affects the licensing of electricians and plumbers within the City of Jefferson. The modifications have been discussed with the Electrical and Plumbing Licensing Boards over the past few years. These changes would provide better protection of the public and increase the professional status of these trades. The proposed bill was mailed out to all Jefferson City licensed electrical contractors (77) and plumbing contractors (46). We received only one positive comment from that mailing and nothing negative. It was then voted on by both licensing boards that approved the bill for it to continue the legislative process. We also emailed the bill out to a list of interested Building Regulations stakeholders (100+) for comments and again only received positive comments, nothing negative. What prompted this bill at this time were a couple of recent incidents. They were: 1. Plumbers and excavators have overlapping work when installing sanitary and storm sewer systems outside of a structure. This creates disputes between these trades on big projects and does cause contract and code enforcement issues. 2. A licensed plumbing contractor recently damaged a structure by accidently flooding the basement twice. The contractor did not have any liability insurance so the owner is suing the contractor for damage recovery. To help clarify and improve these licensing requirements, the bill recommends changing the following: City Code Section 8-3 -.Electrical 1. Adds the requirement for proof of insurance for $500,000 general liability and state required workers compensation. We are currently not requiring any proof of insurance. 2. Introduced renewable individual licenses on a 3 year basis in lieu of issuing permanent licenses. This will allow us to know how many active licenses there are and to have current contact information of licensees for notifications. City Code Section 8-5 -Plumbing 1. Clarified work limits of what needs to be done by a licensed plumbing contractor. 2. Changes the surety bond requirement from $2,000 to $5,000. This bond is for the City of Jefferson in case work in the right-of-way is left incomplete. 3. Adds the requirement for proof of insurance for $500,.000 general liability and state required workers compensation. We are currently not requiring proof of any insurance. 4. Clarified that proof of a journeyman license is a prerequisite to obtain a master's license. 5. Introduced renewable individual licenses on a 3 year basis in lieu of issuing permanent licenses. This will allow us to know how many active licenses there are and to have current contact information of licensees for notifications. City Code Appendix Y 1. It affects contractor licensing requirements within the City of Jefferson . These proposed modifications have been discussed with the Electrical and Plumbing Licensing Boards over the past few years . The proposed bill would make the following changes : City Code Section 8-3 -Electrical 1. Adds the requirement for proof of insurance for $500,000 general liability and state required workers' compensation . 2. Please allow three business days to process the requ est. Page Two Proposed License Changes These changes are being considered for various reasons . The primary reasons for the proposed changes are to provide better protection of the public and clarify license requirements . Add itional reasons are: 1. Insurance changes are to verify compliance with State statutes for workers ' compensation insurance and to ensure financial protection with general liability insurance . 2. Renewing individual licenses will give current contact information and indicates how many tradespeople are still active. 3. Clarifies work limits of licensed plumbers versus excavators. 4 . Submit application stating, name, mnBiL address and phone number. b. Successfully complete examination required by the Board of Electrical Examiners. 80.26. Scope of Work Authorized: 80.26.1. Electrical Contractor shall be authorized to engage in the business of supplying material and labor for the installation, alteration or repair of electrical systems. 80.26.2 Master Electrician shall be authorized to do all types of electrical work as an electrical contractor or while employed by an electrical contractor licensed by the City of Jefferson. A Master Electrician who also holds one or more additional trade licenses with the City of Jefferson may supervise no more than two (2) apprentices in any one (1) trade at any one (I) permitted job site. 80.26.3 Journeyman Electrician shall be authorized to do all types of electrical work while employed by an electrical contractor licensed by the City of Jefferson. The maintenance electrician shall not be authorized to install, alter, or replace service equipment or feeder to any service equipment. 80.27.
