HomeMy Public PortalAbout08-12-2003PLANNING COMMISSION MINUTES - AUGUST 12, 2003 PRESENT: BILL LOE, MARILYN FORTIN, ELIZABETH WEIR, LENNY LEUER, DICK PICARD, RON JOHNSON AND JERRY BROST. ALSO PRESENT: PLANNING AND ZONING ADMINISTRATOR LOREN KOHNEN, CITY ADMINISTRATOR CHAD ADAMS AND PLANNING AND ZONING ASSISTANT SANDIE LARSON ABSENT: MARY VERBICK AND SHARON JOHNSON Chairperson Elizabeth Weir called the meeting to order at 7:02 p.m. Ms. Weir reminded everyone that the Planning Commission was a recommending body and that the city council made final decisions. 1. CBR DEVELOPMENT, LLC - 4585 BALSAM STREET - RE -PLAT OF 7 LOTS TO 3 LOTS - PUBLIC HEARING Loren Kohnen read his memo to the Planning Commission and put up an overhead of the proposal. He mentioned that there had been discussion of the vacation of Oak Street. He said that the public works director has said that possibly the portion without the driveways on it could be vacated in the future. Tom Rollings, principal of CBR Development, said that they will put in a bituminous driveway on the Oak Street right-of-way that will be shared by the Elsenpeter's and the new Lot C. There would be an agreement between the two property owners for care of the driveway. Jim Leviton, 2945 Ardmore Ave., said that he was concerned about the 10' side setback requirement. He felt that it could put a home 20' from his home. T. Rollings said that the builder will try to do the best for both property owners. Lenny Leuer mentioned that there were several trees on the property now and wondered what the plans were for them. T. Rollings said his answer would be the same as for the setback - it is a benefit to save as many trees as possible and the builder would do that. L. Leuer asked who retains ownership of the property. T. Rollings said he would own the property until he sells it and will probably sell all three lots to one builder. L. Leuer said we do not currently have an ordinance to prevent clear cutting a lot. T. Rollings said again, that they will try and save as many trees as possible. Jerry Brost said that he had not seen any comments on water run-off and wondered about that. Planning Commission Minutes August 12, 2003 1 T. Rollings said that they were still waiting for comments from the watershed district. L. Kohnen said that before any building could take place they would have to have a grading and erosion control plan in place. J. Leviton said he is concerned about the increased traffic on Ardmore. It is a curvy road and people use inappropriate speed. He suggested a speed bump of some kind to help control the speed. Elizabeth Weir suggested that Mr. Leviton share his concerns with the city council. Dick Picard said that he agreed that there would be some water going toward the Leviton property. L. Kohnen said that the city engineer would watch it closely. D. Picard asked why 2 park fees. L. Kohnen said because there are 2 newly created lots with credit for the lot with the house on it. Marilyn Fortin said she had a problem finding Oak Street when she went to visit the site. There was discussion of street names and how some of them show up on surveys that are not there. It was explained that this plat was done back in the 1930's and some things have never been changed at the county. Penny Elsenpeter mentioned that not only will the sewer service come up Oak Street for the new lot, but that there is also drainage tile under Oak Street. Mary McWilliams, 2935 Ardmore Ave., said that when they built 14 years ago they had asked the Elsenpeter's if they could come up their (Elsenpeter's) drive to their lot when they had their handicapped daughter in the car, because there were steps on their driveway side and wondered if they would still be able to do so. L. Kohnen said it is city property and I'm sure Elsenpeter's would agree to you using it. Ron Johnson asked Loren if in this area where there are small lots, is it is usual to combine them like this. L. Kohnen said it used to be done quite frequently. Jerry Brost asked the McWilliams if they were going to combine their two lots and they said no. MOVED BY LENNY LEUER AND SECONDED BY JERRY BROST TO RECOMMEND APPROVAL OF THE LOT COMBINATION/RE-PLAT OF THE 7 PID #'S AT 4585 BALSAM STREET WITH THE FOLLOWING CONDITIONS: 1. Buildings to be removed at final approval. Demolition permits required. 2. Comply with any requirements of the watershed district. 3. Two sewer and water connection fees to be paid MOTION PASSED. 2. MINUTES OF JUNE 10, 2003 There were five spelling corrections. MOVED BY LENNY LEUER AND SECONDED BY DICK PICARD TO APPROVE THE MINUTES AS CORRECTED. MOTION PASSED. 3. ADDITIONAL COMMENTS Loren mentioned that there would be two items in September; 1 lot combination/re-plat and 1 variance request. Loren said that the Keller property proposal is not ready yet for the planning commission. The traffic study is still being done, so probably in October. In the Uptown Hamel area; we are working with Farr Development and staff will be meeting with them soon. Bill Loe asked when a developer is interested in doing something in Medina, how and when does it get to the planning commission. There was discussion of how there are usually staff meetings first to get preliminary ideas, etc. Lenny Leuer asked the status of Walter G. Anderson. Loren said that they are building the addition that was approved a year ago and not going forward with the new application. MOVED BY BILL LOE AND SECONDED BY LENNY LEUER TO ADJOURN. MOTION APPROVED.
