"FB RPp RA \\\ (508) 896-3701 FAX (508) 896-8089 COMMUNITY PRESERVATION COMMITTEE MEETING MINUTES of MARCH 25, 2015 Present: Chair Paul Ruchinskas, Jeanne Boehm, Elliott Carr, Elizabeth Taylor, Joan Carstanjen, Roland Bassett, William Klein and Peter Johnson. Absent: Dion Dugan Also Present: Jillian Douglas Recording or Taping Notification "As required by the Open Meeting Law we are informing you that the Town will be audio taping this public meeting. In addition, if anyone else intends to either video or audio tape this meeting they are required to inform the chair." We request that all cell phones be turned off or to vibrate. 1. Approval of 3/11/15 meeting minutes. Motion made by Peter Johnson to approve the March 11, 2015 meeting minutes as amended. Jeanne Boehm seconded. VOTE: 5-0-2 One member arrived following this vote. 2. Discussion and vote on$30,000 professional services budget for community housing. Jillian Douglas, Assistant Town Administrator reviewed and there was discussion on the community housing professional services budget for$30,000. Legal counsel was asked to look into the title issues on four parcels to clear the titles. Millstone/Agassiz Road was taken by tax title and it has been determined to have a clear title though access to the parcel needs to be determined. If access is determined, then a project could be pursued on this parcel and the professional services money could be used for preconstruction work. The other parcel to be investigated is Slough Road/Cranview Drive is two small parcels and due to the topography a house could be built on one parcel but the septic would need to go on the other parcel across the street. Whether this is kept and built on or sold will need to be determined. The .83-acre parcel with frontage on Freeman's Way is in the watershed protection area of town and this may be a viable lot but the type of septic installation would need to be researched. Professional Services money would need to be used to determine if Freeman's Way is buildable and proceed with a request for proposals. Habitat for Humanity is aware of these parcels. Motion made by Peter Johnson to approve the community housing professional services FY '16 budget for$30,000. Roland Bassett seconded. VOTE: 8-0-0 Community Preservation Committee Meeting Minutes of March 25, 2015 Page 1 of 3 3. Review and vote on FY 16 CPC Town Meeting warrant articles. There was a review of the FY '16 Warrant Articles to be presented at town meeting. The Board of Selectmen is supportive of all of the warrant articles. Concern expressed about the introduction language in Warrant Article 7 as to the affordable housing restriction and historic preservation restriction. Paul would like to check with town counsel and maybe changed the language to "certain grants" as not all projects are subject to the restrictions. It was recommended that with regard to the Eldredge property it be inserted in the article that it is adjacent to the Drummer Boy. It was also recommended in the Historical Society Summary it be mentioned that the purchase was completed. Maps for open space will be inserted in the warrant articles. There was discussion on the Article 6, budget reserve funds (a) and a clarification of the weirs language. There was a brief discussion on the waterfall and stream and how the area was going to be corrected. The Department of Revenue has recommended reducing the allocation for the state match and the numbers will be decreasing in Article 6. The affordable housing language will be removed in Article 6 pending town counsel approval. Article 28 was reviewed and the "public water supply" will be removed from the article and there will be no borrowing in this request for monies. Article 29 was reviewed and"public water supply"will also need to be removed and the wording will be changed to read the Conservation Commission and there is no borrowing in this request either. Article 32 has not changed. There was discussion on how much of the $326,000 was left over from the Land Bank and the numbers would need to be confirmed by Lisa Souve. Roland Bassett made a motion to approve the Warrant Articles with additional necessary revisions to be made as needed. Peter Johnson seconded. VOTE: 7-0-0 4. Treasurer's Report. There was a brief discussion on the status of funds and it was decided to wait to review the Treasurer's report until the final numbers are received from Lisa Souve. 5. Brewster Cemetery Association- discussion of drafting of award letter conditions and liaison. Joan Carstanjen has recused herself from this discussion. Jean Boehm has agreed to be the liaison for this project. There was discussion as to how the work would proceed and how funds would be released. An outside company will do the repairs to the cemetery and volunteers will be doing the cleaning of the stones. There will be a 2-year limit on the project. Cemeteries are not subject to historic certification but will be subject to the Secretary of the Interior standards Community Preservation Committee Meeting Minutes of March 25, 2015 Page 2 of 3 6. Brewster Historical Society- discussion of drafting of award letter conditions and liaison and role of consultant. There was a discussion on the Brewster Historical Society project. Joan Carstanjen agreed to be the liaison for this project. Paul Ruchinskas will draft the award letter. Eric Dray will draft the historic preservation restriction and as it will take time for the preservation restriction reviewed by the state it will be a condition to have it submitted to the state before having the house open as a museum. The CPC will have Eric Dray approve all of the specifications for the house on behalf of the CPC and this will be so stipulated in the award letter. Eric Dray will be asked to sign off on projects completed as meeting the Secretary of the Interior Standards. Any costs incurred following the May 4, 2015 town meeting will be eligible for CPC reimbursement. It was decided to hold back twenty percent of the project. After discussion it was decided to research the proper way to do the recapture provision. There are no restrictions on what the monies are spent on while restoring the house as long as they are spent after town meeting approval. This may be re- voted at the next meeting once the research is complete on the recapture provision. 7. Discussion of members'terms. There was a review of the members' terms. Those appointed by the BOS are for three-year terms. Those appointed by the different boards are appointed annually although the town bylaw enacted for Community Preservation Committee calls for three-year terms on a staggered basis. 8. Items that the Chair could not reasonably anticipate. Peter Johnson is the liaison to the Alewife Committee. There was a review of those needing to complete the State Ethic's test. Receipt of the open meeting law acknowledgement was also discussed. 9. Next meeting- Wednesday, April 8, 2015 @ 4:30 p.m. The next meeting will take place on Wednesday, April 8, 2015 at 4:30 pm Motion made by Peter Johnson to adjourn the meeting at 5:40 pm.
