In addition, if anyone else intends to either video or audio tape this meeting they are required to inform the chair."We request that all cell phones be turned off or to vibrate. The Chair called the meeting to order at 4:30 pm. 1. Approval of minutes of October 14, 2015 meeting. Motion made by Peter Johnson to approve the meeting minutes of October 14, 2015 as amended. Bill Klein seconded. VOTE: 5-0-0 f2. Vote to approve resolutions for mortgages for Harwich Ecumenical Council for the Homeless' Housing Emergency Loan Program applicants. There was a review of the HECH application process and the fees included for approval. Three Applications have been received, one today. The two projects were reviewed. It is apparent that due diligence has been done in investigating these awards. There is no known asbestos in the boiler project. Motion made by Peter Johnson that, pursuant to the Vote on Article 7 (Item 2) of the Brewster Special Town Meeting held on May 4, 2015, and the Grant Agreement dated August 25, 2015 by and between the Town of Brewster Community Preservation Committee ("CPC") and the Harwich Ecumenical Council for the Homeless ("HECH"), wherein the CPC agreed to grant the HECH One Hundred Eighteen Thousand and 001100 ($118,000.00) Dollars to administer the Homeowner Emergency Loan Program (HELP) that would provide 0% loans of up to $25,000 for low income homeowners in CPC Meeting Minutes of October 28, 2015 page 1 of 4 i i I Brewster to make critically needed health, safety, and energy efficiency repairs to their homes, and as a condition of the Grant Award, the CPC shall be entitled to recapture its funding should the homeowner ever sell or transfer the Property except to an income eligible heir who will live in the home as their principal place of occupancy. Elizabeth Taylor, 245 Run Hill Road, Brewster, MA has been certified to have met all the underwriting and program criteria to receive a loan under the HELP and to secure such loan and the aforementioned grant condition, she has agreed to grant the Town of Brewster a mortgage interest of$9,845.45 (Nine Thousand Eight Hundred Forty-three dollars and forty-five cents) in the property and to record the mortgage instrument against the title to the property at the Barnstable County Registry of Deeds, the Community Preservation Committee hereby Votes to accept said mortgage interest on behalf of the Town of Brewster. Caroline O'Donnell a/k/a Caroline S. Davenport of 231 Governor Bradford Road, Brewster, MA has been certified to have met all the underwriting and program criteria to receive a loan under the HELP and to secure such loan and the aforementioned grant condition, she has agreed to grant the Town of Brewster a mortgage interest of$17,403.45 (Seventeen Thousand Four Hundred Three Dollars and forty-five cents) in the property and to record the mortgage instrument against the title to the property at the Barnstable County Registry of Deeds, the Community Preservation Committee hereby Votes to accept said mortgage interest on behalf of the Town of Brewster. Bill Klein seconded. VOTE. 5-0-0 Elizabeth Taylor arrived to the meeting. 3. Review of Brewster Cemetery Commission funding request and potential vote to refer the request to the Brewster Historical Commission for its review and recommendation. The revised Brewster Cemetery Commission application has not been received and discussion and vote will await receipt. CPC Meeting Minutes of October 28, 2015 Page 2 of 4 i 4. Discussion of outreach and advertising efforts for the November 18, 2015 public hearing on community housing, historic preservation, open space and recreation needs that might be assisted with Community preservation Act funding. The public hearing has been posted, e-mails to interested parties have been sent and a legal ad will appear beginning Friday, October 30, 2015 in the Cape Codder. An e-mail reminder of the public hearing will be sent just before the hearing date. 5. Reports/updates on open projects. The Habitat project is moving along with the 40B process to begin by the end of the year and it is hoped to have the project permitted by next October. The Millsites project is on track and it is expected to get the work done this fall. There was a review of the Brewster Historical Society letter dated October 27, 2015 from Vice President Sally Gunning on the Captain Elijah Cobb house project. The CPC is pleased with the work that is being completed. i There was a brief discussion on the Brewster Baptist Church. The Chair has been in touch with David Hill about having the second floor of the Church being declared historic and they would rather not do this, as they do not want to be limited as to this area's uses. It was determined the CPC has no jurisdiction with making this request. A local historic restriction is still required and the Historical Commission needs to determine if the Church is historic before the final $50,000 is released. If this project is not approved, the Church will be required to return the $150,000 of CPC funds that was approved. This issue was raised by receipt of a letter from the Massachusetts Historical Commission that the Church may not qualify to be on the State Historic Register due to the materials used in j the exterior restoration. Eric Dray will be asked to clarify the status of the Church. The Lower Road project is submitting bills and a report has been requested. The Mill Pond project expects to close by the end of the year or beginning of next. The Eddy School playground project is closed and unused funds will be returned next June. I Breakwater just got started. 6. Topics that can be legally discussed that the chair could not have reasonably anticipated. All Citizens Access will be looking to put in an application to install handicap access at Point of Rocks Beach. There was a brief discussion regarding whether a structure could be put in this area to house a floating wheelchair. j i CPC Meeting Minutes of October 28, 2015 Page 3 of 4 7.
