COMPREHENSIVE WATER PLANNING COMMITTEE (CWPC)
Regular Meeting
Monday, April 6, 2015 at 4:30 pm
Brewster Town Office Building
Chairman Paula Miller convened the CWPC meeting at 4:30 pm in the Brewster Town Office Building with
members Dan Ryan, Adam Curtis, Elizabeth Taylor, Bruce Evans, Lem Skidmore, John O'Reilly, Russell Schell,
and Dave Bennett present.
Also Present: Sue Leven, Pat Hughes, Nancy Ice, Mark Nelson - Horsley Witten Group

Mark Nelson and Sue Leven gave an update to the committee re: Phase III and new scope of work
Phase III
• Alternatives Analysis Report is done, paper copies corning soon
• Herring River and Schoolhouse Pond Reports are done.
• Management Plan for Mill Ponds Complex is complete
• Regulations: Draft form PB and BOH. Stormwater Regulations and Health Regulations
• Water Resource Atlas for fresh water ponds is done (low resolution version too)
• Updating the web site with new materials-- Project web site

Committee Comments
• Bennett asked about the procedure for the storm water regulations. (PB and Conservation) 2,500
square feet of disturbance (clearing for development and driveway) Bennett thought it was a low
threshold. There was discussion with Leven and Nelson about the threshold.
Taylor asked about Planning Board by-law or Town Code. It is a general by-law.
Proposed Scope.-of Work (memo from HWG)
• Future Development- build out in PB water shed
• Discussion of the Cape Cod Bay water shed- No TMDL but storm water and septic systems contribute
to water quality
• Managing septic systems-- Help residents understand issues- Issues with poor soils and high depths
to ground water- Options under title V? Encouraging shared systems?
• Taylor asked about getting computer information from the BOH. Water records were computerized but
not septic records, We know the lots from Phase Il.
• Miller, P- discovering systems in the water table? Recommend regular pumping every three years?
Currently town is generating 1.3million of septage a year going currently to Tri Town. Options for
setting up private sector septic system management. Contracts involve a system of regular inspections.
Interesting idea. Could this be looked at as an alternative? Alternative wastewater systems,
• O'Reilly asked if Nelson foresees looking at total nitrogen discharge for the lot? Some of the
neighboring towns have requirements.
Next Steps:
• Shellfish and potentially seaweed management in Pleasant Bay
o CCC has given Brewster a grant for a management plan
a Coordinating with Pleasant Bay Alliance
o Funding vs. credit for nitrogen removal- Ryan
Committee Comments:
Schell expressed concern that the white paper scope will be broad enough to include shell fish management
which includes restoration of the oyster habitat. Nelson agreed. There are still discussions regarding credits.
Taylor- Oyster reefs going to be for harvest or left there. Open for discussion. Pros and cons both ways.
Schell - Nitrogen removal affecting this, remove as much as 551 pounds of nitrogen per acre year for oyster.
Nitrogen removal is not a function of harvesting.
Miller-P- Costs includes Delta Grant. Yes.
Task#4-- Help Golf Course to start tracking ongoing practices for nitrogen removal
Task #5- Other regional discussions regarding Pleasant Bay, WMA's
Task #6-- Overview of Consodine Ditch- Status
• Leven noted it has become clear that a lot of people believe the pipe that comes out at Breakwater
Beach is a sewer. Leven will contact Mosquito Control to see if they are interested in participating.
• Schell added that water quality and water quantity is important. He explained possible flooding issues
and asked if a profile be done of the Consodine Ditch from the Bay to Thad Ellis Road.
Nelson stated that it is not in the scope currently.
• Miller, P noted that flooding of that road is not frequent.
• Miller, C asked them to keep in mind they have oversimplified the Consodine Ditch. The flooding issue
is because the pipe is shorter than it used to be.
• O'Reilly asked about 10 samples being enough? Nelson - $2500 for samples (dry flow and wet flow)
• O'Reilly-- Get a better understanding first? More information upfront. Nelson was agreeable.
• Miller, P First act- should be to define "what is the Consodine Ditch?" May be able to use volunteers?

• Leven suggested a community meeting on permitting.
• Schell commented on proposed fix for Walker's Pond. He is concerned about the juvenile herring.
• Nelson will discuss further with Ed Eichner.

Additional Comments:
• Miller, P asked for an outreach piece for the public regarding properly operating (N's and P's) septic
systems. They discussed sources and ideas further.
• Leven gave an overview regarding planning and implementation. There is a need to get the BOS
involved.
• They discussed timeframe with Nelson. Nelson looking for agreement this month,
• Taylor asked about what we are doing about eliminating lawn areas and adopting "Cape Cod" lawns.
• Leven will follow up with Paul Anderson.
• Miller, P asked about enforcement of the fertilizer by-law. Enforcement can be very difficult.
• Leven suggested updating the Landscaping cards with magnets, Add the by-law information.
• Bennett asked about funding. Is this money allocated? Leven noted this has already been voted. ($95k)
w/ $15k grant is covered.
• The committee discussed a vote for support of the concepts discussed.
• Hughes, P-- Encouraged them to think about more money into outreach and coordination. Town
printing budget? Re: Septage management-Very important that IWRMP have a discussion about
septage and septage management. Basic support document required.
Nelson will add a line item for further discussion. More will be determined from where the Tri Town
discussions go.
• Miller, P wants people to know that septic systems are not a "free ride"
They discussed making a motion again and priority of projects. Leven and Nelson discussed budget numbers,
The Consodine Ditch project was discussed again.
• O'Reilly did not want to see the Consodine Ditch task removed. He questioned the septic system
project.
• Bennett and Leven discussed tasks and their inclusion in the original scope. The committee was
considering freeing up money for additional projects.
Nelson noted that he is hearing that outreach and education is important.
• O'Reilly asked about Mill fond Management Study. ($22k) Has there been any discussion with the
BOS of restoring the Mill Ponds? Implementation could be costly.
• Leven noted there is a lot of interest in that system.
Hughes, P--The Board has not discussed the CWPC work. It needs to come before the BOS as an agenda
item. She anticipates a presentation soon. (plan/accomplishments/priorities)

• Miller, P thinks Town meeting would support fixing the ponds,
Leven has talked to Sumner about putting the Mill Ponds into the Capital Plan,
Hughes, P suggested a discussion after Town meeting.
• Taylor noted that when Long Pond was treated with Alum, the State contributed money. Would this
apply?
• Miller, C -- Grant application done jointly with another Town. There is more competition now and
budgets are tight, Alum is around $160,000. They discussed grants. If they are "shovel ready" it helps
with the grants. Fish and Wildlife? Notice of Intent is a 3 year window that can be expanded.
• Miller P, upgrading septic systems part of plan? No, mostly insources.
• The committee continued to discuss the Mill Pond project.

The committee reviewed edits to the letter to the BOS.

416 will be removed and put in a separate memo.
• #4 typo
• O'Reilly asked why #4 is in this memo? It was considered an alternative analysis. It is a point of
discussion.
• Bennett was in favor of keeping #6,
• Schell questioned that these are water quality issues but is the Tri Town meeting a forum for this
discussion. It seems in appropriate to bring up other issues.
• Leven explained this is not a board of managers meeting, it is a meeting with the three towns BOS's.
• Taylor suggested an edit for #4. Of additional properties...
• They discussed removing #6, per P. Hughes.
Taylor made a Motion, Bennett Second to accept the edits of the letter, change #4, remove #6,
Discussion:
Schell #2- How many of"a- i", does the groundwater protection district cover? (little or none)
There was further discussion.

Septic Management info-This topic was covered in earlier discussions.
BOH draft septic system regulation - Skidmore would like to receive comments for BOH from CWPC
Miller, P asked how her comments were presented to the Board? Did the entire Board get a copy?
Leven stated yes. Did every Board member receive comments?Yes.
Miller-P was concerned that the committee has no face to face interaction with the BOH. Leven recommended
a joint meeting or sending comments in writing, Comments should be sent to Leven by 4/22/15.
Miller, P asked to re-circulate the memo that was sent to the BOH from Leven
Bennett attended the BOH meeting. They have received a lot of comments. Bennett and Nelson had a
discussion about the Otis Air Force base plume and vertical separation to ground water.
