The regular meeting of the City Council of Riverdale, Iowa, will be conducted according to the following
order and actions will be considered on the items listed. The notice of this meeting is not considered
final until 24 hours prior to the meeting and may be further modified if 24 hours’ notice is impossible or
impractical for good cause.
In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state
laws, all public hearings and meetings held or sponsored by the City of Riverdale, Iowa, will be
accessible to individuals with disabilities. Persons requiring auxiliary aids and services should contact
City Hall at (563)355-2511 five days prior to the hearing or meeting to inform of their anticipated
attendance.
The requirement that an Ordinance be read three times before passage may be waived by council upon
an affirmative vote of four (4) of the five (5) council members. The public is advised to take note of this
process and be prepared to speak either for or against any ordinance at the time of the first reading.
Per Chapter 21 of the Iowa Code, more specifically described in sections 21.3 and 21.8, a member of the
Council may attend the meeting either in-person or by electronic means, as defined in said sections.

2.PUBLIC COMMENT
Per Iowa Code 21.7, this governmental body make and enforce reasonable rules for the conduct
of its meetings to assure meetings are orderly, and free from interference or interruption by
spectators.
The public is encouraged to provide and insights on the proposed agenda and other items of
concern. Public comment time is limited to three (3) minutes per speaker. Speakers will
introduce themselves, their topic(s) concern, and provide their address for the record. Public
comments do not need to be in support of proposed actions but are to be constructive and
respectful. A lack of decorum will result in the end of comment period and possible removal
from the meeting. All members of council, the public, and staff are encouraged to find ways to
effect positive change in their comments and their actions for the betterment of our community.

•Researched street sweeper options; will present options at September 27th meeting.
•Revised lawn care ordinance, which is included in the council packet for review/first reading.
•Revised the currently published sewer ordinance, which is included in the council packet as a
discussion item.
•Organized 4 meetings, agendas, documents, and resolutions. Ran A/P checks. Created 08/23/2022
council packet and distributed. Processed 08/19/2022 payroll.
•Researched the nuisance at 1052 Fenno Rd; working with legal counsel and Scott County on possible
condemnation procedures.
•Hosted Low Impact with Logan on 08/08/2022 and Lunch & Learn on 08/19/2022.
•Met with Hinson Consulting, LLC, regarding possible general management services for City.
•Worked with maintenance worker to wrap up duties.
•Researched and provided large number of documents to Chris Fennelly, including exporting some
gWorks reports to Excel and cleaning up.

Light switch in FD-was going to replace as requested but determined that switch is functioning as designed. Switch controls
multiple lighting circuits (even breaker #s 2-12 at a minimum) and so is a momentary operation switch that supplies power to
contactor(s) for all circuits and then returns to middle neutral position.

SANITARY SEWER REHABILITATION PROJECT – PHASE 2
MSA is still reviewing the final televised videos. Soon, MSA will begin the process of closing this
project out.
WOODS ESTATES EMERGENCY ACCESS ROUTE
MSA submitted a proposed Professional Services Agreement for Construction Engineering
Services.
Ethics Contracting has indicated they are waiting on the bonds for this project. For the City’s
information, the Contractor must provide the City with a Payment Bond and a Performance Bond
as part of their responsibilities to the City. These bonds must be provided prior to the City
executing their Contract with the Contractor.
A Performance Bond is the Contractors guarantee for labor and materials in the event they default
on their Contract. The City can then draw on the bond to complete the project. The Payment
Bond is the City’s guarantee that in the event the Contractor defaults on the Contract, all their
outstanding bills will be paid. Thus, the City will not have liens placed on them for outstanding
bills the Contractor may have compiled for this project..
CITY OF RIVERDALE – NPDES AUDIT
The City of Riverdale was audited by the IDNR on their efforts to date for their administration of
their NPDES Permit. This permit is required because the City is part of the Iowa Quad Cities MS4
community. The results of their audit will be provided to the City.

RIVERDALE STORM SEWER STRUCTURES EVALUATION
MSA’s report is now going through internal reviews.
SCOTT COMMUNITY COLLEGE ADDITIONS
The Scott Community College work has begun. MSA should be able to furnish a report at City
Council..
FENNO DRIVE ALLEY
MSA has put their proposed Professional Services Agreement on hold, pending the City’s efforts to
obtain additional land to possibly construct a cul-de-sac for Fenno Drive.

95.135 RATES
The rates for the comprehensive sewer service charges shall be reviewed annually and
established from time to time by City of Riverdale Council ordinance and shall be as follows:
1.Basic Sewer Service Charge. The basic sewer service charge shall be charged on each bill to
each customer regardless of usage. The charge is based on the user classification. The classes
are Residential (RESID), Small Other Public Authority (Small OPA), Large Other Public Authority
(Large OPA), Commercial (COMM) and Industrial (INDU). In no case shall the minimum bill be
less than the basic service charge. The basic sewer service charge on each quarterly bill will be
charged as follows for the next five fiscal years:

2.The Customer Usage Charge. The customer usage charge is determined by the amount of
water used measured in units of 100 cubic feet. The unit flow cost per one hundred (100) cubic
feet shall be different for each class. This charge is in addition to the Basic Service Charge. The
charge for each unit used per class will be charged as follows for the next five fiscal years:

Rate to Be Charged. Effective July 1, 2015, the comprehensive sewer service charge, as provided
in this section, to be paid by Users of the wastewater treatment facilities of the city and billed
beginning July 1, 2015, is hereby established per the tables above. The rate charged is subject to
review by the City Council and may be adjusted by ordinance. For calendar year 2020 and
following, the rates will remain at 2019 levels until modified by the City Council.
3.For Surcharge for Wastes of Strength Greater than Domestic Water. The surcharge for the O
& M cost of the wastewater treatment works shall be collected from those Users who contribute
wastes of strengths greater than domestic wastewater. These Users shall be sampled, and the
sample analyzed at least once per month. A moving average of excess BOD and suspended
solids, expressed in pounds, shall be used to compute the monthly charge.

A.Monthly Excess BOD. The monthly excess BOD, expressed in milligrams per liter, shall be
calculated by subtracting the BOD of domestic wastewater (two hundred fifty milligrams per
liter) from the monthly average BOD of a User. If the value is less than zero, zero shall be used to
compute the average of excess BOD.
B.Moving Average Excess BOD Value. The moving average of excess BOD, expressed in
pounds, shall be computed by adding the latest monthly excess BOD, expressed in
pounds, to the previous eleven months excess BOD, expressed in pounds, and divided by
twelve.
C.BOD Surcharge Amount. The surcharge for BOD shall be calculated by multiplying the
moving average excess BOD value by the unit BOD cost per pound. The unit BOD cost
per pound shall be determined by multiplying the anticipated budget by thirty-five
percent (35%) and dividing by the previous year’s total BOD load at the wastewater
treatment works measured in pounds. The unit BOD cost per one hundred (100) cubic
feet of domestic wastewater is obtained by multiplying the unit BOD cost per pound by
1.564.
D.Monthly Excess SS. The monthly excess SS, expressed in milligrams per liter, shall be
calculated by subtracting the SS of domestic wastewater (three hundred milligrams per
liter) from the monthly average SS of a User. If the value is less than zero, zero shall be
used to compute the moving average of excess SS.
E.Moving Average Excess SS Value. The moving average excess SS, expressed in pounds,
shall be computed by adding the latest monthly excess SS, expressed in pounds, to the
previous eleven months’ excess SS, expressed in pounds, and divided by twelve (12).
F.SS Surcharge Amount. The surcharge for SS shall be calculated by multiplying the
moving average excess SS value by the unit SS cost per pound. The unit SS cost per
pound shall be determined by multiplying the said anticipated budget by forty percent
(40%) and dividing by the previous year’s total SS load at the wastewater treatment
works measured in pounds. The unit SS cost per one hundred (100) cubic feet of
domestic wastewater is obtained by multiplying the unit SS cost per pound by 1.877
pounds. The total surcharge shall then be a summation of the surcharge for BOD and the
surcharge for SS.
4.Measurement by Meters. Such rates or charges shall be based upon the amount of water
supplied by the Water Company by the water meter readings of that company. By virtue of
agreement between the City of Riverdale and the Water Company, the comprehensive sewer
service charges will be billed, accounted for, and collected by the City of Riverdale. All persons
required to pay the comprehensive sewer service charge established in this chapter shall receive
billing for such charge separately stated on the Sewer bill and shall pay such charges to the City
of Riverdale as billed. Those Users who are billed by the City of Riverdale monthly shall pay their
comprehensive sewer user charges monthly, and those persons who are billed by the City of
Riverdale quarterly shall pay their comprehensive sewer user charges quarterly.
5.Date Due; Penalty. All comprehensive sewer user charges are due and payable thirty (30)
days after the date of billing. The penalty of one dollar ($1.00) shall be added to the
comprehensive sewer service charge billed to any User when the charge is not paid within thirty

(30) days. In the event the charge remains unpaid for a period of ninety (90) days after billing,
then an additional penalty to two dollars ($2.00) shall be added to the user charge.
6.Special Rates: Grounds; Approval; Private Water Supply Users. Where, in the judgment of the
Riverdale City Council, special conditions surround the use of water to the extent that the
application of the comprehensive sewer service charge or method of measurement would be
inequitable or unfair to either the City of Riverdale or the User, a special rate or method of
measurement shall be established by the City of Riverdale. Such rates or methods of
measurement shall be subject to approval by resolution of the Riverdale City Council. In such
cases, the Riverdale City Council may require that water consumed on the premises concerned
shall be separately metered at the expense of the User, who shall also pay the cost of reading
such meters and any increased billing or collecting charges resulting. In such cases, the Riverdale
City Council may require that water consumed on the premises concerned shall be separately

increased billing or collecting charges resulting. In such cases where a major portion of the
water consumed is not discharged into or does not reach the sanitary sewer system, the
following shall apply:
A.Said water so consumed shall be metered by a separate water meter with a remote-read
register and generator at the expense of the owner. Said remote-read register shall be
readable from outside a dwelling unit or building. Water metering systems existing prior
to May 18, 1976, that conflict with this section may be retained. Replacement systems for
those existing prior to May 18, 1976, shall be in compliance with these provisions. Any
system installed after May 18, 1976, shall be in compliance with this section.
B.A fee of five dollars ($5.00) per water meter with remote-read register and generator will
be charged for annually reading and computing comprehensive sewer service refunds.
An additional fee of five dollars ($5.00) annually will be charged for reading and
computing comprehensive sewer service refunds for water metering systems without
remote-read registers.
Where private or quasi-public water well systems are used and discharged directly or indirectly
into a sanitary sewer system, the comprehensive sewer service charges shall be on an equal
basis as nearly as may be with the charges which would apply to an equal quantity and character
of wastewaters originating through the use of the public water supply.

system installed after May 18, 1976, shall be in compliance with this section.
B. A fee of five dollars ($5.00) per water meter with remote-read register and generator will
be charged for annually reading and computing comprehensive sewer service refunds.
An additional fee of five dollars ($5.00) annually will be charged for reading and
computing comprehensive sewer service refunds for water metering systems without
remote-read registers.
Where private or quasi-public water well systems are used and discharged directly or indirectly
into a sanitary sewer system, the comprehensive sewer service charges shall be on an equal
basis as nearly as may be with the charges which would apply to an equal quantity and character
of wastewaters originating through the use of the public water supply.

We have enjoyed our past work with Riverdale, and are writing to propose a new and
expanded partnership, following discussions with certain City officials including Mayor
Heddlesten, and an evaluation of our understanding of Riverdale’s needs moving
forward. We believe the City would be well-served by a combination of approaches and
adjustments, including contracting with our firm for general management services in
place of filling the vacant City Administrator position for the time being.
Our team includes a team with over 95 years of collective Iowa local government
experience, including 66 years of experience in administrator/manager roles. We have a
deep knowledge of best practices and a strong dedication to public service. We look
forward to discussing further with the City Council, but offer the attached proposal as a
starting point for discussions.

serve as the contracting firm for the proposed services, and will engage as

Consultant Biographies:
Consultant Brent Hinson has worked in city government for 19 years, having served as
Finance Director/City Clerk in Iowa Falls, Iowa; City Administrator in Garner, Iowa; City
Administrator in Washington, Iowa; and beginning in August 2021, as Deputy City
Administrator/ Finance Director in Mason City, Iowa. Brent is an ICMA Credentialed
Manager. He has owned and operated his own consulting firm, Hinson Consulting, LLC
since 2014. He is a past Iowa League of Cities Board member and speaker at League and
ICMA conferences.
Consultant Patrick Callahan has 48 years of experience in city management and
executive search in Iowa. He served the communities of Fort Madison, West Point,
Maquoketa, and Anamosa in municipal leadership positions, and worked as a municipal
consultant for the University of Iowa Institute of Public Affairs, the Brimeyer Group, and
Snyder & Associates before starting his own firm, Callahan Municipal Consultants, in
2013. Since 2013, Callahan Municipal Consultants has successfully completed more than
25 administrator/manager searches in Iowa. Pat was inducted into the Iowa League of
Cities Hall of Fame in 2001.
Consultant Mark A. Jackson has worked in city government for 31 years, first as the
Village Manager in Homer, Michigan, and since 1993, as the City Administrator in Story
City, Iowa. Mark is an ICMA Credentialed Manager. He is an adjunct instructor for Iowa
State University. He also has provided consulting services upon request by cities for the
past 16 years. He is a past Iowa League of Cities Board member.

Proposed Scope of Services & Fees:
We propose the following scope of services, with services to be provided remotely
except as specifically required or arranged in advance:
1. Ensure that council directives, approved operational policies, and business affairs of
the city are executed, conducted, or delegated for enforcement.
2. Keep the council fully advised of the financial and other conditions of the city, and
recommend to the Mayor and Council such measures as are deemed necessary for
efficient operation of the City.
3. Supervises and directs the operations of the City, in coordination with the Mayor and
Deputy Clerk.
4. Direct and coordinate the completion of the city budget and capital improvement
plans.
5. Attend all meetings of the Council and all committee meetings as requested.
6. Develop and recommend policies and procedures regarding city operations.
7. Complete special projects as directed by the Council or as determined to be in the
best interest of the City, in full communication with the Mayor and Council.
8. Evaluate and analyze operations of the City by reviewing reports and data prepared
by others.
9. Supervise and direct the performance and completion of contracts for work and
services.
10. Perform all work duties and activities in accordance with City policies and
procedures.
We would commit to this arrangement lasting at least one year, with the understanding
that we are fully committed to ensuring the City’s continued smooth operations. After
one year, the arrangement could either continue on an indefinite/open-ended basis, or
we could provide the City with a proposal for a search for a new City Administrator,

should the City find this is the preferred approach. We would expect that either party
would provide at least 30 days’ advance notice to terminate the agreement, and we
would agree not to terminate the agreement, except in exceptional circumstances,
unless an alternative management service delivery model had been identified for or by
the City.
Fee Proposal
We envision an arrangement with a pre-determined monthly retainer (we are open to
input, but believe $1,600/month is a reasonable starting point), plus a rate of $80/hour
for work beyond 20 hours/month. We believe that with our deep experience in city
management, enhanced training and duties for the Deputy Clerk, including a possible
upgrade to the title of City Clerk, and the opportunity to potentially consider either a
full-time Director of Public Works position or a third-party contractual relationship for
those duties, we can deliver quality services in 10-15 hours/week. If we find that more
extensive hours are needed, we will, in close communication with the Mayor and
Council, consider bringing in an additional consultant to assist. The City’s best interests
and smooth operations are our utmost concern. We believe in any foreseeable case,
that we will be able to deliver our services significantly less expensively than hiring a
full-time employee, allowing the City the budgetary flexibility to consider changes in its
existing positions, as discussed above.
We would anticipate providing a detailed billing each month for approval by the City
Council.
Please consider this enumeration of tasks as a proposal that can be modified to meet
the Council’s expectations. We are flexible as to the tasks that the Council would wish to
assign to us, within the general scope and scale of the relationship discussed.

WHEREAS, the Mayor and Council members are amenable to rescheduling the council meeting from
September 13, 2022, to September 6, 2022, at the same time and location as mentioned above; and,
WHEREAS, Resolution 2017-17, Resolution Changing the Days of Regular City Council Meetings, sets the
days of the month for Council meetings and provides Council the latitude to change these meetings by
Resolution.

to constitute a health, safety, or fire hazard.] under “Nuisances Enumerated” of the Code of Ordinances of
the City of Riverdale, Iowa, is hereby repealed and replaced as follows:

49.01 Purpose
The purpose of this chapter is to beautify and preserve the appearance of the City by requiring property
owners and occupants to maintain grass lawns at a uniform height within the boundaries of their
property and on abutting street right-of-way in order to prevent unsightly, offensive, or nuisance
conditions.
49.02 Uniform Height Specifications
Grass, weeds or brush shall be cut, mowed, and maintained so as not to exceed the following height
specifications:
1)Developed Residential Areas - Not to exceed 8 (eight) inches.2)Undeveloped Residential Areas - Not to exceed 8 (eight) inches.3)Business and Industrial Areas - Not to exceed 8 (eight) inches.4)Agriculture Areas - Not to exceed 15 (fifteen) inches5)Designated Pollinator Habitat or Prairie Areas - No requirement to mow if requested and
designated by City.6)Requested "Mow Less May" Areas - Not to exceed 12 (twelve) inches.
Grass, weeds, and brush that are allowed to grow in excess of the above-specified limitations are deemed
to be violations of this chapter. Any property within the City, whether vacated or non-vacated, is required
to conform to these specifications.
49.03 Noxious Weeds
Every property owner shall cut and control noxious weeds upon the owner’s property and adjacent to the
curb line or outer boundary of any street, which shall include the parking area abutting the owner’s

property, by cutting noxious weeds to ground level. The use of herbicides alone to eliminate or eradicate
such weeds shall not appropriately abate the nuisance if the subject vegetation is in violation of the
height limit.
Noxious weeds include any weed growth or plant designated as noxious by the State Department of
Natural Resources rules and regulations or by the Code of Iowa Chapter 317 to include both primary and
secondary noxious weeds.
49.04 Abatement Notice and Procedure
49.04.01 Publication of Notice
Annual spring publication of this ordinance codified in this chapter in the official newspaper shall serve as
one official notice to the property owners.
49.04.02 Written Notice
The property owner of record will receive one regular mail notice and will receive a one-week timeframe
from the date of mailing in which to comply with the Ordinance.
1.The written notice is to include:
a.A description of what constitutes the nuisance.
b.The location of the nuisance.
c.Act(s) necessary to abate the nuisance.
d.A reasonable time within which to complete the abatement, not to exceed fourteen (14)
calendar days.
e.A statement that if the nuisance or condition is not abated as directed and within the time
prescribed, the City will abate it and assess the costs against the property owner.
2.After the reasonable time period for the initial violation has passed, the property owner shall continue
to abate the nuisance without further notice.
3.Subsequent violations per subdivided lot in a mowing year shall not require additional notice prior to
the City’s abatement of the nuisance.
4.The City may abate the nuisance itself or by hiring an independent contractor. Independent
contractors shall be paid upon their completion and submission of an invoice, regardless of whether
the cost has been received from the property owner. The property owner shall be charged $50 per
mowed acre per subdivided lot for the first abatement, or $100 per mowed acre per subdivided lot if
abated by contractor. The property owner shall be charged incurred costs plus a $75 administrative
fee for the first abatement in a mowing year, and incurred costs plus $125 administrative fee for
subsequent violations.
5.Collection of Costs: The Clerk shall issue a billing statement of the total expense incurred by certified
mail to the property owner who has failed to abide by the notice to abate, and if the amount shown
by the statement has not been paid a within one month, the Clerk shall assess a $100 late fee and
certify the costs to the County Treasurer and such costs shall then be collected with, and in the same
manner as, general property taxes.
6.The Administrator or his/her designee shall be responsible for the enforcement of this chapter.

49.05 Mowing in the Street
No property shall cut, mow, or deposit in any fashion any grass, weeds, brush or leaves upon the City
Street. Property owners found to be in violation of this section shall be fined $30.00 for the first
occurrence in a mowing year; and $60.00 for subsequent violations.
49.06 Procedures and Requirements
Allowable exceptions may be permitted to the uniform height specifications of this chapter in accordance
with the rules and procedures as adopted by the Council, for the establishment and maintenance of a
native grass area. The Council may grant or deny an exception in accordance with the standards set forth
herein and within the intent and purpose of this chapter. In granting an exception, the Council may
prescribe and impose appropriate conditions, safeguards, and a specific time for the performance for
which the exception will be permitted.
49.07 Application for Exception Permit
An application for an exception permit may be initiated by a property owner or the property owner’s
authorized agent by filling an application with the City Clerk upon forms prescribed for this purpose. The
application shall be accompanied by a site plan and such other plans and data showing the dimensions,
descriptive data, seed content, and other materials constituting a record essential to and understanding
of the proposed use of the area in question. The application shall also be accompanied by a fee as
determined by resolution of the City Council.
SECTION 2. REPEALER. All ordinances or part of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be
adjudged invalid or unconstitutional such adjudication shall not affect the validity of the ordinances as a
whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage,
approval, and publication as provided by law.
