A RESOLUTION' OF THE CITY COUNCIL" OF THE CITY OF
TEMPLE CITY REQUESTING STATE LEGISLATURE TO AMEND
THE CALIFORNIA VEHICLE CODE TO ENABLE LAW ENFORCE-
MENT AGENCIES TO IMPOUND THOSE VEHICLES WITH CALI-
FORNIA PLATES THAT HAVE OUTSTANDING PARKING CITATIONS
WHEREAS, California legislation has permitted the Courts to allow
municipalities to process their parking citations (AB 2392); and
WHEREAS, Section 4760 of the California Vehicle Code authorizes
the Department of Motor Vehicles to refuse the renewal of registration
to any vehicle if the registered owner has outstanding parking vio-
lations; and
WHEREAS, the Department of Motor Vehicles has noted, as a result
of their renewal requirements, that more and more California vehicles
are without current registration; and
WHEREAS, the City of Temple City, in an effort to provide the
most efficient method of processing parking citations, believes that
an amendment to the California Vehicle Code would permit enforcement
agencies to impound those vehicles with California plates that have
outstanding parking violations, and would provide a way to combat the
problems associated with the collection of unpaid parking citations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES
RESOLVE AS FOLLOWS:
SECTION 1, That the City of Temple City does hereby request the
State of California legislators to consider an amendment to the Cali -
fornia Vehicle Code, Section 22651(i) as follows:
When any vehicle registered in a foreign jurisdiction
or without current California registration is found
upon a highway and it is known to have been issued
five or more notices of parking violation over a period
of five or more days, to which the owner or person in
control of the vehicle has not responded, the vehicle
may be impounded until such person furnishes to the
impounding law enforcement agency evidence that bail
has been deposited for all notices of parking violation
issued to the vehicle
SECTION 2. That the City Clerk shall cause this resolution to
be forwarded to the appropriate State Legislators for their consideration,
PASSED, APPROVED AND ADOPTED this 17th day of February, 1981.
